With what it was like inside the courtroom. Reporter indeed, surprise decisions today, at this point a hung juror for the Master TenantDerick Almena after the jury told the judge that they were held in a deadlock. They reveal that 10 people on the panel were in favor of guilt and two were in favor of acquittal. This after the judge warned him not to discuss a reveal which way that jury was leaning. As far as max harris, complete acquittal, not guilty counts on all 36 counts of Involuntary Manslaughter, one count for each victim that died. They were guests throughout the gallery when the judge declared a mistrial for Derick Almena, there was a lot of stunned people. And when that not guilty verdicts were announced for max harris, there were a lot of tears, the defense attorney patted him on the back, they were completely elated. The big question now, what happens to Derick Almena . The da is still mulling over its options, one of which is of course to retry him, especially after theyve learned that the jury was favoring guilt. Just a few moments ago we talked to the chief assistant District Attorney of Alameda County and this is what he had to say. Since the beginning of this case, our hearts have been with the families of the 36 victims that died in this unspeakable tragedy. That still remains our focus. And that will be our focus going forward. As we go forward, and we understand that the jury had a split verdict or a hung jury against mr. Almena, we are going to evaluate the facts and the evidence that came out from this case. We are going to take into account discussions that any jurors may have had with our trial lawyers and we will evaluate that and go forward. Those trial lawyers, i do under chance to talk to the jurors, seven women and five men. And of course the das team also got a chance to talk to the victims families. So the sentiments of both the families as well as the jurors will play a Critical Role as far as whether they will indeed retry Derick Almena. My many family members were clearly distressed, there was a plea bargain for both of these defendants on which they would spend some time behind bars. That plea deal was passed to because the judge said mr. Almena did not show enough contrition. Im my son and his girlfriend died and its just in vain . Ive been here almost every day for five months, its upsetting, there other word of course everyone connected to this case from the defense attorneys, the da, to the civil attorneys involved, were all in shock over this result. Obviously, because we did have plea bargains that did resolving guaranteed prison time for both of these defendants, actually jail time. But now max harris is going to be released forthwith, of course he will still have to go to processing. And of course the fate of Derick Almena is still unclear. They may retry him or decide not to retry him at all. Certainly a huge decision forthcoming for the Alameda CountyDistrict Attorney office. We continue now with Team Coverage of todays verdictsin the ghost ship trial, head now to brooks, and you have gotten reaction from attorneys for both of the defendants in this case. Reporter as soon as they came off the elevator, max harriss attorneys were smiling, they didnt want to speak right away, they got their thoughts together, and they said this is not over, because they still blame the city, they still and others and say there was a failure by the city, and they want to see them held accountable. They also talked about their sadness for the victims. And everything that happened there. But of course they were happy that there was an acquittal by this jury for max harris, and lets hear what they had to say. This isnt a time for us to talk about the two years that might innocent young client has spent in jail, i think this is a time to think the community thank all of the community for their tremendous outpouring this purse process. We want to think the jury, even the jurors that did not continue to deliberate with everybody else. Everybody quite heroically put their lives on hold, worked diligently to come to a verdict, and we are eternally grateful for the verdict today that came through for max harris. If you remember this jury, this newly seated jury spent nearly 6 days deliberating before the came up with this. And one of the things max harriss attorney said was that the reason why this is so complicated and that acquittal came and a hung jury was in place for Derick Almena was partly because they believe that not all the players were in the room, not all the proper people were charged. They said from the beginning that these two men were scapegoats, and now max harris will this evening, after he goes back to the jail and gets processed out. In the meantime, the attorneys for Derick Almena have other feelings, and they are looking at retrying this case and pushing forward. Take a listen. I just had a conversation with Derick Almena, before they took him back to the holding cell. He said that while he was relieved not to have been convicted, he has not, and will not lose sight of the terrible tragedy that occurred. The fact that he was somehow involved in it, the fact that 36 families were shattered. The fact that there was the most unspeakable loss of life, and so while he is happy in a sense to be on convicted, he is very unhappy when he thinks about what happened. And the fact that that can never be repaired. Very emotional for the attorneys, as you can imagine how emotional it is also for the families. Many are still inside the courthouse right now talking with executors, trying to understand everything that has occurred over the last hour. It was kind of a whirlwind. Now there is also attention being paid to the civil case. So we still have to go through all of that where both of those defendants are named there, as well as pg e, the city, and others. So that is just kind of the next chapter oke and said the fact that others were not brought into this case actually hurt her case, and so we are going to have to turn our attention to see if the city or others will be held accountable in any way for what happened for the 36 lives that were lost in ghost ship more than two years ago, nearly 3 years now. This is certainly a long drawn out saga, far from finished. The civil case will be moving forward, and the potential for a criminal case as well. Brooks jarosz my for us at the courthouse. Lets bring in our legal analyst, michael over the course of this trial we had you in several times. We talked about this. You predicted an acquittal for max harris, are you surprised though by what the jury was able to come up with in regards to Derick Almena . Im not at all, because at that same time that i thought max harris would be walked out of the courtroom, i thought they would hold almena responsible. Because remember, he was the one that lied to the fire department. He was the one that was running the place. Harris was more of a gopher for him. I think the jury looked at that, and almost started from the top down. Where were the owners . Where were the owners kids . They owned the building, ran the building, and then you had almena next in command, harris down below. So im sure the jury thought, why should we hold him responsible for this. All along the strategy from the defense was to shift the blame, as you said, over to the city, over to pg e, over to the oakland fire department, and to also sort of suggest this notion that maybe the fire had been intentionally set. It seems it was a somewhat effective strategy . I dont think the intentional fire carried any water for the jury. I think they quickly dismiss that. But, you get to, as i say, the owners, where were they . The thing that bothered me the most was the District Attorneys Office Brought these charges against boey negotiated the cas judge jacobson. Judge jacobson was in negotiations and said almena will get nine years and harris will get three. And then the family came in and spoke to judge kramer and said no, we dont like this. And my heart does go out to the family, but they did have a negotiated plea. If you remember when we spoke, i said be careful what you wish for, because you never know what will go on in the jury trial. And thats why i like to leave it to the prosecutors, the professionals, the judges. Looking at the entire case, a birds eye view of it, going to be a tough case. Now one walks completely out the door. Obviously prosecutors not leading with their emotions like families are. Do you get a sense of though, michael, after looking at everything, the fact that this came down 10 2, 10 in favor of finding Derick Almena guilty, the prosecutors will in fact retry him . As an exprosecutor, i did that for 15 years, you do look to the accounts, what was the count, 10 for guilty, 2 for not guilty. You figure okay, if we go back, all we have to do is get two more jurors and we get a guilty verdict. But ive seen it, i absolutely saw murder trial where it was 11 1 for of conviction, they retry to, and then they brought back a not guilty verdict. Go figure. To make our own henry lee, he was saying even right now, the verdict just announced, but prosecutors are already going and having discussions with those jurors, trying to glean whatever information. What are they trying to learn . What was your thinking, what did you Pay Attention to . Why did you to vote not guilty . What was your hangup . Why didnt you vote . There were 10 other people that were equally as reasonable as you that came from our but yet you two couldnt bring yourselves to do that, why . They are going to fill that hole then, the jurors will tell them i didnt like this i didnt like that. Okay next trial we will take care of that. But, what they are going to do, they are going to go to the defense attorney who i thought did a magnificent job, of all the attorneys i thought he was wonderful. They will go to him and say why dont we negotiate this. Why dont we talk. And i think this time they will sort of call the families out. Theyve heard from the families, so now they will talk to them and go, what would you plea to . What can we do by way of jail time . So they will keep negotiating this to save the expense of a very long and very expensive trial. Because you never know what will happen. You could look into it not guilty or it could hang again. And look at all the money they are spending. So negotiate it, and when you turn to the family, you say, is the second in command said, our hearts are with the family, we say look what happened last time. So here is the deal we can reach, and they may be amenable to that. We will have to wait and see. Keep in mind though that both Derick Almena and max harris have been behind bars for ars. I understand that. Everybody will rethink this, dont be surprised if they come to a negotiated disposition. It will stick this time. Always appreciate your insight. We cannot lose sight of the people who lost their lives in the devastating fire, and here are some of their faces, the 36 victims who died in the ghost ship fire back in 2016, they included artists and musicians, teachers and students, all attending an Electronic Dance Party together when that deadly fire broke out. Many victims family members and friends were there during the course of this trial, some families are pushing for a permanent memorial at the site of that warehouse in oakland to remember the 36 lives lost. This is new video from charleston this afternoon, where historic neighborhoods, as you can see, all underwater. From the satellite you can see dorian is turning off the carolina coast, its moving at a snails pace, and hammering the region with sustained winds at about 110 miles per hour. It is also spinning off damaging tornadoes. The big concern is the storm surge and the flooding we are already seeing across the city. Reporter you know, we had some torrential rains before, and some very powerful winds with gusts up to 50 miles per hour, but its nowhere near as bad as it was before, the rain has subsided quite a bit. And ive got the ashley river here behind me, and at the storms worst, you could not see to the other side, the visibility was so bad, but now you can clearly see it. But the National Hurricane center did put out a warning and they said that just because the storm is moving to the north now does not mean the danger has passed, and there is still a potential for flesh flooding. Dorians powerful winds battering the carolinas, damaging homes and throwing many people into the dark, evacuations remain in place, of town completely or go to one of the red cross shelters. Get to safety, and stay there. Dont let your guard down. This wont be a brush by. Whether it comes ashore or not. And dorian could still make landfall. The hurricane has been consistently inconsistent, making it difficult for forecasters to predict where the storm will go. Even offshore, dorian is spawning tornadoes in both carolinas, many people in this region lived through Hurricane Florence last year, and they know the power of mother nature. The cat to hurricane winds will not trees over, and weve got a lot of them, especially around here. People died from staying traile down. The other big concern is lighting, sandbags lining the streets in commercial and residential areas to minimize any flooding. High tide is only increasing the risk of storm surges. There is also the current come in strong waves battering this jeep that was abandoned in myrtle beach. Now that the storm is moving further to the north, all eyes are on north carolina, where the governor says the big threat tonight is tornadoes. They are expecting the strongest winds with gusts up to 105 miles per hour, anywhere between now and 2 am. Keep in mind here, high tide is going to be hitting is down and the day is wind, and the rain, all at the same time, so we could be a very dangerous situation. Still a lot of concern there. Dorian right now is edging closer to north carolina, so thats the eventual drift. Heres the satellite and radar, lets take a look at the rental observations, myrtle beach reporting nearly 10 inches of rainfall over the past 24 hours. Now wins, you can hour, wilmington gusting at 37 miles an hour and that number will most likely be going up as Hurricane Dorian continues to move up the north. Right now the storm center with winds at 105 miles an hour, moving to the northeast at about 10 miles an hour. That rate of speed will be moving around quite a bit, in fact it will be increasing. So that movement will be increased with the forward speed, that is good news. The winds, the hundred five mile an hour observation, that should be coming down over the next 24 hours or so. Thats the latest on dorian. For us, we have this, another round of showers and thunderstorms out toward the sierra. We have lots of low clouds and fog this morning, today a bit of a cooldown out there, and we still have some patchy fog hanging out near the coastline. Federal investigators say they will remain at that scene for about another week. They are hoping to learn more o this afternoon the ntsb described how one of the five surviving crewmembers told investigators that he woke up to hear a noise and then saw flames erupting from the galley. He tried to get down the ladder, flames had engulfed the letter, and so the crew that was on the bridge had jumped down to the main deck, and one had broken their lake leg in that effort. The crew that did jump down and had reported that they went to the double doors of the galley to try to get in, to get to the passengers, but it was engulfed in flames at that time. Those crewmembers jumped from the boat because of the extreme heat and the smoke. Here in the bay area at least two teachers are claiming that educators and one Oakland High School manipulated grades so that feeling students would receive passing grades. And that administrators pressured them to do thatrates. The Oakland Unified School district conducted an investigation and released its findings earlier today. The complete grades were doctored at this high school and some teachers were coerced into giving students passing gradook and found nothing wrong. Castle mont high, a school in east oakland filled with mostly low income students and low graduation rates, no allegations of cheating, not by students but by some teachers and administrators. According to complaints last year in july by two current and former teachers, educators here at manipulated the grades of at least nine students on an Online Education program called apex. The complaint also says teachers were coerced into falsifying grades to bring up the low graduation rate. The Oakland Unified School district said the internal investigation found no evidence of wrongdoing. We found no evidence to support the allegations of coercion of Staff Members to change grades, ng students answers to test questions. The Online Program is a system that allows struggling students to complete their coursework and recover high school credits through an alternative online curriculum. Says its investigation found problems with the lack of uniformity and how educators were using the system. In the coming weeks we will be retraining all staff who either use the apex classes or oversee the apex classes across the districts. The district plans to bring in an outside investigator to look into the complaints but it says no student graduated who didnt deserve to, and that the district has not disciplined any of its employees. A San Francisco sheriffs deputy shot and killed a dog while trying to serve around 11 polk street in nobhill. Deputy say they were attempting to serve an arrest warrant, thats when they encountered the mans aggressive dog. One deputy opened fire, killing the animal, that suspect was also wounded in the incident and is expected to recover emma but its still unclear what caused that persons injury. No deputies were hurt. A statewide manhunt has ended with authorities capturing the man suspected of shooting and wounding a sheriffs deputy in merced county. Authorities say the 51yearold was taken into custody in fresno county. They say he ambushed deputies yesterday afternoon. This happened as those deputies were following up on a Domestic Violence case at home and does palos. Sheriffs deputies say that suspect started shooting at them from the bushes when they arrived at the home. The deputies then returned fire but the gunmen got away, we are told that sergeant who was shot is expected to carrying about 1 chickens crashed on interstate 80, shutting down the freeway for much of the morning. It happened shortly after 3 30 this morning. The Highway Patrol says the truck hit an embankment, overturned and burst into flames. Officials say crews arrived on scene to find chickens scattered everywhere, most of the birds died, emergency crews then scooped up those that survived, officers shut down all westbound lanes to clear the roadway. We dont want to leave the chickens that are still alive. We want to handle them with care. We deal with everything, we really do. Weve had cattle on the roads before, a few years ago. Weve never had anything to this quantity, and certainly, this is really sad. All lanes were reopened by 12 30 this afternoon. The driver of the truck suffered minor injuries. Officials say those chickens were on y to a Processing Plant and that injured ones will likely be euthanized. The number of Homeless People writing mac bart is on the rise. The chronicle obtained new numbers from barths research department, and they found that an average of 160 Homeless People per 100 cars on weekends, from april through june. That number was 79 during the same timeframe last year. The numbers were lower on weekdays. Back in may, bart sent a Homeless Outreach team to the 16th and 24th street stations, all in an effort to relocate Homeless People and get them into social services. A barts spokeswoman said bart is continuing to push for a regional approach to the homeless crisis and work with the counties we serve. The Trump Administration is said to be filled with plans to revoke lavergnes authority to set its own vehicle emissions standards. The president has said he wants to take away that authority from california, as part of an effort to relax mileage standards nationwide. A Government Official says the Environmental Protection agency is now preparinset a single nat the plan would effectively block california from setting its own admissions rules. But again, facebook doesnt have a really good track record in terms of privacy. Just yesterday it was announced on tech crunch that they found 419 million users phone numbers, ids, birthdates, gender, all kinds of personal information. 419 million is a lot. Facebook is saying thats an overinflated number, there were some duplicates in there, and it somewhere around half that, but even if that is true, 200 million is insane. So you really have to be able to say i trust facebook with my most intimate data, to be part of this dating hype.
