They are concerned, just like we are. We have been in communication about what these discrepancies are, how we might improve them. Reporter he did not say how many days had been impacted. He said officials who rely on the system for data have raised the alarm. The state is working to provide accurate numbers manually. On monday, he expressed cautious optimism over the declining numbers. The sevenday Positivity Rate is lower down in the 14. It is down to 6. 1 . So, 14 day Positivity Rate, reflected in the slide, 7 , sevenday Positivity Rate now down to 6. 1 . It is not where it needs to be. It is still too high. Again, it is good to see this number trending down. The sevenday Positivity Rate is absolutely affected by this. We will certainly be updating the Positivity Rate on a daily basis as we do. If this bill is going to pass with all democrats in the house and in the senate, it has got to be something the democrats like and support. The democrats need to meet us halfway. Reporter they want a targeted and fiscally responsible bill to address the short and longterm effects of the coronavirus. Democrats have been pushing the heroes act, the house passed the data earlier this year. He says it is more than 3 trillion in price tags. We want to sit down in good faith and make a real solution. A wrongful death lawsuit was filed by the widow of pedro zuniga who died from covid19. He was a longtime worker at the safeway plant in tracy. The lawsuit alleges that safeway concealed the outbreak, having employees work most together, not having Safety Measures in a timely manner. So, what do you think the likelihood is that some of these companies are going to be found liable for their employees getting sick . In certain cases, for example, tyson, back in the midwest, they are going to be found liable for what they did. Watching all of this from afar, i think it illustrates why none of us like politicians, whether they are democrats or republicans, because they keep fighting for their own position instead of what is doing good for the country. What the republican want to do now, they want to make it more difficult for employees to sue. Right now, they can sue if a company is negligent. The republicans want to change that to say, well, only if they are grossly negligent. Either way, we also want to change the burden of proof. In short, the republicans want to make it harder for employees, and much easy easier for employers to defend themselves. How difficult do you think it would be for one of prove th employer willfully ignored state and federal safety guidelines in terms of Workplace Safety . Tyson, for example, i dont think itll be terribly difficult. We all know how corporations work. We have the big people at the top, the money at the top running the companies, they want production. They want stock prices to go up. They lean on middlemanagement. Middlemanagement liens on managers and supervisors. In tysons case, they were in a position where the country needed food. They were pushing their employees to go to work. The upper management pushes the lower, get those people in, dont care if they are sick. Let them in. That is why it is going to be easy in tysons case. In that case, they were working elbow to elbow without masks. Although, the corporation will. 2, well, we were following all the codes and directions at the time. Nobody seemed to know or give us direction where their masks were good or bad back then. In their case, i think it will be easier. Safeway, albertson, it might be a little more difficult. The feds and the states define what companies should do. Employees have to prove that they were negligent and not following the rules. And, they have to show that they caught the virus at work. That is going to be difficult. I was going to say, proving, definitively, that you contracted the virus at your place of work is going to be challenging. Lets go back to the policies of all this, Mitch Mcconnell, he is obviously pushing for these Liability Protections for employees and corporations. He essentially says he is worried about us seeing a wave of similar lawsuits to this effect. That is why he wants these protections included. Do you think it is necessary that these companies have some level of immunity if they took reasonable steps to try to create a safe working environment . Again, alex, that is a question of fact. Thats for the factfinder, a judge, jury, arbitration, mediation, it is fact driven. So, when i hear Mitch Mcconnell doing that, he is protecting the employers. He is protecting big corporations. What they are afraid of, the corporations, is that these cases will get to a jury. Juries will be sympathetic. They might lose big money because they were, in fact, negligent. They were not following the rules at that time. Of course, the employees want to get before a jury. What will happen . There will be a big, big legal battle in court rooms. Corporations try to keep it out of the jurys hands. Then, employees try to push it to a jury, where they feel they will get a sympathetic hearing. I dont think it is this, they hold it out because they want this attached to the bill, that is where we all fall off the rails and go, wait a minute, get the bill passed and work the other issues out later. You can protect corporations later, if the democrats will go along with that. I dont see that happening. We will have to wait and see. There is the political fight and the legal battles playing out in courtrooms all across the country. We have to leave it right there. Are legal analyst, i appreciate your time and insight. What we are arguing for our places that have this under control. Then, they have to put in healthy building strategies, including these strategies we write about in our report. It is a 60 page report, detailing all of these strategies that king to be put in place. About. Healthy building strategies are bringing in more outdoor air. Open your windows, put in a box fan to bring outdoor air inside. You could use better filters in recirculated air. Use air cleaners to get you air changes for hours of clean air in the space. You know, i say we need to get kids back because the risk of keeping them out of school is so great, virtual dropouts, Food Security issues, higher risk for exploitation and violence, more sedentary, less socialization, but we have to make sure that they go back when Community Spread is under control. It cannot be schools as usual. We have to put in these strict risks reduction strategies. How realistic do you think these strategies are for most School Districts . How do you think they will be packs . We have been quite effective in using these in other environments. We know they can work. Compliance is going to be harder with kids, for sure. It is so critically important to get kids back to in person learning. What does that say about us as a society if we fail to get kids back and do everything we can to get them back . That is an interesting question. What is happening in the hospitals there . What is happening in beirut . How can they triage the patients who are coming in, to figure out who needs help the most .
