Bill ab 1346 is the best shot tenants have at staying house. The bill would put in place in Eviction Moratorium until april 2021. To be eligible tenants would have to prove that they are impacted by covid19. It helps landlords, too. The bill offers mortgage forbearance for landlords of Small Properties for the next 12 months and six months of forbearance of landlords of buildings with five or more units. The alternative, if we dont pass state law, you will see potentially a massive wave of evictions, tenants that will be kicked out onto the streets and landlords that will never get the money they are owed. I totally sympathize with tenants right now, it is not always the tenant that is in a bad position. Patty mayers mother wanted to take a rental property off the market back in 2019, before the pandemic. She let her tenants know that the plan was for them to vacate in march. Then the pandemic hit and one tenant state. And i dont think he was really affected by covid negativities, but he used it to not move. She is now working with an eviction attorney who says the statewide moratorium is on its face, unconstitutional. He filed a written mandate arguing that judicial counsel is violating the powers provision in the constitution saying the moratorium denied landlords due process. For justice to be carried out landlords need to be able to take their cases to court. When you are telling Property Owners that they have to allow someone to remain indefinitely without being able to collect money for their property, their property is being taken without just compensation. He worries it doesnt do enough to ease the burden on small landlords. I appreciate these people advancing this measure may be well intentioned, i dont think they seriously thought through the long term consequences. But for tenants, inaction means more failsafes falling through. Im kind of in limbo, in no mans left, hoping for life raft, praying about that and seeing what will happen going forward. The judicial counsel is now recommending as of today that they extend the statewide moratorium through september 1. The deadline is still friday and they will make a decision on that and the bill could be heard as early as tomorrow. We know that back in the spring people were paying rent fairly consistently, is that still the case now . No, in short, no, that has dropped off. A new at renters are going into august with unpaid bills. And a lot of people are attributing that to the drop in unemployment assistance. No people are starting to change their behavior with rent.
