Officers arrived they found the woman with a gunshot wound to her neck. They dont believe the uber driver or passengers were the intended targets. But its not clear who the shooter was aiming for. We do believe the correct driver uber driver and passengers were an Innocent Party caught in the crossfire and happen to be in the wrong place at the wrong time. Reporter a second car was hit by bullets and a third car crashed into the second car. No one else was hurt in the shooting. And uber spokesman said they are checking on the writers and drivers to make sure everyone is okay. They are ready to help chp if needed. But the judge is going to try hard to keep it out. Its going to be the goal with respect to jury selection, that is what lawyers have been trying to do to make sure they have people who will focus on the evidence and issues and not the extraneous material. The judge has said politics and immigration are not part of the trial. What does that mean . Anytime those issues come up he will cut it off . Im sure the judges talk to the lawyers. Making sure they dont ask improper questions about those issues once the trial starts. The Opening Statements are kept far from those issues. The judge is going to keep it on the straight and narrow. When it comes to jury instruction, they will focus on, here is the law on the charges and prosecution they wanted to focus on. At the same time, in the jury questionnaire, which i have here, there are a lot of questions about immigration and sanctuary cities. San francisco is a sanctuary city. What is your opinion of this . And how do you feel about people who dont speak english . Have you ever worked for an immigrant rights group are you aware of one . All of those things are brought up brought up in the questionnaire. How are attorneys on both sides weeding through this. With their trying to do is weed people out in a couple different ways. One is whats called a challenge for cause. Someone who may say caught my feelings are so strong i cant be fair to one side or the other. The other would be a challenge where the lawyers dont have to give specific reasons but they can say, my feeling is i dont want this person. There are limits, you cant exclude someone on the base of race, religion or national origin. But otherwise you can go with your gut sense. Each side is trying to get an impartial jury. They tried to use the information in the jury questionnaire to root out any potential areas of bias and find people who to the best of their ability, they will focus on the evidence, they will put aside the publicity around the case and all the rest. Focusing on what happened in the courtroom. Its possible someone who believes in century cities and who believes in immigrants being able to come here and work, regardless of their status, could still convict him of murder . Absolutely. Number 1, you hope the people answer the questions answer them honestly. And they answer them honestly in the jury box. Number 2, you try to get people to put aside any extraneous material and to focus on the evidence. In this case i think its probably possible to do that because the core of the evidence is going to be about the gun, and the intent of the defendant. With respect to the gun, the issue is could possibly have gone off in an accidental way or is the only possible way that this could go off, someone had to shoot it . The other of course is the direction of the bullet. We have the odd circumstance that the bullet ricocheted off the sidewalk. That helps support the defendant. The jury is going to be focusing a lot on the forensic evidence. It isnt a question of exactly what happened or who did it. Its a focus on this particular defendant intent when this happened. If its determined by the jury that this was an accidental shooting, isnt there still some culpability . Someone picks up a gun and even accidentally discharges that, isnt there an issue or a crime committed . Know. The charges no. The charges are such that it wouldnt be the case. If you were reckless in the use of the gun, we dont know that this was the case. The story is he found it under a bench. Lets say the jury believes that. Did he do with the gun, and he carefully opened up the package . Or was he spitting around, what was he doing . If he was using the gun recklessly, the net would be a lesser offense. If you deliberately shot, maybe he wasnt shooting for kate steinle but a crowd, he would be guilty of murder. But if its clearly an accident, and the juryesque steps the conclusion, and the jury accepts the conclusion, the verdict would be not guilty. We will keep an eye on it. Thank you.
