Zarate found not guilty on the manslaughter and assault with a semiautomatic charge. So clearly the jury bought the defense argue that the shooting and killing of 32 yearold kate steinle two summers ago on a crowded pier was an accident. This has been a case chockful of weapons experts, there was also very emotional testimony from steinles father on that first day of the trial. He described how his daughter who was walking arm and arm with him on pier 14 fell to the ground after being shot in the back. The bullet was a ricochet and the defense argument was that the gun west of previously stolen from a park rangers car accidentally went off as he unwrapped it from a rag. Prosecution experts say there is no way for the gun to misfire and that someone had to pull that trigger. Here is what the San FranciscoDistrict Attorneys Office had to say about the verdict. The jury came back with the verdict that they did. Well respect that decision. But again, cant stress this enough, this really is about the steinle family. They have shown incredible resolve during this whole process. And, um, our hearts go out to them. This jurys verdict should be respected. They heard the evidence. They deliberated as a group. They heard readback testimony. They looked at the physical evidence. And they rendered a verdict to the best of their abilities in accordance with the law. Reporter jurors decided not to speak to the media about the case. The widespread reaction to their decision was that this was a surprise. But legal experts will tell you that San Francisco is a liberal city and that this outcome shouldnt come as a shock to anyone. I continue to receive messages from folks in Law Enforcement who are saying, see . If we cant get a conviction on a case like this, we simply have no traction for crimes in this city. Now, as far as zarate, the only charge he was found guilty on was that felon in possession of a firearm and with credit for time served he will be out in no time. Now, there is an outstanding warrant for zarate and that is by the u. S. Marshals office for probation violations. So most likely, when he does get out after his sentencing in december, after he served his time, he will go to the u. S. Marshals office. He will be in their custody and will be deported back to his home country of mexico again. Live in San Francisco, im tara moriarty, back to you. Tara, Kate Steinles parents and family were not in the courtroom. What was the reaction from zarate . Were you in there this afternoon when that verdict you were in there this afternoon when that verdict was read. Reporter i want to mention the steinles. They attended the trial at the beginning and a little during closing arguments. They were very reserved. You know, they came in and they just wanted to observe. I think the legal system and how this would all play out, clearly they are disappointed at the out come here. You cant imagine being a father walking along a pier with your daughter, she is shot in the back and the person did it, is responsible, doesnt serve much time. So in their eyes, justice was not served. When you look at zarate, during the reading of the verdict, i felt that he didnt quite understand what was happening at the time. It went over his head, it seemed. But after everything was read, the Public Defenders Office employee leaned over and whispered into his ear explaining to him what it meant breaking it down for him. He has appeared very frail, very weak and feeble throughout the trial. So perhaps the jurors thought that as well and thought, hey, theres no way that this guy could have done this on purpose. Yeah. He thinks the defense attorney did a good job and the prosecution made a mistake by saying that Jose Ines Garcia zarate pointed the weapon at kate steinle. Why do you insist that he pointed the one . There is no evidence of that in the trial. You made that up out of whole clothed. Once you do that to a jury, a jury says we cant trust you. Where did that come from . There was none. Thats why i said the gun was pointed at the ground, he shot it, it wasnt an accident in that sense. Im not sure a jury will say that was an accident. But he points a gun at the ground, bullet ricochets, that is seconddegree murder in the four on 2 i asked him if the case that this was heard in San Francisco had any bearing on the verdict. Jurors in other counties and here are much more conservative. San francisco jurors are known as being a little more liberal, a little more free thinking. I mean, there are jokes from Defense Attorneys that say to their clients, hey, you want to commit a crime . Go to the city and do it because they are so liberal there, you have the best shot of any of the counties around here. So when youre carrying a reputation like that and this verdict comes back, it it bolsters that reputation. We also talked about the impact of San Franciscos sanctuary city policy. Postal Inspection Service is reporting an increase in thefts from postal trucks in the south bay. The most recent theft happened just last week while a truck was out on its route delivering to homes and businesses. Ktvus Cristina Rendon is in san jose with more. Reporter reporter the theft of mail from a u. S. Postal delivery truck happened in the middle of the day in this neighborhood right near downtown san jose. And it is just one of more than a dozen mail thefts from delivery trucks that the u. S. Postal service has seen this year. Reporter inside the grill in downtown san jose business is good for the owner. But outside, he has noticed his mail has been missing sporadically throughout the year. Postal delivery truck on julian street in the middle of the day when the letter carrier was away from the truck. It happened less than a mile and a half from the st. Postal Inspection Service sent about 150 letters to people in the downtown area whose mail may be affected warning them to check for financial fraud. Five people were injured today in a twoalarm fire at a senior residential complex in San Francisco. The fire started at 1 20 this afternoon at the Mission Dolores senior apartments on 15th street near guerrero. Fire Officials Say when crews arrived, they saw smoke and flames coming from the 7th floor. Officials say three of the five people hurt went to the hospital but none of the injuries is considered life threatening. The individuals who live here that were able to get out did a fantastic job self evacuating. They also were telling firefighters, hey, theres a person that cant walk, theres a person who is handicapped in this unit and thats where we sent Police Officers and firefighters. The ten story also houses disabled people. The fire displaced one elderly residents. No word on how it started. The man accused of killing four members of a family in san pablo while driving drunk was in court today. Henry lee tells us while similar cases often draw manslaughter charges, this defendant has been charged with murder. Reporter Authorities Say the driver, 47yearold fred lowe of sacramento, had a blood alcohol level of at least. 08 on saturday night when he allegedly killed four members of a family on i80 in san pablo and then fled the scene. In this case, mr. Lowes driving was extremely reckless. Reporter lowe has been charged with murder, dui and hitandrun. The d. A. Filed murder charges because lowe has two previous duis in sacramento. His license has been suspended four times and revoked once all because of drunk driving. Cal baseball pitcher jared horn was the only person in the car to survive. His father, younger brother, uncle and cousin all died. Lowe left the scene but was later arrested. Ktvu legal expert Michael Cardoza says you understand the law, lowe was put on notice by judges after each of his prior duis. If you drink and if you drive and if you kill someone while drinking and driving because you have been convicted of a driving under the influence charge, you could be charged with murder. There is sufficient evidence to file the murder charges. Ive confident well achieve success in this case and hopefully bring some measure of justice to the victims. Reporter in a statement, relatives of the victims thanked investigators and said, the families have complete faith that the little system will run its course and justice will be served. Reporter Piedmont Police say the calculated criminals waited for the homeowner to come outside to check the box and thats when they attacked. As they made contact with the residents of the house, one of the residents was assaulted. The suspects entered the home, assaulted the other resident inside the house that resulted in injuries to those two residents. Reporter the men ransacked the home and fled with cash, jewelry and other valuables. The suspect black men in their 20s never appear in front of the cameras. One has black and white shoes, the other wearing Nike Air Jordan basketball shoes.
