Reporter good morning, crews are still out here this morning in sunnyvale trying to get this section repaired before the morning commute begins. Now what happened last night looked like a scene right out of a hollywood action movie. But no, this was real life all caught on a cell phone camera. Now look closely and you can see the deputy pulling a man out of the car. The man stumbles and falls to the ground and then seconds later, boom. The on coming train smashes into the car. Here it is again. You can see how the man fell down but the deputy still grabs him by the arm and drags him to safety. Theres a second angle from the officers side that shows the moment of impact. Now the deputy who pulled the driver out didnt want to talk on camera but a second deputy on scene who actually ran towards the train to try and slow it down said he was just doing his job. I mean just happy with the results you know regardless nobody died and thats thatd be the worst outcome of this situation. And you know, glad that we were here. Reporter nobody was hurt. The train itself was damaged and delayed service for the passengers on board. By the way, investigators say it appears that driver may have been drinking. Were live in sunnyvale, kiet do, kpix 5. Amazing video. Thank you so much. The big wildfire near lower lake in lake county continues to grow. The rocky fire has now consumed 62,000 acres. The fire is only 12 contained. 13,000 people and three counties are now under orders to evacuate from about 5500 homes after the fire jumped highway 20. And now covers more than 97 square miles, thats about the size of oakland and berkeley put together. Cate cauguiran reports from lake county. Right now ground cries are trying to get to the fire line while they still have access. Theyre working to evacuate the families in the area but still some are not leaving just yet. Today an excon accused of killing a Police Officer in tennessee is due in court. 29yearold Tremaine Wilbourn turned himself in yesterday. He was the passenger in a car parked illegally in memphis on saturday night when officer bolton approached the car, wilbourn allegedly got out and had a scuffle with the officer and then shot him multiple times. Police believe wilbourn was taking part in some sort of drug deal. And today jurors in colorado will hear testimony from those who lost loved ones in the 2012 Movie Theater shooting. James holmes is still facing the Death Penalty for killing a dozen people and wounding 70 others in the attack. Yesterday, jurors rejected holmes insanity defense deciding he was capable of telling right from wrong when he carried out the attack in a denver suburb. This morning, Vallejo Police are investigating a mysterious car crash as a homicide. Atierra westbrook was found dead in her car in this crashed caratter yesterday morning. But rather yesterday morning. But investigators dont believe it was the crash that killed the 21yearold. Someone walked up to the car and opened fire on her way to work causing her to crash. So far, there have been no arrests. Closing arguments begin today in a court battle over frozen embryos in San Francisco. Dr. Lee and steven fund lay are divorced couple in the dispute. Reporter the lancaster fairgrounds in northern New Hampshire is roped off with yellow tape this morning as authorities investigate what caused a tragic circus tent collapse. Unfortunately, two people lost their lives in the incident. And adult male and a young child. Reporter Brandon Isham was among about 100 spectators in attendance for the first Walker Brothers show of the day monday when heavy rain moved in. The flaps on the side of the flaps on the side of the tent, they were open. They werent tied down with any poles or anything. And they started going crazy. And people who were part of the circus just yelled run. Reporter more than a dozen others are in the hospital being treated for various injuries. He says his 4yearold son bentley was treated and released after a pole hit his left eye. A string of fires at a hayward apartment complex are being called suspicious, fires broke out yesterday morning at the complex on silva avenue. Two of the fires broke out in stairwells and a third fire in a laundry room. The firefighters thinking it is arson. Several apartments were so damaged people live there cannot return. Well, if you have a mortgage and most of us do, you have to have a insurance but what happens if your insurer cancels your coverage . Julie watts found out some Insurance Companies can canceling policies in areas with high fire risk. I just try to keep it up be the best i can. But not enough for Liberty Mutual which wont renew her insurance policy because the property quote poses an unacceptable risk for wildfire. It was a fire danger when i bought this. They incorporate topography and even wind patterns to figure out fire risk. We are seeing some insurers who are lightening their book of business in specific areas.
