Reporter the question of what killed him is the subject of a very public disagreement for the last year and a half and now it is the subject of a lawsuit against the city and one of its top city officials. The public defender died last year and a month later the corner determined the cause of death. But the city administrator herself went down to the hall of justice to the medical Examiners Office and demanded changes. Ms. Kelly ordered claimant to alter and edit the report findings which would materially alter and falsify the already completed autopsy report. Report claims that he refused to falsify the report. He told ms. Kelly that she cannot make changes to the report and that he would release the report as the doctors wrote it. Soon after in march of last year they released the findings saying that he had died by a mix of cocaine and alcohol. And while the city administrator did talk about the public release of information, she did not order or ask for the cause of death findings to be changed. That in fact the pathologist have already signed the paperwork and there would have been no way to change it. Tonight the city Ministers Office released this statement the lawsuits and allegations regarding the city administrator are complete action varied a subsequent autopsy report from the Public Defenders Office claimed that adachi died from natural causes. In a blog posting the Defenders Office also claimed that where wick had a grudge against adachi. Somebody is not telling the truth. The lawsuit says the city administrator wanted to make changes to the autopsy report. What exactly were the alleged changes . It is early on, they just filed the lawsuit. This is the sort of thing that gets hashed out in court and the City Attorney is not saying what the city alleged to, what she is saying that her client was fired and they filed this lawsuit because they believe it was retaliation. Alejos police chief is still trying to fire one of the officers that shot and killed a man and a taco bell drive through a year and a half later. Willie mccoy was asleep in his car when officer surrounded him in february of last year. Police claim mccoy reach for a gun in his lap before officers shot him 38 times. According to an internal affairs investigation, officer ryan mcmahon started shooting at the car while another officer was in the line of fire. Now this is by the camera video from another controversial shooting involving officer mcmahon one year earlier. Prosecutors decided not to file charges but a federal lawsuit claimed that foster was shot in the back without provocation. In march, the chief recommended mcmahon be fired for unsafe conduct during that mccoy shooting. The Department Tells us he remains on administrative leave. Tomorrow morning a federal civil rights lawsuit will be filed against the alejo police over the death of 22yearold john monterrosa who was shot by an officer through the windshield of a cruiser back in june. Mad scramble tonight to try to fix what they are calling a glitch that is preventing california from accurately reporting the number of coronavirus cases. Smith says there have been talks about hitting the reset button. Meanwhile the county officer says this feels very much like the beginning of the pandemic there wasnt enough testing. State and local eviction moratoriums are preventing him from getting his health back. Reporter since october of last year this home on gable drive in fremont has been considered a jam on airbnb. 209 guests have given linda, a super host, glowing reviews. She has added extra touches like chocolates by the bedside and even advice on how to stay safe during the pandemic rate this might all be charming if it wasnt illegal. I was furious. You see, this couple on this home and linda is their tenant. She is violating their Lease Agreement by renting it out on airbnb energy is also violating the fremont city law by allowing more than two people to stay here at a time. Linda asked them to reduce the rent back in march by 500 a month which they have agreed to an out regret. They are making money off of our house and not paying us the rent. It is kind of like, crazy and every which way you look at it. Two weeks ago a neighbor informed them that their house was being rented out on airbnb. It is not somebody impacted by covid, it is somebody taking advantage of the situation. This isnt only lindas only property. She has another similar model, each room is rented individually and goes for about 50 a night. Neighbors are unhappy that so many people have been coming and going during this uncertain time. By subletting displays linda is violating her lease which is grounds for an eviction. But during the pandemic fremont has in place an eviction moratoriums, so does the state of california. So right now the state is not hearing any unlawful detainer cases even if the landlord can prove that the tenant is not impacted by covid19. We ran into linda outside the home and she declined our request for an interview and confirm she didnt have permission to rent at either home on airbnb but says she and her husband are having a hard time during the pandemic. If that does happen then they could take this case to court. It all depends on what the legislature comes up with. They are scrambling and trying to put in place some tenant protections. The winds did take up for a while, downtown and pretty far inland. So any trees that were weakened by whether its bugs or some kind of disease, and topple over when the winds get to 35 to 45 miles per hour. The wind will be part of the story for tomorrow, but it wont be as gusty. The big story will be the wind direction and that is indicated by the dots on this chart. It is usually just a consistent onshore wind that will kick in by midday and into the afternoon at 15 to 20 miles an hour. But for a few hours in the morning the wind will swivel around to the south southeast and just a little change in direction, it will help the fog to retreat much faster than it did today. Futurecast does shows the mist and drizzle along the coast, but watch how fast the great retreats toward the bay and eventually toward the coast by tomorrow afternoon. You may get an hour or two of sunshine on the coast but more around the inland portions of the bay area will break back through into sunshine by tomorrow. Temperatures dropping down into the 50s and 60s. Upper 50s in the city, otherwise low 60s across the board and everybody makes it down into the 50s by early tomorrow morning. Then we start to warm up, backup into the 80s for the i owtheret good news the dog just makes you smile.
