School and middle school. No one was hurt. The lockdown was lifted and school resumed. But then about 2 hours later, around 2 p. M. , police got another report of a second student with a gun which prompted this second lockdown out of precaution. It turns out the Student Police were looking for in that case was already off campus. Police did contact him and say they found no weapon in that case. The school was given the all clear around 3 p. M. Police are still investigating the two incidents and are not saying yet if they may be linked. Investigators do say the 14 yearold boy who brought the gun here is a milpitas resident. He is facing charges for bringing a firearm to campus but could face more depending where the investigation goes. This is a reminder for parents to lock up firearms. Maureen naylor in milpitas tonight. Maureen, thank you. Now to some new information about an 8year old who brought a gun to a San Ramon School on tuesday. That boys father is now under arrest. 30yearold Anthony Odonnell was arrested this morning at his home. Police say his son brought a loaded gun in his backpack to twin creeks elementary school. He showed the gun to other students and the school was notified. Odonnell, the father, faces charges including child endangerment and criminal storage of a gun accessible to a child. Comments made by at least six Antioch High School Junior Varsity Football Players to a group of female students were so crude and so vulgar that the principal suspended the players and also canceled todays Football Game. Ktvus rob roth was at Antioch High School earlier today and joins us now live from the newsroom with just what happened. Reporter heather, that Junior Varsity Football Game was supposed to start about now. But the game has been canceled because the principal says the group of jv players harassed and threatened a group of females students and that the school wont stand for it. Reporter the football field at Antioch High School emptied. The bleachers empty. Thursdays Junior Varsity rivalry Football Game against deer valley high is off because of behavior of a dozen players. Some of the vulgar statements and comments that were made to their classmates, the female students, were so rude and disgusting and profane that, um, i just was appalled by their behavior. Reporter thats why principal roach suspended six Junior Varsity Football Players for a week and decided along with the coaches to cancel the game. It happened monday afternoon. Ktvu spoke with one of the female students, who says that it all began when one of her friends broke up with one of the jv Football Players. Then a group of players began shouting at the girl and her friend. Then the jv player started shouting crude stuff at us and calling my friend names that shouldnt have been said. And then my friend asked what was the problem . And they didnt say anything. And then they kept saying if she walked over there, she was getting slapped. She was going to get hit. Reporter the school decided to cancel the game to send a message and because with so many players suspended, it would be hard to field a full team. The incident happened just days after the school held an assembly about Sexual Harassment and finding positive ways to treat each other. To me, it was very upsetting that we provided an opportunity for people to learn, discuss some of these really important issues and, um, then to see that behavior was very disappointing. Things shouldnt just be okay with demeaning someone and calling someone horrendous names that shouldnt have been said and then threatening to beat somebody because they got broken up with. There is new information about the killing of a musician outside a downtown oakland nightclub in april of 2015. 26yearold Emiliano Nevarez was shot and killed while carrying musical equipment out in the street after performing at the golden bull bar. Today Oakland Police and the fbi held a joint News Conference to announce that the man responsible for his death is 24yearold [indiscernible name]. But he was killed a year after that oakland homicide during a police chase in placer county. Were at least satisfied that we have the right person that is responsible for this. It doesnt bring the deceased back. And it is something that we are heartbroken for the family over. But it gives us comfort that we have been able to hard work identify the shooter in this. More than 100 people are stilt in shelters more than 2 weeks after the fires wondering whether they will have a new place to live. Dina smith and her family lost their apartment in clearlake. They are staying at the Sonoma County fairgrounds in santa rosa. Red cross staffers dont know how long the shelter will stay home. Her husband is a disabled vet and worries how she will care for her family if the shelter closes. It does frighten me because the American Red Cross are going to close down at any given time and we were just in a meeting where they told us well give you 24hour notice. I have no idea what im going to do with my family, with my kids. I dont know i im so uncertain about tomorrow that i have been just trying to focus on today. [ crying ] today is all i have. In rohnert park, the First Spanish Baptist Church is cooking three meals a day 7 days a week for those affected by the fires. Fire Officials Say if weather conditions stay the same, the four largest north bay fires could be fully contained by tomorrow. The atlas fire which started near Lake Berryessa is 97 contained. The tubbs fire, pocket fire and nuns fire are all around 95 contained. Firefighters have been working around the clock to put out any hot spots and clean up the areas affected by the fires. Those four fires have burned and estimated 200,000 acres. Now that those fires are almost fully contained, wine country needs tourists to come back. The president signed the bill today after the senate sent him the measure earlier this week to help florida, texas and puerto rico after the string of devastating hurricanes. The money will also help western states dealing with massive wildfires. No word exactly on how much of the money will be sent to california. Today congress has approved more than 50 billion in disaster aid so far this fall but more money will be needed [ music ] coming up, the 49ers pledge half a Million Dollars to fight for gun safety. S. Airports including sfo. The new rules apply to both u. S. Citizens and foreign travelers. And they affect roughly 2100 flights that come into the u. S. From around the world every day. Under the new screening process, passengers could be subject to security interviews by airline employees and face more detailed inspections of carryon bags and electronic devices. Travelers we spoke with today at sfo dont mind. Its only being done to protect the people. You might worry but if you are screened, everything passes through, your luggage, you feel okay. The thanks replaced earlier rules that banned travelers from eight predominantly muslim countries from bringing laptops into the passenger cabin area. All right. [ pause ] the Law Enforcement officer whose gun was stolen from his car in San Francisco and then used in the kate steinle killing took center stage in court today during the trial of Jose Inez Garcia Zarate. The bureau of Land Management officer said he thought it was safely stored even though it was in a backpacker in the locked vehicle. Ktvus Tara Moriarty joins us now. Reporter this officer took center stage today. He is not from the bay area so perhaps not familiar with our auto breakin epidemic. He is actually from just south of san diego near the mexico border. This is officer John Wachowski were talking about with blm. He took the stand today and said that he is, quote, safetycan. Now, that struck the defense as odd considering that the officer left a fully loaded firearm inside his suv in a backpack parked along the embarcadero on june 27th, 2015. He said he is, quote, safety safetyconsciou prosecutors say Jose Inez Garcia Zarate got the gun and shot kate steinle on pier 14. Zarates attorney asked wachowski if he felt responsible for steinles death and that question was actually stricken from the record. I have to tell you, thats a spoton question. It makes no difference at all. As you say, whats the difference where the gun came from . The fact is, he either brought it there or he found it there, zarate. If i were a prosecutor back to the old days when i was a prosecutor, i would think that out. Say, you know what . It doesnt matter so why would i call him to the stand . Dont call him. Let the defense call him. Right. And then you would be able to argue to the jury, doesnt mean anything. They are trying to divert you. You know, its like a magician. Hey, look over there while the tricks being done here. It makes no difference. The weapon was there. It was used. It killed kate steinle. Is it really plausible, in your opinion, to think that this guy was sitting on the bench looked underneath and found something wrapped up in in in whatever, unwrapped it, it turned out to be a gun, it accidentally went off and it accidentally killed kate steinle . I have a hard time believing that, especially or in light of the fact that zarate gave three different stories to the San Francisco police department. Which story are we to believe . You were shooting at the seal or the gun went off accidentally . Thats why, frank this will be a battle of experts. The d. A. Will bring in an expert. A forensic ballistic expert to talk about the pull on that gun trigger on that sig sauer. Its 10 pounds. So it didnt go off accidentally unless it was cocked. Who is going to believe it was cocked under a bench and he picked it up and goes boom and throws it in the bay . No, it doesnt make sense. How damning is that, that you threw the gun in the bay, that he gave those different stories and that as she lay dying and people were coming to help her, he went in the other direction . You know, some of thats explainable by the defense. You pick the gun up and lets assume lets assume with all our imagination that it went off accidentally. Like oh, my god throw it to get rid of it and im out of here. It was me that did that. I dont want to be involved in this. So it could be a panic type situation for him. Other than that you have the three different stories. The thing thats getting me is the d. A. Keeps saying, you know, he pointed the gun directly at her. Now, i dont know what if any evidence the prosecutor has of that but she better have some good evidence and i dont know why they are even going there because if he picks up that gun and he thinks, ha, i wonder if it works, he points it at the ground, or points it at something inanimate, pulls the trigger, thats such a willful disregard for human life, thats the exact definition of seconddegree murder. It would be tantamount to, you and i are standing here, we have a gun and we go look at the party across the street. Oh, a lot of people there. Lets shoot the gun in and just for fun. We dont mean to kill anybody or hurt anybody. Thats such a wanton and willful act, it falls into seconddegree murder. If you were the defense attorney, would you put zarate on the stan . No, i wouldnt. I have heard about his lack of education. I wouldnt put him on the stand. The other day in the courtroom we heard stories where he is just drilling, staring at some of the women in the courtroom to make the women in the audience feel very uncomfortable. That was reported to the judge, to the bailiffs. There is a big fight about that. Matt gonzalez did the best he could to explain that but im telling you what, if a jury sees that if they see that, this guy is really strange, we are not letting him out. One of the first things i learned, i have done jury trials a long time, if a jury likes your client, they are going to be more likely to find him not guilty of a crime. They dont like you, youre not going out in the street. They are going to be more likely they see that type of thing . He is a weird guy. So why would i believe the gun went off accidentally . Effective today, my administration is officially declaring the Opioid Crisis a national Public Health emergency under federal law. Reporter drug overdoses are now the leading cause of death in americans under the age of 50. More die from opioids than die in automobile accidents and gun homicides each year. The numbers are staggering. Last year, we lost at least 64,000 americans to overdoses. Thats 175 lost american lives per day. Thats 7 lost lives per hour. Reporter todays declaration does not allocate funds towards the war on drugs but federal agencies will be directed to devote more grant money already in their budget to the problem. That drew criticism. What i would say to the president on that is, show me the money. The president has a budget here that cuts medicaid which is the major funder of, um, how we address opioids. Reporter some of mr. Trumps changes do include reducing regulatory barriers, expanding Telemedicine Services to reach rural communities, and more training for those that prescribe opiates. But he had a problem. He had a problem with alcohol. And he would tell me, dont drink. Reporter on a personal note, the president talked about his older brother, fred, whose life was cut short due to alcoholism. Mr. Trump listened to his advice and never had a drink. He is now hoping a massive antiopiate Advertising Campaign may save a generation from drugs. If we can teach young people and people generally not to start, its really, really easy not to take them. The bill would ban the sale of gun bump stocks, a device allowing a semiautomatic rifle to fire like an automatic, increasing the number of rounds shot at a target. Commonsense laws should be put in place to protect Police Officers and the citizens we serve. Reporter gunman Stephen Paddock allegedly used several weapons some augmented with bump stocks to spray bullets on a crowd of concertgoers. Paddock allegedly killed 58 people and wounded hundreds in the crime including some Police Officers. If as a country we hope to make any progress on making this a more understanding and safer country, it will take all of to us leave our comfort zones. Police officers, men and women serving in blue across the nation, are good guys. And they are trying to do the right thing. We need the support of everyone. University of california president Janet Napolitano announced plans to start a new center to study free speech and changing perspectives on the first amendment. It comes as ucberkeley and other campuses struggle with violent free speech debates. The center will be based at ucs washington, dc center. Fellows will research such issues as whether student views on free speech are changing and what role social media plays in shaping perspectives on the first amendment. In napa pg e responded to downed power lines on silverado trail. Officials shut down the trail just south of highway 28 after a Traffic Accident that left power lines across the road. Skyfox was over the scene this afternoon as pg e crews worked to get those power lines off of the road. Silverado trail was reopened around 4 p. M. The downtown power lines were not connected to the north bay fires, but the accident happened to be just miles from where the atlas fire started. In washington, the fbi is expected to release more information on a dossier that tried to link the president to russia ahead of the 2016 election. There are reports that indicate the Clinton Campaign and the dnc funded that dossier. House Speaker Paul Ryan says the house has been asking for the documents for weeks. The point of these investigations is to find the truth and to make sure if laws are violated or mistakes were maders this not made again and transparency is what gets you there. A win for republicans today as Congress Passed a budget plan by four votes. Will this pave the way for tax reform . Garrett tenney tells us the narrow vote could be a tough road ahead to get the bill passed. The motion is adopted. Reporter it was a close call for republicans on capitol hill with the house approving the budget for 2018. The budget blueprint sets the stage for an even bigger battle the effort to reform and simplify the tax code which will translate to big savings for the middle class. So much time and money is wasted just complying with this incredibly complicated tax code only to be rewarded by having a big part of their income taken and claimed by the government. Its unstainable. Reporter democrats predictably are saying just the opposite standing against the tax overhaul plan and casting it as a giveaway to rich americans. Its an assault. A ripoff, a shakedown, a lotting of the middle class. Reporter the narrow margin of victory could translate to a difficult road ahead for House Republicans on taxes. The budget passed despite protests by members in both parties from high tax states who object to the plan to eliminate deductions for state and local taxes. If the tax bill does make it through the thousands will need only 50 votes to pass in the senate where its attracting some unlikely bipartisan support. There has to be some adjustments. Governor brown along with lawmakers from other large states oppose the proposed removal of a federal Tax Deduction for state and local taxes. Many of the details of the white house tax plan remain fuzzy but some experts say middle and low income americans could be hit hard. It actually gives huge tax breaks to the wealthiest and to corporations, while actually, um, having very little if any benefit for low and middle income californians. 20 House Republicans voted against the budget plan. More than half were from new york and new jersey, high tax states that would be affected if the state Tax Deduction is in fact removed. The San Jose City council will vote next month on a new rent control measure. One tenants Rights Group Says its Research Shows a growing gap between rent and wages that is rapidly pushing many san jose families to the breaking point. The Group Announced the findings during a rally today outside San Jose City hall. The report is certain to fuel the rent control debate in san jose. The gap between what it takes to actually aford the average apartment in san jose versus what renters are making in san jose has grown by three times. Rent control when it first came out is something to me just not right in the long run. Its somebody telling you what you do with what you own. The report comes ahead of a november 14th city council vote. Members will be considering a measure to tie rent increases to the inflation rate. People skipping out on bart fares cost the agency up to 20 million a year. Coming up a plan to make riders prove they have a paid ticket. Coast guard confiscated more than 6500 pounds of cocaine off the coast of california in september and october. The seizure was the results of multiple operations by several crews. It will prevent them from going to the u. S. And central and south america. They were offloaded in san diego yesterday. A series of President Trumpss border wall models are up in san diego ready for testing. There will be recommendations about which prototypes will be replicated along the southern u. S. Border. One expert says a wall could be a worth while deterrent. One lesson that we have learned over time here is that when you put up physical barriers or fencing, the areas where you dont have fencing instantly become vulnerability. The bart board of directors is expected to approve a new ordinance tonight to fight fare cheating which is costing bart millions of dollars a year. Bart says the number of fare cheaters is on the rise and they estimate they are losing between 15 to 25 million a year as a result. They will vote on an ordinance to provide riders to provide valid proof payment. Right now the cop has to see you jumping over the fare gates to give you a ticket. Obviously we have lots of fare gates and a big system and cops cant be everywhere. With the new ordinance, we are probably going to adopt it tonight, anywhere in the system if you dont have a valid ticket, then youre going to get a fine. Bart police would be equipped with machines to scan your clipper cashed to make sure you paid. Offenders could face fines or community service. If approved, the ordinance starts in january. Theres a new mural in las vegas honoring the victims of the massacre there earlier this month. The mural features 58 hearts each one with the name of one of the victims. The artist says its a colorful display thats meant to honor the victims and their families. To the families who lost the victims, it puts out a message saying that vegas has got your back. The tragedy happened here but we as a people, we got your back, man. The mural took him and four other graffiti artists 17 hours to finish. He says he hopes the community will help preserve and protect it. A number of off duty california Police Officers who rushed to help others during that shooting in las vegas have filed workers comp. Claims. But its not clear if they will be able to collect. More than 200 Police Officers from Southern California were at the concert on october 1st when the shooting started. Some of the officers who filed claims were shot as they helped secure the area, performed cpr and got people to safety. Californias labor code says public agencies must pay benefits when offduty officers try to save lives or property in california. But it doesnt mention out of state activities. Ktvus tom vacar reports. Reporter remodeling contractor Charlie Mcavoy and his wife thought their home would be lost in the santa rosa fires. So they fled to their parents home a few miles away. There, they began a project of recovery. This nearly finished trailermounted 200squarefoot tiny home was to be their temporary home. But the fire spared their santa rosa home which sits very close to coffey park. The mcavoys, along with family, friends and subcontractors, then decided this home should for free go to someone who lost theirs. Were working with a woman who has been involved with our Sonoma County foster care system for decades and she is working with all her resources in that community to try to either put a family in the foster care system or somebody who works in the foster care system in this who didnt have insurance and is basically left with nothing. So when we knew that our house was going to be okay, we knew that we had to provide that comfort at least for somebody else. A homicide solved more than two years after a berkeley musician was shot and killed, police have identified the killer. Police say they have enough evidence but theres a good reason why they cant prosecute the suspects. We get details from ktvus Cristina Rendon in the newsroom. Reporter frank, heather, Oakland Police and the fbi have told us that after many interviews with witnesses, coupled with Video Surveillance and help from the media, they were able to identify the shooter. The only problem is that the suspect is dead. [ music ] reporter its been 2. 5 years since the killing of berkeley musician amile llanos nevarez. He had finished a performance and was hit by a stray bullet. The unintended victim of a gunman arguing with another person nearby. Its tragic. It was a sad case. Reporter Sergeant Molina has been on the case from the beginning and can now say its been solved. Within the past month, police and the fbi identified the shooter, a 24yearold man. The thing about this case is that mr. Jamison is dead. Reporter he died in a car crash in november of last year as he was fleeing from authorities in placer
