The prosecutors were dealt a low wind adella was giving a false statement when working for the prosecution. Umstantial st witness for rc evidence. s reporter that enough to con juries. Li was acquitted. Bayat was not convicted either. Circumstantial evidence is a very hard predictor. I want to hear in detail what they found was compelling. They said adella was the murder. Reporter we will see if judge foils will set aside the plea agreement that adella was charged with filing. If that happens they could pull the accessory charges for murder and then charge adella with murderbayat and call li a witness in the case. If that does not happen then mr. Bayat could possibly be charged again but probably not. Li says she hopes to get her children back in the next 20 days. Clearly Big Decisions coming for prosecutors in San Mateo County. s ego lets take more about the split verdict with legal analyst michael cardoza. Your thoughts, tiffany li not guilty a hung jury for the defendant. The case was circumstantially factual for the jury. Circumstantial evidence, notan instruction tha tells the jury, if circumstantial evidence is this that susceptible of two reasonable interpretations, one of which points to guilt, one of which points to innocence, you must as a juror you go with the one that points to innocence , not guilty. Jurors are bound by that. Prosecutors dented the evidence that greens blood was found inside the car and gunshot residue inside her garage. You talk about that being circumstantial evidence. Where did prosecutors fall short . They had what they had. Where they fell short was with the witness adella. He was hired by li to take the body and dispose it. He was was give me 32. Which is cooperating with criminals so you aid and abet. He said fine, ill testify against them but dont go to the witnesses. What does he do immediately . He goes to his exgirlfriend. I know why they did it but they got rid of a big witness and that was you broke the rules, were not gonna use you because you basically are lying in one situation when you are told not to do something and you went and did it so they toss him out so there goes there primary witness. The defense hammered that. He was a liar, they made a deal. And the jury believed them. For direct evidence, you see something that is direct evidence. But if youre back is turned and you blood on his hand i know hes bleeding but you didnt see him hit me. You have to draw inference from that that alex hit michael thats circumstantial evidence. Lets talk about what happens next. Do you see a retrial x the biggest question i have is when a jury says they are hung, we cant come to a decision we tried everything and the Court Declares a mistrial they then asked the jury, what is the count. For example 10 to two. Was at guilty or not guilty . And the jury tells you at that time. Of the da bases their decision on whether to retry a case or not on that count. Ive seen words tend to to for not guilty and prosecutors still try to retry the case. But they really look to the count. If its like 11 to 1 for not guilty, they probably wont retry it. Wrap up a lot of made with this case. Ive 35 million money appears to be part of the equation here. How much of a factor was that . The defense she was able to mount . Money plays and up part. I dont work any harder than my person did not have money. The difference attorney worked real hard i know how hard they work. What money does, it allows you to get investigators to go out and investigate your leads. You can find more facts that will help the defense. When you dont have that kind of money, you cant afford to do that. You cant see that as a lawyer investigating everything. You dont have time to do that in this case they have three or four labor lawyers working in the background. You have three or four investigators pounding through the bushes. So money does help but money doesnt get you off. The facts are the facts in the case. Doesnt help . Absolutely. I love it when clients have money then we can send investigators out. We can do things. More resources. A lot more resources. Does it help . Yes. It does it affect the end . Continuing coverage now on todays impeachment here is. President trump now being accused by democrats of witness intimidation after tweeting insults about former ambassador Marie Yovanovitch during her testimony on capitol hill. The tweet reads in part, everywhere she went it turns bad. It raise questions about why she was fired by her position. The tweet was read during questioning heres how she reacted. What would you like to respond to the president s attacks that everywhere you went turned bad. Well i, i dont think i have such powers. Now the person realtime is attacking you. What effect do you think that has on other witnesses willingness to come forward . And expose wrongdoing . Well its very intimidating. Is designed to intimidate, is it not . I mean i cant speak to what the president is trying to do but i think the effect is to be intimidating. Will let you know. She said she is shocked the president called her bad news in that phone call. The president said quote shes going to go through through some things which the ambassador perceived as a threat. California congressman adam schiff responded. He said i want to let you know ambassador, some of us take witness intimidation very very seriously. Was this, was this tweet witness intimidation . I think you can conclude that it was because after all to do this in lifetime while she is testifying to state that everything she did turned bad including mogadishu where we lost shoulders that were dragged through the street. Somehow she is responsible for that . I think e intimidations was important to her but also to others as much as anything else. Others who might think twice before coming forward. What the president said is not every member of this Statement State Department has refused to come forward. What we might have seen in real time is an extra article of impeachment. Lets talk about her testimony. Ambassador yovanovitch said she felt President Trump and his allies were smearing her. Were forcing her out of that position to clear the way for that investigation into the bidens. During her testimony did she offer clear evidence of that . She does not have a smoking gun, if you will. She can say other people told me things, here are strange things. For example to be called it one in the morning and to be told you need to get on the next plane, its a matter of security and then she flies to washington under these very her in ukraine stances after more than another year. In fact you dido anything wrong, youve lost the confidence of the president. The building a wall they are building a jigsaw puzzle, a brick wall piece by piece. You cannot say that her testimony alone would demonstrate that the president committed impeachable offenses but the democrats have moved the ball in that direction. I want to go back to the intimidated and asked back and the president was asked about the tweet in criticism as witnessed tampering. He said i have a right to free speech. Does that argument whole troop x he can said he certainly can say it but one the consequences, thats a problem you can say a lot of things but it is not necessarily protective speech. In this context to have the president of the United States tweet this out while she is testifying and knowing other people are coming down the line, it could easily deem to be intimidation. If this were anybody else, they could be prosecuted for this. Thats federal criminal law that stops this sort of thing a district the torn it could run with it. The president has immunity but after leaving office potentially he could be indicted for this. Its a long way from free speech without consequences. Late today there was intriguing testimony that happen behind closed doors a staffer from the embassy in ukraine testified about overhearing this phone call which he said President Trump was heard asking the Eu Ambassador about investigations into the bidens. How significant was that testimony and when are we going to hear that testimony in public . Is very significant because what republicans are saying they vest each one of these three witnesses did you talk to the present . Did you hear the present . Each one has a say no. Up to this point the reason for that is the people in the room with the president his spoke with the president the president has not allowed them to testify. The democrats have had to go to the other witnesses. Out looks like there is a second person. Another aid. Will be able to say we were sitting in the restaurant we heard the president s unmistakable voice saying these things. It will directly tie the president and was someone we heard this. On thats highly highly significant. When it comes to foreign policy, the ambassador the avenue ambassador laid out how the policy would shift. Itis really held hostage by the whims right. Each of these three ambassadors have explained to us why what the president was doing with. American interests. You want to be speaking in one voice and you want to know when and ambassador who is been duly nominated, approved by the senate is speaking for all of us. The personal representatives of the United States. The personal representative the president and having a back channel and have it changed is not at all conducive for our interest. You want to be speaking in a clear voice. You wanted to be nonpartisan, you want to know these people have the authority to speak on behalf of the United States. Incredibly delicate messages are passed along. Lives are lost if this is not done properly. This is incredibly dangerous game is played around our policy. Important testimonconstituti law professor. This afternn,ls after the b researchers at stanford are looking into the spread of fake news as if it were an Infectious Disease. They are trying to figure out how to stop missing automation from spreading and to keep people from being infected. Joining in now is Travis Trammell hes a docktor oak candidate at stanford. He is overseeing the research. Thank you travis, for being here. How is fake news like the them ferment information that spread during the 2016 president ial election, how is it similar to the disease . Thanks heather, for having me on a we appreciate the opportunity to talk about this. It does spread like a disease that it spread from person to person. It also spreads at a greater rate among certain individuals. Our Research Points to the fact that potentially individuals who have very strong beliefs on one side of the topic or the other are potentially more susceptor able. Thats a vehicle for the virus to enter into that community but also spread faster within that tightly knit community. How is it . Im guessing social media is playing a big role here. Thats correct. It is spread across all platforms that we have witness. Within the platforms that exist there is an echo chamber that have issues being discussed. People have similar beliefs. When you infect one of the communities that are purveyors of take news, what they are intended to affect, the true believers, the leaders the influencers on those social media platforms. Those influencers read the fake news disinformation virus to their followers. It moves very quickly. So a very Infectious Disease spreads in a similar manner so those models are applied not only to monitor the spread that allows us to investigate countermeasures tos prevent it. When people are spreading this misinformation, are you able to do terman if they know it is fake news or they truly believe it and are spreading it because they want other people who share in their beliefs, to know about it. It appears to be the latter. Most people who are spreading it do not know that they are spreading misinformation. There is a core element, obviously, that produce the information that has an agenda to spread it to in fact true believers within a community. But most normal new users dont know it, unfortunately. Thats a problem within the platforms that even fact check capabilities lagged behind. They are automatically at a disadvantage because that information comes out after the disinformation is produced. They are not governed by any type of procedure or journalistic norms, so they can be first with a lie and correct the lie after the fact is very difficult. You been able to determine who is most susceptible here. Is there a vaccine, per se, for curing fake news . I dont think there is a cureall. Research does not appear to show that. I think just like the disinformation and the viruses targeted, just like with a normal virus you do not treat every individual the same. The same applies for disinformation. There a tech makes that we can use to limit the impact of disinformation. But they need to be targeted as well. One of the biggest problems the plat forms space is a potential clear cure all is not trusted by members within these echo chambers. Future technics need to include the concept of identifying more trustworthy ways to notify people that they have been exposed to disinformation and correcting that information as appropriate. Is certainly is an interesting comparison that you have been able to make. We appreciate you coming on the show. Thank you for talking to us about this very important topic. Thank you.
