I can tell you a Big Development in the case is there have been two arrests and two people are accused of helping the inmates escape. This woman is Marquita Kirk of sunnyvale. She help provide one of the getaway cars. She is accused of renting a u haul van and the Sheriffs Office just released a photo that we have and we can show video. They released a photo of the u haul that they say she rented. She had a long relationship with one of them in. They escape from the palo alto courthouse in what the Sheriffs Office calls a sophisticated plan that involved multiple vehicles. They ran out of an emergency exit at the courthouse and got into a getaway car. Updated they went around the block, they got into a uhaul van. We asked the undersheriff late this afternoon what went wrong . Escapes happen regularly. Inmates plot and plan escapes almost as soon as they come into custody. Were not get were not surprise given the staffing problems from over the years. Youre asking us to do a job without the tools, resources or people to safely accomplish the tasks youre asking. Reporter the Sheriffs Office says they disagree with the deputies associations assessment. They say they are overstaffed at the courthouse with more than usually staffed. Back to the escaped inmates, the men are facing charges in february of an Armed Robbery of a Verizon Store in sunnyvale. If anyone spots that two men, the Sheriffs Office is asking them to call 911. The Sheriffs Office says it is reviewing policies at this point. And one more thing, there were two arrests and the second arrest was a 54yearold man from east palo alto. The sheriff told me he had an intimate role in orchestrating the escape. More questions to come but that is the latest. Ktvu fox2 news. We are learning new information about the man who opened fire in a texas church on sunday killing 26 people. Deputies say devon kelley was accused of Sexual Assault in texas four years ago. The investigation was as dropped. In a Police Report from el paso texas, he briefly escaped from a Mental Health facility in new mexico in 2012. He was later discharged from the air force for physical abuse of his wife and stepson. 12 people remain in the hospital two days after that mass shooting at the First Baptist church and sutherland springs. Here is more. Reporter the front of the First Baptist church can be clean tuesday as federal and state investigators scale back their work in and around the sanctuary. The shattered windows, an indication of corn is left inside by the government identified as devin kelley. The rifle used by kelley was a semi automatic. It was not modified with a bomb stock device like the one used in the las vegas shooting. Atf agents have acquired shell casings from the scene. Those shell casings will be entered into ats National Integrated ballistic identification network. That will help us determine if that rifle was used and on the other shootings. Reporter officials have yet to determine a motive. There is a conflict between those two families. For only 48 hours into this investigation. Things that we release in these press conferences could have an effect. Reporter fbi agent christopher combs says that the phone was flown to a lab in quantico for analysis. At this point in time we are unable to get into that phone. It highlights an issue that youve heard about before with the advance of the technology and the phones in the encryptions, Law Enforcement whether at the state, local, or federal level is not able to get into these phones. Reporter investigators did not go into the details of kelleys background. Or why he was the got denied a gun permit at the local level but not at the federal level. Officials conferred deputies responded to a disturbance at kelleys home at his home but no formal report was filed. It was confirmed she was the focus of a Sexual Assault investigation in 2013 but the investigation stalled. This is providing the latest information about Devin Kelleys past. He was taken into custody at a bus stop after he reportedly escape from a Mental Health facility in new mexico. It was noted that kelley while serving at an air force air force base had allegedly tried to sneak firearms onto the base and that he made threats against several members of the command staff. None of this information was in any federal database which couldve prevented him purchasing the weapon you brought to sutherland springs. Two u. S. Senators are working on legislation to make it more difficult for those convicted of Domestic Violence to buy guns. The senators are working together on a bipartisan bill to require the military to report convictions for Domestic Violence so that information can be entered into a national database. Right now the law only applies to criminal courts, not military courts. The move comes after the air force admitted they failed to report that devin kelley had prior convictions for abusing his wife and stepson. We have just learned from Oakland Police that they have arrested three people as a result of this police chase and crash that ended in a very busy shopping district about one block from the grand lake theater. Earlier we told you about five to five people arrested for a death in concord. All five people who are in custody for homicide are going to be booked under the charges of murder, conspiracy to commit murder. Now because we had a mixture of adults and juveniles as suspects , and because we have further investigated steps to take, we cannot release their names, their identities at this time. Once we are sure that their identities can be released without compromising this investigation that is still ongoing we will do so. In addition to arresting the five suspects, and i will assure you that at this time youre not seeking any other suspects, we have recovered the murder weapon which is a handgun. We have recovered the vehicle that drove the suspect to the homicide and away from the homicide. Now, our work is not done. There is still a lot to do. And we want to present the most thorough and complete investigation to the District Attorneys Office as we can. We will seek that meeting with the das office this week and we will seek charges against these five suspects for murder and conspiracy to commit murder. Our hearts go out to lawrences family as they deal with this tragedy for the days, weeks, and lifetime ahead. In addition to what i have just told you here tonight, we are exploring all avenues that can help explain the modem motive of this case. That has not been clearly identified just yet. We are continuing to work hard at that. We are interviewing people at this time. This investigation goes on as they speak to you here tonight. As soon as we develop that motive, that will be used in the case for prosecution. How many people were in the car . At this time im not going to get specific with the number of people in the suspect vehicle at the shooting. There were multiple people in the vehicle but because other interviews will be taking place i cant taint those by providing too many details tonight. Reporter what do we know about the handgun . We have the handgun in our possession. We have the car in our possession as well. Reporter did they know each other . How many are juveniles and are they in a game . At this moment i can tell you that we have nobody in custody and nobody involved in this place that is a documented gang member. Like i said, all avenues are being explored for a motive. As our leads develop we will follow those leads to conclusion. As i reported yesterday, we believe lawrence was targeted. There is some sort of connection there that led to the shooting and this homicide yesterday. And the exact reason and the exact relationship, how long it happened in the nature of that relationship is being explored. This is still a very developing case. It is just more than 24 hours old. We are still learning new information every day. Reporter again, how many juveniles and how many adults . At this point im not going to get into the number of juveniles and adults. I can say one of the adults is the shooter in this case. The shooter is an adult. Reporter where are they now . The adults will be booked at the martinez jail. The juveniles will be held in juvenile detention and some will be transported shortly. You have been listening to Concord Police updating us on the killing yesterday of a 17 yearold High School Student in concord. They have five people under arrest including adults and juveniles. The police say none of them are gang members. All of them will be charged with murder. They believe that Lawrence Jensen was targeted. Police say they have recovered the murder weapon and a handgun was used in the case. Lawrence jensen was walking with several friends when a car drove up and her person got out and opened fire. They do not believe it is gang related and theyre not releasing the names because they dont want to jeopardize the investigation. The key question is still what was the motive. We dont know that yet. If we get updated information, we will bring it to you. But five people are under arrest. Adults and juveniles all being charged with murder for the killing of Lawrence Jensen. The San Francisco bay ferry is under fire after hundreds of passengers were left stranded for hours. That ferry left San Francisco bound for vallejo but ran into a mechanical problem and broke down in the middle of the bay. Paul chambers is live at the Ferry Building with what happened with that. Officers say those suspects may have been armed. The crash happened at 4 45 near lakeshore and lake park avenues about one block from the grand lake movie theater. Were not sure where the chase started. We do know a number of police cars chased the suspect on the highway and then on the city streets where their car crash. We get more from brooke rose.
