Ahead of the shooting. Authorities are also working to access kelleys cell phone. They have the phone but describe it as encrypted. At this point, police say they believe kelley acted alone, amid a domestic dispute involving his motherinlaw who attended the church and they now confirm that among the more than two dozen People Killed was a pregnant woman and her unborn baby. Records indicate multiple red flag incidents that should have blocked his access to guns. We have a loophole that needs to be closed. Reporter kelley was a suspect in a 2013 texas Sexual Assault case that while in the air force he briefly escaped from a Mental Health facility, and he was caught trying to bring guns on a military base. He was also courtmartialed for assaulting his wife and fracturing her childs skull. This is exactly the kind of individual who should have never passed a background check. Reporter its been amazing to see him wrap his arms around these families to pray with them to talk with law enforcement. He says hes there for them. He says the federal government is here for you, the entire weight of the federal government is being brought to bear. They are having some troubles. Questions are being raised over the police chase in oakland late yesterday afternoon that ended in a crash near lake merritt. Two cars were hit and one of the suspects ended up getting run over. Our Crime Reporter henry lee has been looking into why the chase was allowed to continue off the freeway and into a busy shopping district. Reporter Oakland Police policy allows officers to chase suspects who they believe is armed with a gun and that was the case here. But the crash happened as the suspect exited the freeway into the busy lakeshore shopping districts. Theres plenty of motorists and people Walking Around there. The hulls and bustle of lakeshore the hugsle and bustle of lakeshore interrupted by crime tape. This mercedes Station Wagon with three armed suspects inside smashed into this white chevy, ran a red light and then slammed into the black honda in front of horrified witnesses. People were really freaking out. They were shaken up. It was scary. Reporter the suspect jumped out of the mangled mercedes and one of them a 16 yearold boy was hitandrun over by a motorist. The teen is now in critical condition. The two other suspects who are 16 and 18 are also in police custody. Officers say guns were found in the car and that the suspect in the mercedes may be connected to shooting in and outside the city. Pamela drake. Was this highspeed police chase necessary . Who did it save and who did it hurt . And what would have been the likelihood of somebody getting killed as a result of this . How did that help anybody . Why did they want to chase him down through here when they know especially that time of day theres multiple cars, theres people crossing the industries in many points and its a very busy area . Reporter but police say it was within policy to pursue armed suspects. The factor of initiating a pursuit, because of the nature of it being that it was a vehicle that was identified as being an armed vehicle. Reporter ktvu reviewed dispatch recordings. 16 minute chase and confirmed it was never terminated by a supervisor. When it started in east oakland, a sergeant gave permission to an officer to chase the mercedes. Permission granted. Update speeds and conditions. Reporter the officer did provide continuous updates. Light traffic. Driver is in control. Reporter because the driver remained in control and traffic was light, the pursuit was allowed to continue onto northbound 880, fruitvale avenue and westbound 580 before the mercedes exited the freeway at lakeshore. Now, as far as the guns they recovered, police are testing those weapons found in the car to see if they can link them to other crimes. Live in the newsroom, henry lee, ktvu fox 2 news. I know that area well, henry. Its packed with people. I know that in fairness here, the chase only lasted for about a block off of the freeway. Is there any indication that the police were going to terminate it . I just cant imagine how they could continue that chase in that area with so many people all over the sidewalks and the streets. The dispatch recording didnt show a cancellation of the pursuit but its always possible they were about to especially because they went right from the lakeshore off ramp to lakeshore and lake park so thats possible. But again, youre absolutely right. Busy shopping district. Plenty of people Walking Around, the traders joes there, lots of things going on. So were lucky that no one else was injured beyond that suspect. You just hate to think what would have happened if that chase had continued. All right, henry lee in our newsroom tonight, thank you. Just moments ago, police in concord identified two of the five suspects who were arrested in the deadly shooting of a 17yearold high school student. 20yearoldyearold has been charged with murder and an 18 yearold has been charged with hiding the gun after the shooting. The other three are juveniles. The 17yearold is charged with murder for driving the getaway car. Another 17yearold boy was also charged with hiding the gun and the fifth suspect has not been charged. Friends and classmates have set up a memorial near Olympic High School in memory of the victim, 17yearold lawrence janson. Investigators say he was shot and killed by someone in a black sedan that pulled up near the School Campus after classes let out on monday. Theres still no word of a motive. But police do not believe the shooting was gangrelated. A warning tonight for people who hike and jog in San Bruno Mountain state park. There have been two reported incidents of a man groping women as they ran along a trail inside the park. Investigators have released this sketch of the suspect. He is described as a white man 58 tall about 180 pounds, with blue eyes and blonde hair, and a groomed beard with sideburns. The first incident was sunday, october 22nd, around 4 30 p. M. The second incident was two days ago on monday at around 5 30 p. M. In both cases, the suspect approached the women from behind and groped them, then took off. Est driving a lightcolored 2009 mazda 3 hatchback or something similar. Anyone with information should call the sheriff. Wet weather has returned to northern california. Mainly a lot of the rain will show up after midnight. Its raining in the north bay. The atmosphere is priming all afternoon. When the atmosphere primes like this, its good for good things for our rainfall accumulations. We have a tenth inch up there. Watch what happens after 7 00. It jumps up to nearly three quarters inch of rain by thursday morning. So rain gets going overnight. Lower level winds at 5,000 feet, you see some strong winds. That will help enhance some of the rainfall at the coastal hills especially in the north bay and marin county. These are Current Conditions in santa rosa. You see heaviest rain east of town by st. Helena and Robert Louis Stevenson park. Heavy around calistoga. You see yellow areas, that represents rainfall with the wipers going pretty strong. We have rain in the forecast. Rain as we go into the overnight hours heaviest overnight and it will have an impact on the earlymorning commute. It was exactly a month ago that the north bay fires started and destroyed thousands of homes. One of the worst hit areas was the coffey park neighborhood of santa rosa. Crews are beginning to clear debris, but theres a long road ahead. Today we talked to some of the survivors of the fire, who say there are still daily reminders of the items missing and how lives are changed. Theres a lot of those. Three, four, five times a day you do those. Like oh, our sons toy or, oh, that funny jacket i had or Something Like that. You know . Thats hard. Its fresh every time you think of Something Like that. The tubbs fire alone destroyed 4600 homes in the santa rosa area and the damage cost in Sonoma County is 3 billion. Right now, one of the goals is getting money to homeowners and businesses that suffered losses in the fires. And today the state treasurer found out about that firsthand. Ktvus tom vacar reports now from santa rosa. Reporter santa rosas newest Largest Health facility was damaged in the firestorm destroying all 56 of the exam rooms, pharmacy, lab and all medical equipment. The 24,000 patients dependent on this center now have to go to one of eight other much smaller but just as busy centers. Because the Sprinkler System saved the structure, it will take a year to rehabilitate it instead of several years to rebuild it from the ground up. We have converted every Available Space we have into clinical space to see more patients. Additionally, some of our Sister Health centers have loaned us mobile vans so we have three mobile vans over at one of our locations. And were probably going to be getting additional mobile units. Reporter remember whats being rehabilitated here. This is a medical healthcare facility. Some people that are coming in here are sick or with compromised immune systems so when this is done, this has to be perfect. However long it take half of santa rosa communitys Health Income was generated by this facility putting it deep in financial stress. We will come back and we will be fine. But we need a bridge through this tragedy and this disaster. Reporter state treasurer john chiang who toured the destroyed facility today has access to an emergency rebuilding loan fund but not enough to cover it all. Well look at what we can do to try to push out the money so we can help rebuild Community Clinics such as this one. Reporter if money doesnt flow freely from government, insurance and financial institutions, full recovery for other institutions, businesses and homeowners could take years. We are hearing from builders that they need the pipeline loosened up between lenders and construction companies. Reporter making matters worse, a provision of the proposed federal tax reform bill. Reporter the sheriff says she will be evaluating procedures in the coming days but right now her focus is on finding Tramel Mcclough and john bivins taking them back into custody. Its day 3 on the run for escapees Tramel Mcclough and john bivins, now Santa Clara County sheriff laurie smith is offering a reward for information leading to their capture. We think the 25,000 will really prompt tips. Reporter the men armed suspects in the robbery of a Verizon Store fled from the palo alto store monday out a side door after using a key to unlock their restraints. The union that represents the sheriffs deputies called staffing a contributing factor here. But sheriff smith said with 15 people on duty that day instead of the usual 13, that wasnt the case. Staffing wasnt an issue. When inmates are shackled and waitechained its very hard to them get away. If they have a handcuff key, its not difficult. Reporter how they got the key is a mystery but the sheriff has a theory. Its scary because of what you can get into a jail with drones. Drugs are the least of our problems. We are concerned about weapons. Were concerned about maybe in this case a handcuff key. We dont know how they got it. Reporter there were two getaway vehicles in this case and now authorities have arrested two people for their role in getting them. Rene hunt got the first car a toyota and Marquita Kirk is accused of renting a uhaul which she apparently returned a short time later. Still no sign of the criminals and the sheriff says detectives are working 24 hours a day to find them. I dont think that there were any mistakes made by staff. We have the best staff. We did a great job. Um, it was just the totality of the planned escape. Reporter the two men are dangerous so call 911 if you spot them. New developments tonight involving a man from Southern California who posted a bizarre Youtube Video holding guns and threatening to go on a killing rampage. Authorities say 39yearold david smith sent the video and an email to an employee of a university in orange county. He said he had nothing to lose and would make some examples that no one will forget. The University Employee and smith once worked together on campus. Nine loaded guns were found in his house, hundreds of rounds of ammunition and receipts from a shooting range. Smith pled not guilty to a charge of making criminal threats against a private university. An investigation is under way into the deadly shooting of a protected southern sea otter. The dead otter was found flowed floating in morro bay in september. The California Department of fish and wildlife announced a necropsy determined it was killed by a pellet gun. The female otter was tagged and known to Wildlife Conservation groups as mba741. The Monterey Bay Aquarium created this video as they followed her rescue, her rehabilitation and then her release. Its frustrating. A lot of effort went into this animal. A number of different groups, conservation groups, were involved, the Marine Mammal center, and other organizations all put in resources with the hope of trying to rehabilitate this animal and put her back out in the wild. That part was successful. But to see this, its disappointing, frustrating. Authorities say this was the latest in a rash of sea otter killings along the coast between San Francisco and los angeles. A skinned otter was found and three others were found shot in august of last year. Everybody is waiting on the rain, ending fire season for us around the bay area. This is officially it. Some good rain up in the north bay. Maybe an inch of rain, maybe threequarters. Maybe a half inch. Quarter inch in san jose. We have a little bit of wind with the system. Its a storm. Not a big one but its a storm. Especially for the north bay, the mountains there will be some snow as well so those are low level winds about 5,000 feet high winds and so you see the winds are gusting in those areas around 40 miles an hour. So we could see some gusty winds this evening. So as you look out there now, you can see the current position of the showers in santa cruz. Santa rosa right now, healdsburg, cloverdale, there are the showers. Out some point its coming down heavy. Yellows we saw earlier in this area, theres yellow by the springs, thats moderate rainfall. So thats coming down. These pooling up in some areas. So between now and tomorrow morning, the rain will be heaviest. We are seeing widely scattered showers in concord, oakland. Its not organized yet. But overnight it will be. Light around lafayette. Not messing with the central bay commute at this time. Most of you will be home before the rain really develops. A string of witnesses took the stand for the defense today in the Jose Inez Garcia Zarate murder trial. Zarate was in this country illegally. He is accused of killing kate steinle on a pier in San Francisco about two years ago. Ktvus Tara Moriarty was in court today. One of those witnesses for the defense is a weapons expert. Reporter thats right. They bolstered the defense claim that the killing of kate steinle was indeed an accident. It looked like a win for the defense today. The canadian mountie was the Defense Firearms expert. He testified today that Jose Inez Garcia Zarate most likely unintentionally fired the gun used to kill kate steinle on a San Francisco pier in 2015. Under the law, an accident is a complete defense to criminal charge. And so if there is reasonable doubt that a crime was committed, that this was accidental, that he would be acquitted on all charges. Reporter prosecuting attorney diana garcia tried to keep defense attorney Matt Gonzalez from asking the question but to no avail. He said his opinion was based on a variety of factors including operator error. Unintentional discharges happen particularly when you have someone who is untrained, when you see a single shot and as is the case here you have a Long Distance shot and a ricochet. Reporter another factor the actions of the shooter after the shot. Garcia reminded the jury that zarate tossed the gun into the bay and then walked off the pier. She also pointed to his contradictory statements to police. And the key part of the statement he said he was five feet away from steinle when the gun dis charged. We know thats totally not true. He also admitted to walking by her when she was shot. We know thats not true. Reporter so the defense is basically saying that the police got zarate to admit things that werent true. When asked if he himself would be taking the stand in his own defense, they said he would not be. We know that they are expected to wrap up their case tomorrow so that meaning that closing arguments will probably be monday. In San Francisco, im Tara Moriarty, back to you. You mentioned that that gun expert on the stand today was from canada. Why not get a gun expert from the United States . Reporter a lot of us were wondering about that. That sort of struck us as odd. And i asked garcia about that and he said that guns are guns whether they are in canada or the United States. But we wondered why not use many of the experts we have here in the United States . Virginia voters gave the democratic candidate for governor a surprisingly large margin of victory especially from voters in the suburbs. The democratic candidate phil murphy also won the governor seat in new jersey. And in maine they voted medicaid expansion. Virginia elected the nations first openly transgender state lawmaker. Yes. I am a transgender woman. We won because i am a transgender woman. Because i am a lifelong resident of [ indiscernible ] i never ran way from them. I championed them. Former journalist danica roem defeated a conservative republican bob marshall but the gender identity wasnt part of the campaign. She focused on jobs, education and reducing traffic in northern virginia. Sonoma state Political Science professor david mcewen told us on the four on 2 that the Election Results might give democrats a boost as they try to regain control of congress in the midterm elections next year. As we move forward into 2018, what type of electorate shows up . Are democrats engaged to vote against the administration . Thats usually in president ials not midterms. That didnt happen this last time. Republicans have to see how cohesive they are going to be. If theres one thing the Republican Party is good is eating their young. Here in California Democrats will work to shift seven Republican Congressional districts into the democratic column. The Congressional Budget Office is now estimating that the gops new tax plan will add 1. 7 trillion to the deficit over the next 10 years. Democrats say thats far too high a price to provide a tax cut for the wealthy but House Speaker paul ryan says the Republican Party has to stay true to its word. One of the chief promises we made when we ran for office all of us whether its president or congress in 2016 was that we would do tax reform and cuts for families for people. Friday night into saturday morning when the fire jumped the lines here in the Sonoma Valley and just exploded about 2 a. M. Reporter the flames barreled toward buena vista from all directions, a firefight to save the oldest winery in the valley under way. When we have a chance to save an asset like this of course its a very valued thing. Its an iconic location. So we are going to put all our efforts into it. Reporter we saw the burn area next to a building where wine is stored and made. This is where they really fought it back and i believe were talking five feet from the building. Literally. It couldnt have come any closer without burning the building. The only thing is, back home in chicago, all were seeing is the devastation. Reporter despite that, this chicago resident had no doubt about keeping his plans to visit Sonoma Valley. The hotel, everybody called me to let me know they are operational. So no hesitation. These propose allegation that in isolation might seem innocuous, lets do 1,000 feet instead of schools instead of 600, lets include Child Care Centers, lets limit it to one or two per neighborhood, when you put it all together, it means new businesses will be prohibited in almost every, single part of San Francisco. Its estimated to generate 360,000 a year with the money going to emergency services, parks and maintenance. And the city of cotati in Sonoma County overwhelmingly approved its cannabis tax of 5 per square foot for growers and up to 8 for retailers and distributors. The vote there was also 79 to 21 no. Another ski resort in lake tahoe is open for business. The boreal ski resort at Donner Summit began limited runs for skiers and snowboarders this morning. Resort workers say its a team effort to open this early. Snowmaking crews have been working around the clock to get ready and everyone else is working overtime. A strong winter storm this past weekend also made it possible for boreal to open today. The Mount Rose Ski resort in the lake tahoe area opened yesterday. Mammoth mountain is set to open tomorrow. We cant take a 104year thing and walk away from the tradition. Reporter it was a bed and breakfast build more than 100 years ago as a resort for the working class. You were under 100 for a family of four. Yeah. So its like and we want to be able to do that. But if the county is going to make us jump through all these hoops, its going to be touch. Reporter john and suzanne say they are running into bureaucratic red tape now around permits, accessibility requirements, and other things the ranch had been grandfathered under because it was there before the laws were. Showers started in the north buy but heavy rain is at midnight setting us up with heavy rain at times. Take a look at the forecast. This is santa rosa with a tenth inch and it ratchets up overnight. So by the morning hours, tomorrow, were going to see nearly threequarters of an inch of rain in the santa rosa burn areas. We could see more, certainly in places like sebastopol and the coastal hills. The winds are there, as well. The current radar overlaying with some of the winds and you can see the size of the streaks there represent the strength of the wind. Moderate wind about 5,000 feet some wind gusts to 25 to pa miles an hour. Those will come down to the surface overnight as the rain falls. Its not a wind advisory event but it will be breezy especially in the north bay and out along the coast. Santa rosa there are the showers heaviest now. Those yellows represent your windshield wipers.
