My decision yesterday was personally difficult. I made it because, i believe it was in the best interest of oakland. The interim chief inspected the officers. Allison did not want to comment before the ceremony. We have moved on. We are looking for a new form of leadership. We do wish chief Anne Kirkpatrick well. Reporter the panel lost confidence in Anne Kirkpatrick. And outside of that was the citys First Female Police chief. She was fired without cause. The commission has been upset with her over this lopez of reforms and a deadly officer involved shooting. It might be good to look for somebody internally who has not been touched by any of the challenges. It is a familiar person that has trust. Reporter is it a difficult job . Definitely. Is it an impossible job . I dont think so. I think there are people in the department right now that can do this job. Reporter for now, the officers rush out of the academy are doing the job without a permanent leader. The mayor says she is confident in their abilities. You will provide comfort to victims. You will create calm in moments of chaos. Reporter next up for the officers . Field training. They will be partnered up with veteran officers on patrol. And the Police Commission said the termination was without cause. At the same time, the chair cited a lack of progress on the reforms that have been federally mandated. How much progress do you feel that chief Anne Kirkpatrick was making . I think she was working towards it. What you have, you have the federal monitor that reports to the judge. They have been with us for 17 years. I cannot get out from under the negotiator settlement. Then we pay millions of dollars. His sole job is to evaluate the Police Department on these 52 issues. We were down to two. Now he expanded it to five. He keeps himself employed. Secondly, you have a Police Commission overseeing the chief, and you have the mayor overseeing that she. You have the city administrator overseeing them. And you have the city council. The chief is taking direction for many folks, including the residence. That is the challenge to begin with. In terms of what the monitor, he had a big influence. He counseled the meeting with the judge for next week, where we go before him, he reviews, he reviews the monitor report and the police chief race for response to the report. Now i am stuck for another several years. The reality is, i strongly believe that the council should have been made aware, out of courtesy. To secondly, when you terminate me without a cause, i dont understand it. When i get terminated, i am being fired for cause. I should be paid close to 300,000, because of fired you. Thats of people trying to wrap their head around, why the commission move forward with this without citing a reason. They went on the record, for the reasons why they were firing the police chief. Testing is set to begin tomorrow at Mcclymonds High School in west oakland after a cancercausing chemical was detected in the groundwater. The school was closed today and open unified said mcclymonds could be closed through next week. The district is looking for alternative sites for students to attend class. The chemical in question is tce. It is used in manufacturing as a degreaser or cleaning agent. City Council Members said the source of the chemical is likely a former Industrial Site that is located a few blocks away from the highs will. She says that the other residents and businesses in the area may also be affected. Now we go to San Francisco where American Indian leaders want to preserve a controversial mural at George Washington high school. This comes after critics convince the School District to cover up the mural. They said the depression era artwork of blacks and native americans were racist. The problem is, twitter is inconsistent in their application of the different policies. It was edited in between, showing veterans, showing a single mom, and that was also a parody. Twitter left that up and allowed it to be distributed. They are applying their rules to different people are different accounts in different ways. Is it actual people that are making these calls . Here is the biggest problem, there is an act that came out in 1996, the Communications Decency act, section 230. This protects Major Technology companies from anyone posting anything on their platforms. It does allow them to moderate that. If somebody posted hate speech, or a terrorist threat, they can take that down. They can still protect the ability for users to post anything they want, and allow free speech. The issue with this specific thing, protecting technology companies, it absolves them from all responsibility and monitoring what goes on their platforms. That is what makes it easy for russian interference in our elections, and basic disinformation about the coronavirus. In fact, attorney general william barr is reviewing this specific act, to see if theres changes that need to be made. Provokes a home, the say i saw the video, i got it, it was parody, it is not a joke. Some people do look at these, and they think it is real. Out say anything that can influence others posted online, there should be some sort of label, hey this is edited. Something needs to take place. The defense maintains that he was delusional. They called several psychiatrists of the stand, saying that John Lee Cowell reported hearing voices and was suicidal. Nia wilson sister was hurt in the attack. She says she does not believe the insanity defense. The District Attorneys Office is expected to have rebuttal witnesses next week. Jurors in the Harvey Weinstein trial have reached a verdict on three charges against the disgraced hollywood mogul. When you look at the facts of the case, you say wait a minute, one of the women, haley, had sex with him, and a number of days later, the first time, she said wow, it was , i was. A few days later, she has consensual sex with him. The jury heard that evidence. I would think, wait a minute, you been , and a few days later, you have consensual sex with him . That does not make any sense to me. The other woman said, he sexually attacked me and a hotel room. Her friend was in the hotel room. When she came out of the bedroom, she said to her friend, that is the best sex ive ever had. How do you square that with her now saying . The jury hears all of that, and that is why those counts are important. The jury may have questions about that. When you ask, will they come to a decision . Perhaps. They will have a tough time. You think the judge, the more time passes, and they have not reached a unanimous decision on all of the counts involved, do you think she will accept a partial verdict . Yes. They will declare a mistrial on the counts that they cannot come to a decision on. She will taken those verdicts and read them. I tell you what, as trial lawyers, both sides will go crazy. They will not sleep. I imagine they will have a number of cocktails to calm down about this. You know the verdict is there. What does the jury do . Why dont you let us have them . The judge says, i dont want that to affect the other verdict. It will be interesting. Yes, will be. They do return to deliberations on monday. Very quickly, want to ask about the murder trial of John Lee Cowell, who was charged with the stabbing death of nia wilson at the b. A. R. T. A young man was killed on highway 101 in san mateo, when he got out of his car to try to help another driver who was hurt in a crash. As Elissa Harrington reports, the Good Samaritan was struck and killed by a hit and run driver. Dave according to the chp, the Good Samaritan appeared to be trying to help when he pulled over into the fast lane, and got behind the car that crashed, major his lights were on to help with visibility.
