The scu fire is also in four counts. The three wildfires have burned more than 775,000 acres. All of these fires started by lightning one week ago. Reporter heather, good afternoon to you. Contain system up, which is good news. Also good ws, a large no longer in direct threat from the flames. But if you look screen left, off in the distance, thats smoke rising above the hilltops here in the santa rosa mountains. Those homes along the highway 9 corridor are still in danger, so crews are using an old technique in hopes 0 of making gains the firefight. Just north of felton, firefighters are taking advantage of higher temperatures higher humidity to work gains the fire. The weather is cooperating to help us get those containment lines around those communities that are involved. Reporter firefighters are using fire to fight the 78,000 acre fire. The difficult task burning the vegetation on the ground but preventing the flames from going up into the trees, because if they do that, they could jump the fire lines and make conditions worse. Firefighters say overnight 8 containment went up to 13 . We have a really good set of control on the north end of the fire, the entire north, and then down on the coast, some of the fires, its actually self mitigating, in the fact that its facing lighter fuels. Reporter pg e crews are patrolling burn areas for trees in danger of toppling and taking utility lines to the ground. They worked rapidly to keep the fire in check. Were just doing a technique in which we just try to push through the fire, a painstaking process. We are just working to get the Community Back units feet and safe. Reporter firefighters continued using air drops, using helicopters, because the terrain is so rugged, remote, and hilly. The red flag warning in effect right now could be lifted as early as tonight. As far as the evacuations, a lot of people wondering when they can check on their property. No word on when those Evacuation Orders could be lifted. Well head pack to you. Yeah, they wont lift those until they are certain that theyre satisfactory. Jesse, quickly, how are the Evacuation Centers doing right now . Obviously its been a couple of days now since people have been out of their homes. Reporter well, you know, the centers were filling up when we were last here at the end of last week, and i can only imagine they have gained occupancy since then, but we didnt have an opportunity to get there today, because weve been up in the hills here in the Santa Cruz Mountains tracking the efforts of firefighters, but from what were hearing, the centers are filled up, and people are anxious, heather, to get back to their homes and their normal lives. Yeah, waiting for those Evacuation Orders to hopefully be lifted and soon. All right, jesse gary, thank you for that report. The deadly lnu lightning complex fire continues to burn through several counties in the north bay this afternoon. As we mentioned just a short time ago, five people have now been killed by those fires. Three people in napa victims of the fires coming up in just minutes. According to cal fire, this complex has burned about 547 square miles, and is now 22 contained. 871 buildings have been destroyed. 234 damaged, and more than 30,000 buildings remain threatened. Cal fire said a red flag warning has been lifted and some of the heavy smoke has cleared out, allowing air tankers to come in and make even more drops. Yesterday and day before, we had pretty good smoke inversion sitting over the incident that limited some of our aircraft flying. Today there will be aircraft flying. The lnu lightning complex fire is made up of at least 7 fires in several counties. The scu lightning complex complex has now grown to 347,000 acres across 7 counties. Cal fire said right now this fire is 10 contained. The fire complex covers mainly rural areas of santa clara, alameda, contra costa, san joaquin, stanislaus, and san benito counties. 12 buildings have been destroyed, and thousands remain threatened. Our number one priority for this fire will remain this entire western front along with he call the kala various zone. The majority of our folks are currently working in this area to put in dozer lines, strengthened by retardant dropping aircraft to see if we dan slow, stop, or push the fire away from any of those populated areas. Five people including at least two First Responders have been injured in this fire. A spare the air alert has been issued for today and tomorrow all across the bay area. The air quality considered unhealthy in much of the bay area with only a few spots with moderately bad air. This is a look from our mount diablo cam are this afternoon. Smoke from the wildfires is affecting the entire bay area. Kyla grogan joining us with what the conditions are looking like this afternoon, and kyla, were hoping for some improvement. Any chance that were going to see the air quality get a little bit better in the coming days . Yeah, and to be honest, we tonight really have anything that would indicate a major improvement. What we have are things that arent making it worse, right . So we have a fehas been moving back in, and thats helpful to clear the air a little bit. Newin accordances, you notice it feeling better when you wake up. If you can see there in San Francisco and also marin county, not as bad as in oakland, and certainly san jose doing a little bit worse as well. Thats what is going to be happening. Were ebbing and flowing with this as we go along, right . And well see that marine layer start to move back in. In the morning thats why 76 in oakland, 90 in livermore, and right now in san jose, about 83 degrees. Here is a look at some of the fire areas. This is the august lines complex fire in the Santa Cruz Mountains. 50 and 65 are the humidity levels, so those are pretty good. The scu complex, notice those humidity levels are lower, and temperatures are warmer, and warmer still when we get up to the lnu lightning complex fire. They have also a little wind kicking up. Lets take it over to the other part of the lnu fire, which is over to the west of healdsburg, and look at that humidity level at warm springs ranch. That concerns me. Just 17 . So you see some of the things firefighters are having to contend with as these conditions continue to strange. This is the one in marin county where as you get closer to the coast, we get a much better humidity level. This is good news for us, that the marine layer is going to ha with our environment right now. Ill be back in a bit to tell you more about the extended forecast. For now, ill send it back to heather. Boy, kyla, so glad to see at least some of those firefighters getting some help from the weather. Really appreciate pit. The death toll from these devastating fires continues to rise. In napa, the lnu lightning complex killed three members of the same family. Henry lee spoke to a relative today and joins us now with more. Boy, such an unbearable pain and lots, henry. Reporter mary lost her life after trying to save her disabled boy friend lee joe histon, tom. She left her home and came across a roadblock. She knew they wouldnt let her go back, children meant that leo and tom wouldnt be able to leave. Reporter her mom said she made the fateful decision to go back home. The three sought refuge in a bunker. So they went in there, hoping to ride it out. Unfortunately, the fire was so intense. Within moments, the three lives were lost, including the familys matriarch. Shes kind of like everybodys grandma. Didnt matter if youre biologically hers or not. Shes really sorry shes really warm and welcoming and open to everybody. Reporter her boyfriend of 7 years, threeio mcdermott, used a wheelchair. He was kind of a rough old man, but he just wanted everybody to do good. Reporter mcdermotts son, tom, also lost his life. He was always happy, always had a smile on his face. And another death in solano county. Our condolences go out to this family. That makes a total of 5 individuals directly related to this incident that have perished. It really is such a tremendous loss for that family. That was henry lee reporting. Were not going to have that short window of time, 12 to 18 hours, to try to do search and rescue, ahead of lawyers. We have more time laura and ma are expected to bring devastating storm surge, as high as four feet in some areas. And an added obstacle, the coronavirus. State officials are urging people to use public shelters as a last resort due to social distancing and indoor capacity guidelines. If you can stay with a friend or family member, should you need to get out of low lying areas because of water or other reasons, then thats what we recommend. Reporter they recommend that people staying on shelters to bring extra Hand Sanitizer and masks. As brave fire crews work onstop to put outline wildfires all over our state, at least one firefighter has fallen victim to thieves and looters. A fire grand ground commander working on the czu complex was directing cross when someone got into his vehicle, stole his wallet, and drained his bank account. Frankly, i cant believe that somebody would actually have the nerve to break into a firefighters vehicle, or enter their vehicle to steal something from them when theyre there to protect the community. It honestly blows me away. This comes just days after five people were arrested many fire zone to help prevent burglaries and looting. Fire crews in Monterey County are working hard to try to make sure two wildfires in that area dont merge. Together, the river fire and the carell fire have burned more than 86 square miles. Because of the locations of the fires, the Evacuation Orders affected People Living as far south as arroyo road. The river fire is 23 contained with 9 buildings destroyed, the car mel fire is 15 best contained with 81 buildings described. Back now to our weather. I want to give you a live look outside at the conditions from our camera that we have pointed toward mount diablo in contra costa county. You can see still a lot of smoke in the air. Something we were talking about with kyla grogan just a few moments ago, and kyla, here in San Francisco, it seems as if the air quality has improved a bit, but it is still very poor. Yeah, i mean, you know, its a little bit, but i pposed to g worse, so were going to to just ride this wave of it. As anyone knows who lives in the bay area, yeah, it takes a while, and we still dont have good containment on these fires. So thats where we are, folks. Know its not great news, but thats where we are. Lets talk about some good news. We escaped a lot of the trouble we could have gotten into last night with lightning. We had a few strikes out there, the one along the coast, over by the Santa Cruz Mountains, did touch off another start of something, but nod not too bad. Right now you can see at this hour, there is plenty of lightning over there in the sierra right now. So there is still very unstable situations out there, as far as the air is concerned. However, right here in the bay, were not a doing too badly. We could see a stray possible beginning of something in the north bay, but i dont really think that is going to come together. Its hard to say where the smoke begins and ends and the marine layer begins and ends, because thats starting to patrol the right now. Wind has picked up. Its that onshore flow, which makes things a little more difficult for firefighters, because were getting into that 25 to 30 mile per hour range. We were more around 10 Miles Per Hour this morning. We look at current temperatures. 63 in San Francisco, 80 nhl santa rosa, novato, and napa, 70 in livermore and concord, about 83 in san jose. Live look outside shows you that is the poor air quality we have. That is what San Francisco looks like right now, and thats why were under that spare the air alert and tomorrow, and frankly i wouldnt be surprised to see it extend even further. That marine layer is going to return. So that is going to be helpful. Now for an update on the fires ringing the bay area. Cross this afternoon are making progress on the czu complex in santa cruz and san mateo counties. Containment is up 176 homes, sa destroyed. In san mateo county, there is no longer a threat of that fire moving towards lamonda, lopez, or peskadara. In addition to the destruction, the fire has turned deadly. A 75yearold man died, possibly trying to flee the fire in davenport. Four other people remain unaccounted for. The scu complex is burning around 7 counts, and is 10 contained this afternoon. The cal fire said crews have brought the flames in the east bay under control. 12 buildings here have been destroyed, and thousands remain threat bed. And five people have now been killed in the lnu lightning complex. The fire complex covers two counties, as well as sonoma, lake, and yolo counties. About 547 square miles have burned and this fire is 22 contained. People are being told to prepare to leave their homes at a moments notice in northern marin county. Thats where the woodward fire is continuing to burn this afternoon. That fire has now burned four square miles in the southwest section of the Point Reyes National sea shore. It first started on tuesday. Right now, the fire is 5 contained. No injuries have been reported, and no buildings have been damaged, according to officials, but more than 1600 buildings remain threatened. Cal fire said that flames are burning in steep and rugged terrain. President trump has now approved federal Financial Aid to help thousands of people affected by all of the wildfires here. The federal relief will include grants for temporary house, home repairs, and low cost loans to cover uninsured property losses. Governor newsom said some of that money will also help with crisis counseling and other social services. Joining us this afternoon with more on the firefight is former fremont battalion chief, and former fema president ial appointee mark nuvo. Youve been out 31 the front lines of the fire before. Takes us there and describe whats happening pup yeah, yeah. After about a weeks period of time, finally the firefighters and Incident Commanders get to take a breath here. And its only a breath, for a short period of time. What was anticipated to be 50 mile an hour winds, pushing fire to travel at a mile and a half per hour, that has not materialized, which is good news. So you can see a little bit of a sigh of relief there. What does that mean . That means aircraft can continue to fly, doing water drops, the large 747s. Containment on these fires are starting to go up. Although only in the teens, they are starting to make good progress. They are getting more personnel in. There are 7 fire engines that have arrived from across the united states. More are coming. For those who lost their lives, its tragic. I dont want to understate that. But this could be much, much worse. Theres the president ial declaration you just talked about, which is going to be bringing aid to folks. Thats the good news, but there are some challenges things we can talk about, if you would like. Yeah, lets go ahead and talk about the challenges, and also, mark, explain to viewers at home, the different approaches and strategies that come with fighting fires like this. For example, when a bulldozer might be used, and when, you know, a hose line might be brought in. Good question. What you are hearing Incident Commanders talk about a little bit a dozer line. Meaning there are hundreds of dozers work on these fire lines cutting down brush and trees and trying to get down to Natural Earth to try to create a barrier from where the fire is located and more fuel and forest area. If they can create that line, sometimes it can keep the fire from progressing. Thats called a defensive attack. A lot of the containment you see on these lines have dozer lines. Now they want to get in there with hand crews and put hose lines down there, so they can start to put out hot spots in those areas, because they dont want spot fires, and they dont want the fires to jump those lines. So theyve got containment in the teens, but its a precarious containment. Yeah. And, mark, you mentioned the challenges. Go ahead and talk about some of the challenges that still exist. Well, as we know, we just heard a few moments guy, there are still Evacuation Orders over in marin, and for the in Incorporated Area of gilroy and morgan hill. You heard the Incident Commander running the santa clara complex fire, that we are in an era of mega fires, that theyve not seen anything like this. So wants to make sure hes got his crews operating. These folks have been operating for 7 days, on and off, very little rest. Its been a tough firefight. Its so great to see folks coming in to help them. But we anticipate some weather may be coming our way, certainly in the sierra nevadas. We had 10 new fires today because of the lightning so. Its still very touchandgo for our fires. According to the latest numbers from Johns Hopkins university, there are now more than 670,000 cases statewide, with more than 12,100 deaths. Here in the bay area, there are more than 79,000 cases, and close to 1,050 deaths being reported. As the fight against the coronavirus outbreak continues across the country, the fda is authorizing emergency use of a therapy that many say is untested and possibly dangerous. The coronavirus outbreak has killed more than 170,000 americans, but there could be help on the way for the most acute cases. President trump announcing sunday the fda has given emergency authorization to use plasma therapy on covid patients, but some Health Experts worry about the lack of clinical trials, pointing out the therapy can have serious sideeffects. Can a lessnt plasma is still experimental. It should continue to be evaluated in well designed clinical trials. Reporter meanwhile, the virus continues to spread, though more slowly in recent days. Sunbelt states are reporting the biggest gains with texas and florida joining california now in topping 6 hurricane,000 cases, as the governors of those states move ahead with reopening plans, including bringing thousands of student backs into classrooms this week. Normally you would see people playing on the fields, and you walk by, and theres no traffic. Reporter in new york, Governor Andrew Cuomo said gyms could be reopening as soon as today. But there are still new days in Nursing Homes where 6,000 new yorkers have died so far. Theres a caution flag. Reporter and the Trump Administration reportedly announcing new rules this week for Nursing Homes, requiring them to not only test for covid 19, but also to publicly report it. A new ruling in the Scott Peterson murder case. Coming up next, what a California Appeals Court has decided about petersons Death Penalty conviction. And we are no longer under a red flag warning. The California Supreme Court has overturned the 2005 death sentence for Scott Peterson in the murder of his pregnant wife. The court said prosecutors may try again for the same sentence if they wish. Todays ruling upheld petersons conviction for murdering Lacey Peterson who was 8 months pregnant with their unborn son. Investigators say in 2002 on christmas eve, he dumped the bodies from his fishing boat into San Francisco bay. Today the court said the trial judge made several significant errors in jury selection that interfered with his right to an impartial jury during the penalty phase. Joining us is michael, our legal analyst. So the decision from californias Supreme Court centers around potential jurors who were dismissed after saying they personally disagreed with the Death Penalty. Why did the justices believe that that was improper . Well, what the jurors said that got them kicked off the panel was i dont believe in the Death Penalty. I dont believe in it, but if the prosecution proves the case yard, i will enforce the Death Penalty. And the judge let those people go. The California Supreme Court said youre not supposed to do that. You have to leave those jurors on the jury. Now, you can well imagine, if you have all jurors that say i believe in the Death Penalty, youre going to get a more conservative jury, and that affects the verdict in the case. So you want those people on the jury so you get a fair jury, and were talking about taking a persons life here. So its important, as we can all imagine, that you get that type of your, and thats why they reversed not in the gilt phase, but the death part. They took death off the table. So petersons murder conviction still was upheld despite what the justices found in terms of the improper dismissal of those potential jurors. Why doesnt this why did that they not decide to overturn the murder conviction . You know, thats a really, really interesting point, because if one were to follow that logically, people think wait a minute, this guy is guilty. I know the more that is out there. I sat through that trial. I saw, gosh, about 90 of that trial. I saw the emotion in the trial. I saw the jurors, how they reacted. I mean, you actually had one juror that made it on the jury that after the verdict came back said i lied to get on the jury. I lied about my background. So that kind of thing went on. You couple that with all of the other problems in the trial, like the dog evidence, where the judge let the dogsniffing evidence, where the defense was able to prove that dog was wrong about 66 of the time, and yet it came into evidence. This was a very, very emotional trial. I was was shocked at at the amount of emotion. This decision leaves open the possibility for the stanislaus District Attorney to again once again seek the Death Penalty, retry the penalty phase in this case. Do you think that is likely to happen . I dont think so. When you look at the last time california executed someone, i think it was around 2006, youve got 180 someodd i believe people are death row. You have a moratorium on the Death Penalty. You have Scott Peterson on death row, and now hat he comes off death row, he goes in the general population. You actually get treated better in the facilities are better on death row, so his life is going to change for the worse going into that general population. I do think theyre going to retry it . Absolutely not. Its going to cost too much money, to what end . Appreciate you coming on. Thank you. All right. Turning our attention to the weather now. We are doing better than we were this time yesterday. Certainly we do not have the concern that we had about lightning kicking off, or storms rolling through. That has, at this point, started to roll through, moved past us, and now we do some, interestingly enough, in the sierra, lightning because of the heat of the day and the instability out there from that system. So lets start with a look at the radar here and satellite, and show you what im talking about. This is the last 12 hours, this loop. So you see that moisture rolled through and went to the north of us. Over by mammoth lakes, they have lightning striking right now, heading over to that californianevada border. That shows there is plenty of unstable air out there. Here in the bay area, were looking much calmer. We have the marine layer moving in right now. That brings moisture in. That is helpful for the firefighting. Were happy to see that, and that should deepen a little bit more. We are also unfortunately picking on little bit of wind right now. Oakland north about 15 Miles Per Hour. Take us down to the surface and you see the same story where the wind has picked up. We were less than 10 Miles Per Hour this morning, but now im seeing 16, 17, numbers higher than that, as we get out to sfo, about 21 Miles Per Hour. Temperatures have really had a lit lid on it in San Francisco, where we had a lot of fog today, but hung out. 63 today. Were in the 80s in napa. 90 in concord, and 83 in san jose. Tomorrow it will be similar to today. Hazy skies out there, but well get some sunshine as well. About 71 in San Francisco expected for a high. You might wonder what about the tropics . Well, we have a disturbance that has a chance of becoming a tropical depression, but right now doesnt appear to have any threat to us. Well keep an eye on that. But your eye must go over here, folks, if youre talking tropics. Look here in the gulf of mexico. We have two tropical systems at once happening. Right now Tropical Storm marco is heading into that louisiana coastline, Florida Panhandle area. And then look at this. Tropical storm laura, projected to become a hurricane, cat 2, and move right into that texas louisiana border. Some interesting weather going on there, your heart has to go out to them. As far as locally, well cool down a little on wednesday and thursday, and warm up a bit into friday, saturday, and sunday, but no tripledigit heat out there, so im happy for that. Guys, back to you.
