Around the country, a vote tallies are taking place against a back drop of legal battles and protests. Reporter across the country, states in flux. Counting and waiting for full results from key states, north carolina, pennsylvania, nevada, and georgia. Still in nevada this morning, the president announced a fourth lawsuit there claiming that people voted from outside the state. We are filing this federal lawsuit to protect legal voters. Reporter the state Supreme Court denied the request to stop counting ballots and officials overseeing the las vegas tally matteroffactly stressed that they are being meticulous. In pennsylvania, a court ruled in favor of the Trump Campaign on a logistical issuef allowing them more access to observe the count. Election officials are making progress in Allegheny County, home to pittsburgh. Officials say the first big round is done and they are leaving 30,000 hard to process ballots until friday. What i will say is that Allegheny County processed them faster than probably about everybody. They will work as fast as they can and as accurately as they came. They are also saying that people that may not have met the residency requirements voted. Critics of the president say the legal strategy comes down to this they do not want the votes favorab to joe biden to be counted. The Trump Campaign is pushing back at that. There is a judge in georgia saying he will be dismissing a case where the Trump Campaign was think that absentee ballots were being mishandled. Legal advio the Trump Campaign are leaning in on the in the last few hours, ilLegal Advisers say they hope that amya coneett comes through. They investigated that specific case and that voter did not choose to challenge the mail him ballot when they showed heard the signature. Macomb county twice in a row. When i was talking to vot ts there toda overall sense that i got was that of exhaustion. They are done with this. They do not want to talk about it amore. One woman i spoke with said she was sick of the lawsuits come of the allegations of fraud and the namecalling. I made the assumption that she was a said that no, she was a trump supporter. Sheas just sick of all of this. This electio has caused some personal scars. I heard a lot of stories of people that is seen relationships, part because of one grandmother told me a story of how she and her granddaughteo nearly camlows over this. Friendships lost. One couple i spoke with were both are both biden he said he had lost five friends over their differencestetween presid trump and joe biden. It has taken a toll emotionally and personally for a lot of voters. Judy and no doubt across the country as well. William, yesterday, you were at protests in places woure they wereing votes. There has been a lawsuit filed by the Trump Campaign to stop the counting. S where that stands righ now. Reporter if you remember from re were stron protests of people trying to stop ut this wasde the detroit location where they were counting mail in ballots. Protesters were there saying stop the fraud the count continued. We went there this morning and there were only it was only a handful of protesters. The Trump Campaign filed a lawsuit saying they were not getting enough access to those counting sites and they wanted more eyes on the process. The judge throughout that argument. Threw out the argument. Donald trump really wanted to win michigan. He thought hard he f gh hard to be here. His last Campaign Stop was in kent county. It has been pretty red. The l saying if you do not vote for me or turn out tomorrow, i may never come back here. Joe biden flipped the county and won michigan. Judy it is not always the size of the rallies that will tell us the result of the vote. Thank you so muc as we have been reporting, President Trumps lead in georgia has been cut to a narrow margin. As of this hour, there are still more 47,000 ballots are around the state that remain to be counted. We are joined by our reporter from atlanta. Where does the counting stand . Reporter as you point out, the margin between joe biden and we speak. Ump is diminishing as only about 9500 votes separate the candidates at this juncture with morehan 4 million votes cast in georgia. There is still some counting to be done. In the mid40,000 range. Mailing and absentee ballots need to be scanned and tallied. Most of these ballotsetfrom the pocks of blue in georgia. Urban centers that have voted in favor of joe bid. If you do the mathematics, there is no questio that the margin between the candidates will diminish. Depending on how you do the math, it could mean that joe biden overtakes President Trump. Tomorrow is the deadline for pressing military overseas ballots. The are less than 9000 of come in between now and then. And then there are provisional ballots tt need to be verified. We do not have statewide numbers on that. Here in Fulton County, there are about 3000 of those. Tomorrow we will hav more visibility on this but they are moving deliberately here. Judy we know that georgia was one of the states where they were able to start counting ballots early. Explain how then it is taking so long to count. Reporter yes, they had some time, a couple of weeks in advance of the election. It is not as big a number that you areit dealingin say, philadelphia. Many waited until the last minute. There was a huge arrival of ballots that arrived right election day, officials have other things to do. They did not get busy on till wednesday. Yof go through the process signature verification. The ballots have to be scanned. 2 3 of these hand marked ballots have ambiguous markings which requires a Bipartisan Panel to adjudicate. It is a relatively laborious process. And the folkswaere in georgia to make sure that they get it right. We spoke a little bit earlier with gabriel sterling, in charge of the implementation of voting systems here for the ary of state. Fast is gre we appreciate fast. We more appreciate accuracy. Bedrock upon which people will believe the outcomes of this election. Seither the winnie or the losing side. Reporter the dates to keep in mind counties have to certify their elections individually. Itheir deadlinefriday the 13thf november. The state has to certify statewide by november 20. If there is a half of a percent between the candidates, it is all but certain that there will be a recount. There still a long road ahead given the closeness of the race judy certainly sounds like it could long stretch to come. Was taking so long oury it attitude is that it should take as long as it needs to hear it ever. We have some critical context on where the race stands. Remind everyone on where the race stands. Take a look at the totals for joe ben, 264. Per President Trump, 214. And for joe biden, that includes arizona. 11 electoral votes went to him on wednesday in the Early Morning hours when the ap called that raise for mr. Biden. What is interesting about this map is there are very few changes from 2016. Ye is here on the new jer border. Munro county and north hampton. This is a new pickup for the democrats. These are close town tease. One thing i want to say is that these are counties tt have finished counting including the mail them vote. Mail in vote. I know dan bush was talking about where are all of thvotes that still have to be counted. We do know that philadelphia counting is still counting and we expect around the state allegheny townie, Allegheny County, pittsburgh will finish their votes on friday. Reporter a some senate races are still not called. Look at the balance of power, what is at stake . Porter we have a tie 4848. There is a race in alaska which will likely go replican. Alaska takes a good amount of time to count. Theat of the senate resides in the three other senate races. Two of them in georgia. Lets go through where we are with those. This is the Kelly Leffler race. She was appointed to fill a vacated seat. This is a runoff. None of these candidates have ceived more than 50 of the vote. We will have a runoff. Doug collins will not make the runoff. Kelly loeffler will go against a pastor from atlanta. We will have this result in january. Ok at the other georgia race. Davidth perdue iincumbent republican. He is just at 50 . He may fall below it because in georgia the votes are still coming i and the are largely from Fulton County which is in atlanta. When you look at georgia, i wan to tout a suburban county, copy county. Cobb county. N,clinillary clinton narrowly won thi county. It is the second largest county in the state and it isif dived. 51 white residents. Black residents, 28 . Ichisp residents are really growing there. Rerter i believe there is a deeper look. Reporter this is why john is still in the race. A very heavily populated suburban county, cobb county. Perdue is a lagging. Reporter a lot at stake in the senate. And anothekey race in north carolina. Cal cunningham has been challenging tom tillis thomll s. Reporter it is a squeake look at where look at how the in georgia, if you break it down, u saw red dots at the. Bott look at north carolina, most of these counties have. D and blue do what democrats have done is outpaced republicans by huge margins. And we see this around the country. We are waiting for some of the final votes to come in. 93 of the expected votes to these are the three races that will determine who wl control the senate. Reporter profound implications. Judy i am asking everyone this question even though what we all know is that we care about that every vote gets counted. Tell us why it has taken several days after the election to get the ballotcounted. The ballots being counted right now are those that we were not able to signature verified and start processing and tabulating before the election. Early ballots that were dropped off monday or tuesday before the election. We have had unprecedented turnout in arizona this year. That was the number we did not know howany ballots would be dropped off in terms of estimating how long it would take. There were a lot of ballots. Honestly, we are where we thought we would be in terms of owcounting right and we are actually a head of where we wer in 2018 with more judy and just to remind us ulout arizonas and regulations are there observers from both parties watching . Absolutely. And our tabulaon centers have cameras in every tabulation room. Anyone can go to the county elections camera to see what is happening. Judy you said it would take a little longer to get this information. Do you know when the counting will be finished . The bulof it what we have been told is that the bulk of it will be done this weekend. Maricopa county will relea its totals daily at 7 00 until they are done. The other counties are doing it regularly through the day. By the weekend,e we should h most of the ballots counted. The restna will be provis. Counties have until tuesday to complete the resolving of those to see if they can be counted. That is a much smaller portion of the votes that are outstanding. Judy the Trump Campaign is states. Suit in a number of are you prepared if that takes place . We are. There has not been a suit filed here. Inght now, the president i position to want the votes to be counted. They will be. Stopping the vote count is not something i think heould try to do. After the election, should there be a push for a recall, our recall margin is eremely narrow and there is no basis for someone to go to court and request a recall if the race is not in the margin. Judy i know there is an allegation going around the arizona count that ballots that had been marked with a sharpie peedas opp to a ballpoint are being discounted. Can you set us straight on that . I would love to. The sharpies were provided by election workers because ty are the recommended markers for marking ballots for those abparticularators. The ink dries faster. There is no truth to anything about thosinballots bein lidated. And if there were, in a polling place, if the tabulator could not readhe the ballot,allot would be spoiled and the voter would be issued a new ballots. In the centers, if the tabulator nnot read the ballot, there is a process in place to make sure that all of the ballots are counted. If it was a grand oration a sharpie, it will be counted. Judy im glad to let you have chance to set us straight on that because we know that is an allegation that has been flying around. It is important to bclear on what the truth is. In some cases, they have taken their claims to court. Jeffrey brown takes a deeper look. Reporter the lawsuits do still coming. Do you see a pattern so far to these legal challenges . Are there categories you can put them into . They are smallbore cases. Many are trying to get better access for trump observers to geinto polling places. That might be to try to slow down the count in places where trump is trying to stop a biden win like in pennsylvania. There was an allegation of a legal ballots being counted in georgia and a court found there there have been suggestions that they will follow file suit for a recount in wisconsin. They have claimed there are nonresidents of voting in nevada. Theyave not produced the suits yet or any evidence. Reporter are there lawsuits or potential lawsuits out there that you are watching for that might have real conces . If you are talking about in terms of affecting the outcome of the election, it is unlikely. What you would need is Something Like we had 20 years ago. The race came down to the Electoral College antes in florid in that state, the vote town was so cle. For that to happen here, if itos is not a very race in the Electoral College, tse lawsuits wont matter. And even if it is, if you take a recount in wisconsin, most recounts statewide do not sft a lot of votes. There is a 20,000 vote difference in wisconsin. Most recounts shift only 300 tes. The only one i think is t potentially plausible ifme down to pennsylvania and if pennsylvania was very close is a fit over these ballots that arrived aer november 3 at 8 00 and by november 6 pursuant to a state Supreme Court order. Thit is not clear to m if i didnt is ahead, trump might want those ballots to be counted. Repoer tell us about the burden of proof in cases of election. We just heard from the arizona secretary of state explaining to the public that they are taking their time. They want tot make sure tl of the votes are counted and the process is right. How much deference due courts typically dopi courts lly give . The burden of proof is very high. You would have to show that theree wlegal votes cast that it would cast a cloud over the election. Or, you would have to point to some procedure that was not followed. It is hard to get a court tor or Something Like a change in an Election Results. Some of these lawsuits might be successful. Court there was a case where they wanted poll observers to bi feet away. This is not the kind of relief and these are not the kindsf cases that will change the out, up with something bigger. Ey it is hard to see a litigation strategy to flip the results of the election. Reporter in the last minute, what is the process . Meases are going to state courts and some to federal urt. And how long will this go on . Is it possiblehat legal cases will drag on for some time . They could potentially drag on for weeks or long i dont inc. Anyone will pay attention. If it is a lawsuit in pennsylvania where those ballots issued are not determinative it really depends on how thingse sh out. Im not seeing anything right significant. There are a lot of things that could have been don and it is always difficult to play monday morning quart. We have never had a national strategy. Each state has had its own strategy and as a result, it is hard to fig a pandemic with 50 different plans. And we have never had a coordinated approach. Having a mask mandate across the ulcountry be difficult but corrugated. Ble and could be you can decide what terventions you need to do. Our testing system has not worked well. We still have people that cannot get a test result within 24 hours and are waiting 45 days. And as you wait that long, more infections are happening. Andta our c tracing system has broken down. And i would say that we are focusing too much on not doing things that need to be done. When some things need to be done including avoiding crowded places. Things thacould be done to prevent the super spreading events. Judy where does the blame lies here . Lie here . Helame has to land wit the administration. They never took it seriously enough. They started well with the task force. The cdc has been absent in this pandemic. An not having it play a Critical Role is a missed opportunity and one of the most dreadful mistakes we have had. They politicizedhe cdc which has had tremendous consequences. Athe cdc has not bee to make Public Health recommendations. They have been able totiake recommens that have been doctored todsit the nf the administration. And the administratio instead of advocating a mas production of ppe, they have left it up to the state. And that has been a not well coordinated effort which has had consequences. Judy i want to ask you about what should be done next but before i do that, i have to point out that it is not jint the u. S. S a surge in code vid again, but across europe as well. People are tired of the pandemic. When we locked down and initially to prevent cases from going up, people thought that would be enough but they did not realize that the moment you let ndgo of those restrictionsf you dont put into place asking will come back and spread rapidly. Europeansaw this very quickly. Youngve people started tng and going places and without the from ecological measuresf without the measures of masking and social distancing, it was spreading. They made the se mistakes that are making. And europe is not one block but multiple countries doing different tthat have not been well coordinated. What is your advice on a personal level to americans given where we are in this pandemic . I think it is very hard to tell people not to get together for the holidays. I wouldecommend getting together in smaller groups, fewerls than 10 individ have a d you are getting together with and say let us quarantine ourselves. Avoid contact with others for two weeks gefore we get er. Lets get tested before we arrive and retested. Wear masks. If the weather is good enough, go outside. I would not recommend my family and i would frequently thanksgiving. With 20 people for i do not think that is a good idea. You should have a very good diussion about what is a safe thing.
