You can expect our highs today to be cooler than yesterday. The marine layer is creeping through the bay hovering around the coast and the bay. Dont expect to see much of t a but by tomorrow you may have cloudy conditions even in the inland areas. Thats because of this storm system thats just off the coastline just about 2 75 miles off the coast. Winds are cooling us down, the onshore flow pushing the marine layer in and bringing down temperatures a little bit. Well have more coming up. Hundreds of thousands of people are facing an uncertain future with daca canceled. Bay area politicians will fight the decision however they can. Reporter jackie ward has details. Reporter good morning. States are fighting back, as well. California is one of three states considering legal action against the Trump Administration following attorney general Jeff Sessionss announcement. Washington state and new york are also considering a lawsuit as the immigration status of nearly 800,000 people is now in jeopardy. A little more than a quarter of those people, 220,000, live in california. California attorney general Xavier Becerra said ending daca would be devastating for not only recipients but for the state economy. Our secretary of state is also against the white house decision. He couldnt even have the courage to face the cameras himself. He didnt even have the courage to speak directly to the 800,000 dreamers across the country. For a lot of people, its big numbers of undocumented immigrants but each of those numbers is a person. Its a friend, its a colleague, its a family member. Reporter congress has until march 5th to take any kind of action on daca. If congress does not act by then, starting next year, nearly 300,000 people could begin to lose their status and more than 320,000 would reportedly lose their status from january to august of 2019. This decision comes as attorneys general from 10 other states threatened a lawsuit in june saying if the Trump Administration did not end the daca program by december 5 they would sue. Thank you. Irma is topping the scale as a powerful category 5 storm. Its already hit the island of barbuda. And this morning the system was packing winds reaching 185 miles an hour. Its predicted to march toward puerto rico and cuba before possibly heading towards the u. S. Mainland this weekend. President trump has already declared emergencies in florida, puerto rico and the u. S. Virgin islands. We could be looking at wave heights that would put the ocean over the islands. Despite the need for resources after harvey, floridas governor says fema is prepared and ready to help in case this powerful storm takes a toll. And cleanup efforts in the aftermath of Hurricane Harvey are far from over. Today members of congress are expected to vote on a nearly 8 billion disaster aid package to help people in texas and louisiana rebuild. Some heartfelt reunions in one of the hardest hit regions in texas, parents in texas are finally getting to reunite with their newborns. Last week, eight babies in the icu at a hospital in beaumont had to be airlifted to safety after the hospital didnt have access to clean water. The floods prevented one couple from following their baby to another hospital, 120 miles away. I just broke down. To think that i couldnt see her, knowing that she was going to get in a helicopter without us, i got really emotional. It was really heartbreaking. Over the weekend, that couple was reunited with their baby and doctors say all the babies are doing well. And nfl player jj watts Hurricane Harvey relief fund has toppe 21 million. The Houston Texans defensive end started raising money last week. The initial goal of 200,000 was surpassed in hours. Over 190 donors have contributed. An unknown amount of light petroleum came out of a transfer pipe on monday morning creating a 20 by 20foot sheen in the water. This comes as phillips 66 is working to increase the amount of oil tankers allowed to make deliveries to the refinery. Right now 59 ships a year can deliver oil and gas there but phillips 66 hopes that number goes up to 135. Right now, police are investigating a deadly shooting in East San Jose. This is south Sunset Avenue here behind me and the shooting happened right in front of the parking lot of this apartment complex. The shooter fled and police dont have any description of that shooter to share with us at this point. But they were out here for several hours collecting evidence and interviewing Witnesses Police say they expect to have more information for us later on this morning. The proposal comes after city leaders found 20 residents living in deplorable conditions earlier this year. They were found living in the basement of Clean Wash Center laundry on Mission Street for more than a decade. And they described the Living Conditions as a fire trap. The City Attorneys Office filed a lawsuit against the Property Owner last month. Another Transit Village is in the works, this time near the walnut creek bart station. Now, the first phase of that village starts today with work on the parking garage. Now, take a look at some of the renderings of what this will look like in the future. Bart Officials Say the Transit Village will include a bart police station, new shops, restaurants and public projects. The new garage is the first step in the plans. It will include more than 900 parking spaces. Thats expected to open by late 2018. Bart officials are telling riders, dont worry so much about not having parking because crews are going to work on the garage in stages. So the existing garage will remain open at all times. Bart says the village will also include new apartments. About 600 units. Its all part of about barts ambitious goal to bring 20,000 Housing Units near bart stations across the system. Also in southern california, a section of freeway could soon be named after former president obama. State lawmakers yesterday approved the renaming of a portion of state highway 134. Obama attended Occidental College in eagle rock from 1979 to 1981 and often used that freeway to travel between his home and the school. And back here in the bay area, transit Officials Say smart is seeing strong ridership in the early stages of paid service. The agency predicted 3,000 people would use smart trains on weekdays an Officials Say the actual figure was just shy of that with roughly 2500 to 2900 people taking rides monday through thursday. But weekend ridership far surpassed predictions. 300 passengers were expected. And transit officials reported 2,000 used the smart system. Time check 6 14 right now. Speeds drop right around 20 miles per hour. Richmond parkway getting very busy, as well. Everyone is using that as an alternate route. Even just to cut back over to interstate 80. But a lot of folks are doing that so its going to be a slow ride. Our travel times just jumped, about 23 minutes as you make your way from highway 4 over to the maze. 580 right at highway 24, thats still moving right at the limit. Its getting crowded but overall, looking okay on that approach towards the bay bridge toll plaza. Its about a 28minute ride from the maze into San Francisco. So definitely dealing with the crowds this morning. Wednesday morning in full swing. Westbound 580 right at north flynn, we have one lane blocked, looks like a car broke down blocking the lane and that has traffic backed up into tracy so drivers heading through the Altamont Pass about 52 minutes between 205 and 680. No delays, thats about 20 minutes. So give yourself an extra 30 minutes out the door. Northbound 101, at cochran an earlier crash is cleared. Still a little debris left. Thats causing a big backup. We are seeing residual delays. Take leaving look right now at our skyline waiting for that sun to come up. Look how gorgeous that is. Look at this good levels for southcentral bay and Santa Clara Valley and moderate along the coast and the east bay and the north bay. A lot of that smoke and haze though has been push out because of the winds. Heres our temperatures today. Low 80s for most of us especially inland. Look at this. Concord 85. Pittsburg 85. Cooler 83 in san ramon. 82 in dublin. And it looks like temperatures along the coast finally reaching the normal range down into the upper 60s along the coast. We are watching a storm system just off the coastline right now. And its going to be moving up north increasing our chance of rain, also increasing our cloud cover. So 275 miles off monterey right now, and it is moving towards the bay area. But its not too strong of a system. A pretty weaker low pressure system that will bring us clouds by midnight starting to possibly see a little bit of green along the coast so you may wake up to some rain on the windshield there. But as you can tell, its scattered and its pretty light. Heres your sevenday forecast. Tomorrow when the storm moves through, it will drop temperatures significantly. Well see temperatures below average. Today were about a degree above. And then friday, saturday, youll see that rise in those temperatures. Sunday in the 90s, tomorrow in the 70s inland. According to researchers from ucsan diego, zika could help treat a common form of brain cancer. They performed an experiment on mice by injecting their brain cells with the virus. It slowed tumor growth and extended the lifespan. They say they hope to begin human trials sometime next year. Scientists in the uk have developed a new camera that can see through the human body to detect medical tools during procedures. The goal is to replace xrays and other expensive methods currently used to track medical equipment during surgery. Some of them are young people who want to continue to make america their home. She said getting rid of daca is a bad decision. Over the next 10 years if we rescind daca without replacing it, well lose 60 billion in tax dollars. So there is real economic benefit to allow these people to work, to be able to contribute to our economy and to be able to contribute to our society. Reporter in a statement, President Trump released yesterday, he said, quote, we must also have heart and compassion for unemployed struggling and forgotten americans. He also wrote that this will not be a sudden phaseout but rather a gradual process. Permits will not begin to expire for another six months and will remain active for up to 24 months. Floridas governor says fema is prepared to help in case Hurricane Irma takes a toll. Forecasters are calling irma the most powerful atlantic storm in recorded history. Its expected to possibly hit florida sometime this weekend. President trump has already approved an Emergency Declaration for the state. And ned tahas been tracking Hurricane Irma. By saw the eye passwe saw the eye of the storm pass over st. Martin with much destruction as it passed over the island. This is what im talking about. That is a massive eye. This is a huge hurricane. It went through barbuda earlier and about an hour or so ago it passed over st. Martin island. And it is headed for puerto rico, dominican republic, still continuing to move in this west northwest direction at 16 miles per hour. Look at those wind gusts. 225 miles per hour. And seeing some reports of sustained winds of 190 so again, the strongest hurricane in the Atlantic Ocean, there it goes, heading towards puerto rico. Expected to pass puerto rico by tonight just north or possibly make landfall there. Also, possibly north of dominican republic. And haiti. As it heads towards florida. So as it tracks towards cuba into florida, thats when it starts to downgrade possibly to a category 4, 3, possibly reaching landfall in florida by monday but, of course, people in florida are preparing now. Look at how massive this is as you watch the corner of your screen there. This is a rain futurecast for the next day, this is how intense its going to get. Those sea surface temperatures 85 degrees is creating the perfect storm, wind gusts up to 225. Its the flooding that will be lifethreatening. 20 inches expected in some nde up to 11 feet above ground. We just saw an upgrade here of jose, expected to reach hurricane status by tonight. Also theres katia, going from a depression to a tropical storm. Also tracking these, as well. So a lot of activity going on in the atlantic right now. Jaclyn, to you. We are tracking 2 track Traffic Alerting for drivers this morning. Westbound 80 backed up due to an accident on highway 12 right near red top road. The lanes were just cleared. And that crash cleared over to the shoulder but the backup continues to stretch closer to highway 12 as you make your way into fairfield this morning. So just a heads up. Southbound 680 through the cordelia junction, definitely getting heavy. We are getting reports of a fire in the rodeo area and were also getting were still tracking that earlier crash along westbound 80 right at el portal drive, two lanes blocked. Multiple vehicles and a motorcycle involved in this accident and traffic backed up well beyond highway 4 at this point. Youre looking at about a 50 minute ride from highway 4 to the macarthur maze. Richmond san rafael bridge getting very crowded over at the toll plaza. In the yellow now making your way westbound and reports of an accident over at the Golden Gate Bridge in that southbound direction. It looks like a truck hit one of the toll plaza gates. A man was shot just after 9 00 here last night in front of the apartment complex taken to the hospital and that is where he died. The shooter took off from the scene and police dont have any sort of description of that shooter to share with us yet this morning. They have been collecting evidence out here and interviewing witnesses. And were expecting them to release a little more information later on this morning. Live in East San Jose, anne makevoc, kpix 5. In santa rosa, after outfitting Police Officers with body cameras, the department may be getting an upgrade. The press pressdemocrat reports that the cameras officers currently use are out of date and the city is looking to swap with new cameras that are easier to use and have faster transfer speeds. The upgrade will cost about a million dollars. The pressdemocrat says the City Council Approved the new cameras during last nights meeting. Court documents are revealing disturbing details about the four Alameda County deputies accused of abusing inmates. Former santa rita jail guards justin linn, erik mcdermott, Stephen Sarcos and sarah krause faced a judge yesterday. According to the documents, they allowed gassing and then intimidated those who threatened to report t gassing is a prison term for throwing urine or feces at another person. One inmate accuses mcdermott of putting pressure on his income until he passed out. All for suspects due back in court next week. Its the latest trend in many bay area cities. A woman is now speaking out about what she says the teen did on a hiking trail. Hiker Liz Fitzgerald says that the eagle creek fire got started saturday when a boy tossed a smoke bomb down a raas his friends watched. Fitzgerald warned the teenager how dangerous it was and she returned to tell authorities. Flames started spreading and fitzgerald said the teen and his friends who were filming didnt seem fazed. Do you realize you just started a forest fire . The kid who videotaped it said, what are we supposed to do about it now . Fitzgerald says that the teens initially fled the scene but investigators managed to catch up with them for interviews. Police are hoping other witnesses come forward to give accounts of what happened. Right now, the mission fire in the sierra foothills posts a threat to hundreds of homes. Crews have been using helicopters to drop water on the fire plus air tankers to prevent as much Property Damage as possible. 500 firefighters are working to crush the flames. The fire has burned nearly 1,000 acres and remains just 10 contained. And back here in the bay area, we have learned that one firefighter got hurt trying to stop the spread of these flames in gilroy. Air quality in the area is becoming a source of concern due to the wildfire smoke. Crews fear that the 100acre fire could spread to 600 acres before they can fully contain. So far no structures have been damaged. Officials say that the fire is 45 contained. Big news this morning for a couple of Silicon Valley giants. San mateo bridge heavy out of hayward to foster city. Thats in the red, 25 minutes. We havent seen any reports of accidents or roadwork as you make your way into san mateo. But we will keep a close eye on that. In the meantime, give yourself some extra time.
