Of first degree murder, Second Degree murder, not guilty of manslaughter. Guilty only of one charge, possession of a firearm. Team coverage in and outside the krors. Lyanne melendez has covered the trial from the beginning. Reporter it took six days for the jury to reach this verdict. I would calculate about 28 hours or so of deliberations. Many people were surprised by the verdict, again not guilty of murder, not guilty of assault with semiautomatic weapon and as you mentioned, guilty of possession of a gun. Now that one really surprised me and made little sense to me. This is the explanation given by the public defender jeff adachy. They heard the evidence, they deliberated as a group, they heard read back testimony, looked at physical evidence and rendered a verdict to best of their abilities in accordance to the law. Verdict we werent hoping for. Both sides fought very hard but again the jury is the one, the jurors are the ones to make the determination on the case and we will respect that decision. Reporter and that was Matt Gonzalez, defense attorney and spokesperson for the District Attorneys office. Hear from jeff and his explanation as to why Garcia Zarate was found guilty of possession of a firearm. If we could have that please. They heard the evidence, they deliberated as a group, they heard read back testimony, they looked at physical evidence, and they rendered a verdict to the best of their abilities in accordance with the law. It was a verdict we were not hoping for. I know that both sides fought very hard, but again the jury reporter we will hear eventually from jeff adachy. Apologies. After the verdict was read, defendant jose inez Garcia Zarate did not react but later got up and hugged Matt Gonzalez, hi attorney. And gonzalez maintained all along his client found the stolen gun at the pier wrapped in piece of cloth, if you remember, picked it up and accidentally fired. I want to also mention that possess of a weapon carries sentence up to three years and Garcia Zarate has already served a little more than two years in jail. D. A. Confirmed there is a federal warrant in place. Once released Garcia Zarate will be handed over to i. C. E. Im live from the hall of justice, lyanne melendez, abc7 news. A lot of people are wondering how the jurors reached not guilty decision but they left without wanting to talk to anybody, to reporters certainly. Do you expect that to thank in the days ahead . Reporter i dont think so. The judge made a promise to them and that was to keep their names and addresses and any information sealed. And they also decided not to talk. Usually in a case like this one, one or two members of the jury, perhaps the foreperson, decides to talk to members of the press. Not this time. You have to remember that this is a very controversial case. I said this before, i have been receiving a lot of tweets from people who are very upset with this verdict. Add to that as well. As this case is debated and verdict is debated, some of the jurors may change their minds if hearing themselves being criticized. Some may want to speak out and explain why they did what they did. Thanks very much. One of the most shocking aspects of the verdict, comes despite the defendant admitting to shooting kate steinle in exclusive interview with abc7 news. Cornell bernard conducted that interview just hours after the shooting. Live now. Reporter that interview happened inside a holding cell here at county lockup, 2 1 2 years ago. 48 hours after his arrest. He told me that he shot kate steinle on pier 14 but it was a tragic accident. Heres part of that interview. Did you shoot kate steinle, the lady who was down on pier 14 . Yes. You did shoot her . Yes. I hear the boom, boom, three times. Reporter he claims he threw the gun into the bay, didnt realize he shot someone until picked up by police. Where did you get the gun . [ inaudible ]. Something like that. Sorry for everybody. You feel sorry for conservative including Kate Steinles family . Yeah. Reporter he said he found that gun wrapped in a tshirt on pier 14. Went to pick it up and gun fired. He says he didnt know he shot kate steinle and walked away. Judge in the case did not allow that interview to be played in the trial. Garcia zarate, undocumented immigrant, deported five times, said he came to San Francisco because he knew it was sanctuary city, would not be pursued by federal authorities. Live in San Francisco, abc7 news. San Francisco Mayor ed lee is not commenting on the verdict, at least not yet. Talked about the case earlier today. Another city leader is speaking out, Wayne Freedman from city hall with more. Reporter good evening. From the beginning opponents of San Francisco being sanctuary city have tried to politicize the trial. Likely to continue. Earlier today we spoke with mayor ed lee and asked about the politicizing of this case. That was reaction. We are and will remain a sanctuary city, no matter what the attorney gem of the United States tries to do or president tries to do. We believe and know for a fact were safer city as a result. Thats why well continue being a strong city for immigrants, diversity. Not going to blame people but hold folks individually accountable for their actions. Issue is weve got too many guns floating around our society. Whether discharged by person on purpose or by accident who was legal resident of this country or not, issue is we have too many guns floating around the streets of this and other american cities. Reporter its worth noting that he agrees with mayor lee. Its sad but shouldnt be playing on it. Asked if he was surprised by the verdict. He says he trusts in the justice system. Wayne freedman, abc7 news. Kate steinle lived in San Francisco at the time of the shooting but grew up in pleasanton. Eric thomas is live there with reaction to the verdict. Reporter indeed lived on beale street not far from pier 14 where the tragic shooting happened but grew up in pleasanton, graduate of Amador Valley high. Talked to people who were shocked and appalled by the news. This city of 70,000 people thinks of itself as small town and closely knit, allamerican city. Political viewpoints might have varied but heard from just about everybody we talked to, this was not justice. I thought it was ridiculous, honestly. I was horrified that it would be a not guilty. To me and everybody i know, such an obvious guilty verdict. Shocking that someone would get away with shooting a gun and murdering somebody and get away with it really. One of the things about San Francisco as sanctionized city is something i personally dont agree with. This is a perfect example of it. Reporter mayor ed lee may think being sanctuary city is what we want and many agree, but many we spoke dont agree. Curious what is going to happen to mr. Zarate after this, deported a sixth time . Seems likely. They think the possibility of him getting out of jail with time served as possibility, something they find appalling. Abc7 news. Or something federal for which he might serve time . More questions in weeks ahead. Thats likely too. This became a big issue of the president ial campaign but so far not heard yet from president trump. Attorney general Jeff Sessions is speaking out and taking aim at sanctuary city ordinances, i urge communities to reflect on the outcome of this case and consider the harm theyre doing to citizens by refusing to cooperate with federal Law Enforcement officers. Coming up, hear from family of kate steinle. And man who former Alameda CountyDistrict Attorney john kraiden spent the day in our studios, analyzing and talking about the case. Talked about some of the factors in the decision. All 12 agreed he was not only not guilty of murder but not involuntary manslaughter. Keep in mind that in involuntary manslaughter, there has been a crime committed. In this case brandishing. And has to be so reckless it creates a high risk of death and as result someone died. Apparently the jury concluded that the defendant did not brandish the weapon. If he did, didnt brandish it in reckless way that it would qualify as involuntary manslaughter. Our legal analyst. Reaction is coming in from all over the country and social media. Dion lim is here. Culling through social media since we knew the verdict was coming down. Stay with us, coverage of kate s a San Francisco jury acquitted this man, jose inez Garcia Zarate, of the most serious charges he faced in the 2015 shooting death of kate steinle. Garcia zarate was found not guilty of murder and manslaughter. Jurors did convict him of being in possession of a firearm late this afternoon. Defense team argued he found the gun and went off accidentally. Prosecutors claimed he fired it deliberately. Steinles family told the chronicle they were shocked. Lyanne melendez outside the hall of justice. Quite a day. Yes. And i can tell you everyone in that courtroom was really surprised. We were left with a lot of questions. For example, how do you find a person not guilty of murder yet guilty of possessing a firearm. Thats what i asked the public de defender. Jeff adachi. Right. The crime of position of a gun only requires that the person knowing knowingly possess a firearm. Only requirement. If the jury found that mr. Garcia zarate knew that he was possessing a firearm and that there was no intent for him to hurt anybody or shoot anyone, thats completely consistent with them finding not guilty on the principal counts and guilty on the count of possession. Reporter took the jury about 28 hours or so to come up with the verdict. Defendant jose inez Garcia Zarate eventually got up and hugged his attorney Matt Gonzalez who always maintained that client found the stolen gun at pier wrapped in piece of cloth. Picked it up, picked gun up and went off accidentally. Heres gonzalez ased spokesperson for the d. A. s office. They heard the evidence, they deliberated as a group. Here you see juan inez Garcia Zarate hugging his attorney as he learned returned not guilty on all charges bun, possession of a firearm. Katie has given us a glimpse inside where cameras were not allowed. Interpretation of jose inez Garcia Zarates testimony was crucial in the trial. Lisa amin glooejian is life with more. Reporter i spoke with the interpreter who works for the city of San Francisco. Had a front row seat for entire trial. Asked her what the mood was like as well as defendants reaction once the verdict was read. The mood was somber. Kind of quiet. The defendant seems to be understanding what the decision was. Had every semblance of being happy, content with himself. Jury seems to be very strong and very definite. They look back and i looked forward, and that was it was very unusual, no emotions. And what seemed to be really something to note for lena pritchard, interpreter, how quiet the courtroom was. Said in a case like this in typical trials, this long and extensive, and well publicized, typically a vocal response in the room, good or bad. In this case there was absolute silence. Live outside the hall of justice, abc7 news. All right lisa, thank you. Steinle family gave interview about the case to the San Francisco chronicle and we heard a portion of it. John diaz is here now with dion lim. You spoke with the steinle family in the trial and tell me they didnt have High Expectations when it came to the decision the jury was about to make. Thanks for having me first of all. Went to east bay home and talked to them last week and they were braced for the worst. As far as they were concerned had been a confluence of errors and missteps all along from the fact that mr. Garcia zarate was brought to San Francisco for 21yearold marijuana charge, then released and got the gun because blm ranger left it in his trunk. They were really at the point where they really were not expecting or even really demanding a verdict on murder or homicide. They just wanted it to be over. Which is the reason they decided to give what they hoped and expect will be last interview last week. Instead ended up speaking with you after the verdict as well. Something in your article i found very interesting is that family members said they had no or vindictiveness over all this. Tell me last week as opposed to today. Reflective last week. One of the reasons they wanted to talk before the verdict actually came down. Interesting. Theyre a remarkable family. They had no vengeance, theyre deep in their faith. Nevertheless they were stunned. Talked to the father and brother today. And as jim steinle said, justice was rendered but not delivered today. And i remember early on after the actual shooting happened, made rounds of cable news networks, talking with bill oreilly and fell they were used for political reasons so decided not to talk. Do you think maybe one day theyll decide they want to tell more of their story . They might. But right now just weary of the whole thing. Immediately after kates death, saw it as opportunity to get story out of their daughter and what she accomplished and her life. But ended up, whether they liked it or not, and they did not, becoming a cause celebre in the political world, donald trump as candidate and president always talked about Kate Steinles case and fox news and particularly bill oreilly used it as cause celebre. Thats not what they wanted. Pointed out to me in interview last week, none of this brings kate back. Great point to make. Also talking on social media, waiting for president s tweet. Some of the tweets that expressed anger we couldnt share on the air, so full of rage and frustration. Many thanks to you, john diaz, editor of the editorial page of the San Francisco chronicle. Law enforcement official told abc news the Justice Department may pursue federal charges against jose inez Garcia Zarate. We speculated about that. We heard from our legal analyst on this case. Spoke about why he was found not guilty of first degree murder. What would have to be proved and sentencing would likely be for that. You have to prove not only defendant had intent to kill miss steinle but thought about it beforehand, premeditated and deliberated about it beforehand. The facts supporting that charge are thin. Okay. Second degree murder requires intent to kill or intent to do an act so reckless, firing a gun at crowded pier, with conscious disregard of the danger. Knew it was danger and didnt care and did it anyway. May not have intended to kill miss steinle but doing that act in such a reckless and disregarding way will permit a conviction for Second Degree murder. Insight from john creighton, a former Alameda CountyDistrict Attorney. Kate steinle killed walking had we are father. Police arrested Garcia Zarate an hour later on pier 40.
