But its clear the legal issues are just beginning. Kpix 5s anne makovec joins us live from San Francisco to explain. Reporter today recreational pot sales are finally legal here in San Francisco. So its a bit of a holiday for pot smokers. Local regulators here had a tough time deciding on the rules. Thats why we waited until january 5th. These rules were passed at the end of november. And while these rules go into effect, the feds are threatening a crackdown. Of course, marijuana is still illegal nationwide. And yesterday, u. S. Attorney general Jeff Sessions announced he is rescinding four guidance memos which allowed prosecutors to avoid interfering with medical marijuana in states that allow it. Now, he didnt order an increase in pot prosecutions. But he opened the door to more uncertainty over pots legal future. Federal prosecutors here in Northern California so far say they will continue to address local Law Enforcement priorities. So today, for pot users, it is a celebratory day. Normally, i would, like, either have someone to have a card get it from me or, like, get from the street dealers. [ laughter ] its going to be easier for me. I was getting it on christmas, like, from a street dealer. Reporter dispensary this is San Francisco have been getting ready for today since Recreational Marijuana was passed in november 2016 in california. They have been ramping up supplies and the number of employees expecting some big sales. Right now there are 50 dispensaries, around 50, licensed to operate here in San Francisco. President trump was unsuccessful in his attempts to block the release of a book detailing the inner workings of the white house. Its called fire and fury inside the Trump White House by michael wolff. Earthquake researchers are getting a unique audio impression of the moderate temblor that rattled much of the bay area yesterday morning. The 4. 4 magnitude quake struck at 2 39 and was centered near berkeley. And this is what it sounded like eight miles deep inside the fault. Bay area hospitals are taking extreme measures to deal with an unusually bad flu season. Reporter flu season is far from over but Santa Clara County is already reporting four flu deaths. Local medical experts say this virus has been on a rampage of sorts that led to a statewide outbreak which made some hospitals restrict or suspend visiting hours. At laguna honda in San Francisco, two nursing units are under quarantine and City Health Officials say its a precaution to protect elderly patients. In Monterey County, where one person recently died from the flu, visitors to Salinas ValleyMemorial Hospital can only see patients for 15 minutes. What were seeing in california right now is a very early large spike in cases, four times greater than last year at this time. A sneeze or a cough from somebody who has been infected can spread a half million influenza germs so this is a big deal. Reporter statewide, at least 17 people under the age of 65 have died because of the flu so far and this is the worst time of the year for the virus, the time between december and february. Today we should learn more about the arrest of a man accused of sexually assaulting a teacher in san jose. Police say a man showed up to Harker Middle School tuesday before students arrived. He was roaming around for a couple of hours before he attacked a teacher inside a classroom. San jose police will hold a News Conference at noon to provide more details on the arrest. Today federal authorities may take custody of the man who was acquitted of murder in the death of kate steinle. Jose Ines Garcia Zarate shot and killed kate steinle on pier 14 in july 2015. He was convicted on charges of being a felon in possession of a firearm. Zarate phase an identical federal charge now faces an identical federal charge. Tony serra represents him. He will be at the sentencing today. Zarate will probably get time served and then be given to the feds. Time now 5 08. A stretch of highway is open after nearly a year. And while this round of snow has passed, a bigger danger may lie ahead as extreme cold is expected to freeze anything that hasnt been shoveled away. Police officers in typically warm weather states like here in South Carolina are particularly worried about drivers who have never had to deal with icy conditions. Unless youre driving a zamboni, you cant control the vehicle especially at higher speeds. Thousands of flights were canceled because of the storm. Most airports will reopen today but some delays are expected. A stretch of coastal highway is finally back open in marin county. Heavy rains last february washed away pavement and the roadbed shutting down part of highway 1. The reopened section covers about 5 miles between Stinson Beach and muir beach. Drivers will still face some slow going because the fix isnt totally complete. Its only one lane wide so far in some places. So24hour Traffic Control is in place so 24hour Traffic Control is in place which adds an hour to your drive thanks to six traffic lights. Slower the better. You have to drive safe. Roads are slick from being just paved. The road fell victim to the rain last year when a slide destroyed a hillside. The repairs are major and as you can see from skydrone5 video, it will cost 60 million to fix it. No one wants to add an hour to your drive but at least the road is making some progress. Well begin along 101 where this crash is not really causing delays but its right by the airport. Northbound 101 right near san bruno avenue. And it looks like its now cleared over to the right shoulder. North of there traffic is fine both directions 101 at 380. No trouble getting to the airport. 101 at spencer we are getting reports of an accident along this stretch. We dont see any backup. We havent seen any emergency crews or flashing lights making their way through the stretch and speeds are still at the limit and lots of space between all those cars out there. But you can see the sheen in the road as neda has been mentioning. We have had some rain overnight. So please be careful. Those wet roads, you want to take it easy as you get behind the wheel this morning. Reports of a car thats blocking one of the lanes inside bore number 3 of the caldecott tunnel. So westbound 24 blocking the fast lane. It wasnt an accident, looks like a breakdown. Crews are assisting to clear that but you may see minor delays westbound on 24. So get ready. It is wet over there. And it will continue to be so throughout the next couple of hours, berkeley, emeryville, you are likely next in line as this cell comes through. Further north, it looks like we are seeing scattered showers around the bay. Areas of darker green, yellow and orange, about a quarter inch of rain per hour coming down. But these cells are moving in pretty quickly and they are heading out further east but for now, were only seeing them scattered across the north bay so it looks like yountville just got some rain and now its winding down. St. Helena, as well. The rain is now winding down there. But theres more to come and its all off the coast, all of this going to push in towards the bay area so well a little more widespread rain in the next couple of hours as this slowly works its way on to land. So San Francisco get ready. This is the richmond bridge. Yes, its wet on those roads now. And futurecast heres an idea of whats to come. So the next hour or so well see similar conditions is what were watching on our hidef doppler. By 8 00, 9 00, it will get more intense throughout San Francisco and across the north region. So fairfield, concord, may get some rain by noon today. Then it will move further south perhaps redwood city, hayward, maybe scattered showers in livermore. But most likely, places like san jose and livermore will stay dry from this system. If you get anything it will be very light not measurable. Just a very light drizzle as that storm moves out by later tonight. It will be clear by the afternoon hours. So that will be nice. Right now, temperatures upper 50s already in concord and oakland. So right now, it looks like more of these storms are going to be ushering in. We are getting another storm system that will bring with it some subtropical moisture and thats going to bring us a good dousing of rain by early next week so monday and tuesday, we could see up to two inches of rain in San Francisco. Up to three inches of rain for some of the mountain ranges. The north bay, Santa Cruz Mountains, could get that much rain on monday, tuesday. But the timing is just right. Reporter were in Santa Clara County because already, four people have died from flu related illnesses here and that is exactly why local hospitals are taking extra precautions especially when it comes to people who want to go visit the patients and spend time with them. Because of the statewide outbreak of the flu hospitals have suspended or restricted visiting hours. Health officials are protecting their elderly patients. In Monterey County where one person died from the flu, visitors to Salinas ValleyMemorial Hospital can only see patients for 15 minutes. At boulevard pediatrics in encino the flu is topping the list of a long variety of illnesses this season. Doctors there are seeing coughs from a common cold sticking around for up to six weeks. Wheezing and cough. Were seeing other than influenza a lot of other illnesses, as well. The former marine suspected of noting a Christmas Day terror attack at San Franciscos pier 39 has been indicted. 26yearold Everitt Jameson of modesto is charged with attempting to provide Material Support and resources to a designated Foreign Terrorist Organization and distribution of information relating to destructive devices. Jameson was reportedly working on the plot for nearly two months. Federal prosecutors say that he planned to set off pipe bombs at the beginning of the attack. And then according to the indictment, jameson hoped to funnel people into an area in order to shoot them. He allegedly told undercover agents that crowded pier 39 would be a good target. Relief for taxpayers facing higher bills under the newly passed republican rules law capping deductions to 10,000. But it looks like our sensors are going back to the green but were tracking a new accident and this is southbound 17 right past glenwood and it looks like this is causing just minor slowdowns but we are starting to see some yellow sensors light up our screen here. Its not blocking a lane but its in a bad spot. So please be on the lookout for that. Emergency crews heading out to the scene. Other than that, your ride heading through the south bay looking good. We are seeing the usual slowdowns starting to build along northbound 101 approaching 880. But no reports of any accidents or stalls along that stretch. Out of antioch, starting to see a few brake lights especially as you get closer to pittsburg and things do start to pick up again. We are getting reports of an accident along highway 4. Its not blocking lanes near cummings skyway. Activity on the stretch. 80 seeing crowds developing near highway 4 at hercules. Its about 15 minutes over to the toll plaza. So perhaps mountain view, palo alto, could see some light drizzle from it. And then 6 00, things should be winding down. Some of the rain action will move east towards sacramento, even tahoe could get a light amount of precipitation from it. As far as our temperatures today, this is where we should. A vallejo man is set to be sentenced today for setting a house fire that killed his estranged girlfriend and their 5yearold son. Governor brown and his counterparts in washington and oregon are vowing to prevent more drilling off the west coast. Yesterday, the interior department announced plans to lift the drilling ban off the coast of california and florida.
