Leaders refuse to protect our border and because San Francisco is a sanctuary city. The president went on to call the acquittal of kates accused killer, quote, the final injustice, but an alternate juror in the case says he thinks the panels decision was spot on. He told kpix 5 it all came down to the evidence. An illegal immigrant shot a gun, killed a citizen, and was charged with murder and manslaughter and acquitted. That sounds bad. Reporter it was a verdict that renewed debates on immigration and sanctuary cities. Phil was an alternate juror on the case and had a front row case through the fiveweek long murder trial. I was not surprised by the verdict. I was surprised to see on the news and social media that everyone else was. Reporter the prosecution couldnt prove there was any intent to kill steinle which took first and Second Degree murder off the table. According to the jury instructions, zarate had to be committing another crime at the time kate was shot to be guilty of involuntary manslaughter. Prosecutors believe that crime was brandishing a weapon. But jurors werent convinced. There was no evidence presented that he brandished that gun. There was not a witness who saw him holding a gun. It wasnt possible to convict him or think beyond a reasonable doubt he had brandished the weapon which technically prevented the jury from convicting on the manslaughter charge. Reporter he said thats why zarate was acquitted and it has nothing to do with sending a political statement. What this jury did in this case was they listened to the evidence, to the law, and made a decision based on what was presented in the courtroom and i dont think politics was in it at all. Reporter he hopes the people can understand why the jury made the decision it did. The jurys job is not to provide vengeance, its to uphold the law. In the east bay the chp is investigating another freeway shooting tonight. A driver told officers she was eastbound in san pablo this afternoon when she heard a popping sound. She realized her back window and passenger side mirror were shattered. The woman wasnt hurt but investigators also found a bullet hole in one of her rear doors, two in the trunk. The eastbound lanes were shut down for about 40 minutes while officers investigated. So far there are no leads on the shooter or motive. A rough landing for a pilot in the east bay when his landing gear failed to lock. He came down hard without the gear fully deployed. You can see the cessna 172 in the distance being checked out. This image of the flight path shows the plane circling repeatedly over the interchange, presumably to burn off fuel and do troubleshooting before the pilot headed back toward the airport. The plane sustained minor damage but neither of the two people onboard were hurt. Southern california now. A major flareup on the western edge of the thomas fire has prompted new evacuations in Santa Barbara county. Thats the bad news. The good news is elsewhere. Firefighters are making significant progress on some of the other fronts in the fire in neighboring ventura county. Containment is up on other fires burning in san diego and los angeles counties. All together the fire has burne. Also destroyed hundreds of homes. Most recently in the seaside city of carpenteria, a little bit south of Santa Barbara. Theres little relief tonight, and certainly not here in Santa Barbara county whereas you can see the fire is still very much burning and residents are calling the situation simply devastating. Reporter firefighters faced intense flames early this morning as the massive thomas fire reached the city of carpenteria in Santa Barbara county. Crews attacked the blaze from the air and ground but were unable to save every home. After almost a week on the lines, firefighters are tiring. Talking to the firefighters out here day one, they said its been one of the most trying and taxing fires theyve been on. With the fire bearing down, firefighters ordered hundreds of more residents from their homes this morning. Many not knowing if their properties will still be standing when they return. Scary. Reporter this crew kept a close eye as the fire inched closer to this home. Across Southern California, wind fueled wildfires have devoured nearly 800 homes and other structures. More than 200,000 people have been evacuated but many are hoping to return home soon as firefighters are finally beginning to get the upper hand on the devastating wildfires. At this point the thomas fire is only about 15 contained. There are about 15,000 structures standing in its way. At about 4 00 this afternoon in san marcos high school, they held a press conference where a lot of fire officials characterized a list of challenges as to why the fire is out of their control, citing temperatures and winds and humidity, and that the containment percentage could drop because its out of their control. The feeling of some Santa Barbarans is, its almost setting the stage for a lot more destruction. Are you getting the sense that a heck of a lot more is going to burn before they get a handle on it . That is the feeling. Thats what a couple of people have said to me. Including residents watching this over the last several days. The fire, as i said, only 15 contained. A lot of attention is being paid to the wind and wind direction. But just over the last couple hours and you might be able to tell since what you saw an hour ago, it looks as though this fire is growing and moving. This is way different than what we saw earlier today. The fear is its only going to get worse before it gets better and theres a long way to go. Im curious about where youre standing and where those fires are that are burning behind you. Are you close to the coast . Were not too far from the coast right now, were along 192 and this roadway right here is the division between the mandatory evacuations behind me and voluntary evacuations behind the camera. Behind me, these are a number of ranches and farms. A lot of avocado farms. But all these residents are under a mandatory evacuation. Hard to see at night. Theres a couple homes tucked in to the hills there and the mountains and you can see the ridge line where its burning right now. So definitely a lot of homes and a lot of people and a lot of lives in the way. 192, thats a lot of pricey real estate. Well hope for the best but it doesnt sound good. Reporter its their time of the year to shine but these red kettles could remain empty all because of a severe shortage of ringers. Out of 32 locations, the salvation only has about a dozen ringers even after offering to pay people. When were unable to put a volunteer on the site, then we have opportunities to hire people. Even hiring people this year has just not worked for us. Reporter captain john kelly says volunteers usually step forward well prf the holidays but not this year. Perhaps the economy might be good. They have other jobs right now. I dont know. But were in desperate need of some help. The Salvation Army does much during the year and the money pays for almostal the programs, about 40 . Without the funds, the programs could be cut. Our afternoon program. Our daily bag lunch program. Some of our homeless feeding programs. Programs that might be affected that might have to close if we cant collect these funds. For more than 100 years, the Salvation Army has rung the bell in front of stores and Shopping Centers to ask people to spare some change during the holidays. Often its the ringers themselves that say they are reward would the good feelings that come with helping others. If you can spare four hours or eight hours in a day to help the Salvation Army collect some funds, get the money we need to keep our doors open, wed be so grateful. Reporter len ramirez, kpix 5. Reporter once a week a food truck arrives at this working class neighborhood in richmond offering fresh fruits and vegetables from local farmers at a bargain price. But they realize it can be a tough sell to people used to eating fast food. Its going to take a little time to be able to make that transition from the Ice Cream Truck to a truck like this. Reporter with healthcare costs skyrocketing, the government is willing to pay for people to eat a healthier diet. The cal fresh program, the states version of food stamps, offers low income residents up to 200 a month to buy more nutritious foods. Its literally free money. But data shows only half of the people eligible to get it are currently taking it. Does it surprise you . No, it doesnt surprise you. Why . Because its stigma behind it. Reporter sandy was at the food truck trying to sign people up for the program but it isnt easy. Some fear its an immigration trap. But many feel its something to be ashamed of. People have told them that were taking tax dollars from everybody else and that people shouldnt apply for that because they dont need it. In the city of richmond, only 30 of eligible residents are signed up for the program and its estimated Contra Costa County is missing out on 54 million in federal funds that could benefit the local economies. It is a little crazy. Nobody ever feels guilty about taking a government rebate to buy an electric car or put solar panels on their roofs but helping poor people eat healthier is seen as some kind of welfare scam. The director says we all need to understand, this is a deal that helps everybody. Were asking you to use the benefit to really have an enjoyable eating experience thats so good for you, for your health, and good for the local food economy. Reporter apparently everyone benefits when the poor have the money to buy decent food. The trick is convincing the public thats as important as helping someone buy a tesla.
