Straight to new information this morning about a fire at a highrise Apartment Building in the south of market district in San Francisco. Firefighters are now telling ktvu an electric scooter was the source of this Early Morning fire. Flames broke out before 5 a. M. Inside a building on clementina street and gallagher lane. One person was hospitalized with moderate injuries. Looks like firefighters also rescued a dog from that burning building. Time is now 7 01. California now is under a state of Health Emergency because of the coronavirus. Right now, there are 53 confirmed cases in california. Santa clara county reported three more cases and now has 14. That Emergency Declaration means there will be money available and Resources Available as well as personnel. Also, information will be shared. Meantime, a cruise ship is cutting short its trip and is trying to sail back to San Francisco. Ktvus Elissa Harrington is in San Francisco at pier 27 where that ship was supposed to have docked but has been told to stay away for now. Good morning, elissa. Reporter good morning. Thats right. We have been tracking this ship all morning. I want to show you a map to give you an idea of where it is right now. Now, just earlier this morning, it was closer to san luis obispo. But as you can see, the ship has been moving and now it is still well offshore before you closer to the monterey area as it continues heading to San Francisco. We dont know where it will anchor, but we know at this time it will not be allowed to dock. There are thousands of people on board. The cdc wants to test those showing symptoms of covid19, coronavirus. Governor gavin newsom said 21 people on board are sick. Officials plan to fly testing kits out to the ship. And until then, it is not allowed to dock here in San Francisco. That ship we requested to be delayed, the arrival to be delayed, and the ship is currently off the coast. And currently is that that ship is now being delayed to provide ample opportunity to partner with the cdc and coast guard and state Health Officials to conduct tests because we have a number of passenger and crew that have developed symptoms. Reporter Governor Newsom said a man who died of coronavirus was a passenger on this same vessel from february 11th to the 21st for a cruise from San Francisco to mexico. The 71yearold man tested positive tuesday in Placer County. He was in isolation at kaiser in roseville. Officials say that man was likely exposed on the ship. In Sonoma County, theres a confirmed case thats also linked to this trip. The ship has sent crews to hawaii and was headed back to San Francisco. Its unclear if everyone on board will be quarantined. Governor newsom said that they should get those test results back quickly. Reporting live in San Francisco, Elissa Harrington, ktvu fox 2 news. New this morning, an Oakland Charter school has canceled class for today and tomorrow. Aspire Monarch Academy is reporting that a staff member there may have been exposed to the coronavirus. School officials emphasize theres only the possibility the worker was exposed. But still, officials decided to take preventative action to help protect students, faculty and staff. Class has been canceled now for the rest of the week. A private school in atherton will also be closed this week due to concerns over the coronavirus. The menlo school says a staff member had contact with a relative who tested positive for the coronavirus. There are no signs the worker was infected. I didnt know it would get so close to us here in menlo park. I guess thats the case with coronavirus and how bad its getting. Menlo school is undergoing a deep clean. School Officials Say they are working closely with the San Mateo County department of health as well as the cdc. Our time is 7 05. Some private schools are preparing to keep educating students if theyre forced to close temporarily because of the coronavirus. Many are considering Online Learning so students can keep doing their school work while at home. A school in moraga is considering its options and one thats popular with teachers is the San Franciscobased company out school. It offers its own online classes or individual teachers can use its platform to run their own lessons. It has students stay in touch with their regular teachers. Private schools can make their own decisions based on their own needs and their own finances. But state official havent said if california could afford to provide Online Learning for all 6. 3 million Public School students. Democratic president ial candidate Bernie Sanders says he will drop out of the race if joe biden ends up with more delegates heading into the Democratic Convention in july. He made these remarks on a show after winning fewer states in the super tuesday primaries than expected. Biden picked up ten states, sanders took four. Senator Elizabeth Warrens campaign is said to be assessing the path forward off her bad results on super tuesday. California voters rejected several new taxes and bond measures for education and transportation on super tuesday. So far, statewide, prop 13 is going down to defeat with millions of votes still to count. Prop 13 would raise 15 billion in bonds to fix californias schools. Voters in Contra Costa County turned down measure j. It was a sales tax for transportation projects. If you are trying to get to the airport, give yourself extra time if you use the san bruno freeways there near the airport. Temperatures coming down a good 15 degrees. Others are still above by about one to eight degrees or so. And the low thats in front associated to the north is on its way to bump the high out of here. The Sonoma CountySheriffs Department says Surveillance Video shows santiago boarding a flight with his mother yesterday. Federal authorities are searching. This is his mother. Her name is autumn stone. She does not have legal custody. Stone is facing parental abduction and child concealment charges. 7 15. Happening today, hundreds of teachers, students and parents will be rallying outside of the San Francisco school board headquarters. The school board called a special meeting to talk about laying off staff to help close a 26 million budget deficit. The board canceled that meeting. But the parents, students and teachers say they are still going to hold their rally to let the school board and the public know they want to work with the board to find other ways to cut expenses. That rally is due to begin at 4 30 p. M. Today. The Oakland School board approved 20 million in budget cuts and will send layoff notices to nearly 100 workers. Teachers, students and parents attended a meeting and demanded the school find other ways to fill the budget gap. Many suggested shutting down the School Police program, which they say would save 2 million. The board rejected that suggestion. The oakland superintendent says the cuts are agonizing but necessary. Being insolvent is not an option. Even though we did do our best to try to keep cuts as far away from students as possible, there will still be impacts to schools. Staff cuts will include librarians and counselors. The board also approved using one Million Dollars from the Emergency Fund to help close the budget gap. A new report says San Francisco police completed less than half of the reforms called for by the Justice Department. Oakland police Department Says it wants to pick up the pace on the 272 reforms called for by the Justice Department in 2016. Those reforms were initiated after several officer involved killings that led to the resignation of former police chief greg suhr. Despite slow progress, there have been some positive changes including a reduction in the use of force cases. A state Appeals Court has ruled that Berkeley Police should not have searched a car even though the Police Officer could smell marijuana in that car. The officer stopped the car that did not have a front license plate. The driver pulled over, told the Police Officer he had a small amount of marijuana and passed a field sobriety test. The marijuana was in a closed tube as required by state law. No other drugs were found. However, a loaded gun was discovered under the seat and the driver was arrested. Today coronavirus testing kits are being airlifted to a cruise ship heading back to San Francisco. The grand princess was scheduled to dock last night but was ordered to stay in International Waters and way from the california coast. A 71yearold Placer County man who was a passenger on board the grand princess last month died yesterday from the virus. That marks californias first coronavirus death. It prompted governor gavin newsom to declare a state of emergency. So far, there are 53 confirmed coronavirus cases in california. The Emergency Declaration allows more access to resources for funding and personnel. Santa clara county has more coronavirus cases. Three more cases, now there are 14. One patient is a man in the hospital. We dont know how he was infected. Two other new patients were exposed to someone with the virus. They are isolated at home. News conferences today at oakland and San Francisco by groups of nurses worried about contracting the coronavirus. The registered nurses are demanding more Disaster Preparedness training and safer working conditions. Happening today, former Oakland Police chief Anne Kirkpatrick is renewing her calls to end the federal Oversight Program for opd. Reporter good morning to you, gasia. Anne kirkpatrick will be joined by Howard Jordan, another former Oakland Police chief. And im also learning this morning that noel gallo will be speaking as well at the conference. He plans to head to washington, d. C. , this weekend where he is calling on the department of justice to end the federal Oversight Program that the Police Department has been under for 17 years now. Kirkpatrick and jordan plan to talk about calls to remove the federal oversight monitor, and they plan on releasing new allegations of wrongdoing by him. Its been two weeks since kirkpatrick was fired by the Oakland Police commission, and she sat down with me shortly after where she told me the department was very close to being in compliance with all of the reforms, but then the monitor moved the goalpost, so to speak, and the new reforms would be added. I am truly deeply concerned that we have been under 17 years of oversight. Something is wrong. Its a milliondollar contract. Where is the incentive to find you in compliance . Reporter the federal oversight monitor has we competedly declined to comment saying he cant speak on the case. The lawyers who filed the original suit agree that the Oversight Program is too long, but they say the alternative of possible legal settlements from police abuse cases would be far more costly than an annual milliondollar contract. Kirkpatrick was fired without cause by the Police Commission, which was approved by mayor libby schaaf. It was a decision that schaaf says was hard to make. The trust has been broken between the chief and the Police Commission. So again, Anne Kirkpatrick will be speaking out this morning with Howard Jordan, both of them planning this Media Conference later this morning. Well of course be there. Were told she is expected to make a phone call to her staff shortly, then officially announce it during a visit in person to her headquarters in charleston. Last night in daly city, hospital workers packed a supervisor supervisors meeting talking about plans to close Seton Medical Center and the impact of that. Now, seton is daly citys biggest employer. It serves many low income and elderly patients. Negotiations between the hospitals owner, Verity Health, and a potential buy, kpc health, fell apart in bankruptcy court. To close season at this time is a huge mistake, especially with the coronavirus. The New York Times first reported she is sharing the news with her staff on a phone call, and then she will do so in person at her Campaign Headquarters in charleston. Her support eroded on super tuesday. Lost her own home state of massachusetts. Heres an updated look at the delegate count. Well be watching to see who warren endorses. Michael bloomberg dropped out yesterday and endorsed biden. Biden or sanders will need 1,991 delegates to clinch the president ial nomination. Bernie sanders says he will drop out of the race if joe biden has more delegates heading into the Democratic Convention in july. Well run through, i suspect, the process saying people have a right to vote. But if biden walks into the convention or at the end of the process has more votes than me, he will win. Senator sanders made those remarks after winning fewer states in the super tuesday primary than expected. Biden picked up ten states, sanders four. This is the cruise ship terminal. But as you can see, theres no ship here. Thats because it is being held offshore. Quite a few people on board are sick, and the cdc wants to test those people to make sure they dont have coronavirus. Now, i should mention that there are no confirmed cases of covid19, coronavirus, on board. The cdc wants to test certain visits before allowing the vessel to arrive here in San Francisco. A passenger who was on this exact same grand princess ship on a previous cruise just died from coronavirus, the first death in california. And a number of other passengers are confirmed to have been infected with the virus, as well. That cruise was at sea from february 11th to february 21st. The ship then left on another trip to hawaii. Governor gavin newsom says 21 people on board, including passenger and crew, have developed flulike symptoms. We are going to be flying testing kits to the cruise ship, and we are going to be sending those quickly back to the state and primarily to richmond lab, where well be able to test very quickly. Reporter also on the ship are 62 passengers who were on that first trip to mexico along with the crew. Two women who say they are on board this grand princess posted video on youtube. We havent had fever. But we had a cold and some chest congestion, which is part of the symptoms. But they did then come to our room and check us and determined that we are not with said virus. Aspire academy reports that a staff member may have been exposed to the coronavirus. School officials emphasize theres only the possibility the worker was exposed. The menlo school in atherton said a staff member had contact with a relative testing positive for coronavirus. There are no signs the worker was infected. School will be closed for the week. The menlo school is undergoing a deep cleaning, and school Officials Say they are working closely with the San Mateo County department of health and the cdc. Things are recovering on some of the commutes. The way this goes is the east bay commute starts first. It ends first. Lets start with the eastshore freeway and ill show you that 36 minutes of that drive from the carquinez bridge to the macarthur maze about typical. Then to the bay bridge, about 20 minutes. And 880 is slowing down, which is typically slow here. If you are driving on highway 4, its still slow, and there was an earlier accident coming out of antioch but it is still slow on highway 4 and 680. We have not seen lighter commutes. We maybe heard that some people may try to work from home during these times. It doesnt look like it. People still are going where theyre going. The south bay commute is in full strength here getting up to sunnyvale, cupertino and los altos. Again, all typical uneventful peninsula commute, just the way we like it. Sal, thank you, sir. I dont think well get there. But what about san jose . The National Weather service in monterey was kind enough to answer my request. San jose last recorded rainfall on january 28th. Thats 36 days. You can makeit 37. No rain today. This is the first place. Physical being 1934 when they had 54 days. They had a streak of 54 dry days. They are not even in the top one or two yet. I think the streak will end this saturday. So you can see right there, thats a little rain on a saturday. San jose would have. 16. San francisco about the same and santa rosa. Teachers, students and parents attended the meeting and demanded the school find other ways to fill the budget gap. Many suggested shutting down the School Police program, which they say would save 2 million. The board rejected that suggestion. The Oakland Unified School district superintendent says the cuts are agonizing but necessary. The staff cuts will include librarians and counselors. The board also approved using a Million Dollars from the Emergency Fund to help close the budget gap. Another check of traffic with sal. How are we doing out there . Were covering some of the commutes getting busier. For example, if you turn on now and youre a south bay commuter, some of the east bay commutes are beginning to improve like the richmond bridge, better than it was earlier if you were looking at 7 15 with more traffic. Things are better. At one point it was 45 to 50 minutes now down to 36 minutes here. And counting down getting to the bay bridge, which is about a 20minute delay. Interstate 880 slow northbound. You would expect that and so is 580 from san leandro boundary over to the lakeshore area of oakland. In the north bay the traffic is rather uneventful here on the on 101. Slowing in petaluma and slow from novato to san rafael. Thats not unusual. Lets bring steve in with todays weather. Sal, our weather has finally turned more towards where it should be, not rain yet. San franciscos District Attorney is under fire for his decision not to pursue criminal charges for one participant in a violent incident that happened in San Franciscos Bayview District last month. After a 20yearold man was arrested on robbery, hate crime and elder abuse charges, the d. A. Dropped the charged and pursue Restorative Justice instead. Lets talk about this with San FranciscoDistrict Attorney chesa boudin. Thank you for having me. What did you think when you saw the video of of the attack in the bayview . It was tragic. It was heartbreaking. You have an old man vulnerable, limited english if any english. He is out there collecting cans for his livelihood to pay rent. He is target. He is harassed and discriminated against based on his race and the cans are robbed from him. Its black and white. Very offensive. So why the decision to drop the criminal charges involved in the attack. We see the man crying, being chased, being assaulted this man clearly has no agency as he is standing in his own neighborhood. When we look at this video, it seems quite clear just looking at the video that a crime was committed. Thats why we filed the serious criminal case alleging the robbery against the man that did the robbery. Now, theres a younger man who makes the video. That man was also arrested by the police and he was booked by the police on a robbery charge. But theres no evidence that he took any property. He is a young man with his whole life ahead of him. And making a video is not in and of itself a crime. So he is the one holding this camera at times pushing it up into the victims face. Sounds like we hear him making some statements. Very offensive. Yet none of that is criminal . Well possibly some of it could be. But its not a robbery. And making a video and being racist is not a crime. So why decide to pursue Restorative Justice in this highprofile case . The key thing for us always is starting with the victim. And we reached out to the victim. We asked what he wanted. We asked what his views on the case were. And he was very clear. He said, this is a young man, and i want a letter of apology and healing for the community. We wanted to honor the victims wishes here not only because we always listen to victims and not only because we always want to up lift victims, but i made a Campaign Promise that i would give every victim of every crime the right to participate in Restorative Justice if they choose to. This was directed by the victim in this case . Absolutely. Id like to put a quick pause here and read to our viewers a statement. I reached out to the San FranciscoPolice Officers association. And the sfpoa issued this statement in response to the decision to pursue Restorative Justice saying, quote, this was a violent hate crime and should have been prosecuted as such. Chiesa is supposed to stand up for victims, not repeat offenders. His idea of having a violent criminal motivated by hate paint over graffiti to call that justice is an offensive joke. Whats your response . We charged the person who took the cans with robbery in jail right now as we speak facing a very serious strike charge. He turned himself in on sunday . Correct. It also ignores the fact that we cannot successfully prosecute crimes when victims refuse to cooperate. The victim said he wouldnt have spoken out against the 20 yearold who recorded and posted this video on social media. Correct. More over, it uses victims. This statement and this mentality would have our office use victims as a piece of evidence rather than focus on what victims want and need to heal and move on from a horrific traumatic experience. We are going to use this to heal the victim and tensions dividing San Franciscos communities across the city. Lets talk about Restorative Justice. It may be new to some people. In a case like this where you have an elderly man who who has not much command of the english language from what i understand, who didnt even come forward as a victim, the community had to find him. Correct. And bring him to the Police Department. Correct. How do you give that man agency to look his attacker in the eye and say what you did was wrong . It starts with asking him what he wants and his needs. We know what his needs are. He has been clear, he doesnt what to go to court and testify against the young man who made a video. Can you still prosecute the case with criminal charges if you dont have the victim agreeing to go to court . In some cases, you can. Other cases, you cant. Its an open question. It certainly makes it much more difficult for us to prove that a crime was committed. Ordinarily, making a video and being racist is not a crime. The second person, the older man in this case, he is being charged with crimes. Correct. With robbery, which is a strike, and he is in county jail right now as we speak. Thats been largely overlooked by the naysayers and the people who would have us simply treat the victim as a piece of evidence, have us ignore his wishes and his needs. So the victim says that he will speak in court against the man who was seen swinging the the the trash picker at him we hope he will cooperate. Robbery is serious. We take is seriously and we need to hold people accountable. I believe in many cases this justice is a more meaningful way to hold people accountable than simply giving them a criminal conviction and probation. A 71yearold Placer County man on board the ship last month died yesterday from the coronavirus. This marks californias first coronavirus death. It prompted governor gavin newsom to declare a state of emergency. So far, there are 53 confirmed coronavirus cases in the state. The Emergency Declaration allows more access to resources, personnel and funding. Santa clara county has three more cases now up to 14. One patient is a man in the hospital. The source of his infection is not known. The other two patients are men exposed to someone with the virus. They are now in isolation at home. Anne kirkpatrick will be joined by Howard Jordan, another former Oakland Police, and city councilman noel gallo who is going to washington, d. C. , this weekend to call on the department of justice to open an investigation here into the federal oversight monitor program that oakland has been under for 17 years. He wants to see that program ended, as does kirkpatrick and jordan. Both of them plan to talk about this federal Oversight Program and specifically the federal monitor. They plan to release new allegations of wrongdoing by him. And we all know this comes two weeks after kirkpatrick was fired by the Oakland Police commission. She sat down with me shortly after her firing and told me that the department was very close to being in compliance with all of the reforms, but every time they came close, the monitor would move the goalposts back and new reforms would be added. I am truly deeply concerned that we have been under 17 years of federal oversight. Sure. Something is wrong. Its a milliondollar contract. Where is the incentive to find you in compliance . Reporter the federal oversight monitor has repeatedly declined to comment, saying he cannot speak on the case. The lawyers who filed the original suit agree that the Oversight Program is too long, but they say the alternative of possible legal settlements from police abuse cases would be more costly than an annual milliondollar contract. Kirkpatrick was fired without cause by the Police Commission approved by mayor libby schaaf. She said trust had been broken between the commission and the police chief.
