Chief justice said that we do not decide whether or not there policies and the wisdom. We address only whether or not the agency complied with the procedural requirement that it provide a recent explanation. This decision today was lawless. It was gamesmanship and contrary to the judicial oath. Resident donald trump said these horrible and politically charged decisions coming out of the Supreme Court are shotgun blasts into the face of people that are proud to call themselves republicans or conservatives. The ruling would allow for the department of Homeland Security to overturn it again in the future in another way but observers say that is not likely to happen before the november election. For more on this ruling will join now by the professor from Uc Hastings College of the law. It is very good to have you want today. A major ruling from the high court. The majority of justice is essentially saying that the administration did not take the proper steps to end the program. What is it specifically that took issues with. Thank you so much for having me here. This is a very big decision. A triumph of reason decision making. The court today. Specifically what they had a problem with was the fact that the agency did not properly explain the reasons for resending the program and they did not consider important alternatives. These are longstanding principles. They are there to ensure agencies are making decisions that a rational and based on evidence and expertise and not simply the politics at the moment. In the majority, you heard the chief justice made it pretty clear that what they were doing here was not ruling on the legality of the program or whether or not this is sound policy. One away in on those issues. Those issues were not presented in this particular case. There are other cases working the way through the court system that challenge the program itself. This was not the case. I suspect they will now proceed. The case before the court. I guess one would have to ask what the strategy was. The case was rather the Current Administration had behaved legally when it rescinded the program. Those are different sets of questions. The court answered the question that was before it. Contrary to the rhetoric, that is exactly what theyre supposed to do. Theyre supposed to answer the narrative questions. The court did that today. It did that in line with long standing principles of administrative law. The department of Homeland Security could potentially try again with another order to talk to resend the program. How likely do you think that is to happen given the current Political Climate we are in. The november election is coming up. How might the administration shifted its approach. You are absolutely correct. The decision leaves the agency free to implement the policy that it would like to implement to the extent that it could justify that policy based on the guidelines that were provided by the court. That presents the agency with some options. I am not aware of any statements by the agency. My understanding is the reason the policy was rescinded in the way it was is because the agency was looking for political cover. They wanted to have its cake and eat it too. And wanted to resend the program. It did not want to take political he frantically the reason why was to pull these protections from such a politically popular group. They came up with these reasons. As the court said today. It did not really support the decision is made. It is free to go back and explain itself and explain why the Agency Thinks it is a good policy. To pull these protections out from under the 650,000 dreamers that rely on them every day. They are free to do that. I was going to ask about the broader question. President donald trump obviously dismissed this ruling as being politically charged. He said i will be releasing a new list of conservative Supreme Court justice nominees which may include some or many of those already on the list by september 1 of 2020. If given the opportunity i will only two from this list. Obviously, the president hopeful he will get to a point another justice. I want to get your thoughts on how likely that is to happen and how he may be able to change the makeup of the court. The important point to make is the decision was drafted by very conservative justice. I think it is unfortunate the extent to which we have all politicized the courts. Certainly some of the justices. He has played outside role in that. Again, it is unfortunate. The justices. They are endeavoring to do what conservative legal scholars would have them do which is to interpret the law fitfully and not go beyond the four corners of the case. That is precisely what the court did today. To be celebrated by those who share conservative legal philosophies. The fact the president will take any opportunity to politicize anything.
