He is awaiting his legal fate. In a jailhouse interview he confessed to the shooting but said it was an accident. That he found a gun wrapped in a shirt. When he picked it up it went off three times and he accidentally shot her. He was handed over to the Sheriffs Department by immigrations and customs enforcement. That was in march to face drug charges. Those charges were dropped by a judge and he was allowed to go free. They said they take this case and others very seriously. They said quote bottom line if local authorities had no [ indiscernible ] to the Community Ice could have taken custody of him and had him removed from the country plus preventing this terrible tragedy. It goes onto say ice desperately wants local Law Enforcement agencies to work with us so we can stop the needless violence in the community. We talked with the chief Legal Counsel for the Sheriffs Department a few hours ago. In this case they knew that. We did not. They could have taken measures when they brought him here to make sure that there was a warrant or a judicial order which we would honor. Now the Sheriffs Department goes onto say they will certainly be reviewing this case. Given the citys policy and whats on the books right now in terms of the law they would not have done anything differently. Its certainly going to make a lot of people second guess and maybe take another look at whats happening right now. Not just in San Francisco but about 300 places around the area that do that as well. Why did ice just not deport sanchez to begin with . Why did they go through this process to hand him over on this drug charge . Did they address that in the statement at all . They didnt address it directly in the statement just that he had outstanding charges hear that were really quite old and ended up being dropped by the judge. Then, because there was no formal hold and no warrant for his arrest and the citys policy of not Holding Someone without those things, he was then released on to the street. I also heard the sheriff talking today saying that ice knew the rules they understood that we are going to follow or local laws. Why didnt ice the sheriff questioning why didnt they get account order to say they must hand to her suspect. They are asking that same question. There is a lot of finger pointing going on here. My phone just vibrated. I got an update from the District Attorneys Office saying no update yet so no charges have been filed yet in this case. All right thank you for that. Lets two right now to alley. Shes joining us with a look at the politics behind these sanctuary cities. They are both local and state laws that play here. Can you break it down for us . Shower. San francisco has had a sanctuary policy in affect since the 1980s. County and city officials can be used to corporate with immigration officials to detain somebody simply because of their immigration status. They took this is a step further in 2013 passing it and then they signed into law an ordinance that says only a person suspect of committing a violent felony or serious felony can the county contact ice to notify them that person is in their custody. Even in those circumstances the ordinance says its up to the sheriffs discretion to decide whether or not they want to corporate or come mine kate with with communicate with ice about that person. The exception that that state law makes is that only if a perp is suspected of person is suspect of committing a violent felony they can hold them for 24 hours. Even though there is that state law in affect some counties have found ways to get around it. However that is not the case here in San Francisco. Discussion about changing the citys ordinance have you heard anything about that . Well the mayor put out a statement this afternoon and base thoond statement he wasnt talking to report based on that statement, he was taking to reporters about this. He said hes concerned about the circumstances that led to the release of sanchez. He said that the sanctuary law and policy here in San Francisco is meant protect residents and people regardless of their immigration status. Its not intended to quote protect repeat and violent felons. We also spent sometime talking to the supervisor here who voted for that ordinance in 2013. He says hes very sorry about what happened to steinle but he said this is a policy that San Francisco has had for many years. Its worked for a majority for many years. He said just because trump is tweeting about it doesnt mean they are going to change their policy now. Thank you. This is not the first high profiled case that called into question to question the citys policy. They were shot and killed in 2008 in a drive by shooting in San Francisco. Known gang member was later convicted of those murders. He was in the country illegally. You were part of a team, that represented the family. Your team did not even wait to those convictions. You actually filed suit against the city soon after the murder thats correct. We filed a claim and a lawsuit shortly after the killings happened. What happened to the lawsuit . The arguments were that the city had violated some state laws that would have, a mandated that will be reported to ice. And there was a federal law that prohibited the city from having any statues that interfered with the requirement thats a city would have to ice. We are guyed the city violated argued that the city violated both of those laws. The case was ultimately thrown out. Is San Francisco shielding criminals in your opinion through this ordinance . The remarkable thing i learned today is the week that San Francisco passed their new ordinance, the new ordinance almost completely restricts the sheriffs from being able to report someone to ice whos in the sheriffs custody. Before the sheriff can report someone to ice the person has to already have a violent felony conviction, they also have to have a magistrate determine that theres probable cause to believe they are guilty of another violent felony. Even if those two conditions are met the sheriff has to consider whether the person is a good candidate for rehabilitation. If none of those three things are present only then can the sheriff hold the person beyond their regular hold and release them to ice. The state law that was passed the same week as the San Francisco ordinance gives much more discretion to Law Enforcement authorities. Turned state law somebody who is convicted of vandalism, or drug possessions they could be held over for ice. You have read the story about kate. You heard about it. From a legal point of view, does her family have a case if they decide know what you have been through . This is a really gl answer. Perhaps. Legal answer. Perhaps. [ indiscernible ] against the city. I just know right now House Republicans in d. C. Are threatened to with hold federal funding to any sanctuary cities out there. We will see how far that goes. People should check to see if the apartment is on the rent control. It gives you property map. You type in the address and scroll down, it will tell you when the building was built. It will tell you how many units. Its its more than one unit its under rent control. You should check that to see if you are protected. You should also check there if you moving into a singlefamily dwelling. You know there is two that means your unit is probably illegal. You should know that up front. You still have the same rights as any other tenant. Theres a risk if that unit got reported theres a risk you could get evicted. Its useful to check that out. If i own a coffee shop i chould charge 3 or 4 could charge 3 or 4 why are landlords doing that in. It reduces diversity in our city.
