Joe vazquez is at the scene live right now with this developing story. We have an active investigation scene behind me. You can see what is at the center of this investigation, that white vehicle at rest now against some outdoor restaurant tables. This is the dynasty chinese Seafood Restaurant on story road. Folks were enjoying dim sun at their outdoor tables under the canopy when suddenly their meal was violently interrupted. That white toyota 4 runner crashed right into their tables. Witnessed saw the driver about 50 yards away in the parking lot. He appeared to be revving his engine just before the crash. You know how youre doing a peelout and your tires start spinning and smoking . His car popped up over that sidewalk. I feel bad for the people on this side because they couldnt see. Ere get ou the way reporter the driver was described as an older gentleman. He was also being treated. At this moment its still not clear what kind of medical emergency he may have experienced before the crash, but right now he is being evaluated. Reporting live in san jose, joe vazquez, kpix5. Thank you. Our other top story, an investigation is underway after a man was shot and killed by police in San Franciscos upper market area. Kpix5s devin fehely spoke to neighbors who believe the crime leading up to the shooting was one of desperation. Reporter neighbors say that they were saddened but not altogether surprised by this shooting. Many of them say that this area is in their estimation changing and not necessarily for the better. We we have a suspect at gough and brady. It speaks to a level of desperation thats being seen all across the city. Its the increase of homelessness. Its the increase of drugs. Its the increase of poverty as a whole. So far uncompression, multiple gunshot wounds. Reporter San Francisco police have not released the suspects name or said exactly what led up to or triggered the shooting. Officers tracked down the suspect about a block away from the scene of the carjacking. The deadly shooting the Department Says was captured on the officers body worn camera. I would hope that things could be done nonviolently as much as possible, but policeman has got to protect his life, too. Reporter reminders of the deadly shooting littered the neighborhood a half day later. Remnants of police tape rung from a traffic pole and a fragment was tied to a storefront window giving rise to a feeling neighbors say that they are increasingly besieged by crime. Seems to be Getting Better and worse. You got a brandnew building here, but then you got tents and junkies over here of. People that might not normally commit some of these crimes of desperation, they dont care about the victim because the victim in most cases dont care about them. Reporter the San Francisco police Department Says they plan to release body camera footage of the shooting that should fill in some of the gaps of what we simply dont know right now. In San Francisco, devin fehely, kpix5. A town hall meeting will be held in the next two weeks to address the shooting. New at 5 00 safety protocols during the pandemic may have contributed to the death of a San Francisco firefighter killed during a training exercise. According to a report from the fire department, a water blast knocked 42yearold jason off oa floor rag. Tragedy may have been made worse by confusion over covid protocols. Only four firefighters instead of eight participated in wednesdays pump drill. For some reason cortez left other firefighters and went to a fire escape where he inadvertently opened a valve. That valve didnt have a hose connected to it and water streamed out as much as 100 pounds per square pressure inch knocking him over. We have posted the full Fire Departments report on our website at www. Kpix. Com. Now a live look at capitol hill, the Senate Judiciary committee charging forward with Supreme Court hearings tomorrow for President Trumps nominee judge amy coney barrett. Senate republicans are fast tracking the process just weeks before the november election. As britt conway reports, democrats are calling for delays and demanding judge barrett reach cues herself from certain cases if shes confirmed. Reporter President Trumps Supreme Court nominee is gearing up for a grilling on capitol hill. Lawmakers spent the weekend calling for delaying any hearing to fill the vacancy until after the election. Two republican senators have said theyre not going to participate in this farce. If two more join them, then its game over. Reporter democrats also taking issue with judge Amy Coney Barretts position on key issues. Its rushed. It constitutes Court Packing and her views are too extreme to qualify her to serve on this court. Reporter the hearing comes just ten days after two republican members of the Senate Judiciary committee tested positive for covid19, but republicans are vowing to move forward. I think they are looking for anything to delay things even a day or two or three and i think the Senate Republicans will follow the medical guidance of the capitol physician. Reporter despite the growing calls, Senate Judiciary chairman Lindsey Graham said hes moving full speed sp precautionary moves from some democrats. This weekend new york senator Chuck Schumer demanded judge barrett recuse herself from certain cases if shes confirmed to the high court. Given judge barretts conflicts of interest, she should recuse herself from any decision involving the Affordable Care act and its protections and any decision related to the election. Reporter im britt conway reporting. And tune in tomorrow for a cbs news special report on the confirmation hearings. That starts at 6 a. M. Today dr. Anthony fauci is pushing back against a Trump Campaign ad. Yes. The ad includes a clip of dr. Fauci from an interview. The ad made it appear that he was praising the president s coronavirus response. However, the Infectious Disease expert said today his words were takcontext. In this statement dr. Fauci said, the comments attributed to me without my permission in the gop campaign ad were taken out of context from a broad statement i made months ago about the efforts of federal Public Health officials. He added he has never publicly endorsed any political candidate during his entire career of Public Service spanning nearly 50 years. Meanwhile President Trump is now claiming today that he is immune to covid19 after his doctor cleared him to resume public activities, but according to the cdc, of course, there is no evidence that coronavirus survivors are immune. In fact, Research Indicates it is possible ting reinfected. Looks like im immune for i dont know maybe a long time, maybe a short time. It could be a lifetime. Nobody really knows, but im immune. Today twitter also flagged this tweet from President Trump claiming that he is immune. Twitters warning label says the tweet violated the twitter rules about spreading misleading and potentially harmful information related to covid19. With three weeks until election day more than 7 million americans have already cast their ballots. So far democrats lead republicans in the six states reporting returns by party. However, in Southern California Election Officials are warning about fake ballot boxes. In fact, take a look at this one set up outside a church in los angeles. Locals say the pastor posted about the box on his Facebook Page and urged people to come by and drop off their ballots. Now there are a lot of questions about who placed the box there and if the openly conservative pastor knew it was fake. So im really worried that someone put their ballot in there and that he just saw it was for a certain candidate or saw whatever and just tore it up and threw it away. This is far less than ideal in a far less than ideal election where we are desperately trying to tell people that they can trust the election system. The box has been removed and the local Registrars Office is trying to track down any ballots that might have been op thpastor, he has not responded to any comments. Here in the bay area San Mateo County is inviting the public to watch staffers process ballots starting on tuesday. Anyone interested can go to the registration and Elections Division office on tower road. You have until october 19th to register to vote. For more information on how to register online, go to www. The group marching after Santa Clara County supervisor joe semetian voted against a measure that would have allowed the county to study Sexual Harassment in schools. Its honestly really frustrating when your elected public official does not listen to you, especially when you go to their meeting and you take 45 people and iedyou to and they stillndo so it is really us t asking the supervisor to rethink his decision. Now on to our fire watch in wine country, we have good news from calfire. The glass fire is now 90 contained. Some fire crews are being released after fighting those flames for nearly two weeks now. More than 2,000 structures are still threatened, but full containment is expected by october 20th. Its scorched more than 67,000 acres across napa and sonoma counties. And still ahead how the nfl is supporting people on a journey to be their authentic selves. Plus keeping a beloved San Francisco tradition alive, the italian heritage parade goes virtual. And this is a uniquely wonderful day. Youre hard pressed to find any smoke in that view right now of california. Home youre enjoying this sunday, but the pattern will change, big when was the last time your property tax bill went down . What . Never. Are you kidding me . For years, the residential burden has gone up. While the corporate burden has gone down. Prop 15 reverses that. It closes corporate loopholes and invests in schools, small business, and firefighters. And when the big corporations pay more, your tax bill goes down. Thats right. A savings of a hundred twentyone dollars a year for the average home. Give homeowners a break. Vote yes on 15. Today is National Coming out day, an invitation to those in the Lgbtq Community to go public with their feelings. And the goal is to provide a safe space and day fothose to do so. The nfl is sharing its own message for those within the community. It will air a special psa during todays games supporting players who have come out and urging other athletes to do the same. Today on National Coming out day. We come together with one clear message. To all current players who are thinking of coming out. When you are ready, so are we. Its part of the leagues it takes all of us campaign and coming up at 6 00 well be talking to locals in the community about the struggles theyre still facing and how theyre helping to empower others. Normally this time of year thousands of people would pack San Franciscos north beach neighborhood this weekend for the annual italian heritage festival and parade. Dont know if youve noticed, but this year is not like other years. So this time its all mostly online. The festive video posted on youtube by San Franciscos italian herilus local groups celebrating the culture and contributions of italian americans and in addition to music performances, we saw shots of the ferrari club and the figure skating brian ritano making italian cocktails, of course, with his dog. Taking a live look outside from our exclusive salesforce camera, it is expected to heat up and dry out in much of the bay area this week. The north bay could see high winds and we learned the bay area could actually see Public Safety power shutoffs wednesday . Yeah. Pg e is in charge of that decision. Theyre the ones who put out the Public Safety power shutoffs. Were just about a day too early for the National Weather service to start saying whether or not well have red flag warnings. Thats where you get the heightened level of alertness in the mountains for offshore winds. Wednesday and thursday would be the days for that, but before i get into that lets talk about the increase in temperatures. Concord, im going to use you as my example. The average daytime high for right now in concord would be 77 degrees. Today was 83 and you probably didnt notice. Maybe it didnt feel like it was 6 degrees above average, but it was and were just getting started. Watch what happens. Over the next four days and by the time weve gotten to thursday, its now 95 degrees for the daytime high. Now yes, october can be sunny and warm for us, but thats 20 degrees above average. This is going to be a significant warmup for us even going into october and to show you what the fire weather looks like, the best part about this satellite is you dont see any smoke unless you use a magnifying glass and look right there. You can see a little smoke off the creek fire. This is a glorious day, one of the best looking days in possibly even months over the state of california, thur e. H watch whhappens when we change our Vantage Point and put the winds on there. You can see this big counterclockwise circulation in the pacific and as that thing migrates towards us, that will increase northerly winds. The closer we get to the eastern edge of that big clockwise spin, that starts to drive the winds down our way and you can see the area on there highlighted in the deal early shades. Once you start to get into the deep shades of red, youve got gusts high enough, this starts to look like fire weather. The reason why pg e is already talking about safety power shutoffs is because when we get into wednesday and thursday is because of gusts like that and the terminal the National Weather service puts out red flag warnings, fire weather watches, they havent done that yet, but its early. Air quality is still an issue. Even though it looks great, weve got good air quality out there right now, but the possibility is always there for a little smoke to drift our way. Morning lows midand upper 50s and daytime highs tomorrow bring us to the upper 80s. We saw concord as our example, but that was just one location. Everybodys going through a warmup. If we put it into the sevenday forecast, youll see the differences here with inland numbers on top going to the mid 90s. In the bay well get near 90 by the time we get to friday and you can see the temperatures along the coast will warm into the midand upper 70s. Dennis, over to you. Crazy, crazy day in the nfl. A couple shockers in the league together and the 49ers bench, jimmy g. Against the dolphins and the raiders go into arrowhead and Jimmy Garoppolo back under center for the 49ers today, but for the second week in a row San Francisco switched quarterbacks in the middle of the game. Jimmy g returning this afternoon after missing the last two games. Miami is rolling with 37year old ryan fitzpatrick, looked 27 today. Thats a touchdown, 70 fins. 49ers elevated corner back bryan allen from their practice squad. It cost them, gave up a 28yard pass to devante parker, sets up an easy touchdown, 140 miami. Now the dolphins clearly had a game plan with bryan allen in mind. Fitzpatrick to parker again, 21 7 dolphins. Allen was then benched. 49ers offense is capable of mounting a comeback, but not when jimmy is making throws like that. Double clutches, easy pick for bobby mccain. 277 miami, another terrible throw by jimmy, way over Deebo Samuels head, picked off. Garoppolo was benched in the second half by kyle shanahan. 49ers are crushed at home, 43 17, the most points they allowed at levi stadium. 49ers fall to 23. Kyle shanahan explained the garoppolo move after the game. Just the way the whole game was going just kind of watching how we were playing as a whole, how he was playing. You could tell that he was affected by his ankle. You can ask him more when he gets in. I know he doesnt normally throw the ball that way. I think he was struggling a bit because of it and the way the going i wasnt going to keep putting him in those positions knowing we were going to have to throw it a lot to come back. Jon gruden considers kansas city the raiders biggest rival, but it hasnt been a rivalry much of late. Mark davis is pointing towards victory at arrowhead stadium. Raiders put it away on josh jacobs second tour of the game. They win it 4032, the raiders first win in kansas city since 2012 when the quarterback was carson palmer. Ive taken a lot of sad walks up that ramp. You see what im saying, but not today.
