You were would have been a good extract air traffic controller. Good morning everyone i am feeling pretty good on this first day of february. I feel like i won the lottery. A busy morning out there although crews have cleared the tracks after a maintenance truck broke down overnight on the tracks. It caused delays all morning specifically for the fremont warm springs line. Alex savidge has been talking to passengers and other people. Talking about what is going on with the system. Reporter morning. A tough commute for this part of the bay area using the fremont warm springs line. Repair work has finally wrapped up and the tracks are back opened although you may encounter some residual delays after this earlymorning derailment. This was the scene as crews were able to move that truck off the tracks just south of the south hayward bart station. It came off the tracks this morning at 3 20 and crews were called out to deal with the situation. While this was going on bart was forced to singletrack trains through the area which triggered significant delays. My boss was really nice about it. She understands. I was supposed to be there at 7 30 but i wont get there until 8 00. I am supposed to be a juror in San Francisco at 8 00. If i am not there i will be worried. Maybe theyre coming for me. Reporter the good news is that nobody was hurt in this accident but the derailed maintenance truck caused damage to the electric third rail and the cover to the third rail which was significant and crews had to repair the damage. It was not a quick fix and obviously the northbound tracks had to be shut down which triggered big problems. The concept is when you have to singletrack trains will have to hold up at hayward while they wait to share the track and then the peak of the delay around now is 20 minutes because we are taking the vehicle out and we have to hold trains. Reporter again, this is an improving situation for the commute along the fremont warm springs line. The latest word is that at 8 30 crews were able to wrap up the repair work to the electric third rail and they do have the tracks in both directions back opened and so again they should be improving in terms of the delays although there could be some residual delays for a short time. The San Francisco District Attorney says his office will dismiss thousands of misdemeanor marijuana cases dating back to 1975 they will not have to petition to have their records expunged. Allie rasmus explains what prompted the change. District attorney George Gascon says many of the marijuana related crimes these people were convicted of decades ago are no longer crimes today so it only makes sense to clear their records. This will impact thousands of people, the da office says it will dismiss more than 3000 misdemeanor marijuana convictions that were made before the state cannabis laws changed. The office will review another 4900 felony convictions related to marijuana and consider reducing those two misdemeanors although those will be considered casebycase. A criminal conviction for marijuana crimes can prevent people from getting jobs and housing and it can stay with them for years. Supervisors and Community Leaders came together to make the announcement. Some leaders applauded the move saying that pot loss have impacted minorities unfairly in the past. I feel this is a giant step toward justice. It is a stride toward setting black people free. California voters approved the proposition in november 2016 legalizing the possession and purchase of up to one ounce of pot and it allows people convicted of previous marijuana crimes to petition to have their convictions expunged but that is a costly Legal Process and a lot of people have not taken the opportunity to do that. That is why they wanted to be proactive about this and go ahead and clear the records of people convicted of these marijuana related misdemeanors going back to 1975. Allie rasmus, ktvu fox 2 news. The question of the day is how should your local District Attorney handled the criminal records of people with marijuana related convictions . 49 say expunged misdemeanors, 23 expunged misdemeanors and felonies. 28 say that the local da should not get involved. Chris tweeted on this one i think since the da followed up they should clear it automatically. A lot of people spend money on lawyers but got convicted so they should not have to spend more for the expungement. Another viewer says they should not do anything because people who committed these crimes knew that it was a crime. Another viewer says why should marijuana drug convictions be expunged but not alcohol convictions . It is just another politically correct social justice decision that disregards fairness for all. Many dispensaries in the bay area started selling Recreational Marijuana month of ago today. Joining us live is Andrew Dangelo the director of operations at harborside. What has the boost in business been like . The first couple of weeks we had lines out the door but things have settled down a little bit now as folks have gotten used to the new program. The volume is up about 30 in the new program. What about the clientele . Much different clientele. We have a lot of adults who have never been in a dispensary before. We have outoftown visitors as well and outofstate visitors is something we did not see a lot of before. My patients are not coming back how i expected them to. I think the taxes are affecting that. We are taking a close look. The data is not completely in yet. We are just one month into the program but people who need a lot of cannabis to treat their illnesses are constrained by the new taxes. They are up 30 and wages certainly did not go up that much. So have people gotten over the coming in and not knowing what to expect . They may be timid . Remember marijuana is still against federal law right . So do you have to show your id . Absolutely. You cannot enter without showing your id. The number one obligation is to comply with the law and it says nobody can come to the building who is not 21 years old. We keep a record, everything is recorded. We will scan the id which records the id and it will tell us the id is legitimate. If the feds wanted that list . They cannot get the list. Certainly we would fight any attempt to get the list. I dont think people need to be too concerned. They are not coming after you for buying cannabis in the dispensary. The feds are much more interested in operators like me than in consumers. We are not too concerned about that. I dont think your viewers should be concerned. Where are you putting all of your money . You know, the banking problem is with us. Certainly credit cards are still not something we can except at the pointofsale. So it is allcash i imagine you have quite a stack . What is the proposal that was floated of a taxpayerfunded bank to handle that . Of course we would support that initiative. Harborside and hour leadership have been working with leaders in sacramento to try to overcome this constraint. Public safety is at risk. If i dont believe in using Recreational Marijuana as a taxpayer why are you taking my money and giving it to you instead of my schools and roads . Because we have a Public Safety issue and the government is not helping. Certainly operators like myself who have to use cash to run the businesses, we are concerned about staff and the public. Cash is a coveted thing in society and certainly the criminal elements and the bad guys are aware. They know you have the money. They know that there is no banking service. Are particular dispensary has a local bank that we use so it is not an issue for us but many people in the industry are struggling. Even if there is a public bank, it is not the answer to all because of federal law. Ride, and i think both of us are going to the same place here. Is the next step to get the federal government to at least not in force or make it legal federally . I have been in the fight for 35 years and we are not there yet. But yes cannabis should be removed from controlled substances act. That is the goal in the cannabis movement. That would lift restrictions on banking and commerce and interstate commerce as well. So that cannabis can be a crop for california like wine and other crops how they have helped build the economy and make us the six largest in the world. Quickly, do you think that who is in the white house and on capitol hill will make the decision . Or is it the American Public as their thoughts evolve . I think the American Public has really driven cannabis law reform. The American Public will continue to drive the reform. The federal government moves very slowly. Change comes difficult at the federal level especially when we are so divided. So i do expect the federal government will move more slowly than the people but we will keep pushing and hopefully we will get some relief soon. There is a public bank so is it brickandmortar . Is it online . What would be the best . Well, the cash has to go somewhere and hopefully when we have a bank that we can take debit cards and credit cards with for the pointofsale, the amount of cash people use will be reduced. Henry lee talked with police about the operation and a victim who is happy she got her laptop back. These men and women charged with being part of a sophisticated crime ring. Burglars broke into cars all over the bay area and stole 2000 laptops tablets and cell phones. Those stolen devices were bought by this man the elected theft. We found out he was selling to a couple of secondary people and both of these people worshiping the merchandise to vietnam. It began last year when Fremont Police noticed a 35 jump in car burglaries and decided to take action. In december detectives saw the shipping container at a Storage Facility being filled with 900 stolen devices. The container was supposed to be put on a ship headed to vietnam from the port of oakland. That broke it open and we realized how large the investigation was. Last week Police Arrested this man who was allegedly in charge of getting the stolen items over to vietnam. He was busted after dropping off his wife at the San Francisco airport. He had 18 bags of luggage and they were trying to get them on a commercial airliner for vietnam. Inside the luggage 300 more stolen devices. We believe the estimate is 2 million. Mainly laptops but also tablets and cell phones. One of the victims was Valerie Presley who was you reunited with her work laptop. It sounds like we have the right people on the police force doing their job and getting peoples property back. Fremont police are working hard to return those other items back to their owners. This follows allegations of Sexual Misconduct against franco. It is reported the School Principal has ordered workers to paint over the mural at the student center. Five women have accused franco of Sexual Misconduct. He has denied the allegations. There are other paintings by him inside of the Media Arts Center at the high school. The principal says she made the decision because that merrill is most visible. The future of an Elementary School in alameda in serious doubt because of the expense to protect it from an earthquake. It is reported that seismic upgrades for donald alum elementary would total 34 million. The district does not have the money and is now looking into ways to fund the upgrade or replace the school altogether. It has been closed since june over structural concerns. A controversial memo about the Russian Election investigation could be released today, it was written by california congressman devin nunes who chairs the house intelligence committee. The memo details what republicans call surveillance abuses by the fbi and justice department. As part of the investigation into ties between russia and the 2016 campaign. Yesterday, Christopher Wray released a statement asking the white house not to release the memo saying that there are grave concerns over its accuracy. Details on the deadly crash in virginia involving a train carrying congress. A person killed has been identified as 28yearold christopher foley. The train was taking lawmakers from dc to a retreat in West Virginia when the train slammed into a dump truck at a train crossing. Foley was one of the three people in the truck. Federal Authorities Say that ice agents will not make immigration sweeps at courthouses. The policy was released yesterday that says there will be no civil immigration arrests made inside of courthouses indiscriminately. Agents can go to courthouses to arrest immigrants who are wanted for crimes, but others encountered in the courthouse like relatives and friends would not be taken into custody. The california chief justice complained about immigration sweeps and sent a letter to ice that says agents need to stop stalking courthouses and called the new policy a good start. 50 years ago a group of lawyers came together to help protect the legal rights of minorities and immigrants as well as lowincome people, together they formed the Lawyers Committee for civil rights. Over the years they have taken up cases on voting rights, housing and education as well as fair treatment in the criminal justice system. Happy to be joined by the executive director monica, thank you for being here. I would like to look back to the state of the union address. Some of those policies made it appear he is moving closer to the middle. Some rhetoric was very harsh though. What are your clients telling you about how they feel . The fear is growing and it is not just from when he took office. It was the election as well. We heard in the state of the union, the emphasis on citizens every time he spoke of americans he emphasized the word citizens. When he was talking about immigrants he was giving the example of the ms13 gang members. You know, all americans are dreamers. So the clients we have are living under fear. We tackle those in a number of ways. We are dealing with immigrant students who are struggling. We have asylum claimants hoping to stay in the country. So people are calling not just for representation but even students and younger people who maybe cant afford it. Maybe just some who have questions . Yes, we have questions but we do work with immigrant students as well. We have a constitutional right to education. We found 50 districts were asking about citizenship so we worked with the attorney general last year to make sure those students were not being prohibited from going to school. We had one student who had been kept out for seven months because of the application process. I wanted to ask, this is seen as a problem for latino communities, but it does affect others right . Absolutely. Any group, we have people of color and immigrants from all sorts of countries. We have dealt with the bullying immigrant cases. We have faced any type of immigrant family from any part of the world facing challenges and as the communities of color are. Sometimes you will hear the story of i got pulled over for a broken taillight and it was determined i was in the country illegally. How would you handle that case . We would look for representation for you, but i mean i want to sort of step back. We work with pro bono attorneys, so we have an army of some of the best resources in the bay area. So you know there are individual cases like that that are coming up, but we are worried there will be ice rates coming and how do we mobilize for that . On the other end of the spectrum a lot of people think back to the Katie Steiner case. The verdict, not guilty of killing kate stanley shocked and angered many. Did that resonate in your clients at all . You know, things are always hard. We can point to so many moments that will flare up, but communities are struggling daily. So yes, there may be a case that heightens things or the president may Say Something horrific and that could flare it up but the daytoday struggles are there. A lot of the laws have not changed, just has enforcement changed . Because the laws are the laws. It is illegal to come to the country and overstay, but now you seem to think enforcement has taken a step up . A lot of our clients are asylum clients, so they have come over facing horrific conditions in the country but they are brought here now so they are going through Detention Centers. We have a case in arizona we recently had a good victory on where you go into the Detention Center and there is no link it or anything to sleep on. You are being deprived of sleep. We have made some Small Victories to allow to at least permit some hygiene. A place to wash yourself. Slightly humane but there is a long way to go. Monica, you are here because this is 50 years of doing this and you mentioned the asylum program. There are other programs but what would you say you are most proud of . Not you individually but as a group . The organization was founded to bring upon the Civil Rights Movement and for 50 years people have volunteered their time and served to help people who should have access to an attorney. So that is what we are most proud of. The other thing is how we work. We work with the community and clients. They drive what we do, there is no agenda. A youth soccer coach accused of sexually assaulting one of his players. 27yearold Marcial Gonzalez jr. Was arrested wednesday in morgan hill. Authorities say the assault happened two years ago but the victim and her parents recently came forward. We dont know where gonzalez met the girl. Gonzalez coached at oak grove high school, Live Oak High School in morgan hill , South Valley Middle School in gilroy and the sentinel soccer club. In Sonoma County there will be an autopsy on an inmate who died yesterday in police custody. The 32yearold was arrested for public intoxication by winsor police. And medical emergency occurred as he was being booked into jail. He later died at a hospital in santa rosa. In richmond some residents question if the city Emergency Alert system is effective after tuesday nights big fire at a scrap metal yard. A pile of metal 20 feet high caught fire at Sims Metal Management causing a huge plume of toxic smoke. Richmond fire says a Community Warning was sent at 6 00 pm but the Sheriffs Office says richmond fire never alerted them to turn on the sirens.
