[ indiscernible ] reporter Carlos Francies drowned yesterday after trying to help a friend he thought was in trouble at the water at lake tahoe. The Lake Tahoe Police Department Said he was kayaking here. He swam to a friend who he thought was in distress. He was a great deputy. Reporter he worked that Contra Costa County Sheriffs Department for three years but spent time in rancho cordova. He was the older brother. And he came back to help coach football and track. He kept up for years with younger friends. Every time he came out he would make sure to visit me. Make sure i stayed on top of my grades. Reporter his friends are shocked to lose him but not surprised to learn what he was doing when he died. He wanted to help people. The Contra Costa County Sheriffs Department is working with the deputys family for a memorial service. Following breaking news. This is a live picture from sky fox 2 of a fire that broke out this evening near north gate mall, just below the hill. The fire broke out a half hour ago. Firefighters got the flames under control. Ktvus ross palombo was near the scene and said a concern was a senior community. Residents of the community were not evacuated. The fire is now under control. Evacuations remain in effect because of the jerusalem fire near clear lake. Officials say crews made progress there. Tonight the wildfire is 52 contained. It started on sunday and burned 25,000 acres. Cal fire says right now there are 2,000 firefighters on the fire lines. They hope to have the fire contained by monday. Demonstration is set for this hour following the Police Shooting wednesday of a Armed Robbery suspect. Authorities say there is clear evidence the gunman posed a threat to officers and bystanders. Business owners say they are optimistic that any demonstration will be peaceful. Store owners dont seem to be boarding up windows. Police are prepared to respond if demonstrations get out of control. One Business Owner was hoping for the best. We hope that everything stays peaceful and if it turns up not to be Peaceful Police will arrest people who cause harm to others. The mayor yesterday issued a statement saying the violence wednesday was unacceptable but it was a challenge for police because many officers were investigating the original shooting. New developments now from ktvus ann rubin. Now this agreement could help attract new recruits. Reporter there were two parts. First was the labor agreement. The second involved how to get rid of measure b. And with a plan in place both sides say the process of rebuilding the Police Department can begin. [ cheers and applause ] reporter at a ceremony this afternoon the San Jose Police gained 18 new officers. 400 left in the after math of measure b. Makes it competitive again. Today an agreement, 8 pay increase and one 5 pay intensive. Today we can tell our Police Officers it was worth it. And it will be worth it. The most comlicated part has been about pension reform. Both sides announced measure b will be invalidated. Officials say it will be replaced by a new ordinance that will save 1. 7 billion over 30 years. We are ensuring taxpayers are protected at the same time that we are reducing burdens employees are paying for the benefits. The hope is the changes will make it easier for the Police Department to recruit new officers and bring former ones back. It can happen. It gives them faith. And they go out knowing they have a brighter future. Reporter Union Members have till monday evening to vote on the deal. It would then go back to the city counsel for final approval on tuesday. Live in san jose, ann rubin, ktvu fox 2 news. A judge refused to grant permission for doctors to assist terminally ill patients to die. One of the patients flew to the bay area for the hearing. She battling stage four lung cancer. She is in constant pain and she and other terminally ill patients deserve the right to choose how and when to end their lives. I am not the only one that will have a young child watch me die. In a painful manner. In the end the judge decided 140 years of law should stand. Patients say they will continue their battle in hospitals and in court. Coming up, a controversy in San Francisco putting the futures of dozens of new grads on hold. The board of education is olden an imagination meeting. They are trying to decide whether to change the graduation requirements by eliminating the High School Graduation exam. She needed to pass the High School Exit exam as a requirement. She planned to take the test in july but the state canceled the test. That leaves her and 103 others without High School Diplomas and without that they cant continue on to college. [ indiscernible ] reporter San Francisco School Superintendent says the test is irrelevant, it is being discontinued and students deserve to graduate. They are students of [ indiscernible ] some are immigrants to the united states. Reporter he is asking the board to eliminate the test for a requirement for graduation which law makers are poised to do but it wont be ready before students need to Start College but removing the requirement goes against the law. Yet the superintendent will get [ indiscernible ] we would rather take the risk and stand with the students. Reporter they seem to support the change. As a matter of doing had right thing. The right thing. Reporter Officials Say if the School District eliminates the exit exam they can admit the students this fall.
