Jail infirmary this morning. He was charged with discharging a firearm and homicide, with murder of a police officer, lying in waiters, and drive by. Dozens of members of the Hayward Police department stood in court for the appearance, including the chief of police herself. She stood just a couple of feet away from his mother and family. She feels terribly for the loss of Sergeant Scott lunger. She says she feels sorry for his family, but she says her son didnt do it. Im devastated for the whole thing, devastated for the officer who passed away, devastated for my son. But i believe in god. And i believe that while this investigation goes on, my son will be cleared. Reporter she didnt have a lot of details exactly why she thought her son would be cleared. After the hearing, we tried to talk with the chief of police. But dozens of Police Officers filed out of Court Without speak. But we do now have our First Official narrative of what happened during the shooting. So lungers partner told investigators they pulled over the truck and nearly hit cars. His partner says he heard a brief conversation, then a boom. The officer collapsed to the ground, and the partner started to fire up the truck and drive away. He died of his injuries. The suspect showed up at a san leandro hospital with a gunshot to his side. After estrada showed up at the hospital, they searched his home. And that appears to be the source of the video. That shows the sedan pulling up and one getting out with a visible limp, possibly the suspect. They say they turned up a. 9 millimeter ammunition and found the gun used in the attack. Lunger was in court today. He was represented by an attorney but he is due back in Court Next Month for his next appearance. Thanks, christen. I read the charging docs. I have them in my hand. What have you learned more about the suspect and what happened that night . Reporter the suspect says he was shot in hayward. But when the doctors at san leandro hospital were trying to ask him more about that, he said he would refuse to say who shot him. So not a lot of details so far in his story coming up. But he does say he was shot somewhere in hayward. So he has not said he was at the scene of the shooting. But he is offered few details on it. Do we know anymore about the brief conversation between Sergeant Lunger and the suspect . At first we were reporting it seemed like it happened very quickly as helps approaching the vehicle. But as he was approaching the vehicle, but there were words exchanged . Reporter thats what im getting as i read the probable cause warrant. It offers some details about it and says there was a brief conversation. Again, this is coming from Sergeant Lungers partner who was there. And he said there was a brief conversation of some type. Then the boom, presumably a gunshot, and then saw him go to the ground and firing from the silverado. Thank you for that report. Gunfire erupts inside a Movie Theater. Two women were killed and other injuries. Were learning more jude. Were learning more about the injured. Were learning more about the shooter. We find that the shooter planned this methodically and even visited the Movie Theater before the attack. Reporter a fun thursday night turned horrific as an Innocent Group was gunned down as they were watching a movie. Authorities say this man, john russell house houser bought a ticket to train wreck, and about 20 minutes in, pulled up and stood up and pulled out a semiautomatic handgun and fired. How does that cause a man with so hate and evil to stand up and shoot people in a Movie Theater . What provokes somebody to do that . At first, moviegoers thought it was part of the movie. I saw blood and then i just ran. Reporter Julie Johnson was a local business member. Her family says their hearts are shattered. Nine others were wounded. One remains in critical condition. Authorities believe houser tried to blend in the crowd, rushing out of the theater, but saw officers and went back inside. We know he had at least one additional magazine which he dropped in the lobby. Hi reinserted, reloaded, and returned back into the theater, at which point we think he fired an additional round which was into himself. Investigators are now digging into his past. They say the 59yearold was a drifter, born in phenix city, alabama. They found in his home what they believe were disguises for after the shooting. Think showed documents that his wife filed for a protective order in 2008 alleging he committed acts of family violence, which moved her to remove all guns in their house. In 8 and 9 he was treated for mental illness. So that should have stopped him from buying a weapon. Reporter theyre moving methodically with their investigation at the same time. Theyre saying that two teachers, without a doubt, saved lives. Thank you. Other top headlines today. Firefighters are finally making significant progress against the wragg fire in napa and solana counties. Residents returned home after evacuation orders were called off 50 of 100 homes. You can see above the fire. Right new, mostly smoke at this point. The fire fight goes on. So far, the fire has burned more than 7,000 acres since it broke on wednesday. Its now 20 contained. Officials say the most active part is a remote area that feeds into the park. The federal government is now investigating five airlines to see if they took vallejo of the philadelphia am track derailment in may by raising prices. Southwest, american, and jet blue were at the center of the investigation. The amtrak crash killed eight people and injured about 200 others. Investigators are still trying to determine where the train was going more than 100 Miles Per Hour when it derailed. Fiat chrysler is recalling 1. 4 million trucks and cars after hackers were able to take control of a jeep over the internet. The company says it plans to update its software to keep the vehicles from being remotely controlled. They say theyve taken Network Level security measures to prevent hacking, but those measures dont require any customer action. For your saturday, the breakdown throughout the day, 7 00, 60 degrees on track to reach the lower 90s with winds approaching 12, possibly 15 Miles Per Hour by about 4 00, 5 00 tomorrow afternoon. Right now, though, on the satellite, the satellite perspective, we are in the clear right now over northern california. Well come in closely here toward the bay area. Today in the four by four, were taking four minutes at 4 00 to take a look at the push to legalize Recreational Marijuana in california. Joining me now is dale sky jones, part of commission for cannabis reform. Lets talk about your initiative, specifically what it says, kind of the highlights and what separates it from the few other initiatives that are also trying to get on the 2016 ballot. I think the most important aspect about reform california is the long view that weve taken. Weve been doing our homework for 2 1 2 years now. And its culminating in the same homework our governor has done in his two years of homework. And what that means is hours of times with stake holders, community leaders, officials, and thought leaders to make sure were getting this right and for the right reasons. And this week, the blue ribbon commission, which the governor led up and down the state, gaining all this impact on this exact issue, came out with dozens of recommendations. Really kind of urging tight regulations. I mean, he wants to protect small businesses, protect the youth. I know the Lieutenant Governor doesnt want this to be the next golf rush. Ill talk about what he said a few days ago about the recommendation. And lets play it. As a group, we dont want to maximize revenue and create a in industry for two reasons. Both are predicated on heavy use, increasing use. We want, certainly, tax revenue. But its not a priority, a goal. Were explicit about advertising bans and marketing bans within constitutional guidelines. Were very specific about protecting small cultivators and retailors against the corporateisig of big tobacco. Those are his comments of not becoming the next next gold rush. I think its exciting for the advocates trying to change cannabis policy to have such a post. The blue ribbon report has given us parameters of whatnot to do and the best way to get it done. Number one this, should not be a cash cow. And all that will do is continue to push business in the black market as well. So there are multiple benefits to not turning into into the next cash cow. Lets talk about the pulse of california. Prop 19 back in 2010. I believe we have a graphic here on the results of that. It wasnt a president ial election year. But still californians had the opportunity to vote on whether or not to reelize marijuana. You can see here 53 1 2 said, no way. 46 1 2 said, yes. And then the they put out a poll, 55 of voters said that marijuana should be legalized. Do you think the tide is turning . The height has changed. And 2010, keep in mind, the first time a lot of it was even asked. A lot of folks were like, what do you mean . [ laughter ] the same Public Policy of california poll showed most parent with children are still opposed to legalizing the recreational use, one being roger morgan. I know hes pushing a measure opposite of yours. He spoke to reporters last week about his measure. Lets hear what roger had to say. We should be doing Everything Possible to prevent the use of marijuana, not open the barn door and legalize it so that everybody can get it easier, like alcohol and tobacco. We should have learned something from those two legal drugs that we dont need a third. Calling marijuana a gateway drug. I think he even referenced later in that interview, his own children in that day were smoking marijuana and eventually went to meth. So. Well, its unfortunate about his children. But lets not forget the Bigger Picture here. Number one, the Health Organization and institute of medicine have agreed this being a gateway drug is really good marketing in the nixon area. Its false and ingenerallous to think the enginous to think the drug dealers will market your children. Cannabis is the largest cash crop in california. We should be enjoying the tax dollars and benefits of this, not building more prisons but schools. And education will be the key to keep people off of drugs. And, you know, frankly just contributing members of society. What about washington, colorado . There are opponents that have said since its legal in the state that the black market has not reduced but spiked. And i mean specifically the sales to minors. People growing marijuana in those states and then packing up to states where its illegal and selling the marijuana. Have you learned some things from colorado and washington . Well, id like to see the proof indicating that the black market has even stayed the same, never mind increased. I think this is the same disengeneral white house scare tactics. But we do know disengenuous scare tactics. And even if you are concerned about emergency room visits, its important to find that cannabis is not lethal. So theyre walking out of the emergency room unlike the prescription pill epidemic we are. This is an opportunity to have Safer Communities if we control cannabis for adulters. So the language adults. So is the language finalized . No, it is not. We wanted to make sure were the responsible group. Its a formidable report. Its taking a while to look at the contents and bounce it off.
