It was unexpected after a four week trial and six days of deliberations. The jury found Jose Ines Garcia zarate not guilty of murder, not guilty of Involuntary Manslaughter but guilty of being a felon in possession of a firearm. As an illegal immigrant from mexico, homeless, his status was and is part of a National Discussion regarding immigration and sanctuary city status. Public defender Matt Gonzalez argued that the gun Garcia Zarate was holding went off accidentally before a bullet ricocheted off the concrete pier striking steinle in the back. This is a huge win for the public defenders office. This case was a terrible tragedy. Our greatest fear is that mr. Garcia zarate would not be able to get a fair trial. The verdict that came in today was not one we were hoping for. Reporter steinles family was not in the courtroom when the verdict was announced. Kate steinles father jim told the chronicle after the verdict that he was, quote, saddened and shocked. He said justice was rendered but not served. Keep in mind the jury was told to keep all information, all thoughts about immigration, out of this case. He has remained in custody since the arrest. He is back in court on the 14th. He could get three years. That court date is a status hearing. Well then learn when he will be sentenced. In front of libby schaafs office there is a memorial outside her office where two artists who lost friends in the fire installed an art installation. Visitors are invited to leave notes there to the 36 people who were killed when that warehouse went up in flames during an illegal dance party in the fruitvale district. Now, at least 20 people mostly artists illegally lived in the warehouse. It was converted into this may into a maze of Living Spaces. It offered more affordable living compared to bay area rental prices. But prosecutors called it a death trap and the Master Tenant and a second in command there are facing manslaughter charges. Those two pled not guilty. Now, records show city police, firefighters and building inspectors visited the site before the fire. It was never shut down. The tragedy put a spotlight on shortcomings with the citys fire inspections and the housing crisis. The city did announce changes and promised to hire more building inspectors and according to an east bay times report, the city ultimately investigated more than 70 complaints of illegal housing at buildings like warehouses and storefronts. In addition, another 140 complaints for garages and basements and other structures illegally converted to housing. Now, there were several clues this plea deal was coming. Sources confirm to us that mike flynns attorneys had stopped cooperating with the white house and stopped sharing information with them about the investigation. Sources also told me that certain witnesses who were expected to testify about nike flynn before the grand jury had been told to hold off. They had been pushed bawe also attorn were two possible things he could be charged with. The first was violations of requirements that you have to register when youre lobbying on behalf of a foreign country. We know that at least half a does witnesses have gone before the grand jury here at federal court and testified about mike flynns lobbying work on behalf of turkey and russia. We knew that was a possible charge and it at peers here in this plea deal, special counsel has pushed aside that charge for now, and allowed him to only plead guilty to making false statements to the fbi about his meetings with Russian Ambassador sergey kislyak. Now this is an incredibly significant witness for robert mueller, because you have to remember, mike flynn would have been there for all the initial the discussions and conversations with the administration at the outset. So hes going to have a lot of very valuable information for the special counsel. Paula, thank you. Just to put this in perspective, the magnitude of it all. This is the second associated with the president , his Campaign Chairman Paul Manafort has been indicted, now his National Security adviser Michael Flynn indicted as well. Jeff b jeff can you give us more detail . When you mention Paul Manafort and mike flynn and george papadopoulos. Heres why mike flynn is a key to this case. He straddled not only the administration but also the campaign. He was with President Trump during the campaign period. He was one of the president s top surrogates at that time. And then he transitioned in to the white house. And here is Something Else that is key with this investigation. During that period that he was transitioning into the white house, investigators discovered that he wasnt being he wasnt disclosing payments, that he was getting from r. T. Which is an arm or which is considered an arm of the russian government, its a cable channel that is funded by the russian government. It was just asked a couple of weeks ago to register as a foreign agent. Which it had to do. And now russia has responded to that. Ensuring that u. S. Television organizations in moscow follow suit and register as foreign agents. And so, mike flynn is a key witness because he straddled the campaign, and he straddles the first few weeks of the administration. And, there were these concerns that he wasnt disclosing payments, not only from russia and russian interests, business interests, but also payments tied to turkish companies, as well. He could be sentenced to up to three years for that gun possession charge. He is back in court on the 14th but that is only a status hearing. Santa rosa temperatures just dropped off to 34 degrees ahead of that official sunrise which is occurring this morning at 7 06. Sunset tonight at 4 50. So just before sunrise, thats when we really do see that denser fog. We have this dense fog advisory through 11 00 this morning. So that fog is really sticking around through Central California, fresno, bakersfield, all impacted. As far as our area goes, you can see a lot of that fog to the east. But its not impacting much of the east bay in the form of lower visibility. We are still at 10 miles so thats nice. Santa rosa, though, 1. 3mile visibility there. Expecting that to drop off now as the temperatures have reached the dew point. They are a little below the dew point actually. Heres a look at our afternoon highs today. Its cool now, but it will be nice later on. Mid to upper 60s for morgan hill. Temperatures 67 in antioch and brentwood. 66 walnut creek this afternoon. So sunshine and 60s again in our forecast.
