Guys this is an interview that he never hoped to give. He certainly never wanted to be talking to me or anybody else in the media about this. And when you think about his life, its been seven months for the world but it is every day to him feels like march 13th. Yeah. I can only imagine. Like other recent nominees, barrett did not discuss how she would decide cases on the high court. She repeatedly told the committee she that no policy agenda an did not want to be used as a pawn. Nancy cordis is covering the barrett hearings. Nancy, good morning. Reporter anthony, today senators on the committee get 20 minutes each to follow up on questions they feel were not answered yesterday. Which as far as democrats are concerned covers a lot of territory. But republicans like the fact that barrett is being cautious. They think barring some major stumble today victory is in sight. I have made no pre commitments to anyone about how i would decide a case. Reporter barrett insisted tuesday she does not have it out for obamacare. Im not here on a mission to destroy the Affordable Care act. Reporter but democrat Vice President nominee Kamala Harris argued barretts past criticisms, including a 2017 article suggest otherwise. How many months after you published that article did President Trump nominate you to be a judge on the court of appeals . I believe my nomination to the court of appeals was announced in may of 2017. Will you commit to recusing yourself from any case arising from a dispute in the president ial Election Results three weeks from now . I certainly hope that all members of the committee have more confidence in my integrity than to think that i would allow myself to be used as a pawn to decide this election. Democrats tried unsuccessfully tuesday to pin barrett down on issues like abortion. Are you willing the say that roe was correctly decided . Its inconsistent with the duties of a sitting judge to take positions on cases that the court has decided in the past. Reporter Louisiana Republican john kennedy arg you gooed that judges personal views are irrelevant because they take an oath of impartiality anyway. Are you going to take that oath and affirm it if you are confirmed . Yes. You are not lying . Im not lying. I took that oath before i began as judge on the seventh circuit, and ive not violated that oath. And i would take it again. Oaths are serious to me. Reporter there were some tense moments after barrett declined to say whether she agreed with the courts decision leapizing samesex marriage. I do want to be clear that i have never discriminated on the basis of sexual performance. Reporter hawaii senator mzie hirono. Sexual preference is an offensive and outdated term. It is used by lgbtq activiststs to suggest that Sexual Orientation is a choice. I certainly didnt mean, and, you know, would never mean to use a term that would cause any offense in the lgbtq community. So if i did, i greatly apologize for that. Reporter at one point during the hearing judge barrett was asked to hold up the notes that she had in front of her, and you can see she held up a blank page which was meant to highlight the fact she was answering hours and hours of questions about detailed legal arguments without any notes at all. Tony. Blank page but not a blank mind, nancy. Thank you very much. Americans already showing their determination to have their votes counted with the election just 20 days away. He was with taylor when she was killed by Louisville Police officers on march 13th. He told us they were in bed watching a movie when police raided the apartment as part of a narcotics investigation that was targeting her ex boyfriend. Should point out Kenneth Walker and Breonna Taylor do not have a criminal history, and no illega. We went to louisville over the weekend to talk with Kenneth Walker about that night. To the world this a hashtag and picture and all that. But to me it was much more. More than a girlfriend too, i think thats what i want the world to know the most. That was my best friend. The most important pretty much to me on the earth. And they took her. Lets go back to that day. What kind of day was it for you two . It was a normal day. It was a relaxed day. Really just chillin and just being us. You know, we went on a date, went out to eat. Went back to the house planning take us to that moment when you life really changed forever. It was a loud bang at door. And nobody was responded when we was saying who is it . You all did ask who is it . I dont know. Shes on the ground, i dont know. Is she alert and able to talk to you in. No shes not. Brie. And in the midst of talking to 911 breonnas mom should know about this too. I hung up and called her mom. The police didnt come rushing in . Not at all. I dont think i realized it was the police until i was on the phone with breonnas mom. I hear people outside talking. I thought they were coming for help because i called 911. You think theyre coming to help you . Yes. When i come outside theres guns pointed at me being threatened with dogs and whatever else. Put your hands behind your head. [ bleep ]. Thats whats going on. The officer asked was i hit by any bullets. I said no. He said thats unfortunate. Whats he mean by that . Thats unfortunate after you just lost your girlfriend and you dont know whats happening. And what did you think . I didnt know what to think. I wasnt worried about me. Only reason im out here is because the only way for her to get help is to be out here. We were scared. We didnt know who it was. Walk. We didnt even know who it was. I was in the back of the car. I dont know. I got drug all the way down the street. It was cold and wet. I didnt have on any sacks or shoes. They were just dragging me like i had scabs and stuff on my feet from that. When we left the scene we pulled over in a random parking lot which is a street at the bottom of the hill down the street from breonnas apartment and another officer in an unmarked car and he wasnt in uniform and stuff and he came to my window. His tone was different than everybody elses who was just on the scene . How so . He told me this was a misunderstanding and were going to get to the bottom of it and asking me did i need anything, did i need water and this and that. Hey, can i he get your name . Kenneth walker. Man, there was a little bit of miscommunication. I wanted to talk to you before they left. When i got to the Police Headquarters or whatever it was, they took the handcuffs off of me and everything. I was Walking Around and went to the bathroom. Go ahead. When you get in there you can take the handcuffs. Clearly you all know something is wrong. You dont youre allowed to move freely. Yeah. You dont allegedly shoot a Police Officer and they take the hand cuffs off you. Were you surprised to hear that you were accused of shooting a Police Officer . I definitely was surprised but i was more concerned about is he okay and is breonna okay. At this point i still didnt know if she was alive or not. When did officers tell you you were going to be charged with attempted murder. When did you hear about that . Maybe 5 00 or 6 00 in the morning. What did you think . I was worried if breonna was okay or not. When were you told that breonna didnt make it . I never really got told like directly. I saw it on the news. They didnt te thats how you heard Breonna Taylor died was on the news. I was in the cell and it was on the news, one female dead, confirmed dead. You know, i didnt know for sure what condition she was in when i left. So i didnt know what they did. As his body cam videos and stuff come out, i see they did nothing. Clearly we see the s. W. A. T. Team in there and she was still in there. Theyre still like casing the apartment with her laying there on the ground. Now a crime scene. Lets move out. All right. Shes done. Disrespectful. Do you think if you had not survived this incident, that we would be hearing the story were hearing today . If you had not survived it . Definitely not. There wouldnt be a story. You probably wouldnt even know about it. If i didnt live you probably wouldnt have known about Breonna Taylor. Breonna taylor or kenny walker. Or kenny walker. I dont want everybody to know about kenny walker. As long as they know about Breonna Taylor. What do you want us to know about Breonna Taylor . She would have did anything for anybody. She took care of a lot of people. A lot of people that need her bad right now including me. Wow. A grand jury accepted the Kentucky Attorney generals recommendation not to charge any officers for Breonna Taylors death. Both the Louisville Metro Police department and attorneys for three individuals declined our requests for interviews or comment. Im struck, kenny walker, you can see is shattered, still in as lot of pain. I think this interview was difficult. That night they were watching a movie called freedom riders and he went to watch it again and still gets triggered by songs, movie, certain types of food. Its important to discuss and stress no criminal record. It was the first time hes ever fired his gun when he wasnt on the shooting range. He goes, im not really even sure i hit the Police Officer. They told me i did but im not really even sure about that. I think everybody in america should watch that piece because they think they may have an idea of what happened and this will change your perspective. It comes down to accountability and proportional use of force. Yes. This is a legal kentucky gun owner who fired one shot into what he thought was an intruder and got 20 plus bullets from multiple people on the outside who couldnt see what was happening. Thats not proportionate. Totally dark in the apartment. That was interesting too about calling 911. He said why would i call 911 if i thought it was the police. Clearly by what he says to 911 he doesnt understand whats happened. Yeah. Thats the really compelling part too is the way he was treated there and then the different way he was treated at the lipolice station. Few other think that was a disciplined response to Kenneth Walkers single shot. Its a lot of questions and more of the interview in our next hour. Well have more of what he says including his reaction to the nationwide protest over Breonna Taylors death. He said to a lot of people shes a hash tag, not to him, and how he is handling his grief. Ahead well look at the stories youll be talking about today. Well be right back. U are not f, and youre going to find yourself where you need to be. The race is never over. The journey has no port. President trumps Supreme Court nominee is back on capitol hill this morning after a full day of answering questions. Questioning judge amy coney barrets stance on abortion rights and guy marriage. She side step those and said she would not forecast her visions. She says she would not let her personal believes get in the way. Judges cant wake up one day and say i like guns and dont like guns i like abortion or dont like abortions and be a queen. I have made no commitments to anyone not in the senate or the white house how i would decide on a case. She was asked if she would vote to overturn the Affordable Care act. Senator harris asked about preexisting conditions. What weight would you give to that Many Americans are depending on the Affordable Care act . I cant really say. Thats part of the legal calculus of the case. Judge barrett does say people with preexisting conditions would be considered in the case she will argue next month but she would not specify to what extent. January, good morning. Judge barrett is certainly not the first Supreme Court nominee to side step where they stand on particular key issues. She stuck to that Supreme Court script that goes back to 40 years to when j us tis Sandra Day Oconnor was sitting in that chair. No hunts or forecasts or how they would describe any issue that come before them. What is notable, she didnt shy away from her personal views. She is forth coming that she is a woman of deep faith, shes catholic, she is prolife but stressed that she wouldnt impose her personal views on anyone and wouldnt do that as a justice. I havent seen that before. Being forth coming and not dancing around the issues of who she is personally. Does that give you a sense of what kind of judge she would be . In way way. She flat out said, i would see the law, determine the law much like my own boss who was one Justice Scalia and thomas are really conservative. Most wouldnt see a lot of daylight in there. That tees up almost an historic first for this nomination. She sko be the first conservative woman with that strong overarching judicial philosophy. I say it all the time, as a mom, you want the best mate for your children. She completed us. She completed the family. On the night of the police raid, in his fear and panic, he called his mother for help before calling 911. She rushed to the scene. Recordings show she spoke to the officers about her son told her that night. He called me and said, mama, they kicked in the door. I dont know whats going on. It is one of those calls as a mom, we hope we never get at 1 00 in the morning. He couldnt tell you what happened, could he . He didnt know. I didnt hear anything at first. I just heard him screaming and crying. What is your biggest concern for you today for kenneth. As a mama, i can see things about him he doesnt even realize. When he was a kid, i could kiss it. I cant fix this. I only listed to that 911 call once or twice. It took me months to listen to it. My whole life, ive been there and helped him. I couldnt help him. Because he was considered a suspect in the beginning. Reality is, hes still a suspect in their mind. Hes still a scapegoat. The chaos that followed. Walker was indicted for the murder of a Police Officer. Those charges were dropped without prejudice which means they can be brought up again in the future. The simple lessons we teach them and hold true. Aint nothing good for you at the street. Stay at home. Here you are this one time, you at home. And you get in the worst trouble youve ever been at home. And you did nothing wrong. But do what you were taught to do. Be a man. Protect your family. Tell the truth. Hey, stop playing with me. It is like march 13, every day. I never got to say bye. That makes a big deal. A big difference. When it first happened, you are labeled a suspect. Breonna is labeled a suspect. The Police Officer shot was labeled a victim. What do you make of that . Thats usually how it goes when you are black and deal with police. I dont see this as a black white issue. It became that after. This is a right and wrong issue. It dont matter if hes blue or pink. It could have been elderly people there orchids. It was just wrong no matter who was in there. It definitely turned into a black and white thing when i walked out. We should say neither you or Breonna Taylor had a criminal history of violence or drugs. That doesnt matter to them. People like to skip over that part. Where do you go from here . I look at you and i just see so much pain and right fully so. Do you have friends helping you. I do have a therapist. Ill be talking to him a lot more. I dont agree with therapy but youve got to try everything to try to be okay. When we hear the chant, say her name, what does that mean to you . Shes getting the respect she deserves. Thats the least that could happen. What does justice look like for you for Breonna Taylor. She should be right here next to me. Thats the only justice for me. Wow. None of the officers involved were charged with her death. The Louisville Police department and attorneys for the officers responded to our request for response. Because he couldnt go to the funeral because he was in prison for attempted murder of a Police Officer, Breonna Taylors mother gave him a little urn of the ashes. To be able to hold it and see it, i could physically feel that. Of course, it means a lot for him to have it. There are so many inconsistencies in this story. This started with a warrant that was clearly miss guided. They were at the wrong place. I want to know how that warrant was there. It is not black white. It is a right wrong thing. And his story has never changed. His attorneys were there. They can fill us in about why that warrant came be and how this story went awry. It started off playing uno and watching a movie. There is nothing more sad or tragic than a pair of baby shoes never worn. Tomorrow, youll hear from walkers lawyers who spoke with us about his case. You are watching cbs this morning. And when the big corporations pay more, your tax bill goes down. Thats right. A savings of a hundred twentyone dollars a year for the average home. Give homeowners a break. Vote yes on 15. They say david deserves a gold star but no child should have to go through something like. This and while he gets a gold star for bravery. I cant help but think of the echoes between this story and what he with just talked about with Kenneth Walker. That is what he thought be happening. Gold star for young david. Kenneth walker is in a world of trouble and hurt. And think about Kenneth Walker. Ever since i met him. I cant stop thinking about him. You think being awakened in the middle of the night at 12 00, 1 00 in the morning that is normally not a good sign. You are disoriented. It is black. You cant see anything. And to this day he when he says i dont really know what happened. He really doesnt know what happened. He said i even asked when they said i shot the Police Officer, i wanted to know how he was doing. Oh my god i hurt a Police Officer . His dad a retired military official. His mom a career educator. He said i would never knowingly shoot at a Police Officer. And it is interesting to me that after the big noise that he had time to call his mother first, then 911 then prooents mother. No one had come in to say were the police. So he still didnt know what was happening to him that night. Yeah. I think anthony has it right though. This all does come back to the warrant. Why were they there in the first place. And what were the police told when they showed taupt doorstep. Answer that tomorrow. The attorneys have a lot to say about that. Well be right back. Welcome back to cbs this morning, it is time to bring some of the stories that are talk of the table this morning. Anthony you are up first. Im starting this off. I have a new song that honors the late broadway star nick cordero. It is performed by band members from the musical waitress. He was in the original cast. And it is called lucky streaky. And i always knew that you were the one i give you my heart and you gave me a son it was so alive we were so alive mega who played guitar in the band wrote and produced the song. Cordero originated the role of earl in waitress on broadway. He was an incredibly vibrate and fun loving guy loved by the entire cast and crew. His wife and their son, cordero died in july of course of coronavirus complications. He was only 41 years old. You know how we all feel about amanda and elvis. And people still cant believe hes gone. Perfectly healthy. 66, strong, vibrant and no underlying condition. Sarah brel la said she wept as she sang the song. Very cathartic. And our thanks to the band and the cast who shared photographs too of all that. Beautiful, beautiful song. Powerful song. Yeah. Ive got a scientific dispatch from the frontiers of male idiocy. Research suggests that real men dont need sleep. At least thats what real men believe. Is it study appears in the journal of association for consumer research. And men who got less sleep were viewed as more assertive, more individualistic, more goal orientated. In general more manly. Yes. But hey there is a downside here. Inadequate sleep no matter how manly has been linked to all kinds of health problems. Including increased instances of heart attacks, diabetes, depression. I think this is what we call toxic masculinity. Yeah. Thats what it is. And the other big problem if you dont get enough sleep you dont think so good. True. I noticed that. I dont talk so good either. Male idiocy. Is that a big group or small group . How big that club . It is about 50 of the population. Pretty big group. Mine is about kraft macaroni and cheese. Facing a backlash for an ad campaign. What . They say it is too naughty for some people. Some people say this. The Online Campaign encouraged people to send noods to that you are loved ones. Ads like this taken down after complaints the campaign was inappropriate making kraft macaroni and cheese a sexual thing. Kraft says it appreciates all the feedback and is now removed the content. I thought this was creative. I thought this was great fun. I know we will live in an era of Political Correctness but there is nothing about the kraft macaroni and cheese noodle that looks like a body part. If you do then you should see medical help. I could see if it was an egg plan or peaching something but it was just a fun thing to say about kraft macaroni and choose. Yeah it was kind of fun. But please dont send me pictures of fun. Its a safe and nutritious way for young people to flirt with each other also. Yes. And nudity is okay in the right circumstances. Just having fun with it. Thats right. You mean real nudity or noodle noodity. The message kro that you cant talk about nnudity with c is crazy to me. And if you hold the box up just right you can send a nood that is not really a nood. There you go. We are making a turn here. Yes we are. We are learning troubling new details how the pandemic is affecting female workers. And this is serious. In september, four times more women than men left the workforce according to the National Womens law center. In a new study by mckenzie and company and leanen. Org warns the crisis could erase all the gains women have made in recent years in the workplace. The report says one in four women is considering leaving their job or down shifting their career because of the pandemic. We spoke with three women who recently left a job. I never thought i would have to leave my job. I had a lot of anxiety. I was not sleeping at night. Because i was so worried. I was the general warehouse associate. When covid first came out we were not six feet apart. It was very unsafe. I have a oneyearold. She has breathing issues. And i also have a 13yearold. She has a rare type of cancer. And i really had to leave my job because of them. My kids are way more important than this job. I was working two jobs. One was during medical and scientific communications. It was my dream job and the other was freelance job. I was working the two jobs and i start ad Covid Response project and was delivering food to frontline workers. It was all too much. I was going to bed at 3 00 or 4 00 a. M. I chose to let my main job go. I was a third grade teacher. I decided to quit my job because i didnt feel comfortable puttingy four and a half month old in day care with covid. Almost done. Were getting there. Just human nature as a mother to want to do whats best for your family and if that means taking a step back to ensure safety, then i think thats a decision that many would make if it is possible. Rachel thomas is cofounder and ceo of leanin. Org. And lorena lee, they both helped write this report were talk about this morning. Rachel to you first. We just heard from a mother who left her job to spend time with her children, to be there for her children. Thats actually really common. So the question comes to mind what do Companies Need to do to support these women . Also what do spouses partners need to do . And what does society need to do . Companies are taking steps to support women right now but the problem is they are not doing enough to address the crux of the issue which is burn out. Women cannot be expected to live up to business as usual expectations right now. Nobody can. So what does that look like . Companies need to start asking some tough questions. Were goals set before the pandemic . Are they atapeable and realistic now. Should performance reviews look like before the pandemic . Probably not. And companies also need to set new normts for how they are working. Perhaps no emails after 8 00 p. M. At night. We know women and all employees feel like they are on 24 7 right now and Companies Need to address that head on. Yeah. Lorena, to you. Because the pandemic coincided with this National Conversation about racial justice. And i was interested in the re they might be d doingng in thee afte of t thingngs like the s shooto jormrmd. Does thahat n numbeber surprise . I it doesntt surprise m me franklkly. Even befefore covid there were huge disparity for women of color. We know women of color and particularly black women had fewer opportunities, fewer mentors and sponsors. And when they looked up at Corporate America they saw fewer people that looked like them. And could be role models for them. And then what happened with covid . We saw that back women, for instance, saw three times more likely to face the death of a loved one and felt more uncomfortable sharing that. And i was surprised it was 1 out of 3 managers. On the other hand its mom surprised. Particularly in a manager is white or male they may not be sure how to reach out. May find it risky. Not sure what language to use. What advice for how manager kansas mas can make that call and have that p such a great question and i is really important. Because if you step up to be an ally it actually matters a lot. We know that black women who had an ally over the course of the pandemic are two and a half times more likely to see a fair workplace and to want to stay and feel encouraged and motivated. So being an ally, stepping up and speaking out and asking the basic question of what is going on in your life and let me be there. Let me understand. And let me make sure you still have opportunities in the workplace. Rachel i want to jump back to you. One of the Amazing Things thats happening right now is that it is not just women who are in their first position that are leaving. But women in senior roles who are mid career or even later. They are stepping back. And that is a loss because the kind of chain of success is broken. Those women are likely to be mentoring other women. How do you keep those women in those jobs . What coCompanies Need to do to say hey stick around. I know it is hard now but we need you. The crux of this for a lot of women what. We know is Senior Leaders are facing a lot right now. They are running businesses that are sometimes failing. Employees are struggling. And senior level women are facing the same stressors as senior level men but then some. They feel like they need to work harder. They are more likely to be burned out. And they are more likely to think about leaving the workforce. And as you said, we cannot afford to lose senior level women. When there is more women in leadership, Companies Perform better. They have better cultures and back to that mentorship and alliship that lareina was talk about. Were allies mentors and sponsors so we cannot afford to lose senior level women. Organizations need to be doubling down to make sure they feel supported. If leaders dont feel supports it is hard for them to bring their best severals and the empathy they need to make sure other employees are getting the support they need. Lareina, there is an important question i want to get to to you in particular. California pass ad law recently requiring boards to have at least one woman. And even more recently, the governor of california sign ad law requiring those boards to have a person of color. I think an executive director position. Do you think quotas like that, which dont make it just a duty but a legal responsibility are a good idea, a good way to reach these goals . Well weve had quotas in europe before. And i think it is not so much the issue of a quota per se. But do companies have clear targets and goals . Are you actually being specific about what success looks like . It is not just more women, how many women and at what time period. And if you are not clear on your goal, how do you expect the rest of the organization to follow suit . We know what gets measured gets watched. And what gets measured gets done. And as rachel said we also know that diversity at the top level of a Management Team and a board creates Better Business performance. So why would you say no to that . Yeah. Its a good question. Companies send goals for everything else. They put numbers on it. So why not put a number on this. Rachel thomas and lareina yee thank you so much. Very important report. Ahead, from space heaters to blankets to sidewalk bubbles. How outdoor when you take a look at her record, it all begins to unravel. A look at how some are getting creative to keep diners warm and safe. Vlad, good morning. Winter is coming and Restaurant Owners are working hard to make sure Outdoor Dining areas are Still Available when the cold weather arrives. Some ideas including propane heaters or insulated domes to keep diners warm and the food hot. It is getting a little nippy. Yep. It is going continue to get nippy. Reporter as temperatures start to drop Restaurant Owner and chef alex rush is now faced with a new reality. When restaurants were able to reopen and business started to come back, but then you realize it was going to get hold. What were you thinking you would do . Im always think about the worst. I feel like that is part of my job unfortunately. Reporter the worst may not be here yet but chef alex is preparing to bring the heat at her brooklyn restaurant. Reporter are you worried at all people might not want to eat out here when it gets cold . Definitely. Reporter as the industry reckons with the new normal, restaurants around the country are finding ways to provide warmth and comfort for diners while continuing to serve their dishes hot. Its pretty uncertain as are all things right now. Were just trying to figure out what were going to do. Reporter already ailing businesses are spending thousands on outdoor heaters, complimentary blankets for diners. And it is going to keep getting cold and older and what are we going to do about it. Reporter and outdoor greenhouses. The pandemic forcing owners to think outside the box, or in some cases outside the bubble. I can tell you that with everything going on in this world, eating in the bubble is about one of the best experiences you can have. Reporter in detroit the east eats restaurant is taking that experience to a whole new level by installing about a dozen insulated domes. Actually completely transformed our domes into igloo domes. So you can be there in the rain, in the snow. It is absolutely necessary to protect you, protect other diners. In chicago mayor lightfoot asked the public to submit ideas for a winter dining challenge. Among the winners these cozy cabins and heated tables. Here in brooklyn while Indoor Dining resumes at 25 capacity, chef alex is going all in on outdoors. Right now the best prospects are Outdoor Dining. It is where most people feel the most comfortable. And i think people are willing to bundle up and tough it out. Chef alex is still waiting for the citys approval to use those appropriapropane heaters. While the insulate domes can protect diners from the cold, they are not proven to protect you from the coronavirus. They do encourage customers to socially distance from one another and it is important to still wear your mask when you are not eating. I know thats what i want to know.
