The gun wrapped in a shirt in the tshirt and went off in his hands. He pled not guilty. His lawyer says it was an accident. We can confirm that mr. Sanchez did not know kate steinle and he had no reason to want her to be harmed in any way. Reporter now, sanchezs story has changed along the way. Originally he said he was using a gun to shoot sea lions. This will reignite the debate over whether or not San Francisco should be a sanctuary. The murder of kate steinle has provoked a dispute about who is at fault for letting an illegal immigrant felon go fruit. Chef Ross Mirkarimi said it isnt his fault. He says federal immigration officials messed up by not obtaining a warrant to keep sanchez in custody. Our allen martin talked yesterday with a former head of i. C. E. About that. Sheriff mirkarimi clearly laid the blame right at the door of i. C. E. He said that the city and the county really had no choice. In fact, heres what he had to say. Well, i think i. C. E. Needs to take an account that its not just San Francisco, its over 300 cities now. This could happen again. I think it could, which is why that i. C. E. Needs to upgrade its policy and procedures and practices so that were all working in a more fluid contiguous basis. Reporter how do you respond to that . I think the sheriff is wrong. We are not asking for a legal instrument to pick up the phone and let i. C. E. Know that they are holding an individual, a criminal foreign national. There is no need for a legal instrument for that. The civil immigration system is not designed to get warrants in every, single case. Last year i. C. E. Issued over 200,000 detainers. If we had to get arrest warrants for every one of those to process people through the civil immigration system, first of all, it would turn all those cases into criminal immigration cases and it would just bog down the system. I think he is making excuses because he doesnt want to cooperate. By the way, we have completed coverage of the pier murder on our website, cbssf. Com. Ac transit is considering a purchase of some double derek buses after some test drives went well. Each doubledecker bus can carry 80 people compared with 32 for the agencys standard buses. Each doubledecker would cost about 880,000 compared to about half a million to a new standard bus. All right. I know gianna is having a busy morning. Whats it looking like . California is trying to catch up with technology in efforts to regulate socalled ecigarettes. Kiet do joins us live from san jose with the proposal to be considered today by an Assembly Committee. Good morning. Reporter right now ecigarettes are regulated by a patchwork of laws across 180 different counties and cities but if this bill becomes law itself then it would streamline the law and treat ecigarettes like regular cigarettes. Supporters of this bill say that its been proven that ecigarettes admit cancer causing toxins like formaldehyde and its not harmless vapors as the manufacturers would have you believe. The bill would also make ecigarettes adhere to no smoking laws and ban them from schools, restaurants, hospitals and so on. Senator mark leno said these Tobacco Products are addicting a new generation of smokers to toxic nicotine which we already know is highly addictive and contains harmful chemicals. Ecigarettes lovers are not happy. We dont want tosh lumped up with the smokers because smoking is dangerous and people die of it every day. Reporter there is also a separate bill under consideration that would raise the smoking age from 18 to 21. Now, both these bills head off to the assemblys committee on governmental organization. However, its got an uphill battle because more than half of the members of the committee have taken large donations from big tobacco. Live in san jose, kiet do, kpix 5.
