Promising to preserve its history. There are places like this one in particular that will have such legacy that maybe an independent like myself will be the right person to come in and to build off from there. Hello. It is yet another case of a retail store confrontation escalating to violence. A Security Guard at a san carlos home depot opening fire on a suspected shoplifter last night. It happened at the store on old country road just off of 101. Katie nielsen found out Security Companies are seeing a surge in demand for armed guards. Reporter this is where that shooting happened around 10 00 last night as the store was closing. Shoppers we talked to today said theyve seen armed guards in the store for quite a while. When we asked if that was a positive or negative thing, opinions were mixed. And today just happened to be with my daughter running errands as we told her this was a sketchy parking lot to stay close. Reporter meet his 14yearold daughter as they live in redwood city. He said he wasnt surprised when they heard about that shooting. It is san carlos. Its better than post cities in the bay area. But it was only a matter of time that that was going to start coming this way. Reporter a worker boarded up the broken window early this morning. The only remaining sign of the struggles that happened on monday night when the store was closing. The suspect later identified as 26yearold jonathan mackey, got into a physical confrontation with the armed Security Guard as he is trying to leave the store with stolen merchandise. Mackey hit the guard in the head and arms repeatedly before throwing the baton through the store window, leaving a hole and shattered glass. The Security Guard pulled out his gun and fired two shots at the suspect, hitting him once. The nearby san mateo sheriffs deputy heard the shots and rushed to help. Both the Security Guard and the suspect were taken to the hospital where both are expected to survive. And it is a very unfortunate situation. Unfortunately its becoming a common occurrence now. Reporter he says with more and more violence occurring in the retail settings, there is a huge surge in demand for Security Guards, especially for guards with advanced certifications to be able to carry that baton or firearm. And these are the areas where crime is not necessarily a huge, huge issue there. They are starting to hire the guards. Reporter when it comes to armed Security Guards, protecting stores, shoppers have mixed reactions. I know that theft has been rampant in a lot of these areas. But i think we have to come up with alternatives. Otherwise people will continue to die as a result of gun violence, you know, this kind of sanction on the gun violence. Theyre here to protect us. I think they need to have what is needed to protect the people around them. I mean thats their job. And it is kind of hard to do that with the baton when the bad guys are out there carrying weapons. Reporter the armed Security Guards do not go through the same training as police officers. The state requires Security Guards to have a minimum of 40 hours of training and then additional training courses if they want to carry things like pepper spray, a baton, or a firearm. And back in april. A Loss Prevention worker at a home depot in pleasanton was shot and killed by a suspected shoplifter. The case made it to capitol hill as the mother of the 26yearold blake mohs testified in front of congress on the rise of organized retail crime. And this deadly shooting at a San Francisco walgreens sparked a discussion on how far guards should go to stop shoplifters. A private Security Guard shot and killed banko brown suspected of stealing from a store in april. The d. A. Declined to file criminal charges saying the guard acted in selfdefense. We are now following a developing story in oakland. A deadly shooting just steps from the bart station. One man is dead and police say they have arrested a suspect. The investigation did prompt a brief closing of the bart station, but it is now back open tonight. Police say the shooting happened by the bus zone on the street level near the station. Officers used video images from some of the many thousands of cameras inside the bart system. And to locate a person of interest. The victim died at the scene. Authorities are still trying to piece together exactly what led to this shooting. And another controversial charging decision by the Alameda County d. A. She dropped the criminal enhancements right before the murder trial began for the two men accused of the beating of the 75yearold man. Anne makovec has more on what this means for the case now, anne . Reporter the enhancement is special circumstances. Both defendants in the case have prior convictions. Thats according to the mercury news. And that enhancement could have led to stiffer penalties in this case. The 75yearold pack ho was robbed and beaten during his march in 2021 in Oakland Adams points neighborhood. A widower who walked with the cain and after hitting him in the face. He died from the hospital from his injuries. He is one of the suspects charged with the murder wearing an ankle monitor at the time. I spoke to carl chen who is disappointed, but not surprised that the d. A. Dropped the enhancement, saying that getting off easier is a shame even for criminals themselves. They will continue on the crime spree until they commit the serious crime such as the murder. And so i think we cannot send that wrong message to the entire Community Whether youre the victims or you are the criminals committing the crime. And carl was a victim of the recent robbery himself in oakland. The man convicted in his case went on with assaulting an elderly woman in San Francisco. Also part of the effort to recall Alameda County d. A. Pamela price. She has been under a lot of pressure to crack down harder on criminals. The police chief of livermore recently asked her to reinstate the enhancements in the violent robberies of two women, saying they are necessary tools to safeguard against the clear danger to safety. Now price did charge two suspects with murder with the gang enhancement in the case of jasper wu, the toddler killed in the crossfire of a gang shooting in 2021. But she did remove the condition of special circumstances added by her predecessor, nancy omalley. Veteran prosecutor steven clark says enhancements are used as a tool to keep dangerous criminals in prison or to encourage a plea bargain. He says there needs to be accountability on when and how they get used and dropped. Are you utilizing it to protect the criminal or to protect society and the victims of crimes . And that is a very difficult balance. And weve reached out to prices office on this. They say they cannot comment in an ongoing case, but that the suspects are being held accountable when speaking about enhancements in the past. And anne makovec, thank you. On to Santa Clara County now where a Ribbon Cutting ceremony was held for a new Mental Health system. The facility features 28 new beds and serves people with serious Mental Illnesses as they transition from intensive care to independent living. The group save our city is not against Affordable Housing initiatives, but they argue the majority of the Public Housing is already concentrated in marin city and that not considering public input is wrong. We want to make sure that not just that quote Affordable Housing comes to our community. Dont do things without the community of people who live and reside here who are concerned about what happens here. Reporter senate bill that became law to make it easier for certain housing projects to become approved without public input or environmental review, leaving the Marin County Community Development agency no other option. The county did approve the project. We were required to do so under state law. And we have seen how it works or where there is some discomfort. How can we make it better . And the Housing Association of Northern California says an amendment to the law through sb423 will allow for communities of high segregation and low resources in the future to have a stronger voice. But Still Believes more housing for all is the solution especially for those that can least afford it. Where she not built enough housing over the last few decades. So now we are trying to flip the equation. What if we accelerate that construction . Will we be better as a state for it . Reporter they argue they are being forced to accept that massive project to help the county meet the housing requirements under the state law. I dont think that we can recover as a community and be the community that my parents and the other parents, the other ancestors wanted marin city to be. Jose martinez spoke to the man who is bringing back the legacy business with some new flavor. Im here at Buffalo Bills brewery in heyward, a place that just reopened to resume a 40year brewing history. It is a place where you could feel the history in every corner. A lot of places that i believe are iconic and that follows the identity of the city that becomes the go to place, independence, not the chains. But the Buffalo Bills by far since 1983 that became that immediately. Reporter hes the new owner of Buffalo Bills brewery, a place considered americas first brew pub. A piece of heywards history that hes bringing back to life after the place closed its doors back in june of 2022 after two tough years struggling with the pan demobbing. And to figure that once you have one of those places shut down because of covid and because of the downtowns that are not just here in hayward and in many places, america is struggling to stay alive. Theres places like this one in particular that have such legacy. And just for heyward and caster valley that might be an independent like myself might be the right place to come in with that intent of leaving it with the same character and build off from there. The famous buffalo has been here since 1983. Reporter and alejandro says they continue to build legacy, the home brewer and freelance news photographer who opened this place back in 1983. Reporter so the local residents are excited to see this happen. We used to go there every saturday night for probably 20 plus years. And were a little disappointed that they closed with the pandemic and stuff that we have not been there for three years, but they closed, so it is good to hear that they will reopen and it will be good that they will stay the same. Reporter especially because this place has been a big part of the craft beer movement. But more than that, the guys say it was the familiarity of it that kept them going. And everything was by name, you know, we knew their names and they knew our names. They knew what we wanted. Reporter that is alejandros goal. He wants to keep the Traditional Craft beer and experience, but he is also ready to add some latin american styles especially because he says heyward is a diverse community. Or it could be at the blackjack table. One of the mystery fans to bring with you. Im just going to go there with a good add to do and see how long that will last. Okay, god speed. Lets take a look at whats happening weather wise. Closer to home, you can enjoy the cooler weather far while and the fog retreated to the coast. It will spread back across the city and the bay as we head through the rest of tonight. Even some patches of drizzle as we head through early tomorrow morning. Temperatures on the cool side through the end of the workweek. We are going to see some cloud cover floating into the skies over the bay area. The remnants of what used to be hurricane eugene that will happen by friday and saturday and even that little cloud cover, it is not going to put the brakes on the warmup that will begin kicking in this weekend. Once again, the weekend will bring in some of the warmer temperatures. More on that in a second. Lets track that tropical moisture staying well down to the south. The moisture when it is more concentrated will show up in the brighter colors. Youll see that kind of floating up towards us later it this week. But it does gets dispersed. Its just going to hang out through early next week with some passing clouds that we all need to monitor for any potential of a popup thunderstorm and the dry lightning threat that does not look like it will likely be a scenario around the bay area and well keep an eye on it just in case, but right now, its not overly concerned. The temperatures will warm up despite the presence of those clouds this weekend and back up into the 90s for many inland parts of the bay area as we head into the second half of the weekend. The outlook for the next ten days will show no extreme heat and the hottest day is next wednesday into the upper half of the 90s. But the heat waves that weve seen so far this year have been brief and intense. This one is going to be a little bit longer lasting, but not as intense. Either way be ready for a toasty stretch of weather as we would head into next week. Right now though, temperatures are pleasant across the board from Treasure Island downtown. 60s in the city and santa rosa dipped to 1 degrees below 70 in the moment. Everybody else in the 70s. Thiazide pretty nice territory for the august evening. Enjoy it while it lasts. The fog will be widespread locally dense and some patches of mist and drizzle. It wont take long for that fog to back out of the inland valleys, but more stubborn for the valleys of the north bay and around the bay, but well see the clearing as we head towards midday. On the coast, i wouldnt anticipate much clearing, but through the rest of the week. Temperatures tonight, dropping down to the mid to upper 50s in a few spots into the lower 60s. Once the fog dissipates, temperatures will start to warm up. Well freeze the map here at noon and the mix of 60s and the 70s inland with the temperatures around the bay in the 60s at lunchtime. Not going too far from there and top out at 70 in oakland and the mid60s. The inland temperatures with a mix of the 70s and the 80s. Even the warm spots on the maps reaching the lower half of the 80s. Especially for the inland parts of the bay area to reach above 100 degrees at this time of the year, well take this for as long as they want to stick around. And the dog walking forecast, its brought to you by the dog who is no longer with us, but the parents who wanted their picture on the dog walking forecast one more time. Happy to oblige. Temperatures will still be a little toasty, even below the average readings for inland parts of the bay area like antioch. Thats a little too warm in the afternoon, even though its below normal. Doesnt matter where you were if you wear that fur coat. The morning walk will be a better idea or wait until sunset to get out and about. Temperatures do warm up bit time we hit early next week. Low 70s in San Francisco. And upper 70s to oakland by next monday and tuesday. But until then, just a very slow warm up over the weekend. Temperatures inland will be more noticeably warm by monday and tuesday. Upper 80s in the santa clara valley. Low 90s and the mid to upper 90s for the trivalley and the delta. But again, no extreme heat. Just a trend towards substantially above average temperatures. Not even close to record territory even as that heat will peak by the middle of next week. Along the coast, what heat . Temperatures in the 60s. Okay, rub that down. Double down.
