From San Francisco down across the bay and into the south bay, the steadiest rain right now seems to be in the east bay, basically from oakland and alameda to hayward and fremont. And we have wet pavement on all the major freeways. Obviously all the local streets are wet as well. Thats slowing down the evening commute and anybody whos just out and about in the evening hours. This storm ranks one on the impact scale, a storm of light intensity, but still its slowing down traffic now and continuing to produce wet weather. As we go into the nighttime hours, cold air coming into the northern part of the area will produce snow in areas like clear lake. And as the cold air continues to surge into the bay area during the overnight hours we may see mixed precipitation and light snow mixing with the rain. But basically, by 5 00 tomorrow morning as the morning commute gets under way, well see showers tapering off and maybe a few breaks of clear sky. Sadly two of the plaintiffs in that lawsuit have recently passed away. The lawsuit now includes a wrongful death complaint. And there are also new plaintiffs and new allegation, including that Oakmont Senior Living is attempting to silence employees by offering them money. Thats all we have is each other. This was bess in a hospital bed two weeks after the evacuation from villa capri, an oakmont living facility that burned down in the Early Morning hours of october 9 during the sfro santa rosa fires. She recently passed away as did another resident. Both died in december. Reporter in november, attorney kathryn stead nner fil a law suit. Today she filed an amended complaint that includes wrongful death. According to the lawsuits, villa capri residents survived only because of the hercules efforts. They had to push or carry people downstairs in the dark. When i look at those people, visions of the titanic going down and people saying good bye for the last time got in my head. Reporter it alleges they have tried to silence former employees by offering them 750 to 15 hi 1500 in exchange for t signature on this letter sent by karen ellis. The letter states the employee has no knowledge of any violations of state, federal or local laws by Oakmont Management Group that the employee has not already previously disclosed. The letter also requires the employee to waive any employment claims he or she has or could have against Oakmont Management Group. I think its an unusual letter. Reporter the department of social services is investigating the evacuations at three of their properties to determine if they followed evacuation plans. The plan is no plan. Reporter in an emailed statement on october 16th, Oakmont Management Group says all of our facilities have evacuation plans, we have three backup generators on site. The maintenance people who used to work there said there were no generators. Reporter they have not said where the generators were located or if they were working during the firing. Abc7 news reached out to Oakmont Management Group for a response to the complaint and the allegation that theyve attempted to silence employees by offering them up to 1500. Today the Union Representing drivers for apple commuter buses says they want to keep buses and passengers safe. The yesterday, buses were shot at while traveling on interstate 280. Theyve been a source of protest in the past with criticing calli calling them a symbol of gentrification. Our concern Going Forward is that this type of stuff could continue. And we dont want people to get hurt. No one was hurt in either incident, but at least one bus window was broken. As we hit the peak of the flu season, a new Study Suggests it may be spread not only by coughing and sneezing but simply breathing. It is the biggest study ever done on the topic and they hope people will listen up on what theyve found. Some are doing whatever they can to avoid the flu. But despite the efforts to stay healthy, a new study published in the National Academy of sciences suggests that the flu can be spread simply by breathing, led by the university of maryland, it also involved researchers from berkley. The team found that those who are infected can still generate infectiousary sol infectio infectious ary soles. I think its a real concern in terms of how flu might spread. House Speaker Paul Ryan says Senate Democrats dont oppose anything in the bill, but are holding it hostage for a deal on deferred action for childhood arrivals. Senate bill 54 enforces noncooperation policies between California Law enforcement agencies and federal immigration authorities. Reporter for more than a decade, college and nfl teams have work on symptoms to spot concussions. Eye tracking devices in the bay area are used routinely in the sidelines. But now its suggested that concussions may not be the real signal of longterm brain damage known as chronic traumatic encephalopathy or cte. You dont have to be concussed to get chronic traumatic encephalopathy. Theyre totally distinct. Reporter william moss and his team used powerful Super Computers to image data from impact experiments on animals. They discovered blows to the skull are enough to cause stress damage to the brain even without causing the symptoms of a concussion. In a separate study of deceased athletes in boston suggested that repeated impacts may trigger changes in the brain that trigger cte. What it means is those who have left american football, mostly everybody, that concussion protocols may be insufficient to protect the athletes. That is theres something extra that might have to be done. Reporter currently, cte can only be diagnosed after death with an autopsy on the brain. The victims were often not released from their chains to go to the bathroom. Reporter District Attorney mike hesstrip said the children were not allowed to have food. They would buy pies, leave it on the counter, let the children look at it but not eat the food. Reporter although the children were home schooled, they didnt learn much. Many of the children didnt know what a Police Officer was. The 17yearold when asked if there was medication or pills in the home didnt know what medication or pills were. Reporter when evan and mark newman left superior court their afternoon, they did so what brothers call a good fight to a draw. They call it a victory, but it is an exoneration, which ill take. Reporter would you do this again . Reporter it began october 17th, when they inspected their mothers burned home, despite it being in a restricted, evacuation area. As seen in this body cam video, Santa Rosa Police arrested the brothers, took them to jail and paid 1,000 on charges of not obeying orders to leave. Last week, evan vowed to take the case to a jury. His brother mark pleaded guilty, because he could not risk going to jail. He received three years probation and 180 hours of Community Service. I think there were a number of people just doing their job. But when everyone did their job without thinking about whether it was right or not it spun out of control and wrong became right.
