A peaceful protest in oakland this afternoon to some big names from the golden state warriors. Steph curry and his wife took part in a march around the lake. The event was called walking in unity. Demonstrators chanted the names of black americans killed by Police Including george floyd. Another large peaceful protest today took place in east palo alto. Demonstrators gathered at noon and many of them Holding Signs and demanding justice for george floyd. Then they marched through the city streets to bell street park. San mateo county instituted a two day curfew yesterday which runs from 8 30 pm until 5 am tomorrow. A citywide curfew remains in effect for new york city and tell next monday. Your Governor Andrew Cuomo urged protesters to remain peaceful and to respect the curfew. He said that looting is criminal behavior and will not be tolerated. And he said that for the most part, the protests, last night, were peaceful. A rally was planned to take lace this meeting at mayor bill deblasios official residence. To the latest on the new charges against those for officers in the death of george floyd. How long the trial could last and whether there could be any plea bargains in the case. We believe these are the right charges. Reporter attorney general Keith Ellison upping the charge against Derek Chauvin into Second Degree, unintentional murder. Chauvin had initially faced thirddegree murder. We have a duty to charge the charges that fit the facts in this case. And we have done so. Reporter it carries a maximum penalty of 40 years but the recommended sentence is 12 years and six months. That is much more likely to be what is handed down if chauvin is convicted. The other three officers, j. Alexander kueng, thomas lane , and tou thao face two counts of aiding and abetting. Ellison is the lead on this case. As to freeman have been preparing to let tran20 to plead to thirddegree murder, ellison would not say. He would also say if hes considering please now. It is too early to begin the conversation. We are preparing to try this case. If Something Else happens, will see. Reporter ellison will not personally prosecute the case but has enough staff and does not expect to need outside counsel. He thinks there could be a fair trial in the twin cities without moving it. He has the public for patients. In order to be thorough, this is going to take months. I dont know how many, but, it is better to make sure that we have a solid case. Reporter Derek Chauvin is held in segregation in the state local maxima and security prison. Investigators planned of the other three, fired former officers in custody by the end of the day. Attorney general Keith Ellison says he did not bow to political or public pressure with these charges, even after days of unrest in the streets and huge rallies and demonstrations almost daily. Joining us to talk about the new charges is our legal analyst, michael cardoza. What do you think led them to change the charge to Second Degree murder . What could they have seen that would get them to change their minds . Reporter im not sure, it is more what they saw in the video, that is changing it to the attorney general local office and taking away from the District Attorney which i think is a smart move because the das offices are too close to the Police Department. After this trial, they have to Work Together again. I das office is more likely to be a little more lenient than an attorney general who doesnt have to work with the local Police Department every day. Reporter this case is getting worldwide headlines. You think that public pressure put any part in this . Of course it did. They are attuned to that. They understand that. Last week, when the charges came out, thirddegree murder, i thought it is tough to get a convention can against the Police Officer. And especially with a high degree of homicide. The more i watch this tape and the more i thought about it, i thought wait a minute, if a non Police Officer did it, no matter what color, they be charged with firstdegree murder. Putting money on someone to connect and have an that person, in this case, george floyd, putting a knee on his neck for over eight minutes, he knows that would lead to strangulation. He knows, as a Police Officer, it doesnt take long to strangle somebody, five, six, seven minutes, he leaves the d there. Theres a tent for first dream murder. If i was in charge, i would charge firstdegree murder against this officer and let a jury decide what it was. Is it a first . Is it a second . Is it the third . I would let it does jury decided and myself saying well, this is second. No. Foul a first in this case. You do it any other case. Why not in this one . Reporter would you think are the chances who will be convicted . Im pretty sure he will be convicted. Youll never know with the jury trial. I tried enough jury trials, you never know whats goes on. Look to the streets. Look at the people in the streets. In this country and other countries, look at the people reacting to this in a negative way. They say, while he is a Police Officer, not in this case, because in this case, it is so different and so egregious and thats why i say the first degree, keep in mind, when they try for first, it doesnt mean the jury can bring back a Second Degree murder, a third, manslaughter. They can convict of a lesser included if they choose to do so. Hang on that, when i was a prosecutor, i had one case that hung, 10 jurors for first degree and two for Second Degree. And they couldnt agree to that. We ended up with a hung jury and had to try it again. Most people think is hung jury, but no, he can hang on degree, not withstanding, im telling with the reaction of people, take this to trial in the first degree and you have a good shot at convicting the skype because i think he should be convicted of a firstdegree for what he did in this case. Reporter what is his defense for his Defense Attorneys . How will they argue this case . It will be difficult. He did not have that intent. And he was merely trying to hold this man down. Keep in mind, this was a big bouncer in a bar. Im sure theyre going to say that, it would be difficult if he got looser got up, it would be difficult to control him. I have to think the Police Department back there their protocols, it is to put a knee to the middle of the back and not the neck. Then you have those other officers that are condoning, very tacitly, what he is doing. That is why they are being charged. It will be more difficult to get it conviction against them of a higher degree. The jury may be a little more lenient towards him, but not withstanding, they will convict them of at least a 3rd degree murder if not manslaughter. But, for officer tran20, a minutes with a knee in the neck with a man telling he cant read, and he calls out for his mother, you have a lot of good facts and for this da to say, or this attorney general to say it is going to take months to get it together, dont let this go on too long. What is in this case will be presented to the jury is that videotape. I can almost see doing an opening statement, playing the videotape and saying we rest. There it is. Theres the firstdegree murder. Im being facetious when i say that but that is where this case is. It is in that videotape. It is compelling and heartbreaking to watch. This is a youth march that started at Mission High School. And, there are probably an estimated 5000 people. From what we understand, this is on 18th street between dolores and church. We spoke with one surfer who said people seem to be mindful of social distancing on the beach and in the water. I was trying to be mindful of that but it does get hard when you get excited about the waves when you get out and youre running the high and i realize someone is coming close. You can see from the ground level that this crowd is sprawling, going in all directions around Mission High School where this started, it was supposed to start around 4 pm. It got underway earlier perhaps energized by the news coming out of minnesota about the new charges that the four Police Officers, all four Police Officers will face. The crowd is very large. I had a chance to walk through the crowd and get a sense of who was here. I saw a lot of young people. I saw a lot of people with kids. A lot of families and a lot of young people out here with signs that Read Everything from and mass incarceration and a lot of signs showing their support for black lives matter. We noticed the crowd is starting to shift. As im speaking, im getting an alert from San Francisco saying there is a citywide, mandatory curfew that goes to anyone who signs up to San Franciscos Emergency Alert system. That alert went out about the curfew set to go in place tonight at 8 pm. San francisco is still under that curfew. Earlier, we received an alert that muni service was being rerouted. As we can see from the helicopter shots, this is a large, sprawling demonstration which would impact anybody who is able to go through the area. It would impact, you can see a car with a person on the loudspeaker there. On the side of his car, he agrees justice for floyd. He is shutting out the window trying to get the crowd excited , trying to get the crowd aware, this group of young ladies saying no justice, no peace. That is a lot of what we seen so far. A lot of people expressing their outreach, starting to again acknowledge what has happened today in minnesota with the charging of all four Police Officers. You touched on that this crowd is starting to move from our vantage point. It is hard to get a sense of exactly, you might have a better sense on that. You can see that ariel shot, its hard to see that helicopter shot. I will look at that later but we have seen the crowd shifting in the area. It is a very large crowd. It is already around mission good park. The citys on the west side of the park, we are on the side of the park and you can see there are thousands of demonstrators out here. A lot of them, all of them voicing their support for George Floyds family. Speaking out against Police Brutality and you can see hundreds, hundreds of black lives matter signs out here. We will monitor this crowd speaking out, voicing their outrage over what happened, what we watched unfold on that video out of minneapolis. We will monitor developments. We will try to get a sense on where this crowd is moving, how it is moving. There are a lot of variables at this point. There is a sizable police presence, not here in the park. Not in the immediate proximity to the demonstrators who are here right now. But, ive had a chance to move around the perimeter. Ive seen a large amount of San Francisco police in the area. I talked with one officer who said he considers his job to make sure people still have access to their First Amendment freedom of speech. That is what he is here to ensure. Those officers really in the promoter, not interfering with this act of civil disobedience with people saying, it is not business as usual. We will leave these helicopter pictures up for moment. This has to be one of the largest, if not the largest protest we have seen here in the bay area since the death of george floyd in minneapolis. You can hear what christian was talking about. You can see the police line right there, keeping the protesters from marching down the street. All of this started at Mission High School. There are crowd estimates in the thousands, roughly 5000 or more. Just a massive crowd on the scene. They are walking, in some cases down valencia. They are headed, we believe, towards the Mission Police station. We will keep skyfox up and keep christian on the scene. You see just how large this crowd is in San Francisco. Everything weve seen so far tells us this is been a very peaceful demonstration. Again, we need to note that a curfew goes into effect, in San Francisco, in two and half hours at 8 00 tonight. But right now, this is whats going on in the city, right in the thick of things by dolores park. Thousands and thousands of protesters headed towards the Mission Police station. Contra costa county is easing restrictions when it comes to the coronavirus along shopping malls and other indoor businesses to reopen today. Many business are slow to open their doors. Theyre working on following the safety percussions to rent the spread of covid19. Christine joins us with more on the story. We want to prevent the spread of covid19 is a major priority. We are really excited to see our customers. It will be nice to have people in the store again. Reporter not all shopping malls are opened. A spokesperson for sun valley mall in concord says they are reviewing the order and plan to reopen soon. They will make that announcement on their website. Two more california inmates have died of the coronavirus. A spokeswoman for the California Institution for men in San Bernardino county says both men had been held at the facility in chino and died at outside hospitals. One man died yesterday and another today. The deaths are the 11th and 12th covid related deaths at that institution. They currently have 446 inmates who are positive for covid19. A violent night in vallejo with looting, organize burglaries and a Police Shooting. New information on what led up to that definitely shooting. There have been hundreds of arrest of protesters during the demonstrations in the bay area. So what happens next for all of those who were taken into custody and will they face charges . The Minnesota Attorney general announced that 44year old Derek Chauvin has been charged with seconddegree, unintentional murder for the death of george floyd. Thats in addition to the charges he was arrested for last week of thirddegree murder and seconddegree manslaughter. The three other officers were also charged today with aiding and abetting murder. The attorney for the floyd family call todays developments as significant step forward. A group of mostly young people gathered in san jose for protest demanding justice and equality. It started at about 10 00 on lincoln avenue in san jose. Is a peaceful demonstration and was organized by black lives matter. It was another night of chaos in vallejo. Police responded to a number of reports of looting throughout that city. For more on the civil arrest, henry lee joins us. Henry, you have new information about the definitely Police Shooting of a suspected looter and the officer say at first he thought the suspect was armed. Reporter we were told that the suspect had fired first but it turned out he was armed with a hammer, not a gun. The mans family Attorney Says the shooting should have never happened. Reporter 22yearold Sean Monterrosa we shot and killed by fully hope Police Tuesday morning outside this walgreen store. Please chief said on also fire five shots through a police car window at monterrosa after thinking polluting suspect was reaching for a gun. Investigations revealed that the weapon was a long, 15 inch hammer tucked into the pocket of the sweatshirt. Reporter monterrosa died. Another suspect rammed another. Other suspects involved took off in a pickup truck. Police say theres been widespread looting in vallejo over the past two nights with opportunistic criminals breaking into stores throwing rocks some bottles on Law Enforcement and leading officers on chases. Monday was a terrific night. Something we never seen in 27 years. It was an orchestrated, organize assault on our city. Reporter city Officials Say the looters are adjusting from peaceful protesters. The unrest has led Solano County to call in the National Guard to prevent looting at businesses. At least 15 National Guard personnel are stationed in vallejo. We needed the Additional Resources to safeguard the businesses that were destroyed or severely damaged. Reporter an attorney for monterrosa says he did not deserve to die. He was a well loved member of the community. This wasnt a person that was committing murder. This wasnt a person that, from the Information Available to us, this wasnt a person who shouldve ended up dead on monday night. Reporter the attorneys is waiting for bodycam video and footage to see the moments leading to the shooting. Will not believe anything they tell us anyways until we see the video. Now, their marching and in some cases theyve gotten to the Mission Police station. There are officers running the Mission Police station. Theyve set up barriers to keep these protesters away. From everything we seen, this has been a peaceful demonstration. What gets your attention is a large it is. It has to be one of the largest, if not the largest demonstration thats happen here in the bay area so far. We have a sense of where it started. That is Mission High School. There are still people who are there. There are so many people heading down towards the Mission Police station. We do have christian on the scene. He is working to get more information. Hundreds of demonstrators have been either arrested or cited in the bay area as a result of the protests. The question is what happens next . We take a look at what local das will likely do. Reporter please have arrested or cited at least 146 people. The Alameda CountySheriffs Office has arrested 156. In san jose, the police have arrested 180 since protest broke out on friday. Arrest may be coming. Tensions continue to boil over following the Police Killing of george floyd in minnesota. Legal experts say many of these cases probably wont see the inside of a courtroom. The difficulty with these mass protests arrest is they are easy to make but they are very difficult to prosecute in court because of the level of proof that is required in court. Reporter Stephen Clark is a former prosecutor. He says the primary focus of police during protest is getting people off the streets rather than building an airtight case. Das must consider whether charging a case will only be fanning the flames. We want to create a situation where we are sympathetic with peoples right to protest. Reporter this law office said it will represent anyone arrested during the protest for free. We are offering to represent these people pro bono. We believe in this cause that strongly. This is a revolution and we want to be there with them. Reporter defense attorney tyler smith is getting ready for a long fight. He will be cutting any deals with prosecutors and will push for dismissals in all cases. We dont expect the das to just throw in the towel and dismiss the cases but, our plan is to force him to. Reporter some District Attorneys have signaled they will be charging many cases. The Santa Clara CountyDistrict Attorneys office says their philosophy when reviewing cases is that the sent is american. But looting, vandalism and physical violence is criminal. The San Francisco das office says it supports protesters and First Amendment rights but is reviewing commercial burglaries and battles them on a caseby case basis. District attorneys must also consider rather prosecuting the case is worth the risk of potentially spreading the coronavirus. If their background or the underlining offense doesnt suggest they are continuing risk to public safety, it is likely those prosecutions will be delayed. Reporter hes a former prosecutor. Oaken police are in an hours long standoff with a man armed with a rifle and barricaded inside of a home with two young children. This is been in active scene since around 5 30 am. It is happening at home on harmon avenue and 57th. Police received reports of a man firing a gun and a shot spotter system also picked up the sound of gunfire. Officers responded and said the man fired at them through window. Police have been negotiating now with the gunman, who is believed to have two children, ages six and eight, inside.
