Having to slow down and singletrack past the scene of this derailment further north near south hayward but certainly it has been frustrating for a lot of riders. That was the station announcement that was played at the fremont station this morning letting the commuters know about major delays on bart. All of this caused by a maintenance truck that derailed on the tracks just south of the south hayward station at about three deck 20 in the morning. These trucks are designed to drive along the tracks and crews on board do repair work. The accident caused damage to the electric third rail and crews are having to repair the third rail and they are also working to get the truck cleared from the tracks. In the meantime bart riders are running late. My boss was really nice about it. She understands because she rides bart. I might not get there on time depending on the delays. I am supposed to be a juror in San Francisco at 8 00. If i am not a there i am a little bit worried. They might be coming for me. Reporter it is unclear why this maintenance truck derailed overnight but clearing it from the tracks and repairing the damaged rail is not going to be easy. A spokeswoman for bart says it is not a quick fix so this could be an issue throughout the commute. We are waiting for more details on how long the repair work might take but again, at last check the delay is running between 10 and 15 minutes along fremont warm springs and we should point out normally trains are traveling from richmond down to fremont and warm springs but this morning the trains are headed southbound and stopping at the bay fair station. That is just a heads up for commuters in southbound directions near fremont. Thank you very much alex. So delays are also affecting passengers going nowhere near the fremont station so the delays on the Fremont Richmond line with minor delays filtering through the entire system. I want to go to the freeways to see if more people have started taking cars instead. It is hard to tell on interstate 880 it is slow, but that is a normal everyday occurrence. We are looking at traffic on highway 4 which is typically slow coming up and over willow pass. 680 from concord to walnut creek is moderately heavy. Palo Alto High School is reportedly painting over a mural after james franco made it at the school. This follows allegations of Sexual Misconduct. The High School Student newspaper reports the School Principal has ordered workers to paint over the mural on the student center. Five women have accused franco of Sexual Misconduct. There are other paintings by franco inside of the High School Media arts center. The principal says she made the decision because it is most miserable visible to the outside community. Youth soccer coach in the south bay has been accused of sexually assaulting one of his players. 27yearold Marcial Gonzalez jr. Was arrested wednesday at his mothers home in morgan hill. Authorities say the assault happened two years ago but the victim and her parents just came forward. Gonzalez coached at Oak Grove High School in san jose, Live Oak High School in morgan hill, South Valley Middle School in gilroy and the sentinel soccer club. The girls varsity soccer coach was surprised to hear the news. When you hear about that, it brings it home. He is from morgan hill so you know, it is disturbing and this seems to be a lot of that going on and coming up. Administrators from east side district issued a statement that reads none of its students are involved. The district says we are shocked and deeply disturbed this could happen. Mr. Gonzalez has been relieved of his position. Police are checking into whether or not there are more victims. Police in fremont say that they broke up an International Crime ring. Eight people were charged in connection with the theft of 2000 laptops, tablets and cell phones. The suspects have been accused of breaking into cars all over the bay area to steal the items which were being sold on the black market in vietnam. In december they saw a shipping container at a san jose Storage Facility filled with 900 stolen devices. We believe it is about 2 million. Mainly laptops but we also had tablets and cell phones. Fremont police say that the investigation began last year when they noticed an increase in car burglaries in the city. Now they are trying to return the recovered stolen items back to the owners. The future of an Elementary School in alameda is in doubt. Over the expense to protect it from an earthquake. The Bay Area News Group reports seismic upgrades for the Elementary School would total 34 million and the alameda district does not have the money. Is looking into ways to fund the upgrade or replace the school. The elementary has been closed since june over structural concerns in the event of an earthquake. Northbound on the right, southbound on the left and at the bay bridge toll plaza we have 25 minutes on the delay except for the carpool lanes. We want to mention the south bay. San mateo bridge traffic looks okay driving to the highrise we have some slow traffic on highway 4. On the freeway slow from hayward to fremont but it is looking a little more crowded today because of the bart situation or because of some earlier problems. Lets get back to the desk. The San FranciscoDistrict Attorney will be dismissing misdemeanor marijuana cases dating back to 1975. People affected will not have to petition. Allie rasmus in San Francisco explaining why the District Attorney is making this move. The District AttorneyGeorge Gascon explain many of the marijuana related misdemeanor crimes people were convicted of are no longer crimes today so it only makes sense to have the records cleared. This could impact 3000 people. There are 3000 misdemeanor related convictions that will be dismissed. These were made before the state cannabis laws changed. The office will review 4900 more felony convictions related to marijuana and consider reducing those two misdemeanors although they will be considered and evaluated casebycase. Some of the convictions go back to 1975. There is a criminal conviction for the misdemeanor crimes that could haunt people for the rest of their lives preventing them from getting jobs. George gascon was joined by supervisors and Community Leaders when he made the announcement and some of those leaders plotted the move. I feel that this is a giant step toward justice. It is a strive toward setting black people free. The process will take no hearings. People will not have to hire attorneys. They will not have to come to court. We believe it is the right thing to do. Reporter california voters approved proposition 64 in november 2016 legalizing the purchase and possession of pot and it prevented allowed people to have records expunged but going through the Legal Process can become located and costly. Not many people have gone through those steps so that is why it was important to be proactive about this and take it upon themselves to dismiss those misdemeanor convictions. Back to you guys. When they are nonviolent and they were not against anybody else, i feel like we need to take a second look. The nonviolent part, i guess some misdemeanors expunged, he will be looking into felonies upon further review. Certainly people who were violent will not get out. We were thinking what could be a felony and i guess maybe the use of a weapon. Sometimes the felony could be the amount of money or the size of the crime but again nonviolent. Federal Authorities Say that ice agents will no longer make immigration sweeps of courthouses. The policy Statement Released yesterday says ice will not make civil immigration arrests inside of courthouses. Agents can go to courthouses to arrest immigrants wanted for crimes but others encountered in the courthouse like the families and friends of the imprint would not be taken into custody. The chief justice in california complained about immigration sweeps and sent a letter to ice saying that agents should stop stalking courthouses and calls theres a good start. Some bay area pharmacies are running out of flu shots. Many cvs pharmacies have run out of the vaccine for people under 65. You can still find the vaccine at safeway and walgreens. One bay area dr. She had friends who took their own lives and she wanted answers. I was determined. She got answers interviewing High School Students who had attempted suicide or thought about it. 20 hours of footage became the onehour documentary not alone. She felt if they heard it through someone else they would realize they are not alone. Is something they can live with and deal with. As a film making its way through schools across the country and on this night at the Mill Valley Community center. The head of the programs sponsored and says no family is immune. Two of the Group Leaders children had suicidal thoughts herself. You know kids struggle but you dont think they are struggling to that point. She speaks openly but so many families do not. They fear if they talk about it, it would plant an idea and then they would commit suicide. 12,000 calls come there to the suicide hotline each year. The point of the film is to be the hotline yourself. If you are worried about a friend, tell someone. Young people may think they can handle it. Every single one of these teens said dont worry about making them upset, tell their parents or a teacher or counselor. Secrecy keeps the suffering, depression and suicide going. Teens in turmoil say that they were too ashamed to tell their parents. They felt guilty for being a mess up like i am provided everything, my life is so good but i dont want to bring them down. Were sure the conversation start . Families in this audience had questions and impressions. It is great to be out there and looking for signs. Not alone is a film with no adults, no statistics, no professional advice, just teenage testimonials. Richmond fire says the Community Warning went out at 6 00 pm but the Contra Costa CountySheriffs Office says richmond fire never alerted them to turn on the sirens. The bart situation, we had the derailed maintenance vehicle on the bart system between the south hayward station and union city. We are waiting to hear from bart. Repair crews are hoping to fix the tracks by the maintenance vehicle that derailed. This happened between south hayward and alex savidge is on the scene with more on the story. Reporter good morning. Bart is expecting crews to wrap up repair work any minute and then they are hoping to get things back on schedule. In the meantime, there are between 15 and 20 minute delays along the fremont warm springs line. This is a live look at the platform at fremont. A lot of people are behind schedule because of this maintenance truck that overturned this morning causing some problems. We heard a short time ago from a spokeswoman about what the issue was. The concept is when you have to singletrack the trains we will hold them at hayward while they wait to share the track and then the peak of the delay around now is because we are towing the vehicle out and we need to hold the trains out while doing that. Reporter this morning, commuters, a lot of them showed up at the stations and that is when they found out about the delays. It obviously caused some headaches. This started with a maintenance truck that derailed this morning as it was riding on the tracks near the south hayward station. These are trucks that are designed to drive along the tracks so the crews can go to work on the tracks. The accident caused damage to the electric third rail and crews have been doing repairs. A short time ago they will able to clear the truck from the tracks so we are expecting to get word soon the tracks are opened in both directions and they will no longer have to singletrack through the area. In the meantime, it has been frustrating for a lot of riders. I have no clue how long it is going to be. I just hope to get to class on time. I need to get to hayward. What were you thinking . Thank god my boss is really nice. This happens fairly often. Not every day, but i mean even the time transfers dont seem to be well timed. Was arrested wednesday at his mothers house in morgan hill. The suspected assault happened two years ago but the victim and her parents just came forward. Gonzalez coached at oak grove in san jose, Live Oak High School in morgan hill, South Valley Middle School in gilroy and the sentinel soccer club. The coach expressed surprise upon hearing the news. Administrators for Eastside High School district issued a statement saying that none of its students are involved in the case. The district has also said we are shocked and disturbed. Police are now checking into if there are additional victims. A man in milpitas is facing charges after impersonating a Police Officer and sexually assaulting a woman. He has been accused of contacting the victim through internet dating site earlier this month and arranged to meet her at the hotel. He showed her a badge and gun and ordered her to have sex with him. The victim complied. He was arrested in tracy last week and there may be other victims. The person killed has been identified as christopher foley. The teacher of an Elementary School in doubt over an earthquake issue. Seismic upgrades for donald elementary would total 34 million. The alameda district says they do not have the money and is now looking into ways to fund the upgrade or replace the school. Thousands of people convicted of marijuana related crimes in San Francisco will have their convictions thrown out, they happen before the Marijuana Law changed. Allie rasmus live to explain what is happening from San Francisco. Reporter some convictions go back decades to 1975 long before state laws on cannabis about personal marijuana use and commercial sale changed. The District AttorneyGeorge Gascon says the office will dismiss 3000 misdemeanor marijuana related convictions and the office is going to review 4900 more felony convictions related to marijuana and consider reducing those. Although that will be a caseby case basis. If the criminal person has a criminal conviction it can sit on the record for years preventing them from getting jobs and since these are no longer crimes today it only makes sense to have the moral records cleared. People will not have to hire attorneys and they will never have to come to the court. We believe it is the right thing to do and it is the just thing to do. Those people affected by the war on drugs get a little bit of a break. From the system that has been targeting africanamericans, latinos and other minorities since the 80s. California voters approved proposition 64 in 2016 legalizing the purchase and possession of one ounce of pot and it allows people of marijuana crimes previously to have their records expunged but that could be a complicated and costly process and not many people have taken the initiative to do that. It is just more fair to be proactive about this and go ahead and throw out the previous misdemeanor convictions. Allie rasmus, thank you. The policy was released yesterday reading that ice will not make civil immigration arrests inside of courthouses indiscriminately. Agents can go to courthouses to arrest immigrants wanted for crimes, but others encountered in the courthouse perhaps relatives or friends would not be taken into custody. The chief justice of california complained about immigration sweeps at courthouses and sent a letter to ice and says they should stop stalking courthouses. Fremont police broke up an International Crime ring were eight people have been charged in connection to the thefts of 2000 electronic devices. The suspects are accused of breaking into vehicles all over the bay area and selling the items on the black market. In december a shipping container was found in san jose being filled with 900 stolen electronics. We would estimate 2 million, mainly laptops but also tablets and cell phones. Police say the investigation started last year when they noticed a 35 increase in car burglaries in the city. They are now working to return the recovered stolen items.
