Thats where we begin. A lot of anger over the grand jurys decision in the Breonna Taylor case. Two officers were shot last night during the protests. That is not okay. Two officers involved in taylors death were not charged. Now the shootings marred what had been a largely peaceful demonstration of outrage in a city where a state of emergency had been declared in advance. Other protests across the country remained peaceful with thousands marching for change late into the night. All of this renews the call for accountability and how police deal with black americans. Our National CorrespondentJericka Duncan is in louisville. Jericka, lets start with that shooting last night which threatens to undermine that message. What do we know . Yeah, good morning. Well, right now we know that those two officers who were shot at were transported to a local hospital and are expected to be okay, treated for what appear to be nonlifethreatening injuries. But all of this comes at a time when a city is still grapple with the death of Breonna Taylor and now the words from the state attorney general here that the officers who killed her were justified. Officer down. Right there. Officer down. Reporter it was a frantic scene around 8 30 last night after two Louisville Police officers were shot. Interim police chief r Robert Schroeder says a suspect is in custody. One is alert and stable. The other officer is undergoing surgery and stable. Breonna taylor reporter although protests started peacefully, some people set trash cans on fire. Around 100 people were arrested. The protests came after months of waiting for a decision in the killing of Breonna Taylor. Former louisville detective b t Brett Hankison was indicted but not related to breonnas death. The grand jury voted to return an indictment against detective hankison for three counts of wanton endangerment, for wantonly placing the three individuals in apartment 3 in danger. Reporter hankison was arrested and released on bail. The grand jury concluded he wildly fired ten shots and endangered the lives of a pregnant woman, a child and a man who were in an apartment next to taylors. Officers Jonathan Mattingly and Myles Cosgrove will not face state criminal charges. The use of force by mauthly and cosgrove was justified to protect themselves. This justification bars us from pursuing criminal charges in ms. Breonna taylors death. Reporter taylor was killed on march 13th as they executed a search warrant for drugs or money. Neither were found. Her boyfriend believes the police were intruders so he filed a single shot which hit mattingly in the thigh. Police returned fire. Six bullets hit taylor. Somebody kicked in the door and shot my girlfriend. Reporter walker has maintained police did not identify themselves before they used a battering ram on the door. Cameron said the officers did knock and announce. That information was corroborated by another witness. Reporter law professor Collin Miller has worked with taylors family. He believes the grand jury did not hear all of the evidence. And we have several witness accounts from neighboring apartments. The neighbors saying we never heard the police knock and announce. Reporter taylors family Attorney Ben Crump called the decision to not charge any officer in taylors death outrageous and offensive. It continues to disrespect the black women they have permeated in American Society since they first brought us here in 1619. Reporter the fbi is also conducting an investigation. One of the things theyll be looking at is whether or not police obtained this warrant using false information. And hankison is also under investigation by an fbiled task force into allegations of Sexual Assault unrelated to Breonna Taylors case. Jericka, thank you. Kenneth walker was charged with attempted murder of a Police Officer after the raid in march but those charges were later dropped. He is now suing the Louisville Metro Police claiming misconduct. Early this morning we asked his attorney, steven romines, about the jurys conclusion that the officers actions were justified because Authorities Say that walker was the one who fired the first shot at them. Well, in every other situation in kentucky, a justification of selfdefense is determined by a jury. And it should be in this case as well. When we start letting elected politicians determine who should be charged and who shouldnt, then we are going down a very dangerous road. It is the exact opposite of the way our criminal Justice System should work, and unfortunately, it happens oftentimes in Police Shooting cases. That the prosecutors say, well, the police were acting in selfdefense. The police do not have any higher right to selfdefense than any ordinary citizen does in kentucky. Now because steven, wasnt isnt your client saying he was acting in selfdefense . When you listen to his 911 call, he clearly didnt know they were Police Officers. Absolutely not. And that is why the case was dismissed against him was that he was acting reasonably acting in selfdefense. And hes in his own residence. So he has a presumption that hes acting in selfdefense. Weve got a dozen neighbors who were interviewed by police as well who said they never heard the Police Announce that they were police. Theres no question they were beating on the door. But they never announced as police. Attorney general cameron said, well, the two police said they announced. So were going to start taking the word of the targets of the investigation as exculpatory . They also said they had a witness who said that correct. Heard the Police Announce themselves. Yes, and that witness, that witness, gayle, was interviewed by the police three days after this happened initially. And he stated, i did not exact words. Did you hear them announce as police . He said, i never heard anyone announce as police. He was subsequently interviewed two more times over the next month by law enforcement. He eventually says, yeah, i yeah, i may have heard them announce they were police. In fact, i saw a uniformed Police Officer. Thats after the shooting had already occurred. There seems to be some confusion, too, about the ballistics in this case. What do you know about that . Well, i know the ballistics done by i know what the ballistics done by the Kentucky State Police show and that it was whether or not Kenneth Walker shot or hit sergeant mattingly, it was inconclusive. Ive got the documents. And the attorney general camerons got the document slrkss but i dont know why he wants to play these games about talking about small portions of the evidence and not releasing the entire file. Release the entire file and let people make their own decisions, which is the same thing of, indict them. Apply the presumption of innocence, apply the rule of reasonable doubt. Let them go to trial. And if they are acquitted like everybody else, fine. But do not by prosecutorial fiat say theyre innocent, exonerated and im going to decide they dont get prosecuted. Well, there are still the other thing about it, gayle, is the issue of selfdefense justification in kentucky law does not apply when you kill a third party. If they are acting in selfdefense on Kenneth Walker as they claim, they dont get to kill Breonna Taylor as well. All right. And thats the law. So him telliing us what the la is in kentucky, thats not the law. Steven, so many questions in this case. All of it very upsetting. What we do know, its also not okay to shoot at Police Officers in the streets. The violence has got to stop. Violence on top of violence on top of violence. It will get us nowhere. President trump is deepening the threat of a constitutional crisis after the november election. He has refused to promise that hell leave office peacefully if defeated. And we really see this as a great opportunity to provide access to testing for our customers, to get them back in the air and traveling as safely as possible. Reporter hawaii has been largely closed to tourists since march, but next month with proof of a negative covid test result within 72 hours prior to arrival, the state will waive its twoweek quarantine. In every other situation in kentucky, a justification of selfdefense is determined by a jury. President trump is deepening the threat of a constitutional crisis after the november election. Ive been complaining very strongly about the ballots and the ballots are a disaster. Justice ginsburg will lie in repose until later tonight. President trump will stop by later this morning. Protesters taking to the streets across the country after a decision not to charge Louisville Police officers in the death of Breonna Taylor. Two other officers were shot overnight in louisville during clashes between the police and protesters. They are expected to survive. Other commdemonstrators set fir. More protests in new york, dallas, washington, atlanta and dozens of other cities. Breonna taylor was shot and killed when officers served a drug warrant no drugs were found. Only one officer is being charged but with endangering neighbors. Jericka duncan is with us. How are conditions right now . Reporter there have been a few people that have come to the memorial site praying over the city, really, but the National Guard has been activated. Theres a 9 00 p. M. Curfew to make sure anything that turns into a violent demonstration, if you will, does not take place. I want to go to the video from last night that were talking about. This came from the Louisville Metro Police department. This was the moment the officers were shot. Police have a suspect in custody. We learned within the hour that suspect is a 26yearold, the officers are expected to survive. Protests began after a grand jury announced a former officer was indicted with wanten endangerousment but for firing shots into an adjacent apartment. Kentuckys attorney general said the fbi determined a detective fired the shot that killed taylor, and the Kentucky Attorney general saying the officers were not charged because they acted in selfdefense. Kenneth walker, the boyfriend there that night said that police did not announce themselves. He also believed that the Police Officers were intruders. Thats what he says happened. The fbi continues to carry out its investigation so there could be federal crimes to come. That investigation not expected to wrap up any time soon. Anthony . Jericka, thank you. Joining us now is the attorney representing Breonna Taylors family. Good morning. You said a week ago that at a minimum the three officers should be charged with Second Degree manslaughter. What do you make of the Kentucky Attorney generals explanation has to why none of them were charged . Breonna taylors family as do me and my cocounsel, we think its just outrageous. Its offensive. Were still trying to figure out what evidence did Kentucky Attorney general present to that grand jury . Did he present any evidence on behalf of Breonna Taylor . Because if he didnt, he unilaterally decided that he was going to exonerate these Police Officers and that breonna would never get due process that she would never get justice, and so we are demanding that he release that transcript so we can see if there was any evidence that breonna had any voice in that grand jury proceeding. The attorney general spoke to Breonna Taylors family yesterday, did he not . What did he say . He spoke to them about ten minutes before everything was released to the public, and he did not go into the nuances. They were not told that the wanten endangerment charges were for the white neighbors apartment and not for breonnas apartment. Did not tell them there were no charges for the bullets going into breonnas body. Did not tell them that the black neighbors that have bullets go into their apartment did not have any wanton endangerment charges. There seems to be two Justice Systems in america. One for White America and one for black america. This was shown yet again in the grave mischaarriage of jus injustice. We talked to Kenneth Walkers attorney in the last hour. He told us he feels its a coverup. Would you use that phrase, too . Well, i think it was a shammed proceeding. Thats why were demanding that the grand jury transcript is released so people can see if anybody spoke for breonna in that grand jury proceeding, because black women lives matter, and Breonna Taylors life matters. The fact that not just black people but if you are a parent of a daughter, a parent of a child, you should be troubled by this, because Tamika Palmers daughter, Breonna Taylor was killed in the sanctity of her own home, and our system is trying to say its justified, its okay. And just because they say its legal, gayle, that dont make it right. We know throughout history they have said things are legal, but that dont make it right. Yeah, and thats what i keep thinking. I keep thinking about the family today and how theyre processing their grief while theyre still calling for peace. Its not okay that two Louisville Police officers were shot in the streets. Luckily theyre going to be okay, but how is the family processing their grief . Theyre awarded 12 million. On some level, somebody thought they had been wronged in this case. And to have no charges, nobody held accountable for the death of their daughter. You know, gayle king, that is the hard thing. The civil settlement was significant. It set a precedence for systematic reform and speaking to the value of black womens lives in society, however, as Tamika Palmer says, she wanted accountability, the officers to be held accountable. So it would serve as a deterrent so we can prevent future Breonna Taylors. She is trying to define the legacy of her daughter in the chaos of all of this, and she really wants that legacy to be to prevent these unjustifiable killings of people of color with nobody being held accountable. Ben, yesterday the attorney general for the first time said that they had a witness who claimed that the Police Announced themselves before they went in. We had not heard that before. Had you heard that before . We had heard that before, but i want to put this in proper perspective. Our legal team has 12 witnesses. 12 neighbors that say they did not hear the police knock and announce, and this alleged witness that they keep presenting, he apparently gave two previous interviews where he said he didnt hear the police knock and announce. So the day he only presented his perspective and then the presented the other 12 neighbors, then he has unilaterally made a decision on whether or not breonna would ever get due process, whether she would ever get justice, and that is not right. Yeah. Kenneths walker attorney made that point. This witness has apparently changed her story. Its called a no knock warrant for a reason. You dont announce yourself. Several witnesses there, including Kenneth Walker when you hear him, he said he had no idea who these people who came into his apartment. The fbi is warning that foreign adversaries may seek to exploit divisions post election and doubt in the process. The president has talked about doubting the process. Hillary clinton has told joe biden not to concede if its messy. To you, sir, are you worried about whats going to happen the day after election day . Tony, first, thanks for the opportunity to be with you. Yes, i am worried. And the story that i tell in battlegrounds is one of how russia is trying to drag us down. Russias not that strong, you know, their economys about the size of texas. They have some real problems with demographics, the collapse of oil prices, and so forth, and putins coming under more and more pressure. What putins trying to do is trying to be a last man standing. What he wants to do is polarize us, divide us on the issues that already divide our society. Issues of race and gun control and immigration, and pit us against each other. A great way is to raise doubts about our our democratic principles and institutions and our processes and especially the election. What do we do i think for all americans we have to really be cognizant of this danger, tony. How do we temper the situation which is obviously volatile when you have russia involved, as you say, they are weak. But people who are not weak, President Trump, former secretary of state hillary clinton, they are also commenting on the election and fueling the idea that its going to be messy and potentially stolen one way or the other. How do you quiet things when you have our leaders involved in the fight . Well, thats a big problem. I think all of our leaders, the president , everyone, you know, Vice President biden, everybody i think has to send a simple clear message to the American People that we can secure our election process. And i think the American People ought to be proud of what our government has done. I mean, under the trump administration, to secure elections after 2016. As you recall, theres a lot of progress made between then and 2018. The russians were in many ways foiled in their efforts to raise doubts about the 2018 election and to to create another crisis of confidence. Some of those reforms involve standing up new organizations to protect information election infrastructure, but then also our Cyber Capabilities are much more agile now. We can combine a good offense with a good defense. But i would just say to you and your colleagues, i mean, what you do as journalists is so important. We need authoritative sources of information now more than ever. Yeah. And its in social media and the pseudomedia where russia kind of has a field day. They use this to move us to extremes and reduce our confidence in who we are as americans. Yeah. Weve been telling voters to be patient, that this could cake some time to count all the votes. But im curious, what was your reaction our job is made more difficult when you have an exchange like the president had with the reporter yesterday. He was asked could you commit to a peaceful transfer of power. That is conventionally known as a softball question. The president did not say, of course i commit to that, he instead continued to undermine confidence in the vote. Im curious, knowing what you know about russia and foreign actors, what was your reaction to hearing the president say that . Its one of disappointment. I think we have to have confidence in the system that our founders set up. Su you know, our founders were worried about factions, what we now call political parties. They had very muh in their minds that the bloody experience of the english civil wars in the 17th century. And many of our founders didnt want parties to exist at all. So i think its really important for us to have confidence in the system they set up and especially separation of powers. We do have traditional review. There are armies of lawyers from both parties already out there. We have to have confidence in the checks and balances that our founders set up. General mcmaster, one of the remarkable things about you is in addition to your career in the military, you also have a ph. D. From unc chapel hill. On top of that, you have an extreme nonpartisan position. You, in fact, do not vote, sir, and have not in your career. I am curious, though, now that you are retired, will you vote in 2020 . Well, im having a discussion about that with my family. Its a big change. What are they saying . When i was 17 years old, you know and so i really im trying to figure out now what my role can be here in my second career and how im going to participate in our democracy. What i really wanted to do with the book and what i hope i can do in the discussions like this after, you know, after its publication is help bring americans together. As were at each others throats, these great challenges to our security, theyre not going away. And in many ways, the crises that were encountering today, covid19 and so forth has cotlized these challenges catalized these challenges. Theyre counting me off. Its a meaty read. Leading antiracism scholar, thats ibram xkendi, is calling for justice after a grand jury cleared Police Officers of any charges for the killing of Breonna Taylor. Former detective Bret Hankinson was indicted on three counts of wanton endangerment for shooting into an occupied home next door. Taylor, an emergency medical worker, was shot and killed by police, as you know, during a botched drug raid in march after her boyfriend shot at them thinking it was a robbery. Kendi tweeted in part yet that to be black in america is to walk in the valley of the shadow of pain and death. Right now, our love of Breonna Taylor is filling us with rage. Kendi is a cbs news contributor and professor at Boston University and author of New York Times bestseller how to be an antiracist. He joins us this morning. Im so glad youre here this morning. I got to tell you this is extremely hard to process. You know, number one to hear that there were charges, all right, but it was because of shots fired into the apartment next door where no one was killed. Breonna taylor in her own home, unarmed, was shot six times, and no one is going to be held accountable. How are we to process this . I think many people, particularly many black people are processing this and black women in particular black women in particular, seems like yet another slap. Go ahead. No, it does. And it seems as if black women, it seems as if black people are simply not being protected and defended in the court of law. Particularly as it relates to Police Officers. It does not seem it is blatantly apparent to people that when it comes to an unarmed black woman and white cops that they are not essentially equal in the face of the law. Thats a problem. There is not equal justice. You know, why would those officers have to shoot 32 times, you know, in that apartment when someone clearly was thinking that they were being robbed. I mean, its just unfathomable to people, and its enraging to many of us. Yet it keeps happening. Some will say, listen, the court system has spoken, there was an investigation, and maybe its time to accept the facts of the investigation. Even the attorney general yesterday said sometimes, you know, the law doesnt always go along with what has happened. That he followed the case law as it is written. Well, then the case law needs to be rewritten because, you know, as Martin Luther king said, there are laws that are just, and there are laws that are unjust. And so its argument is that this is the case law, then clearly Breonna Taylor did not cause her own death. The people who killed her should be held to account for her not still being with us right now. For her not being one of those people right now on the front lines fighting coronavirus. Yeah. I hate that its become a black white issue because it is a black woman. But should should white people be concerned about this, as well . I think its white people can certainly look at the fact that black people are disproportionately being killed by police. But they could also see that white people are being killed at higher levels in the United States by the police than people in other countries. And even for white people, its very difficult to charge, let alone convict, an officer who ended up killing an american citizen. And so to me this is a part of a larger problem that i think all americans should recognize. I cant help but think what the outcome would be if it had been three black officers who had shot a 26yearold white emt who was serving on the front lines. I cant help but think how different maybe this case would have been. Tony, sorry life was on the cusp of changing. Its tony dokoupil. Thank you for joining us this morning. I want to ask you to address directly an entrenched idea out there, particularly in White America. Its something i hear from viewers in fact, justice this morning i heard from viewers. You mentioned black people disproportionately likely to be killed by police. It is pointed out to me often that, oh, that must be because they are disproportionately likely to be involved in violent crime. I was just sent today the fbi data on arrests, and there are more black arrests around violent crimes. When i get that response from viewers, when you hear that point of view, that idea, whats your reaction to it . I just dont see the relationship. Again theyre saying because black people, according to the fbi data, are involved in more violent crime, it then follows that they would be in more violent altercations with police. So like with like and, therefore, this is just whats to be expected. Well, i think we need to first and foremost reimagine what the cause is. Again, its either because black people are so violent and theyre so reckless with the police and thats why theyre being disproportionately killed. In other words, theres something wrong with black people. Or theres something wrong with our criminal Justice System. And eive been arguing for monts that to say theres something wrong with any group of people, any racial of group is to express a racist idea. And to me, there are people who are white who who engage in violent altercations with police. And those Police Officers used restraint. They deescalate the situation, which is precisely what they should be doing with that white person just as they should be doing with with black people, but theyre not doing with black people because of this idea that black people are dangerous, violent animals that need which they need to use lethal force because they fear for their lives. The symptom of a deeper issue. It is. And thats why for me we can be critical of Police Officers, rightfully so, but lets forget that americans commonly believe that black people and black neighborhoods are more dangerous. That americans commonly connect blackness with criminality and danger. So this is a largescale sort of problem just as, you know, Police Officers dont write laws. And certainly attorney generals, you know, and so we need really a change even in our case law, and we certainly should not be protecting anyone who is killing another american. Exactly. Including people taking shots at Police Officers. I also think that is just as egregious on the flip side. Thank you very much, ibram xkendi. We talk about the difference between race and ethnicity and educate people on things that our Education System should have already taught them. A lot of it is teaching people its okay to not know. We were advocating for flowersing the number of increasing the number of School Counselors and got a response of you should set up a bake sale and raise money. Thats not real policy change. Reporter do you think your generation gets a bad rap . Yes, we have the reputation for being engrossed in technology. The cool thing is were using those things to achieve some missions. Sending messages on tiktok about empathy, social justice, about how to vote or using instagram and snapchat to amplify stories that havent been heard. If i can cause 100, 200 kids to become inspired and start their own projects, i think my work has been a success.
