Reporter ken, the da did not provide an explanation for not filing charges, but at this hour we know that four of the five suspects are out of jail. The Contra Costa County da has 72 hours to file charges against the five suspects arrested in connection with the halloween night shooting in orinda but declined to do. So the suspects were arrested in a series of raids in vallejo, antioch, san mateo and marin city. Im surprised because a lot of effort should have gone into prepare the arrest warrant that led to the militarized vehicles going into marin city and the effort that it took to make those arrests. Reporter former San Francisco gang prosecutor and criminal defense attorney tony brass says not bringing charges means the District Attorney does not have enough evidence to proceed. Tonight a District Attorney spokesperson only said the investigation is ongoing. My experience with the contra costa District Attorney is that they are very prepared. They like to be prepared. S are well built. Reporter brass says the da can still issue a warrant for the suspects arrest at a later date. Five people died at the party attended by more than 100 people at the airbnb rented home. Tonight the Sheriffs Office said in a statement, we stand by our investigation and the arrests were made pursuant to a judges order. Although the District Attorney may want more investigation done, the persons arrested and responsible for the crime will ultimately be held to account. Right now were told that 28 yearold Lebraun Wallace from san mateo is the only suspect that is still behind bars. He was arrested on suspicion of murder and conspiracy. The utility now says 300,000 customers could be cut off when the winds pick up wednesday. Two more bay area counties were just added to that list, san mateo and santa clarita, but the biggest bay area impact will likely be in sonoma where kpix5s joe vazquez is tonight. Reporter not tonight, not tomorrow, but wednesday, thats when pg e is saying they may cut out the lights again. That would make it the fourth power shutoff in two months. Fire conditions are on the way. On wednesday offshore winds will be gusty, low humidity, dry vegetation. Thats why pg e says they may shut off power again, an expensive inconvenience. I threw probably like 3, 400 worth of food away. Im afraid to buy food anymore. Reporter here we go again. Yup. When will it stop . No one wants to go through another fire, but were tired. Were just exhausted. Reporter when we talked to Sonoma County supervisor susie gorin two months ago during the first power shutoff, she was frustrated because she said pg e is not communicating well with county staffers. She said while they are not sharing enough what goes into their shutdown decisions, pg e has been opening up a bit. Theyre sort of making the effort. They certainly did during the kincade fire. We asked them to embed one of their pg e into our Emergency Operations center and they did that. We asked them to embed one of our eoc officials into their Emergency Operation center and they did that. Reporter pg e tells kpix5 it has improved communications with local governments. The Power Company says many factors go into a power shutoff decision including weather conditions which are unique for each event as well as ground observations by work crews. Authorities say his sister misrepresented the transactiond and in most instances the people who sent money from china did not receive ownership interest. A company has been slapped with a federal lawsuit for allegedly failing to stop racial harassment during the construction of apples new corporate headquarters. The suit is claiming that African American workers helping build the apple park project were subjected to racial slurs, swastikas and even a noose left at the site. The subcontractor air systems is accused of failing to take action to stop the misconduct, a violation of the civil rights act. We reached out to air systems for comment but have not heard back. Reporter for the sixth time in less than six week stanford students have received alerts of possible druggings. The most recent was at a party friday and another student who believes someone slipped something into her coffee saturday. They send out like a crazy amount and i was like wow, they havent done anything to stop it . Reporter University Staff did not want to go on camera but wrote in an email the department of Public Safety did not have evidence to confirm the most recent reports but ask anyone with information to come forward. Were sold the narrative its safe and its up to the university to uphold. That. Reporter this phd student who didnt want to give out his name says for four years he worked for a Student Service that gave safe rides to peers on campus and back in 2015 when he was an undergraduate, it could take weeks or months before students learned of a campus crime. Now he says stanford pushes the alerts immediately. Obviously theres things that need to be fixed and so i think this is a step in the right direction. You have more information the students have, the more informed they can make their decisions. Reporter but carmen duran believes theres still room for improvement. I definitely think the administration should do more to making sure students feel safe on campus. Reporter in the first incident reported this school year the victim actually tested positive for the date rape drug and last year a fraternity lawsuit chartered here at stanford after more than a dozen people were drugged at a part. But as Susie Steimle uncovered, the numbers simply do not add up. She spoke with dozens of people who say this program put them back on the street. All i need is a roof, a house, thats all. Reporter after four years of living on the streets eureka miles finally felt hopeful when counselors at the Navigation Center in berkeley found her permanent housing. They were going to pay our rent for six months, which is plenty of time for somebody to go back to work and get on their feet. Reporter but when she got to that address in richmond, her hope faded. Her permanent home was this garage. So every time i got to go to the bathroom or cook breakfast or dinner or anything, i got to go in, unlock the door. Reporter her rent was 1,500 a month paid for with public money awarded to the nonprofit that runs berkeleys Navigation Center, Bay Area Community services or bacs. When eureka complained, a Building Department inspector came out and found no access to a restroom, black mold, nails sticking out of the walls, no electrical and a rat infestation. The garage was ordered shut down and shes now back on the streets. I think its horrible. Its all that is not right. That is not right. I mean what is therwas billions of dollars donated to get us off the street, to get us permanent housing. So whats going on . Reporter james carthills permanent placement through the stair program isnt working out either. Thats not a permanent situation and its continued turmoil. Reporter bacs placed him and his wife in a small room in this san leandro home with six other tenants and a livein host. Taxpayer money given to bacs paid this bill, too. According to james contract the money goes to a Company Called Second Chance at life independent living. At last check, its not licensed to do business in san leandro. James says he cant even use the living room because there are people sleeping in it and hes not allowed to cook. James had it out with his landlady seen here in a Facebook Live post. Independent living home. Were independent. Hey, dont cook on the stove no more. Reporter shortly after he received an eviction notice. He has to be out by years end. Its caused more stress than living on the street. Reporter then theres this homeless senior who asked us not to show her face. Somebody has to be held accountable for this. Reporter bacs placed her in a room in this house in stockton for 850 a month. I think its absolutely ludicrous for anyone to even want to spend that type of money when they can find themselves a studio, especially out here in stockton. Reporter shes right. We looked on zillow and found plenty of studios for about the same price. Once again taxpayers paid the 850 a month here as well, that is, until a fire damaged this home. Thats when she says her counselor offered her a new placement in a Halfway House for men in berkeley. So now im back to square one. So im going to be sleeping in my car. Reporter bacs was awarded nearly 5 million from the city of berkeley to run the stair program here on Second Street through next year. In its contracts with the city of berkeley bacs promises its 75 success rate of getting homeless clients into permanent housing, but people we talked to who have been through the bacs program and are now on the street say that goal is not just unrealistic, its not being met. Theyre just working the numbers, get these people. Lets show how od doing. Reporter michael ruth is the founder of first they came for the homeless, a selfrun drug free homeless camp in berkeley. As an activist, o tell him permanent housing is anything but. They dont need a palace. What they need is their own space and this is one of the biggest things ive been trying to tell people is if you want somebody to start recovering from everything thats going on the street, you need to give them own space. They need privacy. They need security of their possessions. They need to be able to come and go. They need to be able to make decisions without pressure. Instead theyre shuffled into the first opportunity available so that somebody can check their name off a list of being homeless. Thats not a solution. Reporter bacs supposed success rates are inconsistent at best. It promised 75 success rates to berkeley for the stair program, but in its sales pitch for another Navigation Center in fremont bacs boasted an 82 success rate for the same program. The city of berkeley claims only 64 of stair clients were permanently housed and 22 of that group fell back into homelessness meaning the success rate reported by berkeley was actually around only 50 and michael zint said he thinks that number is likely inflated to win more contracts. Its a game. Its a game so that they can get on tv or they can go to the government or they can go to whoever and say look at how successful were being. We need to expand this. Reporter bacs is growing rapidly. The nonprofits tax filings are broken into a services and housing arm. Total revenue on the Services Side grew from 13 million in fiscal 2016 to 22 million last year and if bacs acquires more property, its assets have grown from 530,000 in 2015 to nearly 15 million in 2018. For several weeks now weve been asking the city of berkeley to provide someone to sit down with us, explain the numbers and explain how someone in eurekas position was placed into substandard housing only to end up back on the street. Berkeley declined our multiple requests. So did bacs. This should not have happened to me. It ruined me even worse than what i was before. Reporter eureka hopes her story and other will wake the city up to whats really going on. Im not going anywhere till they fix what they did. And not do it anymore, not doing it to us. We are people. Reporter the city of berkeley and bacs sent us brief statements saying they take any allegations very seriously. We have posted those statements on our website and after we brought eurekas story to the attention of bacs we found out over the weekend she has since been placed in a hotel. Bacs is expanding. Weve talked with nearly two dozen people who are bacs clients in oakland and that group is organizing and theyre asking that both berkeley and oakland audit bacs to see the money is spent appropriately.
