Governors actually doing is moving from essential businesses very, very slowly, to lowrisk businesses. Stage two will offer consumers to go to nonessential retailers that choose to reopen under Strict Health distancing roles. That includes the counties detect, ready to trace and detect infections as well as going back to shelter. Where moving forward but with my on the data. My clothing, sporting goods, flower shops, and others will be open for Curbside Pickup of merchandise, no indoor shopping. People may return to their jobs for nonessential can fracturing such as furniture, clothing, and toys, and a wide array of other factories as well is Logistics Centers so long as social distancing and disinfection methods are practiced. What does it mean to move into stage two . It does not mean a return to normal. We know the covid19 is still spreading. What will not reopen now are offices, inside dining restaurants, malls, and outdoor museums unless otherwise warranted. It is a dynamic process, this is not etched in stone, we want to continue to work with people across sectors and to address consequences. Reporter as of now, wont be until stage three, weeks or months away were more close contact workplaces can return to the public under safety protocol. They include churches, weddings, movie theaters, hair and nail salons, gyms, yoga studios, and others. One stage three happens, remains unknown. Stage four, still an unknown number of months away will and the overall shelter in place are stayathome orders. Then and only then will we be able to go to large sporting events, concerts, amusement parks and other close contact event. Everything hangs on the most important factor consumers, customer confidence. Just because you open the business and have the ability to do Curbside Pickup or take a product from a retail store and put it into the trunk to provide for social distancing of physical distancing to a customer does not mean theyre going to show. Nor does it mean your workers will show. Reporter the governor promises more guidelines for those businesses next tuesday. But, make no mistake, if the county cannot comply with the state requirements that the county cannot move ahead. Reporting live,. Any idea how thecounties are thinking about moving forward with this plan . Obviously theyre interested in moving forward they know the damage being done to the economy , but they have no choice but to comply with most of these things because the last thing you want to have is a rebound of the infections themselves, because disclosures will take a lot longer and beyond that they will do a lot more damage. All right. Still to be seen just what type of changes. Thank you. Once again, millions of americans are without work. The Labor Department releasing weekly jobs report, 3. 2 million americans for Employment Benefits last week, more than 33 Million People have filed claims since midmarch, california saw the highest number of initial unemployment claims of any state last week. At 318,000. For more on unemployment and what businesses are doing, were joined now by an employee lawyer with the devito law group, its good to have you on here. Your firm is working directly with a lot of companies in the bay area on ways to try to keep employees on the payroll, in the mid of this crisis. What are the strategies being employed . That is correct, what were trying to do is figure out how you can keep the most employees to keep them legally, so the question is whether you lay people off or you furlough them. If you furlough a group of employees, and you can maintain their Health Benefits while they collected employment, so thats one of the methods in which employees are keeping employees on payroll. What kind of companies are you working with . Are they companies that reached out to your firm to try to figure out a way to save as many jobs as possible . Absolutely, its across all kinds of industries, all of it. Any employer can reach out to discuss strategy. Most employers are trying to do, is there trying to keep as many employees as possible. There trying to have a strategy with respect to how do you lay employees off and allow them to come back to work, and when youre doing layoff, how do you do it legally . If you have a number of employees they want a layoff, do you do it by way of seniority . By way of performance . And in doing so, all laws that applied pretran13 still apply. If you lay people off, you cant violate discrimination laws, you can fire people because there part of a protected class. You have to make sure you youre not letting whistleblowers go. We have to keep an account the people youre letting go, even if youre trying to do that, you have to make sure its within the legal framework. In many situations are you running into where Companies Just cant resolve, the bottom line is just not going to allow them to keep people on the payroll . Even if they talk about cutting back hours, reducing hours, some sort of furlough program. How often accompany she saying look, i have no other choice. But to lay people off entirely . Make sure, i think its daily. It depends on the industry. And so they are looking at how many people can they keep, and if they keep them what kind of benefits can they give to them . For example, if you have employees that are getting paid 50 grams, can you reduce everybodys salary by 10,000 to keep everybody . Or if we have highlevel management can they reduce their salary so we can keep nonexempt employees. Generally speaking, some of the industries are getting so hard they are just going out of business. Theres nothing they can do. Some employers are working the workforce with thwhen governor lifting that we are allowed to bring some of the workforce back, and in doing that, how do you bring them back . One of the Big Questions is the governor said earlier, is due those people want to come back . Just because they will be lifted, people will be scared, and said i want to go to work. Im afraid, because im immunocompromised or live with my grandparents. Even when the lift occurs, will those employees actually go back . Thats another question. Absolutely, there are certainly going to be some reluctance in terms of putting your safety on the line, going back into Work Environment. What steps are lumber companies you are dealing with taking to ensure a safe Work Environment . If edwin the get employees who are returning to the workforce . All of my employees what is at the cdc, with who, with osha, they have to look at those regulations, so the employee said i want to come back to work because i am afraid or live with my grandparents, and im concerned about impacting them, as long as the employer is taking the appropriate steps to make sure theyre giving a safe environment to come back to, and the employers are going to be hardpressed to say that they cant come back. However, we still have to look at obligations under the a. D. A. And whether there is an employee that might come back who says i am concerned about coming back because i have a disability, or have a compromised immune system that i cant come back. So again, we have to look at it on a casebycase basis. My employers are putting into place all of the safety mechanisms so that when the lift occurs, they can advise employees there we have a safe environment to come back to. Certainly, things get very complicated in the midst of a Health Crisis such as this one. We have to leave the conversation there, really appreciate your insight. Thanks so much for coming on. Theres a picture right there of the call that we get, and we were able to talk to members of the community, Business Owners that are hurting, that are worried about how we can open back up, and what we are going to do. As we go down this road of recovery. Is a painful process, but the napa chamber of commerce of the other chambers here in napa county are paving the way to make it really work, and theyre working hard with our Napa County Health department to come out with the process, it will be safe, and efficient for all businesses in the community. Do you know when that plan might be availed . The plan was typed up and submitted to our Napa County Health department, and Governor Newsom came out with new orders today and from what i understand, the Health Department will be updating the guidelines as early as tomorrow. So, its kind of the phasing in , two step phasing in of kind of a soft opening, and a bigger opening for more businesses in the county. The governor living in a to the county officials whether not they want to move into this phase, it sounds like you and napa are in fact going to move forward with the opening more business. Yes, its the goal, the chamber of commerce has made it real clear under the leadership of mike murray and our city of nappy chambers well as all the other cities of napa county, have made it clear to our Health Department that this is a crisis, and our businesses are hurting desperately, and we need a road of recovery. But we need to do it in a way that is safe, for the people of napa. Absolutely, before let you go can you tell us how testing is going in the city of napa . Were doing a lot of testing, the county just came out yesterday and announced we are doing testing for everybody. Anybody there once a tester need to test, we are offering testing for our napa county residents. And its wonderful, you know, napa, we are a world destination. Millions of visitors every year, and yet in our county, weve had very few people that have been tested positive with the coronavirus, and we have only had two people passively. Two people is two too many. Its horrendous, but were certainly not new york and other places, and we really are ready for soft openings and to begin to build the community. I think that is what a lot of counties are hoping to do. Doris gentry of napa, thank you for talking with those. Thank you. The city of berkeley warning its residents to prepare for fire season, the actions are telling people to take now. From boom to bust through talking expert on the enormous impact the coronavirus pandemic has taken on californias budget. Climate california state budget have gone from boom to bust because of the pandemic. During a silly briefing this afternoon, governors and reflected that just a year ago the state had a Budget Surplus of more than 21 billion, another status projecting a 54 billion deficit. They been working to pay down its debt and boost social safety net programs, but that is all changed with unprecedented unemployment and steep spending on healthcare. Governors and stressed that the federal government needs to step in to help. Because of this pandemic, because of what it is done, these revenue shortfalls are bigger than even the state of california. We need the federal government to recognize the. s making pushback against comments that california is a poorly run state, that should not get a bailout. The governor is said to release his budget blueprint next week. More on this, were joined by professor of economics and law at uc berkeley. Investor its good to have you on here, the state of california is spending a lot more money right now in the middle of this Health Crisis under the same time, given employment where it is right now. The status sinking in less money in terms of tax revenue, are you surprised at all given all of that that we are facing this massive budget hole . No, im not. If you told me these numbers three months ago, i wouldve been stunned and told you this couldnt possibly be true. But of course, let us change since then. So, california had been boosting its Rainy Day Fund for the last several years, is that going to give us any sort of a cushion . The rennie five day fund is about 16 billion, which is wonderful and normal time. Would help us quite a bit. And i think initially, the governor thought that when this crisis restarted that it would help. Its just turned out to be much, much worse than we were originally thinking. This is the Unemployment Rate is probably in the vicinity of 20 . And this is just going to be much worse than the financial crisis we had, just over a decade ago. Its really we have to go back to the depression to get an economic decline the spring. During the depression, states did not perform the functions that they perform now. The didnt raise taxes, on the skill they do now. They didnt do very soon that they do now. So, this is really unprecedented for us. In the governors right. We need money from federal government. We are getting some, some of it is automatic. In the stimulus packages that have been passed, there is some, but it is certainly not be enough. How much more were going to need . California, like other states needs to have a balanced budget and so if we dont get it were going to have massive tax increases and spending cuts, unimaginable. And so if you dont get money from the federal government, it will be very, very tough. On california will be bad for the economy. Its really a political question whether or not we will get it. The president has certainly staked out to make the public consistently staked out a position that is very antagonistic toward giving more money to the states. One hopes that as they hear more from governors, both republicans and democrats that they will begin to realize that this is not the result of profligate behavior by states, but simply a terrible catastrophe hitting the states as well as individual citizens in the u. S. Your confident professor that is not for this unprecedented Health Crisis, that the pandemic that weve been hit with, the state of california would still be running with the surplus. Oh yeah, the original budget may revise the just came out as the one that is showing the terrible news. The governor was proposing spending increases, people might differ about the proposals he was making, but thats small has been going bac to several governors, california has been responsible, and with that tax increases, we have had moderate moderation of spending programs, and if you added up california has been fiscally responsible. We certainly wouldve had a Budget Surplus, if and additional Rainy Day Funds of love or distract the economy is doing well. As we wrap up here, this is going to put Public Schools in california an extremely tough position. They got a big chunk of their funding from the general fund, the states general fund. How much money do we anticipate Public Schools the k12 schools in california will lose out on . Its on the order of 18 billion. Based on the funding formula that translate state revenue changes in the Public Education funding. Its horrible. Public education is a big part of what was spent in this state so we have large budget cuts will have large budget cuts in Public Education. Its going to affect k12 spending, university and community colleges, we dont get additional funding from the federal government it will be a real disaster in terms of state programs. Even if we raise taxes. We will leave the conversation there, we appreciate you again, professor of economics and law at uc berkeley. Thank you for your time, we appreciated. We will speak with the city councilmember from berkeley to learn about the actions theyre asking residents to take as we head toward fire season. Temperatures warming up today, but it will not last for long. Time changes in the weekend forecast, and next week, we are talking about ring clouds. Your forecast is coming. Some areas are posting warmest temperatures of the year, with a warmup comes increased fire danger, and the city berkeley is asking residents to get prepared. Were joined by berkeley city councilman susan, thank you so much for being here. Your message residents is simple, its time now to get prepared. Thats exactly right, with warm weather approaching, we encourage everybody to get ready for fire season. We know that the water levels are down, and grass will become very dry, and we are expecting, unfortunately, very bad fire season this year. Fire season, unfortunately, does not know that we are also going through this pandemic. So, now we are asking peopan evacuation plan. Discuss where you will be and how you will contact your family. And also take care of your properties. Clean your roofs, and your gutters, make it five foot Defensible Space around your home. And be alert. Sign up for alerts in Alameda County. Definitely very good advice, good steps that all residents should take. I want to touch on something that you talked about, susan, the fact that we are going through this pandemic, are you concerned that people might be forgetting that fire season is approaching . I think its hard for us to focus on anything other than covid19. But, as i said, the factors the season is getting warmer. And we are approaching that time of year, when we know there will be first. Thereve already been 750 fires in the states. They havent been very big, but we know fires coming. And it is hard for us to represent around that because we are so intensely focused on dealing with the shelter in place and keeping our families safe and following the rules. This is kind of a crisis we may be facing. In addition to residents taking action, what is the city berkeley doing to get prepared . We are actively working our Emergency Services Operations Center is actively working on this issue, as i know the county is in the state is, and agencies like the red cross are planning now. And they are considering how we would handle evacuations in the events that we are still in a shortterm play situation, how would we house people safely . During covid19, but again, i want to stress that it is everybodys individual responsibility to make sure that they connect appropriately with very short notice, should we have to evacuate. And in the event of the threat of a wildfire. So please, pack your go bags, make sure you have masks. N95 masks are hard to come by because heavy smoke is very harmful to your health. There will affect everybody, not just People Living in high hazard fire areas. Youre certainly right about that, obviously these precautions the people all across the bay area should be taking. We really appreciate your time, thank you. Stay safe. It is quite a warm day around the bay area, but markets are to tell us that we are going to be dialing back the temperatures coming up for the weekend, and let me see if i got this right. There is a chance for some rain here coming up next week . Its hard to imagine how it looks out there today. I know, not a cloud in sight for today, you might think the rainy season is over for the year. But we are tracking that rain chance and early next week, not a strong system but anything in may is always of interest in terms of rain shower. Actually had rain last year in may, the sure possibly we could be talking about more rain showers as well. Thats a few days away. Today, temperatures of a trending way up, especially for the in the neighborhood.
