Well, live remarks from investigators coming up in just minutes. From the bay station, youre watching kron. And news. Thank you so much for joining us here on kron. 4 news at noon. Im stephanie lin. Lets check in on our forecast as we take a live look outside at this beautiful scene right here about coit tower right there. Looking a bit overcast and just a bit breezy as well. Lets check in now with kron 4 meteorologist kyla grogan who is tracking all those conditions for were starting off a little cloudy again. Get another cool day today before things start to change as we get into tomorrow. Lets start with a look around the state right now. You can see la sitting about 82 degrees, a little warmth down there. Phoenix, 105, certainly of work in the Desert Southwest Santa Barbara about 74 and reading about 83 degrees. So were going to have a mild day today because of that cloud cover because we started off with that marine layer thats going to be eventually starting to compress when we start to warm up. But today, yeah, were still in the 50s and San Francisco 60s in oakland and you can see just low 70s from san jose to livermore, right on up to santa rosa. So again, well be looking out for that fog to clear a little bit as we get into the afternoon. Im taking you down to about 3 oclock notice. Its clinging to the coast in parts of the peninsula just like it did yesterday. But east day in land and also north bay and south bay should be looking pretty good. Then its going to rebuild in tonight. But tomorrow we will start off a little foggy and then she get a little bit more of a break. A little bit for tomorrow as we start to get back to kind of more seasonal temperatures. So today were looking out for those inland low 80s. Again, very similar yesterday. Kind of those upper 60s, low 70s around the bay and about that low temperature for out of the coast. But then notice by friday were going to move into a space of where we should be kind of normal seasonal temperatures, upper 80s inland. And then we kind of get into some heat saturday and it continues for sunday and monday. Going back a little bit. Well talk more about that in our extended forecast. But a cool day on tap today. And then ive got some triple digit heat in the extended forecast. Well have details on that when come back in just a bit for now. Send it back to stephanie. All right. Looking forward to that update. Kyler. Thank you. And today, former President Donald Trump appears before another federal judge this time. To answer charges that he conspired to subvert the results of the 2020 president ial election. Our washington correspondent Trevor Shirley is in dc with that. Former President Donald Trump faces 4 felony criminal counts in this indictment. And todays arraignment now marks his 3rd appearance before a judge this year. Those federal criminal counts include conspiracy, obstruction in denial of Voting Rights in whats arguably the most serious criminal case. Former President Trump currently faces. We have never had a situation where a sitting president is accused of plotting basically the overthrow of democracy. And we will continue our coverage of president and that january 6 arraignment in just a moment here for now, we want to take you live to these remarks being provided by officials on a hazmat situation thats happening in san pablo. Thats forced the evacuation of a community there. And im here today with a rep other representatives from our first responders. And i want to start by saying the whole response here has really been a cooperative effort of a number of local agencies, including Contra Costa County fire. Richmond fire Contra Costa County Hazardous Materials, which is part of our health department. The walnut creek bomb squad is here. The city of San Pablo Police department. And the fbi bomb squad is now on scene. And youll hear more about that. I think really the whole response here has been about really first protecting Public Safety, which is there was an evacuation zone yesterday. Youll be hearing today that the evacuation zone is going to be reduced in size this afternoon that we are working also with the red cross individuals chosen to go to the gym in contra costa to stay overnight or seek any help from the red individuals can go there the whole effort has been to really address the explosive chemicals that are on scene at the house and to protect Public Safety and to do it in a way gets residents safely back into their homes in this community. So with that, im going to turn it over to captain toler of Contra Costa County fire. And then youll hear also from a stamp at the police department. Thank you. Supposed to do my first name is chris c h r i s last name is toler t o t r. And im a captain with Contra Costa County Fire Protection district. Just a brief update. And a yesterday morning, approximately 10, 30, we received a call of a gas leak. Once we got on scene, we discovered that we had major Hazardous Materials incident. Started called inappropriate resources to mitigate that incident cs. Now we have multiple agencies on scene to assist us and that effort. So with that, you have any more additional questions. Ill be happy to answer questions. A lot on this may be formed by what happened the last last year where we something i cant speak to what the other agencies and there policies, protocols and for Contra Costa County response for major Hazardous Materials incident. Its just what you see here. We dont know the quantities. We dont know the exact types. We dont know the names of all the chemicals that are found. We know that they span all classes of Hazardous Materials in various quantities varias improper containers inbox. We dont know the exact time as to how long theyve been you right now. Right now, the bomb techs and hazmat tax are testing to find out exactly in rying to identify exactly the product that they havent seen with that they have to contain stick stabilizing, contain transport and properly dispose of those items. Most of the families in the evacuation zone. We dont know exactly where they but we do Contra Costa College gym set up red cross says it received them if theyre affected by the evacuation. Want to express it in that we really appreciate their patience. Were trying the best we can to get them back in their homes as supervisor. Joy just stated, we are going to shrink the evacuation zone here pretty soon. And were also going Police Escort during our down time. 2 residents on and stanton under Police Escort. Were going to go ahead allow 2hem to get vital items is important items out of their homes. I dont know how much material as has been removed far as percentages of. What was in the store said, we do know that some have been removed, but we dont want to give a number because that could change. It contains between the start of this press conference and now so we are probably a little less than halfway done with the materials moved in that store to a proper disposal site. Initial call was for. Was there actually a gas leak or was it it was a odor of gas. All the people that we dont know. Were still trying to identify the individual lived in the home. We know he passed away approximately approximately 6 months ago and thats from unofficial sources from his neighbors. We do know that his brother has been on scene. Hes been assisting trying to give us some information. We dont have the owner. We do have the brother of the owner. It was the one that was attempting to remove and or clean up the property. And thats what initiated the people. The individual that owned has passed away. His brother was on scene moving the product moving and trying to clean up the property. And with he was advised to i want to call. Because there was a strange odor. It was approximately 6 months ago and i cant speak to that. I dont know background. Was there can officially speak to that. Weve had conflicting reports as to who he is. Types of Hazardous Materials. It . Extensive . Really to to put they they range up and down our classes of what we consider has materials exposes one doubles things of that nature. The reason we have to be so careful and methodical. We have mislabeling it containers. We have mislabeling of the boxes. Dont know product is in that actual container the product has been identified as being light sensitive. Most insensitive water, reactive. And what that means is if light hits that particular. Product or that particular liquid, it could cause a Chemical Reaction and due to the improper storage. We have a lot of different chemicals stored together. So were trying. Okay. So we were just listening to officials give and a live update on that hazmat situation that started in san pablo in a community in san pablo on wednesday. Just to recap here of us all started yesterday morning around 10, 30 officers responded to calls of a potential gas leak once they arrived on the property, they found what the captain we were just hearing from described as a major Hazardous Materials incident as of this point officials, they still dont know what quantities are exact types of hazardous chemicals were found. They are working to investigate that. But they did say that those items were held in improper containers and boxes. Its unclear how long those chemicals were at the site officials also said that bomb techs are testing and trying to understand what products are on the property. And theyre also working to stabilizing contain that situation in terms of the families in the evacuation zone. Could only say that there is an Evacuation Center that is still open for people who need it. Thats at Contra Costa Community gym at twentysix 100 mission bell drive. That is open to evacuees. And the other significant update here is that the of that property had passed away about 6 months ago. We were told by officials there that the brother of that resident has been in touch with officers. He was apparently moving those chemicals on site when he was advised that there was a strange odor coming from those chemicals and he was advised to call 911. Lets talk about our forecast now taking a live look outside at mount tam gorgeous view of the bay area from here. Love seeing that green hillside in a court. Of course. The clouds up above kyla. Yeah, i have. That was behind me, too, because it looks so right . Its kind of cool to see the marine layer just hanging out right and thats the story. As we started our day today as we started a little cloudy, a little cool, kind of like we did yesterday. Its been this pattern that weve been in so far this week, really. And were going to see that. And as we get into tomorrow. But right now, certainly temperatures are cool out of the coast just in the 50s. You can see that same story in San Francisco, but weve got some 70s out. Theres a popup inland because we are going to warm up today kind of to where we were yesterday just below average temperatures but still should be a pretty nice day out there. Little bit of a breeze going right now. Fairfield, about 50 Miles Per Hour in concord about 17. So watch out for that. As you walk out the door, low pressure still to the northwest, High Pressure down over really the its the southwest. But its kind of nudged over into the southern central part of the country. And that is going to be on the move. And thats why our forecast is going to change. But today we are still going to be hanging out with the marine layer, particularly along the coast today. And temperatures today, as you can see out of the coastal just be about 60 degrees. We will see some low 80s as we head inland in the north bay and the east bay. Lot of 60s and 70s out there. But the bigger stories weve got some heat coming now. No watches or warnings here in i should say northern california, although this is a red flag warning in the very top northeast for that just went up and also in oregon because theyve got fireprone conditions there. But the heat advisories, the heat watches and warnings have gone up for parts of southern california, including palm springs. And this is saturday through monday evening. That is the same time frame that were going to be looking out for some heat as well. And you can see it in our extended forecast, though, no watches or warnings up at this moment. But you can see saturday sunday, monday, were going to get up there. Its not too long of a stretch, but it is certainly going to be some kind of nasty heat for those of you who are in love to just be prepared for that as we head into the weekend, it does not last long. As i mentioned by tuesday, were coming right down the hill back into the 80s. Back to all right, cuyler, thank you for that update. Targeted at obstructing bedrock function of the u. S. Government. Theyre not taking this white house. Were going to fight like missions process of collecting counting and certifying shall be deemed sufficient declaration. The results of the president ial election. He is accused of trying to overthrow the 2020 election using fraudulent means, as they say in the indictment. Former President Donald Trump arrived at the washington, d. C. Courthouse just a few moments ago. Weve got a live look. This is mostly going to be invisible to us. Hes going in did go into an underground garage is being processed when he he will be processed and fingerprinted that presumably happening now. He is going to answer to the indictment charging him with 4 felony counts related to his efforts to undo the president ial election loss. Hello, everyone. Were continuing to watch this thank you for joining us for this kron. 4 special report. Donald trump, the 45th president of the United States being placed under arrest for the 3rd time this year in this latest criminal case, he is facing 4 felony charges, conspiracy to defraud the United States conspiracy to obstruct an official proceeding, obstruction of an attempt to obstruct an official proceeding and conspiracy against rights. A you know that trump has been very publicly defiant, even suggestintoday that he is proud, honored to face this fight. He and his supporters consider to be another politically motivated prosecution. Kron. 4 political analyst michael yaki is with me. Hes been sitting here quietly not for long. I suspect michael, in what ways. I mean, this is somber, regardless of political affiliation to see a former u. S. President arrested, rained all of that unfolding. Now. What are your thoughts . Well, as you said, this is unprecedented and indeed some ways very, very somber day for the United States. Youve never had a situation where a former president has been accused of attempting to essentially subvert american democracy and your 3 counts of conspiracy. One count of actually attempting a bizarre actually obstructing the official proceeding, which is the which was the certification of the ballots on january 6th. And so this all comes down in many ways in terms of emotion to the events january 6, everything that the prosecutions talking about led up to that. But really, for think most americans, its really about. Redemption. Justice, whatever you want to call it for the events january you touched on this. But in what ways is this really uncharted territory . Well, its uncharted because one you have a former president to the former president is running for president again, 3, its in the middle of the president ial season and for hes got 3 other 2 other proceedings, possibly 3 other proceedings that will be going on at the same time, hes already been arrested and charged with. In the federal court in miami regarding the retention and now destruction of classified documents. Hes got the the tax case anew in new york city. He may have the electoral case in georgia, possibly as early as next week. But this is sort of the big one. This is one that that again emanates from the shock and the trauma the horror that all of us experience in january 6 and whether or not he is someone who will be held accountable to it or not. And again, hes presumed innocent hill and 2 until Proven Guilty by a jury of his peers beyond a reasonable doubt. This is something where he has the ability to make his case. And so we will see whether or not people who want just a scatter of people who think this is a something else. Find that out you made me think of former Vice President mike pence this week. And some ways saying, hey, as you just did, presume innocence until proven otherwise. But he also had one of the pit, the airlines and the whole week talking about trumps crackpot lawyers saying what his cheat years wanted to saying. It was like, you know, one of those notable of the week, but we havent really seen a lot of republican leadership. Obviously, Chris Christie, asa hutchinson, those are exceptions. Not really a lot of them speaking up. Are they ctill afraid of donald trump . Well, one, theyre not really afraid donald trump as much as they are afraid of alienating. That core. 33 35 of the Republican Base that can be the difference between winning the the republican primary or not so use have people like ron desantis anothers pretty much parroting the donald trump line people like nick ailing Chris Christie or will her down at the 1, 2 , level, you know, trying to make a difference trying to different themselves. Of course, mike pence, who could and should be youre the biggest beneficiary of what is happening. Hes waiting to see if hes going to get that bounce or not. You wonder, though, michael, and this is about law, but its also about politics. Trumps supporters, if the needle hasnt really been moving at this point, what chance to trumps republican rivals half and primary . Well, if you go by, if you go by the polls right now, theres really almost 0 chance. I mean, the lead is so big and so large in the primaries, our are getting closer and closer and again, who makes up the primaries and whether or not people who think that they want to vote for someone else are turned off by the fact it seems insurmountable, you know, could make it a selffulfilling prophecy. But the question does what its more about the general election . I think does this is this someone who could possibly be convicted prior to the election, you know, the pain of which court goes first, which which is proceeding gets gets priority. You could have again unprecedented times. The in preston and conviction of a former president who running for president of the United States. Yeah. We were looking earlier just live views outside the courtroom. At least earlier, michael, it didnt seem to have the large numbers of trump fans out there that they did the first time, although that could change is this goes on. Well see. We do have a delegate for the California Democratic party. He is former president of the United Democratic club. And were talking about corey smith. Weve talked a core smith in the past corey, if youre what are you watching for as all of this unfolds today . Good afternoon. I you know, as as he was an earlier, truly, sad for the for this country for the united kind of proceeding forward with the news about former President Trump. Obviously deserves the right to a fair trial and presumed but but, you know, says jack smith and others put for the the evidence will speak for itself. And i look forward to that. The evidence coming out and seeing if the president did, in fact, break the law. If so, what would that the Commission State . Corey, i dont know if you read the indictment, but were getting decent idea where the defense is going. Some idea anyway being used dilution defense. Thats not my term. But the argument that trump actually believed he had won the election. Do you see going anywhere . I the president did very, very good job president in a really good job of both towing the line and for some some reason being able to cross the line at the exact same i think he was very deliberate in his words in january 6, certainly leading up to that. And then subsequently you know, if that is in fact, his defense, how the Republican Party and potentially nominee trump will also then make the case to voters that while hes delusional on one side and should also be the president of the United States after the 2024 election seems inconsistent. But you know, many of the president s comments in the past have been inconsistent, my opinion, lacked any sort of coherent thought. And so its worked for him. Unfortunately, in the past. And it is togally possible that it may work for him again in the future. Prosecutors clearly saw that defense coming korea. The indictment is very specific. It also includes a references to or trump supposedly acknowledge privately that he knew he lost the election. As for a free speech, you might have heard bill barr, former attorney general under trump saying free speech doesnt give you the right to take part in a fraudulent conspiracy. But thats another chunk of this defense that trump and the right to say what he wanted to say. And its a violation of free speech to suggest otherwise. Yeah, i mean, this is where the prosecution obviously had to be very detailed details and only wants to bring forward a case that they believe that they can prove weve got 6 coconspirators. It involved in certainly how how they and how Vice President decide to testify or what they do share with prosecutors terms of what the president did or did not say private conversations, theres a little bit he said she said that you cant prove anything it is a burden of proof beyond a reasonable doubt as it should be. Now, i personally believe that the president from the president was absolutely aware of what he was doing. And i do think that the evidence speaks for himself ultimately believe that he should be convicted whether or not that is to be determined based who actually comes out says stuff because as pointed out earlier, Republican Base right now is a truck they see is the single most powerful voice within the Republican Party. And you republican that wants to be the nominee is frankly scared. Hissing humpback, huge percentage of the party and therefore meeting their chances of actually becoming the nominee. And so its a difficult situation for all of that. The other candidates who dont want to take the entire Republican Party while at the same time in they they do want to hold the former president accountable for his actions. Some people are saying that this is the most Important Court case most important decision. Some going so far as to say it in u. S. History. A bit of hyperbole, corey, or would you agree . Its certainly unprecedented times, right. And the fact you know, many have accused former president of running to stay out jail. And the idea that if you can get protect actions of the white house, that that somehow be is his way out of it is unique. It is. It is living history and youre certainly seeing it at all times. I hope for the sake of the in the short and the long term that that the president is ultimately held accountable for actions that he did actually push in terms of both the insurrection and and you know, attempts to subvert will of the voters. But history will play itself out and one way or another. We are going to have an election next november. Its totally possible, but it will be former President Trump against president biden. And what times we live in. Alright, current, im being told to wrap up, but well be checking in with you. And i know well be talking to you again about this corey smith delegate for the California Democratic party, a former president of the United Democratic clubp i know youll be watching corey, thank you for sharing your time. Todays case is the 3rd criminal investigation. Donald trump has been charged he was first indicted in new york in march. You may remember on state charges stemming from hush money payments made during the 2016 president ial campaign. Prosecutors accuse donald trump of paying off adultfilm star Stormy Daniels to bury the allegations of extramarital encounters. Trump pleaded not guilty to 34 felony counts of falsifying business records. He is set to appear in state court in december on 2 months before republicans begin their nominating process in june. Remember special counsel jack smith charge trump in federal case in florida and this was the one related to the mishandling of classified documents that were found maralago. It was also the First Federal case against a former president. Trump has pleaded not guilty to 40 felony counts against him, including charges of retaining classified information. Obstructing justice, making false statements. A federal judge has scheduled a trial in this case for next may. And yeah, theres more 4th case probably in the works. A District Attorney in georgia has been investigating whether trump and his allies illegally meddled in the 2020 election in that state. She has signaled any indictments in that case will probably come this month. Meantime, trump again denying wrongdoing, very defiant, publicly says hes being targeted by democrats trying to keep him from reclaiming the president say. All right, lets turn to michael. Hes been sitting her patiently continue wanting to jump in every opportunity. What cards are the prosecutors apparently or possibly not showing . Michael, you heard bill barr say last night, hey, this is the tip of the iceberg. And jack smith has a lot more. What what might that i think theyre couple things you can do. I think the for the best guide for that is going to be looking. At the january 6 hearings cause who testified there whos testify as moves, particularly damning and who didnt appear named in the indictment because certainly some of allies information thats coming forth. Its coming forth from people who are there, some who werent there, but also. Especially with regard to the intent, right, the state of mind, whether its you call it the delusion to fans. The good fate reliance and whoever you know, what was trump really thinking . Because the key to any, any fraud or conspiracy claim is. Knew what you were saying was false and him in meant to induce what people were doing to make into terms of creating an illegal act. So you have, i think mark meadows lane and wait. He was reference as the chief of staff mention anything more about him as as the chief of snaff in the indictment. He apparently was talking to the grand jury. He has turned over text and documents of the grand jury. You have other people who are i think the lane and wait to all talk about the fact that former president understood he lost the election and nevertheless proceeded with this conspiracy. This plan, this object of attempting to create the created. It create the well essentially to obstruct the ability of the election to be certified january 6. Michael, im interrupting your only to point out that we have been watching the scene outside that washington, d. C. , courtroom. There have been some speculation just how many people would show up. Obviously. Were seeing people with signs in support of trump. We are seeing people, obviously hoping he will be a. And up prison. By the way, that is sparking some fascinating speculation and debate and questions from lawyers, ok, if hes convicted, run. Apparently the answer is can he served from it should happen prison . Apparently the answer is yes. This sounds like the things theyre not quite so sure about is if donald trump is elected, could he pardon himself . Sounds like thats a maybe. Yeah, thats thats a maybe anyone that would me know. Its interesting parts about the case in maralago. Im and miami. The documents case is he is convicted of the misuse of classified documents. One of the common punishments that they have you cant have access to them for like forever. But if obviously, if youre president. You have to have access to classified documents or to make character. Youre also that means one of the interesting Little Things that thats going on and could spring from that case. But yes, lots of Different Things. Cancer from a jail cell where they put him under house arrest in the white house. How does he go into nato . All these sorts of things. And again and you is sort of been a nightmare of well, its right for you. No doubt the drama of even talking about it, someone being elected and serving from, you know, that may not happen. Im just saying that the fact that were speculating of stuff like that is amazing. Were looking at our producer said with 3 of the the Capitol Police officers who defended the capitol on january 6, which cena going in . I mean, i dont know that theyre playing a part, but they were seen entering the courthouse just a few minutes ago. And for some people, its a this all goes back obviously, too, that the emotions run very high because of that. And thats a a huge backdrop you know, sort of whats in here is that the one thing that they have traditionally done well and which did not happen. On january 6 is crowd control. So youre going to see, i think. Areas where there are Trump Supporters area where there are antitrump, anti trump folks, its going to well cordon off. This could be a large area. Its not going to be where theyre all lumped together like they were in miami, for example. But this is something where you know, you would expect things to go well in terms of it. But used and i dont. And i just dont i dont think anythings going to happen. But its one of the things we just worry like. For example, what happened yesterday at the capitol . You know, there was some kind of a threat and they had to evacuate the senate bill. 8 people were told to shelter in place. And i think it didnt turn out to be much. But it obviously has got people. Yeah. On edge. Saw the bill barr interviewer, how damning or not or does it matter that former attorney general saying, oh, yeah, he knew. He well knew that he had lost the election bill behind since bits and drabs since he left. Quietly sort putting the hammer on his former boss. And this is another example where i think really enjoyed going on tv and saying, yeah, you know, maybe i thought in the beginning that he was kind of delusional. But in the end, theres no way he could have been end. And whats interesting about the dilution defense, it really puts in part to your make that defense successfully. You have to put into question the state of mind and the cognitive ability of that person. You know, can you . Successfully make argument someone can reasonably say make it a can or can make an assumption that despite the fact that you have 900 people saying. The sky is blue and one person saying the sky is actually a bright shade of orange. To really to say that you believe the person believe that sky was orange requires. Thats the mission essentially. And contesting of your mental state. I cant believe the donald trump. What would allow that to go forward and quite frankly, if you put that state of mind and you and almost begs donald trump have to go up on the stand. I think the last thing his defense wants to do, its have donald trump go anywhere near the docket, the dock and a in a federal court. All right. Again, were continuing to look at the outside courtroom as a police presence. Weve seen people there in support of donald trump, people and not in support donald trump. Let me just step back for a minute, michael. I mean, one thing you have to say about trump, them or hate him. He certainly knows how to stay in the limelight. Why are in some ways so fascinated with the sky . Well, i think talking to. So when those in the newsroom today about how the fact that that for a lot of a lot of democrats, words like one step away from for trump, Arrangement Center and then we were able to pull back after joe biden was elected and this is essentially like ptsd all over again. But it is because he understands and has access to a stern part of the media that will simply echo everything that he wants to say. And they and he and he knows how to manipulate the press. He understands that basically live advertising, which you say enough people will believe it. And he and whether we like to scoff at enough. The fact is that maxim is still good now as it was, then and hes maximizing it to them. Most possible extent. Thats why you have 30 percent of the Republican Party apparently, you know, close to 69 of Republican Voters who believe that joe biden was. Falsely elected in twentytwenty when everything. All the evidence is to the country. And i think one of the important parts of what this trial its going go to produce is will the parade of republican witnesses, people who heads of parties, people who are majority leaves. People have Held Elected Office for years coming forth and saying. We told him there was nothing wrong. We told them we couldnt do what he wanted us to do. Is that going to possibly shake things up in just sort of noise. But if you can see it happening, you can hear what theyre saying. Ty over and over again that ive been a lifelong republican. I was for trump. I work for him. And then he asked me to do something that that to me violated the very tenets of democracy. Will they have an impact thats going to be the real test. And thats in many ways the litmus test for this countrys polarization because were at that and were at and inflection points. Think were ready. Were ready, gone past that. But if there is a possibility, as long he is still in the public realm of people who are like him pulling us back from that brink. Thats going to be the real test of where we where we are in the next 4 to 5 years. All right, michael, i have a familiar face and voice coming up. But jonathan madison, jonathan medicine has joined michael an eye on election nights. There he jonathan has been very active in the bay area and the state Republican Party in leadership positions. He is also an attorney. So what are your thoughts . As we saying earlier, jonathan republican, democrat, this is a rather sobering day to see a former u. S. President being arrested and indicted arraigned. What are you thinking as youre watching this unfold . Well, i think its a demonstration of the American People that literally anything can happen even to a u. S. President the significant thing about these charges, catherine, is that for the First Time Ever unlike the other 2 indictments, these charges would show if trump is actually held accountable here that to the greatest extent by the law, it would show that a president can be held criminally liable for his actions in office and months even after theyve left office. So this would raise some real questions about what we call a president ial immunity. And so whether youre donald trump, whether joe biden, republican, democrat, anything, youre youre really raising eyebrows now because of the First Time Ever throughout our countrys history that a president faces these kind of charges. And so i think that this is a real as as eloquently said, catherine. So real sort of a wakeup call for the country. A sobering moment. Definitely. Jonathan, we were have been talking aboui the defense and the fact were getting some idea of what that will be their term was being used. Dilution defense. The argument from trump attorneys, perhaps that he truly believed that he had to the election stolen from him. And yet we also had people like bill barr, again, the former attorney general saying now he he knew, you know, i was there. He indicated in some ways that he knew he had lost. What are your thoughts what you are hearing . Jonathan, regarding the defects . Its a great question. I this is this is classic intent law, right . If anyone they went to law school, including michael, you understand intent is the hardest thing to prove in a legal action, especially criminally criminal intent. They have to show that trump and actually the intent to defraud the american, the american voter. Really, were talking about a deprivation of rights. Were talking about the intent, not just the fact that it happened, but did he intend to the plan . Wasnt for thought, right . These are the questions that have to go into the prosecution. Thats a its a very real question. Mister barrs regardless of what he may know that we do, the prosecution doesnt just have an easy win and any prosecutor that says its easy prove intent may not be as successful as a whole host up to the heat. So they have a they have a real challenge jonathan, we talk to congresswoman barbara lee this she says she has some republican friends and colleagues who are privately up halt many who are not. Are you in privately of paul the category or are you what are you hoping for . As you watch this unfold . Yeah, im im a privately up publicly it. Im appalled. By abide by all and, you know, i think but im im appalled by a number of Different Things appalled by the process. Im im shocked by the fact that you could have all of these different charges happening at the same time. And i dont find it coincidental that are happening on the on on the on out the on the onset of the president s election in this upcoming election cycle. I think, you know, the prosecutions had ample time to bring these charges to to really wrap up these charges and all the sudden its happening now. I just, you know, as as a thinking person, i i just find it difficult to believe. But what i hope answer your second question is that justice is ultimately served that the facts will speak for themselves if the president is guilty that he be held accountable behalf of the American People out here. If youre republican, democrat and some of my friends on the right may not agree with it. If hes guilty, then he should be held accountable. They goes for President Trump, president biden, whoever it is. So i and my hope is that this will somehow strengthen our country as opposed to setting it back and pushing us more into this sort of a flustered entertainment cycle where the bar really just to clarify shes talking colleagues and friends who are republican who publicly support him or at least dont say a lot. But i actually are appalled by what they i accused of doing. So. Trump is in the courtroom now. Were jonathan, let me ask you if we hear from the former president later today, i dont know the new steven going to say anything in court. What would you perhaps expect him to say or what would you hope to hear from him . Ultimately, i hope the truth. I want to know what happened. You know, i ive had enough of these gimmicks you know, im as if someone inspiring it as it was to hear former president s a yeah, im even going to have to the American People behind bars of. I have to you know, i want real facts. I want real facts for the American People. So if it turns out based on the facts that hes innocent, i dont want to be held accountable to the fullest extent the law because hes an innocent man. And thats why you heard the prosecutor state that, you know, hes still innocent until Proven Guilty. So i think we have to keep that in mind. Is, you know, we we get overly zealous in terms of making these opinions in terms of what hes done. Lets let the law speak for themselves. I want to hear what happened. I dont i dont want to hear him say the gimmicks that appeal to his party. I want to i want to the truth and nothing but the truth. Well, as you know, Jonathon Niese been very defiant publicly. Even i think made the a 4th indictment will clinch my presidency. So he hes clearly not in the mood for that knowledge. Apparently any kind of a wrongdoing. He also has the talent. It seems for convincing followers that theyre in this with him, that hes sort of fighting for them and continues. Yeah, i think. Its an interesting position that hes i mean, you said well, catherine, you know, hes on one hand. Hes got
