Brim removed a shoe from a sleeping passenger, and williams tried to stop him. 6 months ago, San Francisco Police Arrested him for negligent discharge of a firearm, and possession of a concealed firearm in a vehicle. I have authorized additional overtime for sworn officers and for cfos to be out in the system on nights and weekends, and be in the additional presence of the system. Now to the latest on the planned power outages. The utility says it was able to scale back the outages to a total of 48,000 customers because the red flag weather was not as severe as expected. Customers lost power this morning in solano, sonoma, napa, lake, and mendocino counties. Pg and e says it hopes to restore power to all customers by tomorrow night. We still have the red flag fire warning, because those northerly winds have been increasing over the past 12 to 24 hours still. Especially for the higher terrain in the north bay hills, and the east bay hills up above 1500 feet or so. So the warning is in place until 7 00 tomorrow morning. The winds could be going up above 30, right around 40 miles per hour. The ridgetops, we could have gusts topping 50 miles an hour. Mount st. Helena has backed off to 30 miles an hour. Just hours ago, the California Public Utilities Commission asked questions, and hear the comments. They failed to maintain services during emergencies. They were also criticized for not keeping state Emergency Managers informed. Many of them blamed these issues on the lack of notice. Commissioners explained, that response was just not acceptable. A lot to sort through after todays testimony. Joining us is the constitutional law prefer at uc hastings. How damaging is todays testimony . Potentially, its very damaging. Mr. Sondland says of course there was an arrangement that ukrainians had to do certain things in order to get the meeting, and to get the money. The other thing, mr. Sondland said everyone at the top of the state department and the white house knew what they were doing. They didnt go rogue. This wasnt some separate operation. It was the mainstream operation. He said there was no irregular channel. This was just the regular channel. The way things were done. A lot of push back from republicans during todays testimony. Essentially, what they keyed in on is that they said to ambassador sondland, look, did the president ever explicitly say to you this was a quid pro quo . We just heard the president saying he said no. Theyre sort of saying to the ambassador, you assumed that this was the case. How affective do you think that line of questioning was . I think it isnt really. Because after all, look at what we have. We have the transcript. Everybody says read the transcript. The transcript says, i need you to do me a favor, though. Theres a connection. You have the president telling people, mr. Giuliani is my guy. When you put it all together, mr. Trump did not say to sondland explicitly i want you to say this, was unnecessary. You use circumstantial evidence all the time in cases. To some degree, a very strong direct case. But you know republicans are going to push back even further, and say sondland, just another unreliable witness, they say leaning way too much on second hand accounts. In parts. But sondland is also saying i talked to the president. I talked to other people. You can point to bits and pieces where sondland said yes, i surmised, i saw this. But hes there with the group. He is integral to the whole thing. For him not to know every single piece, you have other people to shore it up, and theres really no other competing narrative. Its not as if youre saying theres a totally different story here that really hangs together and it competes with this narrative. Yes, you can point to weaknesses. You can say this is not perfect, its not all tied up in a bow. If you went to jury with this, its a very strong case at this point. You think theyve proven bribery at this point. They probably have shown all the elements, piece by piece. What you need for bribery is you have to have a solicitation of a thing of value. The thing of value was the announcement about the so called investigation into the bidens. You had to have had some exchange in that way. But clear that youre trading a thing of value, for a public act. The publwould be the meeting in the white house, and the release of more than 400 million that congress had already authorized, the Defense Department had already certified, and thatswhat you would have. So you probably have the elements. Its not necessary for an impeachment case, because remember, were not at the criminal standard. We dont have to prove this beyond a reasonable doubt. But for an impeachment case, its all there. Today was not a good day for secretary of state mike pompeo, and for mick mulvaney, because they were suddenly brought into this in a very public way, by ambassador sondland. Of course, weve had push back from both of them since then, saying we dont know what youre talking about. I think what speaks volumes is the refusal of the white house to allow the central figures to go in and testify. If they all had a strong story to tell, to explain why all of this was on the up and up, they would all be there. Mr. Pompeo is a very smart man. Again, they always say, first in class at west point, and he went to harvard law school. Its a pretty good law school. He knows the game. Head of the cia. Eight former and current santa rita jail inmates have now filed a lawsuit, accusing the alameda Sheriffs Office of forced labor. The suit also accuses the Natural Food Service company, arrow mark of profiting off inmate labor. It allows inmates to volunteer to prepare food, or to clean facilities. The program is a way for inmates to get out of their cells, and have access to a better meal. Attorneys say the program isnt volunteer based, because when participants are sick, or dont want to work, deputies threaten them with extra jail time. The purpose of our jails and prisons is not to provide profit for private companies, such as arrow mark. Part of this case is to point out that arrow mark is engaging in what we call an unfair business practice, by taking advantage of free labor to compete unfairly with other food service companies. A spokesman for the Sheriffs Office says the allegations are inaccurate. He says deputies do not force labor, and that if inmates get sick, they can take time off, or quit if they want to. When the power goes out during dangerous fire weather, like we had today, often cell service goes out as well. More than 700 cell phone towers went down across california. Now lawmaker is introducing legislation designed to make sure people can still make important calls during these preemptive power shutoffs. This bill would require Wireless Companies to have backup power for their cell towers for up to three days. Why are you introducing this legislation . First, theres no requirement there be battery backup for cell towers today. No requirement. The Cell Phone Company will say they have battery packs, might last a couple of hours. But after a period of time, it all goes down. Today, were not relying on land lines in our homes to stay in touch, and to hear about alerts. We rely upon our cell phones. So those towers have become a lifeline for people throughout our whole region. The power of those towers go down and the backup batteries go bad, everybody is more vulnerable than you can imagine. Do you think theres any scenario, where because there were cell phone towers that went down during an emergency, that the people didnt get those important critical alerts maybe to evacuate . Well, ive heard from many constituents in contra costa county, where the cell phones did go down, and they had to evacuate without knowing whether they needed to evacuate, and i heard their stories. Luckily, we only had a few power events in lafayette, places in east county, and vallejo, so it was, to the extend it could have created a greater endangerment, but its not just wildfires. Those cell phones are the lifeline for people. We need them to be up and running for at least three days, which is what my legislation is going to call for. We are been looking further into this issue, and when we looked for responses from the major cell phone carrierers, they in essence, down played the effect of these cell towers going down during the planned shutoff. How do you expect the Wireless Companies are going to respond . Do you feel like these companies have been forthcoming enough in this process . Its our job to create some safety standard at a minimum, and then hope that they at least meet that, and do even better. So there is resistence. They had to answer to the Public Utilities commission today about how many towers went down, and the potential consequences of that. Its my job as a representative to put pressure on these companies to meet at least a minimum standard. I know there will be resistence. There are other components to this legislation as well that youre introducing. So the one component is to make sure that theres backup power for all cell phone towers. But another part of what youre putting forward here is going to help folks with lifesaving medical devices. We heard some of these stories during some of these planned shutoffs recently. How are you going to help those folks . When the power goes down, that electricity powers some important critical life elements for people. Oxygen. If you have an electric wheelchair, and you cant move your mobility is dependent on power. My legislation is going to call for the utilities to provide power backs to these most vulnerable people. Theres over 100,000 people that need electricity for their life benefit. Right now pg and e is doing very little there, and they need to do more. Wireless companies, they are not required to inform the county, or the state about cell towers that go that needs publi commission. I think there needs to be broader transparency, for how they do their work. They need to be accountable for it. Two california lawmakerrers are taking a critical look at the barriers of the states leave program. That provides six weeks of partial wage replacement to care for newborn or a seriously ill family member. Next july, a couple of weeks of paid family leave will increase from six to eight weeks. Senator Hanna Beth Jackson argue that this program is not realistic for many low and middle income families. For now, im joined by Assembly Woman gonzalez. Its a partial income replacement. Even minimum wage workers only get 60 of their salary if they go out on paid family leave. So most of us who have had children, know thats the time when life gets most expensive. Its hard to get by on minimum wage, but to get by on 60 of that, if youre a working mom, its going to be tough to simply say, well i can stay home, getting 60 of what im used to getting. The other barrier is not all jobs are protected leave. If you work for a job with under 20 employees, you dont have the guarantee your job will be there when you go back. Although you might want to take that leave, you might rather have your job upon return. So how can the program be better . So there are examples throughout the united states, and in other countries where we can have income replacement get closer to 90 of a woman or mans income, i think that thats an obvious way to ensure that lower wage workers can actually take it. Then we can ensure that every job is Still Available to that worker if they go out on leave. Thats something weve been battling for for a while. Simply a federal program that allowed for workers that had a company with over 50 employees could have job protection. We want to bring that number down to ensure every worker has job protection when they go out on leave. Is there in fact, funding available from the state to do that . Thats one of the things we have to talk about. Actually, the paid time office is paid by the workers. Theres 1 taken out of our paycheck. These low wage workers are paying into it, but not able to actually gain the benefits from it. Theyre subsidizing higher paid workers leave. That 1 is taken out of our paychecks if we make over 117,000. One way would be to increase that for higher income earnings to make sure that 1 continues to get taken out. We could look at employer contributions. Theres no employer contributions in california to this point, or we could look at government subsidy of the program. Those are all things we need to ensure that actually low income and middle income women and men can take it as well. We expect to find out more about those findings next mobility. What are you hoping to see in this audit. The big Key Takeaways for people and this program. I just hope that we see as we extend the number of weeks available, which we want to do, we need to do six weeks. We need to get to 12 weeks. That we ensure it is equally accessible for all workers. A woman who makes 40 to 50,000 a year who cannot get by on 60 of her income should also be able to access family leave. Pretty decent winds out there. Still in place in the north and the east bay. Remember, yesterday, i was standing right here, saying there was no rain in sight. I recall. That was not the case. Nature can humble you sometimes. That was not supposed to deliver rainfall here in the bay area it certainly produced. These numbers are not high. Keep in mind, the bulk of this was falling within a 10 to 15 minute period. So its actually pretty impressive. Some pretty intense downpours. The real rainfall today though, has been to our south. Down toward los angeles and san diego. The bulk of this storm center is focused in Southern California, and in the sierra, they actually picked up a little bit of some snowfall. A Winter Weather advisory in place. This was sierra tahoe earlier today, around 2 inches of snowfall. So the Winter Weather advisory, a few more hours before this expires this evening. Heres the satellite, showing you this. Look at the circulation down towards Southern California as we come in closer to the bay area. We just have clouds that moved across the region earlier today. Right now, most areas are in the clear. As you know, we talked about in the first segment, it is very windy out there, especially for the higher terrain. Current numbers, santa rosa, 68. We have oakland 70. San jose, 66. And Half Moon Bay in the mid 50s. 55degrees. Well check in on some of those winds a the surface here, and still a bit breezy towards santa rosa, napa. Fairfield winds going up above 26 to 31 miles an hour. In oakland, winds only 3 miles an hour. The winds at least on these panels, not nearly as strong.
