Any wildfire broke out last night. You can see the flames taking over a mountain. There are dozens of homes nearby. Some of them have been evacuated. The fire is said to be about three acres. Half a dozen other fires are burning across Southern California. This morning, thousands of firefighters are working to contain the flames as a stronger wind is expected today. There have been major progress to report. The creek fire is 85 contained. The lilac fire in San Diego County is 50 contained. The biggest fire is the thomas fire burning in ventura county. It has burned 155,000 acres and is just 15 contained. 535 homes and buildings have been lost. Governor brown survey the damage. He said the destructive fall fires are the result of Climate Change and that it is the new normal. This is very odd and unusual. It is the way the world is with the kind of Carbon Pollution that we are not just living with but still generating. It is still increasing. Governor brown warned that crews could be battling the fires for weeks. He will talk more about the fires and Climate Change tonight on 60 minutes right here on kpix5. Six landlords have been accused of price gouging in the wake of the wine country wildfires. During a state of emergency, it is illegal to raise rent by more than 10 . Governor brown extended the rule for six months in the fire zone. But the Sonoma CountyDistrict Attorneys Office found bigger increases. One couple could face a year in jail for increasing the rent by 32 . Other people had bidding wars for property in santa rosa. We have Business Information on the charter bus crash that left dozens injured. This happened friday night around 8 00 near chavez. This was on 101. He says it all came down to the evidence. And Illegal Immigrants shot a gun, killed a citizen and was charged with murder, manslaughter and acquitted. And it sounds bad. He had a front row seat to the five weeklong trial. He says according to the jury instructions, josi garcias had to be committing a crime at the time kate was shot to be guilty of involuntary manslaughter. Prosecutors believe the crime was brandishing a weapon but jurors were not convinced. There was no evidence presented that he brandished the gun. There is not even a witness that saw him holding the gun. It was not possible to convict him or to think beyond a reasonable doubt that he brandished the weapon which prevented the jury from convicting him on a manslaughter charge. The jurys job is to uphold the law is what he says. His reasoning of brandishing seems to be a key move. According to the d. So they went with brandishing. None of the witnesses saw the gun before. And under brandishing, it has to be in an angry or threatening manner. So that was not proved either. He asked the nation to take inspiration from those who sacrifice their lives to bridge the racial divide. We want our country to be a place where every child from every background can grow up free from fear, innocent of hatred and surrounded by love, opportunity and hope. However, prominent African American leaders boycotted yesterdays event. Congressman john lewis and Bernie Thompson said President Trumps attendance and his hurtful policies are an insult to the people per trade in the civil rights museu. The white house responded saying that it was unfortunate members of congress would not join the president and honoring civil rights leaders. In the bay area, people upset about u. S. Plans to move the embassy to jerusalem and there was a rally in kpix5. Muslim leaders and palestinian leaders organize a demonstration at United Nations plaza. Some say President Trumps decision to formally recognize jerusalem shows a bias against palestinians. I think this is the continuation of a u. S. Policy that has been happening all along. It just shows that allegiance or alliance with the illegal occupation of palestine has been there since the getgo. Never in the history in my involvement in the world of politics, have i witnessed any onslaught of things happening as rapidly, quickly and decisively period. I have not seen that before. There are a lot of factors going on. We know he will be replaced by a democrat. Contrast that with new jersey where the democrats are saying, wait a minute. Let the trial play out. We wont take any action against that senator who is accused of ethics violations and corruption. Im saying that the moral high ground is a convenient place for many the right thing is to allow us as a party to be able to say, we are committed to the idea of the highest of standards to the highest level of moral conduct, et cetera. And anyone that violates that, we will, in some manner or another, caused them to be dismissed sooner then later. That is only for democrats. The republican standards were a bit different. Now we are talking about the world of law. Alex kaczynski is a prominent federal Appeals Court judge and now stands accused of Sexual Misconduct. Washington post reports about the day he subjected clerks to inappropriate conduct. He has had over 500 employees during his tenure. And they say he said that it is regrettable people may be offended by what i have said or done. Removal of a federal judge is not easy. It takes impeachment. A majority vote in the house of representatives and a trial in the senate. Followed by nine to thirds vote in the senate. But that is not the case when it comes to lawmakers. Another state lawmaker in california stepping down as well after serious sexual accusations. This Democratic Assembly man is accused of following a female lobbyist into a restroom and committing a lewd act. He denies it all and says his resignation does not mean he is admitting any wrongdoing. He told the Los Angeles Times my stepping down is not out of guilt or fear. It is an idea that i think it is time to move on to new opportunities. He is the second hacker sacrament allegedly her to resign in two weeks. And tony mendoza has been stripped of his leadership pending an investigation into improper behavior with female staffers. When we come back, another day of striking from oakland city workers. Now they say they will work with state mediators to get the situation resolved. We will sit down with a union rep right after this. After the Largest Workers Union and the city say they are now to the strike in oakland. Today will be the sixth day. Now the mayor is responding after the Largest Workers Union and the city say they are willing to enter mediation. The mayor sent of this statement saying the continued strike is harming our most vulnerable residents. We cannot spend money we dont have. We will continue to work in good faith. Mayor libby schaaf has declared an impasse in order to bring in a state mediator. The goal is to bring them in early next week if the two sides can agree. Until then, the union says we thousand workers will continue the walkout. Joining us to drill down on this is rob jacoby. You are the lead mediator. How much of this is money and how much of this is about working conditions . I should clarify. I am the lead negotiator. It is primarily about our working conditions and community issues. We have repeatedly tried to engage with the city around the problems oakland faces with illegal dumping, homeless encampments and bad conditions for emergency dispatchers. There is an economic component as well. Lets talk about the bad conditions or the emergency dispatchers. What is that about . You could have people forced to work up to 16 hours at a time and then be back on the job in eight hours. One thing we are proposing is to give people a minimum of 10 hours off between shifts. People with long commutes cannot answer 911 calls effectively with only eight hours. What is it about homeless encampments . The homeless encampments some of them have been cleared in the past. I applaud the city for letting people remain in the site while the area is cleaned. However, the city has not come up with policies that allow us to do that safely. In other words, you want more Police Protections when you clean up the homeless sites . Basically, if the homeless encampments will be left in place and workers clean in and around them, the city just has to address that and work with us. Lets talk about wages and benefits. The city is offering four and then one next year. In arath year. 1 next year. 1 if economics allow. You want four and then one, then one and then one. So is there a big gap there . I dont think there is a big gap are particularly not in the first year. That is what is unfortunate. We offered the city to do a one year deal. We should have done that last week when the Union Proposed it and then we would not be out on strike. Another question is benefits. The city says that with pensions, they have a huge unfunded liability because past City Councils have kick the can down the road for us. They dont have the money to cover the raises and the pensions. Oaklands finances are in better shape then they have been in decades. The citys liabilities are lower than decades. So the city is doing better and better. But if there is a turn in the economy and we thought it back in 2010, it could result in layoffs. And they are talking about 186 layoffs for workers. Where does that put you guys . We think that is unrealistically pessimistic. There are a number of reasons why. There is a lot of new revenue coming into oakland. Property taxes rising with new units. New canvas tax money coming in the next year. The city has not accounted for that. As always, if there was an economic downturn, the union can talk to the city about negotiating in order to save peoples jobs. Last time, it was dicey. People wound up getting laid off. People got laid off. Other people took unpaid days off. That was a pay cut of 10 a year. And the issue of benefits. In order to save money, it appears the city is not hiring more parttime people. You want to put a end to that just put an end to that. Half of the workers are considered temporary or part time. They dont have rights on the job. They can be let go without any reason whatsoever. It is not acceptable. It is probably one of the most potent Political Forces in california. You have a lot of allies in the state legislature. A lot of allies in the democratic party. What kind of force can you bring . We have long time tried to be a progressive force for change in california and across the country. We are using all of our means right now to convince the city that it is in their best interest to work with the workers and fix the problems facing oakland. And we will continue to do that over the coming days. Do we go back to work monday . Currently, the union is on strike indefinitely. Yesterday, the city did agree on a mediator. I am hoping mediation will begin monday. If mediation begins monday, do you go back to work monday or tuesday . What do we see going ahead . The city has been bargaining with us in bad faith. Simply agreeing to a mediator does not undo that. If we get in with the city monday and it appears they want to compromise and reach an agreement, we will consider ending strike action. And when do we know if people will go back to work or not . Is that something they will say monday night or Tuesday Morning . The Bargaining Team will talk at the end of the day monday and we will notify people as soon as possible. Until then, we have to assume that the strike is ongoing. And if you had a nickel right now, would you bet it would go into next week . I think the city will be reasonable and reach an agreement. I dont think it will last up to five much longer. The senate voted 8114 for a spending bill to keep things running until december 22nd. Google says its own analysis showed no gender pay gap. I have to point out that the initial lawsuit was on behalf of all women employed by google in california. Lets go across the pond to europe. We have some news coming from the royals. A number of the a member of the european royal family is the latest man to come forward with sexual allegation ms. A flood of assault and harassment allegations came after that. No comment on the latest accusations from kevin spacey. That is what we asked former San Francisco mayor willie brown. What is the moral ground on personal conduct as far as an elected officer goes . When i ran the California State Assembly on the democratic side of the aisle, i preferred resources going to women candidates. I had more confidence there would be fewer occasions i would be surprised ultimately by virtue of some conduct i had not been permitted to know about. As a matter of fact, i resorted to the business of doing Opposition Research on people i was supporting, rather than let somebody else discover that. That is the first thing when you run for office. You hire a group to do research on you so you understand what is it doesnt all come into play. Voters dont necessarily care. Roy more supporters some say, even if this happened, it was a long time ago. It was a different time. Fine. Democrats are still defending bill clinton. We have parties that have overlooked they choose to decide. Right. They can say, that happened a long time ago. There are some serious misunderstandings from the Public Office standpoint on whether or not certain things can be done to enhance the opportunity. With all the working relationships you have. Believe me, i know that is confusing. Let me tell you. If you are the person in charge and you have got to select a quality team, you look for all kinds of characteristics in each of the people you are trying to make part of your team. Believe me, those relationships sometimes get muddled because people demonstrate to the next person without you doing the solicitation. And it becomes a problem. Im lost. Are you saying that sometimes your staff gets on the staff . Are you kidding me . Dont say it that way. Do it like i did. Of course not all staff are created equal. Your Office Manager may have more power than the intern. Melissa, i am getting calls from elected officials on the federal, state and local level. They are talking about how they are going back in the mental clock back 2030 years, wondering if they have something that could possibly pop up and a lot of them are worried. For women that have had questionable interaction with men over the years the women have to wreck our own mind and say, did i invite this somehow or am i part of the problem . So if men have to replay that and their head, welcome to the club. Police and San Francisco are searching for this man. They say he walked into an assisted living facility in broad daylight and sexually assaulted an elderly woman. It happened november 26th at a senior home on bush and laguna street. The man was seen leaving the facility through the back door. Here is a photograph of the suspect. He was wearing dark clothing and a lightcolored baseball cap. He is about six feet tall and 170 pounds. If you know who he is, call San Francisco police. He wont be able to get pot anytime soon in downtown venetia. City council just voted against allowing dispensaries in the area. However, they will talk about allowing marijuana sales and delivery outside of the downtown area. First off, do you expect them to be back at work tomorrow . They have stated they are not coming into work tomorrow. The strike will continue monday. Where does it go from here . We have agreed to a mediator. David weinberg is part of the true mediation group. That is what we will be doing tomorrow. We are getting right down to it. We want to resolve this. When the mediator comes in, do they take the entire package and reword it or do they just go to the points of contention . Or do we take a look at the whole Economic Impact of the package and its effect on City Government . Thankfully, i have never gone through a state mediated process before with labor. This is very unusual for oakland to be in this position. It is because we would love to give our workers the raises they have asked for but we simply cannot afford it. This is not the first time we have been to this rodeo. I have been covering it for 20 plus years and i have seen it before. A situation where the city agrees to deals that they may or may not have the money for. Later it results in layoffs, furlough days and reduced service is. Some of those people on the line that you are seeing marching downtown oakland could be out of a job. Yes. I remember that personally very painfully. In 2010, i was a city worker and was one of the people that got laid off just before 75 cops got laid off. And 25 of the workforce was cut during that time. That is the kind of thing we dont want to see happen again. At the same time, you are facing pension Cost Increases and liabilities there that you dont have money for. That is what we are trying to say. This is the part you have not seen before. The city has always been very cooperative with workers. We believe they deserve raises. But every time we write a check that we cant cash, it causes financial instability and Office Service interruptions. Workers are complaining that they have too high of a workload already. If we give raises we cant afford, we have to lay off workers. That means fewer services for residents and a higher workload for the existing workers. Again, i personally got laid off in 2010. I know what it is like as a worker to completely lose your job. That is not good for anyone. Then why agreed to go to mediation where you could be faced with that reality again . The mediation is not binding. It is just an attempt to get the parties together. There are some noneconomic issues that are still on the table. This is part of the process to demonstrate that we really do want to reach a consensus decision with our workers. We want everyone to get back to work. Not everybody can be happy. You have to answer to the voters, taxpayers and people of oakland who are expecting services to continue on. May expect a certain responsibility from the council. I hope they see that we have stood up for their interest. We have taken an unpopular position with labor. Obviously, i personally and all of our representatives have generally enjoyed a very Good Relationship with labor. But we cannot afford to hurt our vulnerable families that are already unhappy with the level of service they are getting now. A couple of the issues are parttime workers, the use of the city, untied unpaid businesses. And some working 16 hour shifts with eight hours often between. Not getting enough sleep. You have homeless camps. The offer addresses all three of those issues. The basic offer on the table is a 5 raise over two years with the possibility of that to go to 6 if we hit certain revenue marks. We have also agreed to premium pay for any worker having to clean up homeless encampments. We recognize that that is hard work. For some of the lower paid workers and the workers really having trouble we are having trouble retaining like emergency dispatchers, they actually have an eight 8 9 raise on the table right now. Park maintenance workers have a 10 11 raise on the table. So this deal is crafted by the city council as well. You go to closed session. Is members of the city council that are the primary deciders. That is correct. You set off the sideline and vote if there is a tie. Yes. When it comes out, you are the one in front of the cameras. What is it like being the wicked witch of the west . [ laughter ] it is what i signed up for. I love my city. I was born and raised in oakland. I was a city worker for more than a decade before becoming an elected official. That is what the mayor does. The mayor is the communicator in chief. It is my job to take the heat. So eventually it could come down to a deal where somebody has to make the call on whether or not you can afford it or not. You have a chance of going back to work or paying something down the line that you dont have. Who make that call . At the end of the day, we will try to go into mediation. The way the state law works if there is not a mutually agreedupon deal, after the factfinding process, after we consider the nonbinding recommendation of the fact finding mediator when all is said and done. Then the city would have the right to impose a oneyear contract and then get back to the bargaining table. That is the way state law works. Okay. It will be an interesting week for you, the union and the city of oakland. It is so unfortunate. These are friendships. We love our workers and we respect them so much but we just cannot send money we dont have to. Mayor libby schaaf, thank you for joining us. She has a tough one. The owner of the house is jeff franklin. He produced the show and bought this place flexed eight last april. He announced plans to make the inside look like the tv show set so he could film there or rented out to the public. This week, they took their fight to the planning commission. Not all neighbors share concerns about renovations. But who we talked to did not want to go on camera. It is one thing to start a vegetable garden because you love fresh food. But it is another thing to take all that food and give it away to people in need. And the jefferson award winner has been doing that for years. And has not looked for anything in return. Chris vance was not really a gardener until 15 years ago. I started hiking. I started cooking and eating better. I started growing vegetables. First, in his home garden. Then about seven years ago, while working as an assistant with the Pacifica Sanchez library, chris saw a piece of land next to the building. Every now and then, the city would mow it and that would be it. I knew exactly what to do with the space. It has been a bountiful harvest ever since. But what was he going to do with all of the kale, carrots and cauliflower he was growing and not to mention his favorite, lava beans. His boss asked him the same question. It just popped into my head. I heard about the resource center. I had been there. I said it will all go to the resource center. For more than 30 years, the Pacifica Resource Center has provided food, Housing Support and other Critical Services to those in need. For the past exyears, chris has been giving away his harvest to the prc. He took it upon himself to do something he loves and turn around and help the family. It is life saving. And annual donation 400 keeps the garden going. And with the help of his volunteers, chris donates as much as 800 pounds of produce every year. But chris is set to retire in a few years. After that, he says he will come back to the garden as a volunteer. It just makes my heart sing. So working the soil, growing healthy vegetables and donating them to the Pacifica Resource Center, the jefferson award goes to chris vance.
