They have been driving around and keeping an eye on things here in terms of what the wind is going to do today that remains to be seen. Yesterdays fire officials said they plan to get air support up once the sun came up this morning. They want to try to fight the edges of the fire to keep it out of neighborhoods so more homes dont wind up like this one. The wind is starting to pickup and some say they could, experts and Officials Say they could get up to 70 miles an hour today. That could cause a big problem. We know in the past in fighting these areas in the past couple of days at least two helicopters had come down because of high wind. Can you tell us about, such a problem up here was with the wind and the smoke and how bad it was for the air quality and people breathing. We all had to have masks and many areas of the bay area, what is it like there now . Reporter the same thing here. We all have masks. My mask is just off for the moment. It is difficult to see. Even driving in last night on the highway the smoke can be so bad at some points that it is really difficult to see more than a few feet in front of you. As far as the air quality it is not air you want to be breathing and right now. People will want to wear a mask if they are Walking Around this area or in homes and buildings. You can smell the smoke anywhere you go. Even if you dont see them you can smell it and eventually the wind comes through and you can see some of the smoke. One question people are going to have is what will happen with this air support . It feels like the wind is getting stronger today and the plan was to get some air support up to fight this fire along the edges as soon as the sun comes up. The big question is can they do that and can they keep some of this fire a little more under control . What the fire official also said yesterday was at this point containment is still very difficult and seems unlikely. He said at this point it is up to mother nature. It started at 10 30 last night at an Apartment Building on bascom avenue. 13 cars were damaged or destroyed and a carport. There was also damage to one apartment and all the People Living in the building were evacuated. They were allowed back into their homes at 11 30 last night. The fire is still under investigation. Oakland firefighters put out a fire last night at a homeless under interstate 880 near jack london square. We got this video shortly before firefighters arrived. No word on how the fire started or if there are any injuries. Today will be day two of a struck by oakland city workers disrupting City Services. This afternoon the Oakland City Council will hold a special closed session that may help and the strike. Oakland city workers picketed outside a building yesterday where mayor shaft was holding a Reelection Campaign fundraiser. The union says they want a one Year Contract with a four percent pay increase. We want to come to a resolution. We want to get back to work providing services that we provide for the city of oakland. The city of oakland once a longer contract. The mayor said the city is offering a four percent increase for the first year with the possibility of a two percent increase in the second year, depending on revenues. The city has also proposed an additional . 96 an hour increase for street maintenance crews who cleanup homeless encampments. We cannot make Financial Decisions today that we cannot afford either today, but particularly in the longterm. The unions chief negotiator says not all the sticking points are dealing with money. Other issues include mandatory overtime and staff shortages. The city council is due to vote on that one your contract this afternoon at 1 00. We tried to reach out to three city council members. Two told us they will vote for the one your contract. The third councilmember is still undecided. A simple majority will get a oneYear Contract approved. There are other labor issues to talk about in dublin where hundreds of teachers and parents held a candlelight march last night. They say they are protesting the lack of progress in the ongoing contract talks between the Teachers Union and the Dublin School district. Negotiations over pay and benefits have reached an impasse. A state mediator has been called in to assist with talks which are set to resume tomorrow morning. We are bargaining for a fair contract for our teachers so we can stay in dublin and keep working for our students. We believe in dublin and they deserve the best future for the greatest schools in the state. The teachers say they are getting shortchanged when it comes to pay and benefits compared to teachers in neighboring school districts. He held a News Conference saying he respects the jurys verdict to acquit josi and has Garcia Zarate of the most serious charges. The Homicide Team in my office worked tirelessly on this case and i hope their hard work is appreciated, even if they were not able to secure a guilty verdict. Critics say gascons prosecutors overcharged the case leading to that acquittal. Prosecutors pushed for a first degree murder. The jury found the suspect not guilty of seconddegree murder and Involuntary Manslaughter. The Us Attorneys Office has filed new charges against garcias are Garcia Zarate. He was acquitted of murder and manslaughter. The jury did find him guilty of being a felon in possession of a firearm. He will be sentenced on that conviction next week and federal immigration officials have already said they intend to deport him to his home country of mexico after he serves his sentence. It is wednesday, december 6. Good morning. The fire crews from all over the state, as we have been telling you, are battling the Southern California wildfires. It is really moving this morning. Really being blown by strong wind. The three fires burning in los angeles and ventura counties have now burned almost 80,000 acres. Two firefighters were hurt battling the creek fire in northern san fernando valley. Tens of thousands have been forced to evacuate. Authorities say it is likely hundreds of homes have already burned and there is no containment on two of the fires. Only five percent containment on the one burning right now near the Magic Mountain amusement park. The biggest of the three fires started monday night near santa paula in Ventura County. The wind quickly pushed it towards the city of ventura, now across 101. It has burned 78 square miles. Ellison barber hit the ground and is at the fire scene. We are still focused on the wind and what else can you tell us . As i look over your shoulder at that was at home reporter there are a lot of homes that look like this in this neighborhood. In addition to the fires that people are dealing with, Southern California as of last night at about 9 pm 44,000 customers were without power. You mentioned the home behind me. I will show you a little if we can. There are quite a few homes in this neighborhood that look a lot like this. They are just flattened and destroyed. It is a lot of what we saw during those fires up in sonoma just a couple of weeks ago. You can see there is really not much left of the home. There is across the street a house that is Still Standing, but behind it there are houses that are flattened just like this where the fires have jumped. That has been the concerned the concerns, the embers are jumping. Thats what makes these fires so unpredictable. I know you are still getting the lay of the land. I am just curious, we see the devastation behind you there, have you heard of any situations where people tried to stay behind and fight the flames . It seems like everybody did get out of there. Reporter it seems like people really did heed the evacuation warnings. That is something in the press conferences yesterday that fire official fire officials said have been a positive. They said it was difficult and spread fast and we were not able to contain it. They said one of the wins they had was how they got people out of here quickly. 27,000 people evacuated monday night. We have heard fire Officials Say yesterday that one person, there seems to have been a car accident where one person died trying to evacuate. Not a lot of details on that when they were talking about it yesterday. When they were talking about the situation they said there are not a lot of wind when theyre looking at this fire, it has been so difficult and at this point theyre not sure if or when they can contain it, but they were able to get people out of their homes and out of the area quickly monday night when it started moving. It was moving so fast. Thats what we are hearing and seeing. We just looked at live pictures from overhead. Thank you for that update. We are hearing that the flames will continue. The flames are moving towards the getty center, across 101. Some of the people in the Evacuation Centers in Southern California say the Holiday Season is especially tough. A tough time to be away from home. Santa must have heard them. He showed up at one of the Evacuation Centers and handed out candy canes and some much needed hugs. People who dont know if their homes are Still Standing say the visit certainly helped brighten what was otherwise a very stressful day. Two months after the north face fires the fbi says they need to investigate fraudulent claims and potential scammers. The fbi recently created a task force that will help them prosecute people trying to make money off disaster victims. Lee martinez is in fountain grove. Tell us more about this. Reporter Public Officials have said that in an Alarming Number of claims into fema are duplicates, and even some fire victims have reported having trouble applying for aid because they found someone else had already registered with their name and information. It is believed that some of these duplicate applications may be fraudulent. The fbi leads a task force of more than a dozen federal, state, and local agencies to investigate fraud related to the northbay fires. The fbi is looking into these duplicate claims as well as Fraudulent Charities and advertisements for housing and jobs directed at fire victims. The fbi warns fire victims not to respond to unsolicited emails for housing or jobs. They warned against those soliciting money for charity. The main goal of the task force is to collect intelligence from other major disasters in houston and puerto rico to spot fraud trends. In other more positive news coming from the northbay fire areas, this weekend a second wave of money from the northbay fire really fun relief fund will go out. Victims who lost either homes, jobs, wages during the october wildfires and who have previously had applied for these funds will be getting a check cut to them over this weekend. Unfortunately, the deadline to apply for this relief fund has ended in some of the areas, two counties in particular. Those who are in napa still have until friday to apply. Those in the Sonoma Valley have until december 15. We are talking about the fires in Southern California. Just to give you a perspective, i know, steve, you are watching it, but it has jumped 101 and has closed part of five near Magic Mountain. It was burning in that area. Im just going by what i see on twitter at it is getting worse. The 101 between Santa Barbara and ventura, right down to the Pacific Ocean. There is a shot of the fire reflecting off of the Pacific Ocean. Now it is near the getty center near belair crest. Densely populated areas. Very expensive areas. Mainly densely populated. These are coming from people who work in la tv. These are not just random tweets. Good. The wind is making a bad. There is one dust, we have a breeze here, there is still some pretty good gusts coming up the Oakland Berkeley hills heading to the coast and parts of the city. This is more localized, not widespread, but we do have a freeze warning. If you are in wind protected areas you are probably in the upper 20s or low 30s. If you have a breeze youre probably in the upper 30s or low 40s. This is the thomas fire from 9 pm last night until 4 am. That was last night and now look at this morning. That is where it is down by the ocean. This is zero containment. There are still gusts. Fremont canyon has 80 miles an hour, thats the strongest gusts ive heard about. East northeast at la. It is in the Higher Elevations where it is funneled down the canyon so the fire weather warning continues through friday. There are some 40s and plenty of 30s. Santa rosa at 30. Some 20s to the north. Near the concorde pavilion is 35. Walnut creek at 33. Dublin, pleasanton and san ramon all at 32. Berkeley 46. It is clear. It is offshore breeze. There is no sign of anything for us clockwise except maybe some patchy fog. Otherwise, high and dry with lows in the 30s and 40s. Highs in the 60s. Sal . We do have traffic that is getting busier. Looking at Solano County commute on 80 westbound from vacaville, fairfield, vallejo, some slowing in vallejo approaching the bridge. On 37 leaving the vallejo area, which is typical. If youre driving to the maze it is going to be an 18 minute drive. Traffic is going to be okay. At the bay bridge toll plaza it is backed up for 15 20 minute delays. People are actually backed up for about a 15 minute delay before they make it onto the span. Lets go back to the desk. A Homicide Investigation underway in san jose after a man was found shot to death on a high school campus. Police rushed to Mount Pleasant high school about 7 00 yesterday morning. When they arrived they found the body inside and entrance to the school. Classes went on as scheduled. However, police have increased patrols on and around the school campus. We dont have any suspect information at this time. We want to ensure staff and residents and students that would you have officers here on campus. The name of the man has not yet been released for police say the victim is neither a student or a staff member. The two men charged in oakland in the deadly ghost ship fire are due in court today. The preliminary hearing for both men was postponed from monday because the judge was sick. Both men are charged with 36 counts of Involuntary Manslaughter for each of the 36 people who died in the fire. During todays hearing the judge will decide if there is enough evidence to go to trial. It is expected to last a week and include testimony from former tenants of the warehouse and Law Enforcement investigators. In oakland a new type of shelter is now open for people who have been living on the streets. The city opened a village of 20 tough shed shelters on a vacant lot at brush and sixth streets in west oakland. They are open to anyone who has been camping nearby. Yesterday only one person moved in. It was the first day the shelters were available. That one person did not want to talk to us. Another man said he is considering the possibility of moving in. I dont like people telling me what to do or where to go or having to check in. It is an enclosure where you get out of the rain. I know it is a transitional thing and a step towards something else. The shed shelters are insulated, but not heated. They do have cots with handwashing stations. There is security and also counselors who can help the homeless find programs that will help them make a more permanent move off the streets. The city of oakland expects to clean up the sidewalks and the camps before christmas. They hope to set up even more sheds early next year. San Francisco Mayor edley has introduced legislation to to great theory more Navigation Centers for Homeless People in the city. There are currently five Navigation Centers which allow Homeless People to bring pets and possessions on site and they offer access to City Services with the goal of transitioning people to long term housing. The mayor wants to create three more centers on the edge of Visitacion Valley and in the south market neighborhood. I knew lawsuit says california is failing students it comes to reading and writing. The lawsuit was filed on behalf of parent and former Elementary Students and their families in los angeles and in stockton. One student named in the lawsuit is a sevenyearold a second grader cannot spell words like help and need. The lawsuit says one of the nations Largest School district , california has 11 of the 26 Lowest Performing School districts in that is in literacy and basic education. In response the state department of education says california has one of the most ambitious programs in the nation to serve low income students. The San Mateo County board of supervisors passed a greenhouse Cannabis Cultivation ordinance. Ordinance takes effect in january and requires marijuana greenhouses in San Mateo County to be at least 1000 feet from residential properties, schools, youth centers, playgrounds, and drug and alcohol treatment facilities. Personal outdoor cultivation at private residences and all other commercial cannabis related activities will remain prohibited for at least one more year. A Bay Area Company is about to become the new owner of one of the nations weakest forprofit college chains. The Parent Company of Devry University will transfer ownership to Cogswell Education based in Silicon Valley. The terms of the deal we have not heard yet. The announcement comes a year after Devry University agreed to pay 100 million to settle a federal trade commission lawsuit. That lawsuit alleged that the college misled thousands of students about their post graduation job prospects. Two investigates has an update on the bart fleet of the future. Reporter more trouble for bart is coming to light as we approach the 2019 date when the last old bart car is supposed to stop carrying passengers. Bart 2. 5 billion project to replace the aging fleet has hit its latest snag where bart officials seem to be increasingly hesitant to provide exact dates of when the new cars will be in service. In November Bart failed a test run of the new 10 car lineup with the California Public utilities commission. As a result, bart was required to write up what went wrong. Two investigates that response the detailed both hardware and software errors. Software wise, the trains failed to identify seven of the 10 cars. Hardware wise, doors failed to open when the train stopped. Bart says neither of the issues were safety related, but the problem could affect service. Four months two investigates has been holding bart and canadian manufacturer of rda accountable for promises made regarding the fleet of the future. First, 60 cars were promised by the end of the year. Than 20. Than 10. The bart Spokesman Says they are still hoping to get those 10 cars in service by december 15.
