We cannot continue to do what we have done for the last number of weeks. There is counties continue to reopen, the governor pleaded with californians to take covid 19 seriously. There is a surgeon hospitalizations and icu patients. The state performed a record 96,000 tests with the positivity road rose to 5. 1 . We have seen increased numbers and a lot of those numbers reflected in the bay area. That is part of the state that has moved into this new phase. Reporter the governor appointed to memorial day and statewide protest. The state remains confident in its preparation. We crushed the curve. We made it Crystal Clear when we did that. We never experienced the big spike where we were not prepared for an increase. Reporter the governor threatened to withhold relief funding for counties that would not comply with the reopening criteria including a new face mask order. We are going to attach consequences to that. It simply will not flow to those counties. Reporter the message is not sitting well with and assemblyman whose district includes sutter county. He said, once again the governor is instituting a one sizefitsall this time with major consequences if in his sole discretion we havent complied. Our federal funds are being held hostage. What do you say to people who are not taking this seriously . I would say that we havent really seen as much of a decline. We have always had a steady number of cases. I think state wide when we see increasing and hospitalization the whole point of flattening the curve is that we have enough icu beds for the people who needed. So this doesnt really reflect more testing. Of course, the testing the Positivity Rate is another set of evidence that leaves us to worry that this is indeed a real increase for seeing in california im going to talk about hospitalizations. Overall, our capacity is well under the limit. 8 of hospital beds are being used. 30 of icu beds are being used. What does that tell you . It tells us that in california compared to arizona and texas and florida where theyle bit of gift. The people of california have some time in which we can avoid new york and florida and arizona situation. We have done that before. We were the first to do shelter in place. We have to think about our community. It seems that handwashing and Wearing Masks are simple requests. These cases are trending upwards. What is the message you want to send about those simple tasks . I guess one of the things is that people think of these Public Health messages. There are 10 things that they put on the list. It is just wearing that mask. That is probably the number one thing. I wear my mask. Keep your nose and mouth away from others. I think that people have d indoor settings. We have had graduation parties, reports from contract traces of pledge parties. These are high risk indoor settings where people may not really think about the risk. The state right now is taking a closer look at School Safety and the impact of Police Officers on School Campuses. Tony thurman said today he is aware of the many calls for changing policing on campuses. It is an area that requires additional discussion and action. We are seeing data that shows that many cases, when there are policing campus this results in more suspensions and arrests and other students of color. This is a condition that must be changed. He also says he has asked experts for a review of research and data on the impact of police on School Campuses. The Oakland School board will be voting tonight on whether to dismantle the District Police department. Most School Board Members to support the funding the Police Department. Kyla johnson suggested redirecting more than 2. 5 million in police funds to student services. A new safety plan could include civilian safety resource specialists. Oakland police would be called for more serious incidents. Calls for Police Reform and the funding have led to a petition drive. More than 225 faculty, staff, and students have signed on to defund that universities Police Department immediately. Most private universities do not have a police force and the money spent can be better used for student resources. That we would like the funding to go to his us as a community. Having police on campus is not a given. There are other ways to protect our student body and our faculty and our community that do not involve the police. A University Spokesman said an email in response says imparts the university is committed to quote creating space for processing, listening, and deep understanding taking immediate action to address institutional racism at sdsu. The University President has committed to forming an Advisory Board by mid july. Also in san jose the mayor has laid out a nine point Police Department. One of the goals is to empower independent external reviews of alleged Police Misconduct or abuse. Jesse gary joins us with the details of this plan. Jesse . Reporter the mayor says the community expects better of its police force. The impetus of change is the killing of George Floyds well in Police Custody on may 25. The mayor says that most san jose Police Officers show great response while responding to a rally that had violent elements to wait here in downtown san jose. That was on may 29. The mayor says because of bad actors on both sides, change is needed. These events have poured salt into deep wounds. Once of systemic racism, police brutality. Reporter the mayor said a nine point plan to reform the san jose Police Department. The department has been criticized for actions of some officers during a may 29 demonstration in downtown san jose. Multiple bystanders said they were roughed up or assaulted as officers try to maintain control. Part of the reform includes greater transparency, an external agency perhaps under the umbrella of the independent Police Auditor to investigate alleged misconduct. Audits of departments 449 million budget in the event of future cuts. Expand them ands role to include oversight ability for the police chief and the city san jose we need to move beyond the notion that somehow or other the public will simply trust the police to police themselves. We are interested in sitting down and finding ways to help our officers to the very best job they can when they are serving their communities. We will have more interaction with the way Law Enforcement conducts itself, particularly and areas with use of force. No amount of reform well besides the confirms, we are not going to agree on everything. Calls for defunding the Police Department are rooted in the desire to look at policing in a new way and follow through on those changes. The mayor would like to see young people joined the force and perhaps rship money. Thats part of the old san jose cadet program. We like to return to our coverage of the ongoing push for Police Reform on capitol hill. We are joined by, congressman, lets start with looking at the two proposals head to head. Why was the gop bill that failed in the senate today a nonstarter for democrats . Why do you believe the democratic plan voted on tomorrow goes further in terms of meaningful reform . There are two things that are structural changes we need. It will change the standard of force. Currently if officers think force is reasonable they can use deadly force. That is inconsistent with law. It can only be used as a last resort. The hospital does that. The house bill says you can sue Police Officers if they engage in deadly force that is unwarranted. These two changes, the standard of force and Police Accountability are necessary to address the underlying issue. I know the democratic plan also with limit qualified immunity making it easier for members of the public to soothe at the Police Department for misconduct if that doesnt fact happen. That really seems to be a point of contention between the two sites. Do you think that the democrats will have to budge on that issue if they want to reach a bipartisan agreement on Police Reform . At the heart of what we need, the problem is that Police Officers do not get convicted or have any accountability. If you dont change the standard of force to have the ability to hold officers accountable, what is going to change . Collecting data and training may be steps that are additionally helpful, but they will not change the underlying problems. I do not think that House Democrats will compromise on certain essential issues. Tim scott believes that the two proposals being put forth by republicans and democrats are not that far apart. Do you agree with that assessment . Are you optimistic that something is going to get worked out. . Will we be back at square one like we have seen before . I respect senator scott and i have worked with him on a number of issues. There is a difference because the democratic bill is trying to change the structure of the criminal Justice System by changing the standard of force and making Police Accountable to the law and for being sued. The senate bill does not do that. I would say we are far apart in terms of structural change. People do not want to pass the bill that will tinker with things or have incremental change. We are looking to do something that meets the moment with the mass protests around the country and George Floyds modernday lynching, we have to do something substantial. I do not doubt senator scott good faith, but the bill is what we need. A big vote tomorrow in the house. You will vote on this sweeping Police Reform plan that you obviously believe goes much further than the republican proposal being put forth. Whats that passes in the house, how much pressure will that put on Senate Republicans to come back to the table and continue trying to negotiate a bipartisan deal. The pressure will be from the people out there demanding this. It is not just black lives matter. We have people in cities and counties all saying that the lynching of george floyd was horrific. Something needs to be done. I think theres a genuine outcwas horrified that will put pressure to get something done. I think that the house bill passing will be a good first step and i hope the senate will adopt some of the main measures. All right. We look forward to seeing how things play out coming on. Struck a federal Appeals Court ordered a lower court to drop the case against ent trumps former National Security advisor, Michael Flynn. It dates back to 2017 and Robert Muellers russia investigation. Ray bogan has the details. Win the prosecution of Michael Flynn for pleading guilty to lying to the fbi may be coming to an end. An Appeals Court ordered the district judge to dismiss the case after the Justice Department dropped the charges. Flynn reacted. Its a good thing for me and my family but a great boost of confidence for the American People and our Justice System. He has been exonerated. I want to congratulate him. Reporter the decision was 2 1. The District Courts actions will result in specific harms to the executive branch is exclusive power. Judge Robert Wilkins dissented and said the Appeals Court overstepped its bounds and ordered a lower court to roll a certain way. He wrote of the decision to dismiss the case is no mere aboutface. It is more akin to turning around an aircraft carrier. Judge sullivan is expected to comply it could any time between now and it already scheduled july 16 hearing. The decision comes on the same day a career prosecutor testified on capitol hill about the dojs handling of the case involving roger stone. It was brought by the Justice Department and reversed by the Justice Department. Are you surprised they have ordered the case dismissed . Not necessarily. This story has a lot of twists and turns. Michael flynn was a Lieutenant General leaving the military and becoming a lobbyist and then joining the Trump Transition Team and then possibly exceeding his authority as it were and having clients in turkey and other places and utilizing that information as part of his transition into the trump administration. Since the very beginning, this is had a lot of complications. I am not surprised by any decision in this case. Do you see politics at play in this decision . Absolutely. This is a systemic problem. In washington dc there are people coming in and out of government. In doing so, they risk being in a place where they may actually violate or come close to violating the law. This order from the federal appeals order was a 21 decision. We are waiting for the judge in the lower court to dismiss the case. Is this case close for Michael Flynn . Is highly unlikely another appeal will happen. I think at this point its probably over. There would be no point of appealing. 21 by the Appellate Court ordering the judge in this case to dismiss the case will probably stand as is. Its a cautionary tale. I was going to say, how rare is Something Like this to happen . It is rare in the sense that you dont usually see a situation where you have so many things going on over the course of many years. Bear in mind, we are 3. 5 years into the first discussion inside the doj and other places about whether Michael Flynn had broken the law. This is been a long trail. As all the viewers know, theres a molar investigation, the testimonies before congress, whether Michael Flynn pled guilty because he was protecting his son. Whether the sun was threatened with prison. Many twists and turns in this case. And we are not done with it quite yet. We will of course keep watching. Is it safe to say my scott, child backtoschool once the campus is reopened . To understand more, we are joined by the director of the Healthy Buildings program at the school of Public Health. Is good to have you on here today. You write an opinion piece for the washington post. You are absolutely to school once those campuses do we open. You say that everyone else should as well. Why do you believe that . Let me start with why i wrote that and thank you for having me on. I have been an investigator of sick buildings for a long time. Before i gave the all clear, i asked myself, would it be any different if my kid were in that school or my wife or in that building. Ive done that same thing was schools. Yes, kids should return to school. Is for these reasons. Kids are at lower risk for severe complications. Not zero risk but lower risk. We know proven strategies that can improve risk. Things like wearing a mask, terms of the massive costs from potentially another year of school closures. We cannot disentangle those two. When i weigh them altogether, the answer is yes. As long as appropriate controls are in place you write that these long term closures are affecting Student Health and leading to more abuse and neglect. There are a multitude of reasons to get kids back into the classroom. Obviously, the level of education is much greater in the classroom setting. You talked about some of the recommendations to try to make School Campuses more safe. You talked about Healthy Buildings. You talk about schools being able to have cleaner air, increasing ventilation. How will schools go about doing that to reduce the spread of the virus . This is something really important. It is something that every school should do right now to prepare for what ever happens this fall. This oped was one port pointing to a larger story that my Harvard HealthBuilding Program released today that outlines many Risk Reduction strategies. Its available as schools for help. Or. We talk about Healthy Buildings. Heres what we want to do. Increase the amount of fresh outdoor air that comes in. Increase filters. If you have a naturally ventilated building, open up the windows and put a fan in the window to increase airflow from outdoor to indoor. And then these air cleaners. This can help address one mode of transmission, aerosols or airborne transmission when paired with a layered defense approach of many strategies including mask wearing, handwashing, and this can be effective at reducing risk. The thing is, you cannot wait until the end of august to look at your buildings ventilation system. The time to start looking at it is right now. Can you say that even with all of these precautions being put in place, there is still risk involved here and there are likely there will be outbreaks. What should districts have in place in terms of a plan to address those up rakes . That is a good question. The goal is zero cases. We dont want any adverse events for our kids. The reality is, they are going to happen. We have seen what is going on in this country. The country has failed to put in the protections and protocols it needs to manage cases. We are starting at about place. We need to reopen the economy in a safe way. The first thing school should be doing is establish a culture of health, safety, and shared responsibility. Start with your messaging to the community and start educating staff, parents, on what to expect. Starting today with that morning message, change the entire culture and make it health first so that we can start to prioritize the things we know they can keep people safe. If someone does get sick, we recommend that you limit classroom interaction as much as possible. In our report we talk about group distancing as well. That is how we can slow this transmission. If someone gets sick in a classroom, it doesnt have to shut down the entire school. It seems like its pretty important to create those sub groups and students only interacting with a certain core hurt. We appreciate your time. The senator says he was assaulted by protesters. The state is put pair to activate the National Guard. Republican lawmakers say officials should have acted sooner. This is a failure of leadership and it has to end. The violence started after the arrest of a black man who walked into a restaurant with a baseball bat and megaphone calling a white man a racist. He was taken into custody and allegedly escaped from the squad car. For those people that decided the way to express themselves was from criminal acts, that should never be tolerated. Reporter people continue to call for the removal of statues. Hundreds of National Guard troops have been mobilized to protect monuments. Crews put up fencing in Lafayette Square after protesters tried to tear down Andrew Jacksons statue. You give power to people that the maulers monuments and attack churches and see city streets and set fire to buildings. Nothing is sacred. No one monuments. Everybody cares about somebody. And somebody else. If thats the case, demonstrate and prove it. A plea today from the governor to all californians, to wear masks, it comes as coronavirus cases daily records, while hospitalizations and i see you visits also start to crease. The governors message comes on the same day there were nearly 39,000 positive coronavirus tests nationwide, that is a new record for the united states. Welcome, everybody. California also setting new records for the number of cases of coronavirus, there were more than 7000 confirmed cases yesterday, an increase of nearly 4 , it brings the total number of cases statewide to more than 190,000, there were 52 more deaths. Somewhat lower than the average of the rest of the week. With those numbers trending higher, the governor was practically begging people not to go back to their old habits. Heres another number for you, the state saw an increase of 9 of positive cases in the last two days, the governor expressed that people need to change behaviors in order to slow the spread.
