The debate over the funding Police Departments continues across america. What does policing in america look like if that happens. Would like to bring in a criminal law professor to talk about this. You said that you can talk about the criminal legal system in america without talking about race. I would imagine you can talk about what the future looks like without examining the past and how we got to this point. That is of faces and with th police we have now, they are one of many possibilities in our own history and worldwide. We did not have professional police until 1838 and before that we had a combination in the north a civil watch where everyone would participate in making sure the community was safe. In the south we had sleep patrols which were essentially ways of keeping inslee people of african descent from running away from otherwise resisting. If you look over time and specifically back to the virginia slave codes if anyone wants to look those up, you can see that some of our doctrine said things like qualified immunity and what happens is someone who resists Police Discipline or the discipline of their owner is, it echoes in th grow from the roots and a change in adjust and they should say to the Police Officer that they have had bigger roles and they are else i can a lot of different types of conversations. How wellequipped are they to handle calls with people who are suffering from Mental Illness or having some kind of breakdown. The roles have expanded. I dont know if the training and everything does come with it has expanded at the same ratio. It is a question of what you want to specialize in when we have a fire we call the Fire Department and they have equipment and training and thats all they do, handle fires. And we have emergency medical technicians. Some as having a Mental Health crisis and we would have a team and at some as having a Drug Overdose we sent someone out there with experience dealing with that. So what do we want our police to do . What is there core competency . I think one thing that is distressing to me is when you look at what most people would say is poor competency solving crimes like murders and , if you look at the clearance rates in los angeles, all of the homicides reported in the Washington Post to the study of this in less than 50 resulted in an arrest. That is an arrest. That means over half of the homicides no one was ever arrested for that. We need police to specialize in solving these. Yes, i think it is complicated. You have the issues of efficacy and you have systemic bias which if you talk about that reflects society wise and its a complicated situation which i people are talking about that the funding and the supporters are saying they like to create something new that may not have all of these systemic problems and can be rooted in something different. Its a complicated question that we have little time to answer. What can that look like . Its hard to imagine Society Without the Police Departments we have taken as part of that. We need to think about why people do the things we dont want them to do. Do people still because theyre bad or because theyre poor . The people use drugs because theyre dealing with Mental Health issues or because they are bad . Where we have a better idea of why people do things that we consider antisocial, we can have a better idea of what will help them stop doing that. I dont think people are deterred of doing drugs and i dont think anyone addicted did it because they did not think the police would catch them. I think there are bigger problems and i dont think its the job of the police to solve these problems by using the might of the criminal legal system. We are looking at all of these things we have been doing and looking at where we can go. Thank you so much for the insight. This conversation continues across the nation. Electric car maker tesla defined county orders reopening its fremont factory. Days later employees has apostate the covid19. We will speak with a reporter who broke the story and talk about the length between their work and the virus. A sign of progress in the wind country. When others may follow and the safety modifications in napa after the break. Sunny skies and warm temperatures for today. It looks like the warm up will continue in your wednesday forecast. We will have the update coming up. Several tesla workers have tested positive for the coronavirus after the fremont facility was reopen in defiance of Alameda County Health Officials. These cases were brought to light by the reporting of the Washington Post. Our Technology Reporter wrote this piece. Is good to have you on. A couple of these cases at least were at the Seat Assembly plant away from the facility. What do we know about the people who got sick and how much they interacted with their colleagues on the job . So, what we know is there were two people, workers have been told got sick. Those people have yet to return to the line. There are at least three others. They were exposed or at least took precautions likely because they worked in close proximity to those other individuals. Several of those people have return to the line. The folks who are said to have coronavirus have yet to return to work. So Alameda County Health Officials never got any reports about tesla workers testing positive for the virus. Wouldnt tesla be required to report those cases . Tesla is required to report workplace infections. What complicates the situation is that tesla basically restwell before they were allowed to officially by the county. It was around mothers day shortly after elon musk tweeted free america now. He had gone on this rant about the factorys inability to reopen. And tesla had employees report to work as soon as may 11. May 10 or may 11. And so for that week there was sort of a gap what the policy was from the county level and what tesla was doing. The county did not officially strike an agreement with tesla to fully reopen. And that was may 18. Before that agreement, tesla would not have had to report active or known coronavirus cases at the factory. We do know that tesla we start with officials and they were required to put in place a number of safety protocols and there had to be social distancing on the job and workers had to wear masks. Do we know that all of that is still happening here and how concerned are the employees youre talking to and how worried are they about their safety . The folks im talking to were very concerned about the conditions over there. They are receiving masks but there are a lot of protocols put in place and this is a factory where people work with heavy machinery often in close proximity and it is a densely packed factory. 10,000 workers. There are a lot of requirements put in place. From Wearing Masks to temperature checks and ensuring the people dont go in break rooms at the same time and making sure everyone doesnt arrive at their shift at the same time. What im hearing from employees is that has basically been reduced to everything is normal but Wearing Masks. This may have changed over the past couple of days. It is possible these protocols were in place and have just sort of become more relaxed as people have gotten into the groove of things. There is ongoing concern about whether employees are adhering to social distancing and whether management is enforcing it. That is a lot of workers packed into one facility. We have to leave it there. I appreciate your time. Thank you so much for coming on. Take care. One of napas most popular activities has started back up, and we are talking about wine tasting. For more, were joined by our legal analyst Michael Cardoza it. Always good to have you on here. Lets talk about the romances partner. She is an essence accused of laundering money that came from him that he obtained through illegal schemes according to prosecutors. How is she concealing this money . Her role was number one certainly as his girlfriend she didnt have the horsepower to get involved to affect what was going on at city hall or to your contracts for these companies outside of city hall. So what she did as a girlfriend was launder money for him. People would give her money and the money would be put in the bank account and then transferred to another bank account in some instances and then pay his bills. He had a piece of property in stony brook where he had a second home and he called it the ranch. Other people that were looking for contracts to do work for the city and favors for him would to work on his ranch. One of them gave him a gate and other gave him stone and they would send out workers to work on his house. And he would funnel paying them to his girlfriends. That is how she got involved. And prosecutors say that she knew the money were the proceeds of illegal activity in their words. Let me ask you about the two city contractors accused of providing essentially free construction work on the Vacation Home you mentioned in exchange for getting help with city contracts. It sounds like from prosecutors this was an ongoing relationship and scheme. How much did it take for investigators to unravel exactly what was happening in this alleged scheme . I am sure would they initially got involved with the feds usually do is they begin h and arrest them and then they begin to negotiate. Usually what the feds do they want to go up the ladder and who was working with you and who is implicated in this that is above you. He doesnt have to people under you. He has negotiated a deal with the feds. They wont tell him specifically why he will get by way of sentencing but they tell him we will let the federal judge go that you give us cooperation. Who do you have . And this case he flips on his girlfriend and says here is what she did. And then he flips on another man who was a contractor and a woman. He said look at these two. I was involved with them. They gave me gifts, for an example of knew what these gift were for according to prosecutors. And you talk about everybody turning on one another. The u. S. Attorney in this case after filing these three new criminal complaints the u. S. Attorneys office says that this is not going to be, these are not going to be the last charges you see in this case. A wealth do you think goes down as part of this corruption investigation . I can give you names, but i can tell you that they will be talking to hernandez and kong and saying, you are all under arrest. Who do you have to give up . If you want a lighter sentence, give us some names to us. The u. S. Attorney anderson has said publicly, look, if you were involved dont walk to the fbi or the u. S. Attorneys office, running give yourself up and let us know what you know about this or if youre implicated because you want to have early acceptance of responsibility to get a lighter sentence, they are putting the word out. A lot of people foolishly think well, i was involved but no one will flip on me, come on. He flipped on his girlfriend. Believe me, those people will save themselves, hernandez and con will give up names of other people implicated here and give the feds the way that the money was funneled and other people per chance within city government. A lot of these people im telling you, the morals of alley cats. They get into government and use it to their own benefit. The feds are coming in and coming after you. We have not seen the last in terms of criminal charges. All right, always good to have you on. Thank you. People continue to talk about the into Police Brutality as george floyd is laid to rest. Georgias secretary of state and state House Speaker call for investigations into voting delays on the day of the states primary. Voters face a long line and some polling locations did not open on time and others struggled with the voting machines. Most of the problems were in atlanta and surrounding counties for voters described arriving before polls open and standing in line for hours. For more on the issues taking place in the investigation we are joined by our political analyst. The ap is reporting that joe biden has won the president ial primary in georgia. The discussion about how we move forward is continuing. There are so many tely. There has been a history of problems in georgia and across the state in atlanta and thereby cobb county. Throughout the state where voters cannot get into the polls are when they do, things are broken. I talked with the journalist a little while ago base in cobb county who reported that at arriving at the polls she found the situation where some of the machines did not work. They had to use a stylus and the stylist wasnt working. The overarching problem is for a lot of voters in georgia, they are prone to Voter Suppression of black americans if they are not able to get to the polls in way in. We have been hearing about that for quite some time. You know, when youre analyzing the problems, i mean, there are so many sources for what these problems are. Is that the technology or poll workers . How do you fix some of these problems before we get to november when certainly the discussion about how these elections will go forward and whether or not these results will be challenged in areas that already have problems. How did those problems get fixed and do we have a sense of what can be done to change this . There is an a lot of time. Georgia is ground zero for the types of problems that are occurring around the nation whether it is machines that dont work, and adequate training of poll workers, poll workers you dont show up because they are fearful around coronavirus and all of that can bind makes it a tough thing that has to be solved very quickly. Georgia is going to be an couple of senate races and all this right. Sons why georgians what is ironic is this is been going on for so long that you would think that one by one these problems would have been fixed. Were seeing these problems across the nation. It is across the nation and specifically in georgia. There are segments of the voting population that are disproportionately affected. If there are access problems hitting certain populations more than others, they will be hit hardest. Well, one of the comments i was make is the systemic problem that disenfranchises black voters potentially. There is numbers that suggest that actually does hold down the voting and the population. The problems of even more than that in georgia. They have to do with white voters and higher in neighborhoods not getting things to work and not being able to vote and having ballots loss. It is systemic unfortunately the problem with it affects one part of the georgian population more than others it is a deep problem and certainly we hope they can be addressed especially as we head toward november.
