We just got word from chp that they have cleared all that activity from that crash out of the lanes there. So traffic should start to pick up but be prepared for some residual delays in the meantime. If you are making your way over towards the bay bridge toll plaza, once you get past that accident, you are in the green and smooth sailing all the way to the toll plaza. No metering lights just yet. And we have about a 12minute ride from the maze into San Francisco. Theres an effort in california to as you make your way the state a sanctuary state. Anne makovec reports. Reporter the bill would make a strong statement on behalf of the state. It is up for another reading in the assembly. We have heard of sanctuary cities. There are many here in the bay area. But this could make the entire state and sanctuary state. Democrats pushed for it starting in january less than a week after President Trump signed an order threatening to withdraw federal grants from sanctuary cities. The bill would prevent local Law Enforcement statewide from using resources to investigate, interrogate, detain, detect, report or arrest persons for Immigration Enforcement purposes. Supporters say its necessary to prevent fear of deportation in family members that are living in california illegally. Donald trump is acting illegally. He does not have the power to pull this money. And so were going to fight him to the end. And were going to protect Illegal Immigrants. Reporter the California Sheriffs Association opposes the bill saying it would limit the ability of Law Enforcement agents. Now yesterday 15 states and dc sued the u. S. Government to block the plan to end daca and asked congress and asked them to come up with a solution in six months. California will file a separate suit. There are 220,000 Daca Recipients in the state. What are the legal grounds for the lawsuit . The attorney general says that it violates Daca Recipientss rights to equal protection and due process under the law. He also says the administration might be violating privacy rights because Daca Recipients were under the assumption of safety when they originally turned over their personal information. Today donald trump, jr. Is expected to be questioned behind closed doors by the Senate Judiciary committee. The questions will be about his fathers president ial campaign and whether he colluded with russia. The focus will likely be on a meeting that he attended with a russian lawyer and others during last years campaign. That russian lawyer had promised to provide dirt on hillary clinton. Now to our storm watch. As Hurricane Harvey continues to tear its way through the caribbean, the islands left in its wake are reporting total devastation the system is sitting just north of the Dominican Republic right now. Sustained winds are at 180 Miles Per Hour. And at least 10 deaths are being blamed on the storm. The United Nations says it estimates as many as 37 Million People could be affected when all is said and done. Here in miami, mandatory evacuations are under way for high risk areas on the coast. For everyone else, its strongly suggested to get out of the way as quickly as possible. For those looking to evacuate by air, American Airlines says it will wind down operations on friday afternoon in south florida before completely canceling flights throughout the weekend. In a little over an hour from right now, a crew of 9 people will be here at the pg e facility in hayward. They are going to be packing up all the necessary gear and equipment they need before they fly out to florida tomorrow. Pg e has a mutual aid agreement with Florida Power light. That means each company will send crews to help in the event of a major power outage caused by natural disasters. Florida power asked pg e to send 100 linemen, engineers and logistics specialists they stole be on hand to help restore electricity. We do have a significant storm. If we lose power, if we have, um, any level of street flooding or any wind damage that knocks down any of our telephone lines, any of our cables reporter some forecast models show the eye of the storm could turn east before getting to the florida peninsula. Neda, what are the latest models suggesting . Right now it looks like turks and caicos in line next. Right now puerto rico it didnt hit the island, but, of course, you see how massive it is. It certainly impacted them. The winds are still 180 Miles Per Hour. Its been at 185 miles an hour for 35 hours. That makes it the longest storm to stay that strong. Its because of a warm ocean waters sea surface temperatures now reaching 90. It picks up steam over the warm waters. It will stay a category 5 according to the latest track with wind gusts up to 220 Miles Per Hour moving westnorthwest at 17 Miles Per Hour. So heres the bahamas. And then as it gets closer to florida, this is the turn that everyone will be watching to see if its going to impact florida and the east coast or the west coast of florida. This is a cone of uncertainty several models basically showing that it could go anywhere in this cone. Models show it veering to the east of florida. By the weekend florida will feel it. People are told to evacuate now or tomorrow because it gets closer. And along the east there, they will feel the impact. Georgia, south carolina, it will be a category 3, its expected to downgrade then but certainly, that still means destructive winds and flooding. Heres a look at the rain futurecast. What were seeing with this as it reaches turks caicos and the bahamas, up to 20 inches of rain possible and look at this massive area that is impacting the ocean. Thats whats going to cause the storm surges up to 20 feet possible for islands. They are 9 feet above sea level. A new proposal would make some dramatic changes at the Santa Clara County jail in the wake of a highprofile scandal. The proposal comes in the wake of some highprofile problems at the county jail including the beating death of an inmate at the hands of three guards. The Oversight Board would monitor daytoday operations and investigations into any complaints. The county board of supervisors is expected to discuss the plan next week. An oakland man is now suing bart for Excessive Force. It stems from a Violent Arrest at embarcadero station. Kpix 5s jackie ward is live at the station in San Francisco with more reporter kenny, this is where that oakland man Michael Smith was arrested as he and his then pregnant girlfriend were leaving a train. It all started when four bart Police Officers responded to a 911 call from a passenger who claimed a man who might be armed threatened to rob him. Smith alleges in the lawsuit that he was never told he was suspected of a crime or questioned. Instead, the lawsuit states smith was thrown to the ground with guns pointing at him and proceeded to get severely beaten. San francisco public defender jeff adachi has this to say about the case back in december. This case was a classic case of racial profiling. Reporter months ago, smith was tried and acquitted for four counts of misdemeanor battery charges on a police officer. The jury couldnt reach a verdict on two other battery charges. He was never charged with robbery or attempted robbery in connection with the 911 call. But if you are connecting to 242, we have been seeing some slowdowns speeds drop right near port chicago highway and they continue to be slow on 242 until you get to 680. We have been tracking an earlier accident. All lanes have been cleared. This is along westbound 80 right at willow avenue. You can see speeds still very slow in that area. And backing up towards the carquinez bridge. So right now, we are about a 22 minute commute for drivers making their way from the bridge over to the maze. We continue to see some minor slowdowns as you approach the toll plaza. Just in those cash lanes. Still a 12minute ride in the green as you make your way across the span. So temperatures cooling 5 to 7 degrees compared to what we experienced yesterday. And this will be the coldest day of the week and then were warming right back up tomorrow. Live in hayward, Katie Nielsen, kpix 5. The heat over Labor Day Weekend brought recordbreaking temperatures and also proved to be deadly here in San Francisco. The heat wave contributed to three deaths all in their late 70s or older. And they all died in their homes. From heat wave to backtoback hurricanes, one san jose state professor says get used to it. It maybe the new norm. A woman says that these recent weather events including our own recordbreaking heat wave over the weekend are signs of Global Warming she says that its been a concern for decades in her field and now the rest of the world is taking notice. Harvey was probably able to grow strong because of the super warm temperatures in the ocean in the gulf of mexico. And that might be indicative of Climate Change. Whatever changes are going on, they are happening faster than we thought. She says that Climate Change means more heat waves or cold weather patterns, droughts and extreme rain event like hurricanes. And while she said we shouldnt panic, she is concerned about how Global Warming will impact future generations. Global warming and Climate Change is a hot button issue and always debated. One thing you cant debate is last weekend was so hot. Cooling down this weekend but warming back up . It wont be near as hot as last weekend so triple digits we dont expect that coming up. But today will be the coolest day of the week and then get ready for a warming trend. So heres a look at whats going on out there today. We have a storm system that was rolling through our area Northern California right now and you can see some green there. Some areas of yellow and orange and reds. Some heavy rain interstate 5 towards redding. This is outside the area but i want to show it to you because of all the lightning strikes that are occurring there. Thats not what Firefighters Want to see. This is areas of dry lightning on top of these mountaintops that already have that dry brush so certainly something they are watching very closely. There is a red flag warning for areas to the north of us and on the eastern side of the sierra. Heres the storm system. It brought rain down across the sierra moving up north and then theres another band thats creeping its way through redding right now as it moves north, as well. For us in the bay, we are going to get high clouds from this, also a chance of rain. So let me show you that chance. In the next hour or so, were seeing this little area of green coming towards us. By 8 00 this morning, possibly see some areas that will get some raindrops there on the windshield. If you are heading out the door this morning, maybe grab that umbrella or at least a hoodie or hat or something because you could get some of the rain. Its not going to be measurable. Probably less than. 10. Our temperatures are definitely feeling very cool out there. Three hurricanes in the atlanta, hasnt happened since 2010. Im going to track them for you coming up. Right now, we are definitely seeing yellow on our maps. We had a couple of accidents out of antioch along the westbound direction of highway 4. That is starting to slow even speeds speeds drop right around 50 Miles Per Hour. Then once you get to 242, we have an accident southbound 242 at grant street in the Center Divide. Its definitely causing delays as folks are trying to make their approach towards 680 there. We were tracking also the four Minute Travel time but it just jumped into the yellow where were tracking even more significant slowdowns due to an earlier crash. Westbound 80 past willow avenue, that is no longer blocking lanes. Its all cleared to the shoulder. And we still have traffic backed up to about cummings skyway at this point. 25 minutes from the carquinez bridge traffic backed up to the foot of the maze. This is the accident along 80. This is right near highway 4. The westbound direction is going to be slower than usual. As the immigration debate heats up nationally, some california lawmakers are working on a plan to declare a sanctuary state for Illegal Immigrants. Kpix 5s anne makovec is live in the newsroom with more on where this plan stands now. Reporter kenny, the deadline for the state legislature to approve new bills is in eight days. And today, another push to pass a law that would make california a safe place regardless of immigration status. Reporter the public defensor says theres body camera footage that proves that bart Police Officers went too far. [ yelling ] get down on the ground down on the ground reporter last summer at the Embarcadero Bart station, jeff adachi says his client, Michael Smith, of oakland, got in an argument with a man who called 911 and said smith tried to rob him and was armed with a gun. As smith was leaving the train, officers quickly surrounded him. In this body cam video, you can see smith kicking at officers but the lawsuit states cell phone video shows smith getting punched in the head as he was pinned to the ground. In December Smith was acquitted for four battery charges. Its really helped because were able to show the jury that the officers were not truthful in their statements like for example one of the officers says, he tried to walk away your look at the video and standing in one place the whole time. Reporter a jury was hung on two other battery charges and they were dropped. Smith was with then pregnant girlfriend during this event and she was also detained by officers. Adachi says an officer had a knee in her back for 21 seconds and that she miss car tried as a result. The woman wasnt pregnant once the woman told them that she was, they treated her with respect and then offered her medical advice but she declined that. In San Francisco, jackie ward, kpix 5. Some in the east bay may have heard quite a roar coming from way, way up yesterday. This may have been the cause. Take a look. An f16 over walnut creek and lafayette. We snapped these pictures. The faa told us the fighter jet comes from Naval Air Station fallon but the reason for that flight isnt clear for now. What a show. [ laughter ] definitely could hear it right above. Yeah. Makes you look up. Unforgettable everybody is looking up. Hopefully everybody is looking straight ahead both eyes on the road both hands on the wheel. Right now, we are tracking a couple of crashes on your thursday morning commute a little slow. Southbound 242 at grant street, we have a crash in the Center Divide speeds drop below the limit there right around 45 Miles Per Hour. As you are making your way along highway 4 out of antioch, over to 242, you will be in for some slowdowns about an 18 minute ride. Traffic is still very slow along interstate 80. This is the westbound direction as you approach highway 4. This is all due to an earlier crash. No longer blocking lanes. So it happened just paths willow and you can see that the drive times remain in the yellow. Highway 4 to the maze about 22 minutes. Lots of brake lights. Residual delays there. We are still waiting for a tow truck so thats likely what everyone is taking a peek at as they are coasting by. Over at the bay bridge toll plaza, traffic is backed up well into the foot of the maze. You have about 14 minutes from the maze into San Francisco. And thats a check of your traffic; over to you. All right. We have been tracking, of course, hurricanes all morning long. Continuing to do so. We have three out there in the atlantic. This hasnt happened since 2010 where all three storms formed into hurricanes. I want to track two big ones, irma and jose. For the next day or so this is where the bahamas will get beat down but then look, jose is heading towards the Leeward Islands. They already just got hit by irma. And then jose is expected to track just north of puerto rico. Obviously, this is where irma is expected to track just east of florida. So these two at the same time you really feel for the Leeward Islands backtoback hurricanes there. And heres a closer look at whats happening with irma. We have all these hurricane warnings in effect for the bahamas. The bahamas are next in line. So this is right now really blowing strong winds north of the heading towards the the turks caicos. It will head for the southern tip of florida. But it is expecting to go to the east. You can see these models now slowly agreeing as time gets closer and closer to when it may hit the u. S. Then it could affect georgia and the carolinas. People are evacuating now. This is a cold front coming down from parts of the midwest. If this drops further, that will push the storm out into the atlantic. So the cold front, the jet stream, if it dips, that will help the people in florida and georgia. The city of oakland is accusing the Golden State Warriors of failing to pay their bills. City Officials Say the team still owes them more than 800,000 for this years championship parade. The city also wants almost a quarter Million Dollars for the 2015 parade. The warriors were supposed to pay for the parades by august 18th. So far, no money has changes hands. Warriors claim the bill for this years event tripled in cost from early estimates. A suspicious fire has left a San Jose Little League team without its snack shack. The structure went up in flames late sunday night at anderson elementary school. It likely stemmed from two garbage cans set on fire around the same time. The fire comes just days before the teams season kickoff. Its a big blow. The snack shack is our major revenue generator for the league. You know, you think of baseball, you think of hot dogs, hamburgers, soda pop and slushies and thats the facility were able to sell that to our kids. The Little League team has created a go fund me page to help make up the cost. A hate Crime Investigation is now under way in the east bay after a noose was found right outside alameda high school. A staff member found this noose on the sidewalk yesterday afternoon. Police made clear, quote, the persons responsible could have left the rope on display with the intention of threatening another person. While many locals and the district expressed outrage, some in the area hesitated. I think people feel more comfortable blatantly displaying racism and hatred and thats scary. Thats a conclusion that youre drawing no, this is what the district said in their statement. The noose is a symbol of violence thats extremely intimidating and threatening to blacks in particular in this country. We are deeply disturbed that this happened.
