It has definitely been draining. Reporter this 19yearold thought she would be moving into this Apartment BuildingNear San Jose State University next week. But because of the pandemic all of her classes are online and she no longer feels safe sharing a room. So she has moved back in with her mom in long beach but she is still on the hook to pay rent in san jose. I will be paying the remaining balance, i have no choice. She also pays rent at home, her mom lost work because of covid19 so she is picking up extra shifts at target to help her family stay afloat. The financial strain is getting to her. Am i going to have to be a parttime student now to make up for the money that i have to pay. 19yearold gianna is in a similar situation. I miss my friends in the whole social aspect, going to football games. She is supposed to be heading back to Sacramento State but instead she is at home in pacifica and her mom is footing the bill for her apartment your campus. I dont think its fair, try to look at it from their point of view also. I dont think it is fair that there isnt any type of leniency. Carol has been out of work since april, she works at Alaska Airlines and has enough money saved in giannis college fund to cover the apartment but she was hoping she wouldnt have to pay for housing that gianna will not use it. Unfortunately, theres no helper now until our federal government takes action. Millions of students across the United States are facing this exact same situation. Her legal advice is to try to avoid seeking legal advice and offered to pay a fee to get out of the lease if at all possible. She says that is likely what is best for both parties, especially if you really dont have the money to pay for the entire year. If we could come to a deal upfront to take some lesser amount of money instead of going through the expensive and time intensive process of suing a student for rent. Students should check their lease for an active god clause. Its rare, but if you have when you can terminate your lease due to forces outside of your control like a global pandemic. If you dont have the clause you can offer to pay a fee. If that doesnt work, you can give your landlord a 30 day notice to vacate which legally incentivizes them to try to replace you. But until you find a sub letter, you are still on the hook to pay the rent. I did pay the first months rent because, i dont want bad credit, and i didnt really have a choice. Carol is worried she might have to dip into her savings that she planned to put towards a masters degree or worse, drop out altogether in order to pay for an apartment she will never use. I have to sacrifice my education for an apartment. Students are organizing around this issue already. Theres a petition going around in san jose and is got more than 1000 signatures on it. And you mentioned unless lawmakers step into put in place protections, these families will have to pay for it do we know if anyone is working on those types of protections . The city of berkeley and Solano County got ahead of this and said we need to do something to protect students. Unfortunately, state law reigns supreme. So there is really little they can do to enforce protections they did put in place. Its got to be state law if its going to make a difference, or federal law, because this is a national problem. Protecting students and their parents who oftentimes have to pay for these things. Thank you for that.
