Im Audrey Asistio welcome to nbc bay area news at 4 30. Weve been very busy this afternoon talking to police, School Leaders and students about what exactly went down at Christopher High School. Were going to tell you what weve just learned in just a bit. Also were tracking other stories on this wednesday, including take a look at this, this ship sinking in the delta. Its got a huge hole and its taking on water. The big Environmental Concern its now causing also the Surveillance Video is haunting. A passenger hijacks a bay area bus. You see right there with a machete. Investigative reporter Candice Nguyen will join us with a closer look at complaints with the panic button for bus drivers , and oaklands former police chief is looking for a new job. How he could soon be working hand in hand with the mayor who fired him. But lets go ahead and begin this afternoon with that stabbing, a student was stabbed during a fight at a south Bay High School. Gilroy police say it happened just before noon inside a locker room at Christopher High School. Investigators say a boy stabbed another boy during that altercation. The victim was taken to a hospital. With what are being described as nonlife threatening injuries. We did speak with a student who was inside that locker room during that fight. And so you just hear a, like, commotion. Hes like, oh, hes got a knife, hes got a knife, and everybodys just freaking out. Everyones like, just freaked out. The coaches, theyre theyre like like they just saw a ghost. Like police say no one else was hurt in that fight. But the school was placed on lockdown for about an hour while officers investigated the student accused in that stabbing was arrested and taken to juvenile hall. Okay, now to new details in the david biggar case. Jury selection is taking place right now for the state case against the man accused of attacking Nancy Pelosis husband. Now, this comes days after depape received a 30 year federal sentence. Our Sergio Quintana was at San Franciscos hall of justice all day. Sergio, whats the latest . Well, so, audrey, right now they are actually starting to wrap up the first day of jury selection in this trial, there are 120 people that make up the potential jury pool. Theyre going to whittle that down to 12 members of the jury, and then six alternates in the state trial, as opposed to the federal trial. David depape is facing eight felony charges, and that includes two new ones that were added to the charge that were added just recently. Those two new charges are kidnaping and intimidating a witness or threatening a witness. Of course, hes also facing charges that include attempted murder. Again, this is the beginning of jury selection. It will continue through tomorrow. So yeah, it sure is a process. Sergio, you mentioned the federal trial. It wrapped up last week or so we thought. So what exactly happened there . Yeah. In fact, there were the two people who we didnt expect to see in the state court today were his two public defenders from the federal courts. Thats because last week, when the judge was issued, was conducting the sentencing hearing. David depape was not given an opportunity to speak at that hearing. And so now the judge has acknowledged that that was a mistake. He has reset another hearing, but the public defenders on the for that federal case have filed a new motion. Theyre basically saying, yeah, theyll go ahead and go with another sentencing hearing. But they are asking that the sitting judge, jacqueline, us district judge Jacqueline Scott corley, be replaced with a different judge. And so its not exactly clear how thats going to all. Schedule out what we understand is that on tuesday, there is going to be a pause here for this state trial so that they can have that hearing in federal trial. But at this point, thats kind of up in the air. Sure a lot going on on the state and federal level. Sergio, thank you for that update. Appreciate it. So right now that ship youre looking at is sinking in the San Joaquin River delta. This is about 15 miles north of stockton Sheriffs Office says that that ship called aurora has a hole and its causing the vessel to take on water. Its also leaking diesel and oil into the delta. So right now its not clear what caused that hole. State agencies, along with the coast guard, are now on scene. Ousted Oakland Police chief laurent armstrong now has his sights set on another leadership role in the city. Today, armstrong filed to run for the citys at Large Council seat. The oakland native and former chief says that his goals are to address public safety, clean up street conditions and work to balance the citys finances. Right now, oakland is facing an extreme budget crisis. So you may remember armstrong was fired by mayor shengtao last year but was later cleared of any wrongdoing. He says he feels his job is still not done in oakland. I balanced the opd budget for the first time in 40 years. The first chief to do that to have a balanced budget. So i understand how to spend money and how to make sure the department actually takes care of the funding that it receives. But i also come with the experience of solving problems in the city, addressing crime in the city, addressing homelessness issues, and working collaboratively with organizations throughout the city. Armstrong joins eight other candidates vying for that same council seat. He says he hopes his 24 years at opd and his leadership experience will help him stand out from the crowd. His candidacy comes as hes pursuing a lawsuit against the city for wrongful termination. Just a heads up, gilroys dmv office is closing down for a few months to get a makeover. Office on auto mall parkway is getting new flooring, furniture, and other improvements. Its going to be closed for some time june 5th through september 3rd for those renovations, the Hollister Office on sally street is the closest alternative, which is about 15 miles away. You could also access most dmv services online, or you can visit the santa Teresa Salinas and san jose offices. Antioch is set to lose an amtrak station this year, and protesters are calling on transportation authorities to reverse their decision on the San Joaquin County joint Powers Authority voted last year to move the pittsburg antioch amtrak stop to oakley because of safety and crime concerns. The new oakley stop is set to open this year. While the antioch is set to close. So community groups, as you see here, against that closure, held a rally today urging leaders to reconsider. They say that the station is vital to the community. Seniors, veterans and youth who rely on it to get around. They listed. One of the problems is that people are rambunctious around here. Like, this is some type of problem area that theres suspicious activity going on. All live. That cant be further from the truth. This this train station, is for our community and our community is saying we want to keep it. You guys find Something Else to do. In a statement, Contra Costa County supervisor Dianne Burgess called that decision to close the station final while she said the county is working with bart tridelta transit and other agencies to make that transition smooth. All right, now to a story from our investigative unit. Video of a vta bus being is highlighting the agencys fragmented emergency response, and the driver is speaking publicly for the first time, saying that when help is delayed, everyone on board and on the road is impacted. Investigative reporter candice wynn joins us now with this story. And, candice, youve been digging into this story for quite some time now. Yeah, for more than six months now. Audrey, when bus operator Carlos Durante was suddenly threatened by a passenger with a 17 inch blade machete, he tells me he needed help right away. Turn around. Bro. I cant make the friend. He told me, make this uturn or else youre going to start bleeding. That Surveillance Video is from 2022, but nbc bay area obtained it late last year while investigating bus driver attacks, now taking a closer look at this incident, we found when zarate pressed his silent panic button on the bus, the alert did not go straight to Law Enforcement. It went first to vta transit dispatch, essentially for review and then to the Sheriffs Office. Now, for years, bus drivers have told us they need a direct line to Law Enforcement in these emergencies. And this fragmented response can waste valuable time when drivers and the public are at risk. If the person had told me to hit a car and i told them i couldnt, that i wasnt going to do it, and he told you to hit a car . Yeah. On the 80 overpass. Now vta is head of security and safety tells me these issues are not specific to vta. He said, whether its the driver using the radio or a passenger using a cell phone to call 911 vtas principle is for first responders. Audrey, to get on scene as fast as possible. And thats what you said, right . As fast as possible every second counts. Candice. So im wondering how long did it take then for help to show up for that bus driver . It took 11 minutes for the first sheriffs unit to finally arrive on scene, but trying to figure out that time, i found out that no one is really tracking how long that bus driver is actually waiting for help when they press that panic button. And let me give you an example here. The Transit Agency is handling their own response call for service. Sure. The Sheriffs Office is looking at their own call for service. Wildlife experts are now taking to try to figure out exactly what is going on here. Also, during the largest fires on record, smoke covered nearly 75 of california. And all that wildfire smoke has had a huge impact on our lives. Of course, and its also been damaging the lakes as well. Amazon upgrades alexa wants you to pay more or smoke or drink which one americans do more francisco, but in other parts of the state, its a different, very sad situation on an island of t coast north of santa cruz, a dead sea lion pups are washing ashore. They appear to have been born too soon in these drone shots were taken over ano nuevo island. Each red arrow that you saw there points to a dead pup. There are nearly 300 for reference in an average year. Scientists count about 700 pups born and just 1 or 2 miscarried. Researchers at uc santa cruz are trying to determine whats causing all of this, but it could be that theres just not enough food. Scientists have been tracking the sea lions via satellite and say some are going as far south as Baja California to get food. My best guess, and its a guess, is that food availability is down. California sea lion populations are at a historic high, so that theres theyre already at a point where theyre pretty much maxed out. And since early may, theres been a spike in sea lions at pier 39. And biologists told us that theyre here for all the anchovies we have up here. There were more than a thousand, which is the most weve seen in 15 years. Turn out to our climate in crisis. We know wildfire smoke is damaging in so many ways. And in a new study published today, scientists focused on how its impacted our lakes ecosystems. Scientists at uc davis say that during the largest fires on record, smoke covered nearly 75 of california. And here to give us more insight is meteorologist vianey arana varney. So how damaging has all of this smoke been to our lakes . You know, when we look at smoke, we look at the air quality impacts to us humans, but its also impacting things like our lakes. And what scientists did is they looked at responses to wild smoke folk in those lakes. And between 2018, 2020 and 2021, what they found during those years is that was the three largest fire seasons on record in the state, and during that time, the lakes were exposed to an average of 33 high density smoke days with august and september having the highest smoky days, researchers believe that smoke and ash can hurt photosynthesis, kris and oxygen levels and damage the lakes actual ecosystem. So whats the data researchers are looking at . Yeah, well, the studys lead author from uc davis is Research Scientist adrian schmitz, and they basically measured things like temperature, light and oxygen in the water. All of the components that play a key role in the Overall Health plant and aquatic life of the lake itself. They looked at impacts from ash, for example, during the 2021 caldor fire in the tahoe basin, thick layers of black ash could be seen on the shores of lake tahoe. Scientists are still studying the influence this had on the waters clarity and species itself. They say theyll need to take more measurements over diverse bodies of water throughout the state of california to further track the actual smoke impacts, but i did reach out to researcher schmitz, and im actually hoping to connect with her to get more insight not only on this study, but other studies that they have also done, you know, regarding smoke and lakes and other ecosystems throughout the entire world. Really, theres a lot to look into for sure. Absolutely. All right. Thank you. Okay. So the weather is great. Memorial day weekend is almost here. So with all of that in mind, a reminder for water safety data shows 90 of drownings happen in front of an adult, and a child can drown in less than 30s. We spoke with three time olympic Gold Medalist and former competitive swimmer rowdy gaines about how parents can make sure that their kids are staying safe while in or around the water. The number one cause of death in children ages 1 to 4 is drowning. Number two. In that 5 to 14 age group. But the good news is we found the cure. And the cure literally is taking swimming lessons. If a child takes those formal swimming lessons, it reduces that risk of drowning by 88. So a lot of my messaging this summer as we head into this busy summer is put your child in swimming lessons. Other tips he mentions avoid buying your child a blue swimsuit. Dont swim without a lifeguard. Never dive in. Head first and watch your kids in the water. Even if a lifeguard is already present. But if you notice around the coastline, those cool 50s, weve got 24 hour temperature change right now running about nine degrees cooler in areas like palo alto, San Francisco and morgan hill. Just as we forecasted. Tuesday was probably our warmest day of the week so far, but at least the skies have been clear with that pleasant sunshine you can see here on satellite radar. We do have Clear Conditions overall across the state, and in the next couple of hours in San Francisco, one thing you likely notice is the breeze from the west. At about 20mph right now. But youll notice even overnight conditions are going to stay pretty clear. Were going to dip down into the 50s for San Francisco.
