rights advocates are speaking out tonight after san jose police released this video of officers shooting and killing an unarmed murder suspect. thank you for joining us here tonight on kron 4 news at 10 i'm justine waltman i'm jonathan mccall 27 year-old david tovar was wanted by police. >>connected to a series of crimes across santa clara county. but that was before officers tracked him down to an apartment complex in san jose back in january. kron four's dan thorn live for us tonight with the very latest details on the video and the investigation. >>the video of the shooting is dramatic as it shows officers firing several rounds of tovar within seconds of seeing him one of those officers said they believed tow bar had a gun. but after the shooting one was not found and now civil rights advocates say tovar should not have been in video released by san jose police officers are seen attempting to arrest a man wanted in connection with several violent >>officers are then heard firing several gunshots as david tovar is seen running along a second-story balcony of an apartment it's this video of criminal justice advocates say show and unjustified killing the video is really infuriating upsetting. >>it is as if these police officers were in a video game. hunting mister tovar sajid khan is a deputy public defender in san jose he's joined other advocates in calling the shooting brutal and excessive shots fired shots fired such suspect on the second floor tovar was being investigated by police in gilroy morgan hill, san jose and the chp after he was linked to a number of robberies and 2 shootings, including a murder. >>police say they were on high alert in pursuing the 27 year-old because of his violent criminal history, even if she was. >>suspected of crimes had a right to due process you to write the arrested him. he brought to court and he informed his charges shooting happened on the morning of january 21st when tow bar was tracked to this apartment complex on the apology rive. >>police say he was reaching for his waistband when they opened fire but after the shooting tovar was not found with a gun. >>khan says these types of killings by police are showing dramatic changes need to be made within departments we have to use these moments to re imagine and rethink. >>how we police our communities and who we trust to be policing our communities and how we police communities of color. >>this shooting will be under review internally and the santa clara county district attorney's office is also expected to investigate and because tovar was on armed the state attorney general's office may also get involved. reporting in san jose dan thorn. kron 4 news staying in san jose tonight right now police are investigating get another homicide their second in as many as this in 2 days. >>it's also the 9th homicide in the city so far in 2021. the latest happening on cornelia drive just before 6 o'clock tonight. another homicide happened around the same time just last night as well. we are seeing in contact with san jose police to learn more details about both of these homicides stay with kron 4 as we get more details. meanwhile in the north bay, a traffic stop led santa rosa police to find this bag of pills believed to be either oxycodone or counterfeit pills laced with fentanyl along with a ghost gun loaded with a 15 round magazine. a digital scale and material used in drug sales. police tell us the driver 18 year-old carlos santana sanchez was wanted for an outstanding warrant. he's also in custody tonight for possession of that gun and possession of narcotics for sale. >>now to the peninsula where it's been one week since san mateo county reopened a lot of indoor services because the county reached the red tier county officials now looking ahead to move into the less restrictive orange tier sometime next week. >>kron four's gayle ong spent the day in san carlos talking with businesses there. >>if covid data holds true san mateo county can move in the orange tier on march 16th here in downtown san carlos people prefer to eat outside we many empty tables inside restaurants. people taking extra precaution. normalcy really matters but also some caution. >>we want to do it too fast jim cox says he prefers eat outside, but is not opposed to eating indoor down the road. there's enough social distance seen in the mask seem to work well, everybody's wearing mask. so plenty of course when you have to put something in your mouth across the street in downtown san carlos kevin kyle having lunch 4.0 the cost is 3.9. >>that's up to 3.9 daily new cases per capita for the county to move into orange. the county has been in red for week services like indoor dining gyms movie theaters nail and hair salons are allowed to operate at limited capacity, yan's garden in san carlos is sticking to outdoor seating and take-out only is a nice steak and people they lie outside you know. >>maybe later on i. 84 inside. >>manager steven lee says the restaurant will reopen inside when more people are vaccinated. >>a body you know get a shot, you know as protect you know for the people you know. >>yan's garden is not the only restaurant here in downtown san carlos who was waiting to welcome people back inside many other restaurant managers and owners tell me they feel more comfortable after more people get the shot. here in san carlos scale ong kron 4 news. >>and as we keep track of all the covid shots that are happening in the bay area at the oakland coliseum site more than a 1000 people got vaccinated on saturday. so far more than 10 million californians statewide have received their covid vaccines. the coliseum site is one of the largest vaccination sites in the state. and in san francisco police chief bill scott received his first dose of the covid vaccine. this weekend. he tweeted this picture after receiving his shot. chief scott also encouraged others to get the vaccine. going on to say the vaccine along with preventative measures like wearing a mask are the best tools to help end the pandemic. >>san francisco supervisor matt haney says he wants to see better vaccination sites in the tenderloin and on treasure island. in a letter sent to san francisco public health director doctor grant colfax he says that access to the vaccine in these areas is failing adding that the tenderloin has the highest new case rate in the entire city in the 3rd highest overall case. count. yet just over 4,000 people from the neighborhood have been vaccinated he says his district needs a high volume vaccine site that can be easily accessible by the folks in his district and he says it needs to happen. immediately. a democratic congressman congressman from northern california and has introduced a new bill that would expand veteran access to the vaccine. the bill would allow the va to vaccinate any veteran not just those currently enrolled in the va health care system. representative jimmy panetta co-sponsored the bill and says it would reduce vaccine waste while also freeing up more vaccines at the local and county level. >>and now let's get a check of the latest numbers from the state on the amount of vaccines that have been sent out so far as you can see the state has delivered more than 13 million vaccine doses with more than 10 million of those already in people's arms. but here in the bay area. no big changes to report counties are still steadily increasing the amount of vaccines. they have administered with santa clara. still at the top of that glad tidings international church in hayward on sunday to receive their first dose of the covid-19 vaccine. i think it's super the. >>underrepresented have people have not had this representation before and so i'm glad it's available and that's why me to participate at the mobile vaccination site was set up in partnership with fema to improve access to underserved communities. they serve jerry macklin says this is something the hayward community desperately needed here we've got to make a last time we lost a lot of time along the way here and so now the underserved communities have to be visited the site on sunday. >>he says up to 1400 people will receive their first pfizer dose here between saturday and sunday on the safe return again in 3 weeks to give everyone their second dose congressman swalwell says he's trying to expand the site and make it permanent our hope is >>because of the infusion of american rescue plan funds that we're going to dramatically increase the amount of vaccines available and that will mean that it's not just that sites like the colosseum but they'll be mobile you've deployed to sites like this and whether it's this congregation or this community. now heads to the house for a final approval, which means the latest round of stimulus checks could start to be shipped out relatively soon. but lawmakers stressed that the bill is helping americans in more ways than just another round of checks. it also gives americans a 3 how a $300 boost in jobless benefits and expands the child tax credit for yet another year. there's also money for funding for vaccine, distribution and testing along with rental assistance and money to help schools reopen safely. but republicans still believe that this deal gives too much to too many. >>we have so many different ways that we're helping the public with this piece of legislation this was a targeted piece of legislation. it was because people need to help this was not really about coronavirus in terms of the spending as this was a liberal wish list of liberal spending this was never about getting people back to work or kids back to school or the disease behind us that's where it should have been focused. >>the biden administration says the bill will strengthen the effort to combat the spread of the covid-19 virus. >>the house is expected to take up and pass the deal on tuesday. >>leaders of the official recall campaign against governor gavin newsome speaking out today in sacramento as their petition reaches 1.9 million signatures. they say that's more than enough to qualify for a special election later this year. the group needs about one and a half million validated signatures to spark won. those nearly 2 million signatures have not been verified by the secretary of state's office they have though until march 17th to turn them in. organizers say this movement is one that the state has never seen before. >>of the 1 million 950 thousand collected our guest one 0.6 million of them the collected by volunteers up and down the state and for those of you in the press and seen things before i don't think you've ever seen a volunteer in like this literally people from all walks of verification. >>more fallout from governor gavin newsom's vaccination rollout plan a number of california counties are now asking to opt out of the state run blue shield vaccination program get this right now none of california's 58 counties have actually signed contracts with blue shield. even as the state plans to place 10 counties under blue shield oversight this week. last lee counties board of supervisors asked for an exemption from the plan saying that the company doesn't quite understand the unique needs lee county and its diverse population. ventura and san joaquin counties have also very latest hunting and what you can expect as you head out the door in the morning. >>yeah that's right jonathan and just see not an atmospheric river, but it is going to be a cold core storm that is going to be very unstable in nature, so it could bring us the threat of small hail pop-up thunderstorms with lightning that may also be detected in addition to light to moderate rain so let's track this storm hour by hour for you tonight live look outside in the east bay over berkeley, very dry clear calm conditions, but rain totals with this upcoming storm really peaking tuesday for wednesday expected to bring most of the bay area about half an inch to upwards of an inch of rain even higher amounts for local hills and mountains and we could see snow levels in our highest peaks with our local hills and mountains dropping to as low as 2000 feet just because it is a very cold core storm. so radar right now tracking very dry weather see some low clouds streaming through mainly along the coast and some high clouds overhead. but here's a look at our storm set to arrive in the coming days, we're going to notice a stray shower or 2 to start your work week monday, really impacting those of you in the northeast specifically in santa rosa overall monday is going to be a dry morning and afternoon but by monday night we're going to start to notice another stray shower making its way through the san francisco peninsula around 8 9 o'clock and then by around 10 o'clock. that's when we're going to notice some widespread light rain starting to make its way east into parts of the east bay for you but then drying out by monday night into early tuesday morning and that's when we're expected to see the bulk of the wet weather arriving shortly before your new lunch time hour and then it's really going to peak in intensity by around tuesday afternoon through tuesday night so that some are expected to get the biggest threat of pop-up thunderstorms if any lightning is detected as well it will pretty much happen by tuesday afternoon through tuesday night even through wednesday morning and there's a look at those snow levels dropping for those of you in mount hamilton. in the south bay but then by thursday morning. we're going to clear out and dry out from all of the wet weather so monday really just track about a 10th of an inch of rain or less slightly higher amounts for those of you in santa rosa. but then tuesday and wednesday when we get those light to moderate downpours we could see anywhere from 3 quarters of an inch to upwards of an inch of rain and then watch how the storm just kind of fizzles out the rain totals dropping significantly as it shifts south and east into the east bay valleys and south bay you can expect to see less than half an inch of rain but then after that no rain in sight even leading up to our 10 day outlook so really take advantage of tuesday and wednesday for those of you who love the wet weather because it looks like our march miracle. this may be it hopefully we get another shower or 2 by the end of march it happens that's it though usually get storms in april and may so we still have some chances but spring is right around the corner, so we'll have to wait and see all right we'll keep our fingers crossed thank you, yeah. >>thank you. >>former minneapolis police officer derek chauvin will appear in a courtroom on monday to begin his trial for the death of george floyd and while everyone is all too familiar with the video of chauvin kneeling on floyd's neck. his family and supporters are still worried that enraged the nation and the world former minneapolis police officer derek chauvin with his knee on george floyd's neck stop reading right broke floyd was killed in his death became a symbol of racism and police brutality protests and riots broke out a police precinct in minneapolis was even set on fire. >>and now 10 months after floyd's death officer chauvin's criminal trial is set to begin on monday, everybody wants some mom. >>he pleaded for help and nobody cared. great character knee on his neck. but 8 minutes and seconds former officer chauvin faces second-degree unintentional murder and second-degree manslaughter charge. he was originally charged with third-degree murder. but the judge dropped that charge he'll reconsider that decision before jury selection starts monday morning. >>chauvin's attorney is expected to argue that the officer acted in self-defense and used reasonable force we know that with the beginning of this trial. it also means an increasing number of protests. >>protests over the emotions of anger and fear. and hope the hennepin county courthouse looks like it's part of a fortified war zone with multiple layers of fencing and barbed wire surrounding it ahead of the trial. >>some businesses are also boarded up worried about a repeat of last summer's riots that broke out in cities across the country setting fires to structures of any
