Im raj mathai. Were going to start tonight with new information about that Alaska Airlines pilot from the east bay, accused of attempting to turn off the engines midflight. The pilot lives in Pleasant Hill with his family. He was off duty but riding in the cockpit as many offduty pilots do. According to new court documents, that pilot told investigators he had taken psychedelic mushrooms 48 hours before boarding that plane. Today Joseph Emerson made his First Court Appearance in portland. There he is. The 44yearold pled not guilty to the charges against him. Those charges include 83 counts of attempted murder, reflecting the number of people on that flight. According to federal court documents, emerson admits to trying to turn off the planes engines on that flight on sunday. He told the pilots he was not okay. The flight had taken off from the seattle area and was on its way down here to sfo. But after that incident in the cockpit, the flight made an Emergency Landing in portland. Investigators say emerson explained he was dealing with depression, hadnt slept in 40 hours, and thought he was having a nervous breakdown. Those who know him, including a fellow pilot, say these details do not fit the person they know. I think he had a perfect record in terms of how his students succeeded and passed their check rides. He was exemplary. There was no question. Professional, safe, that was joe emerson. The planes two pilots managed to stop emerson before he cut off the engines. Emerson was then sent to the back of the plane, where he reportedly asked a Flight Attendant to handcuff him. At one point he also allegedly tried to grab the emergency exit door handle, but a Flight Attendant stopped him. We should note its not possible for a person to open that emergency door midflight. Also this evening, Antioch Police responding to cell phone video that shows officers shooting a man. They say it does not tell the whole story. We first showed you this video yesterday. Well show you a clip of it again. A warning, it is graphic. [ sound of gunfire ] the video was given to us by a civil rights attorney. It was filmed from a balcony and shows four antioch cops firing more than a dozen shots on october 1st. The man they shot was a burglary suspect named daniel makken. Makken was hit nine times, but he survived. Officers say they fired their weapons after makken ponted a gun at them while running away. The attorney who leaked the video demanded the antioch p. D. Release body cam video proving their claims. Tonight Antioch Police released photos from body cam footage showing what they say is makken turning towards officers with a gun in his hand, makken pointing a gun at officers, and there it is, the gun itself. Police say the angle and perspective of the leaked video does not depict everything that occurred. Police also determined there was a warrant for makkens arrest in a homicide case. Another headline were watching, is social media too addictive for kids . Meta is now facing a lawsuit for more than three dozen states, including california. The attorneys general, including california a. G. Rob bonta, are accusing the Menlo Parkbased company of cultivating an addiction to its sites to boost profits. The lawsuit claims young women are especially vulnerable. It accuses instagram specifically of creating Severe Mental Health and body image issues. What meta is doing is illegal and wrong. It harms our children and deserving of collective action. Meta responded to the lawsuit with a statement that reads in part that its committed to providing teenagers with safe, positive experiences online, introducing more than 30 tools to support teenagers and their families. Well, this could be a setback for Driverless Cars. The dmv just put the brakes on cruise. Cruise can no longer operate its Driverless Cars here in california unless someone is behind the wheel. The dmv suspended cruises permit effective immediately. The Decision Centers around a crash that happened earlier this month. We covered it extensively. This was at fifth and mission in san francisco. A different car with a driver hit a woman crossing the street. That woman flew directly into the path of the driverless cruise car. The cruise car then hit the woman. After the crash, cruise allowed two of our reporters to view the video, which showed the car coming to a stop after hitting that woman. But according to dmv documents, cruise cut the video short and did not show the car dragging the woman another 20 feet. The woman survived the crash but has severe injuries. Lets bring in nbc bay areas senior investigator bigad shaban. You were one of those select reporters who saw the video. Bottom line question here. Did cruise mislead nbc and the dmv . Reporter i mean that really is the sort of elephant in the room here and the question i think the dmv is sort of putting everyones eyes too. Its really difficult to overstate todays news. Were talking about a major regulator that has determined that a Driverless Car Company not only has a fleet of unsafe vehicles, but its also accusing the company of misleading state regulators and frankly the public about shortcomings of that Driverless Technology that impact the cars ability to really protect those on the road. And as you mentioned, this all stems from that october 2nd accident, and the video that cruise showed us really substantiated much of what cruise told the public at the time, that it was the fault of another hitandrun driver. However, the dmv now staying that that video doesnt really tell the whole story and, in fact, left out a considerable and notable chunk, that the driverless car, even after coming to a complete stop, then continued, essentially dragging the woman who was trapped underneath the vehicle for about 20 feet. Its amazing that were talking about this, that you, us, nbc and the dmv got this partial clip. What does the suspension mean . Does cruise have to get its cars off the roads now . We mentioned there can be humans behind it, but does that do them any good . Reporter up until today, cruise was operating about 200 Driverless Cars on any given day. You had 50 during Business Hours and about 150 in the evening hours. So immediately, effective immediately, cruise was told that it needs to take all of its Driverless Cars off the road in the state of california. So what does that mean for cruise . Well, cruise is allowed to continue testing the vehicles with a safety driver behind the wheel. Thats someone who could override the vehicle if there is a need. And just applying to what happened on october 2nd, the argument essentially the dmv is making is that it feels confident enough to keep the testing vehicles on the road so long as someone is able to step in. The argument, if you sort of read between the lines, essentially saying that had there been a safety driver in that car when that accident happened, a human would have realized pulling over is not a good idea because the pedestrian is trapped underneath the car. So let me just leave the car exactly where it is. Bigad, youve been in these cruise cars, the Driverless Cars. Youve had some issues with them as well in one of your previous stories. You have a direct line with cruise and their representatives. Whats their response to all of this, what just happened today . One of our main questions was what is your response to the dmvs accusation that you misrepresented what happened and that you didnt initially give them the full clip . So a spokesperson tells us that cruise wanted to get the information out as quickly as possible so it could allow authorities to have the information it needed to be able to try to essentially catch the person who was involved in that hitandrun. Obviously, as you might imagine, the critics, particularly on social media, arent buying that. Theyre saying whether you wanted to release the information quickly or not, there wasnt a great reason on why you would conveniently clip the very end of what happened that shows one of your vehicles dragging a pedestrian some 20 feet. So as you might imagine, thats one of the main contentions that the dmv has, not only that the vehicle didnt know to stop and continue stopping, but it was this allegation that cruise essentially tried to misrepresent what happened not only to state investigators but to the media, to the public. Final question really quick. What now . Is this a twoweek suspension, a twomonth suspension . When could cruise get back on the road without humans . So the suspension is indefinite. There is no timeline on what cruise has to do to be able to get its cars back on the road. The dmv only saying that the suspension will stay in effect, raj, until cruise is able to prove that it has remedied everything the dmv has pointed out that at this point is leaving state investigators with the impression that cruises driverless vehicles are not safe. Its going to keep you busy. They havent said just when they expect to make those changes. They do have five days to appeal the process. The more likely scenario is that cruise is going to outline some kind of changes within the company, within its suite of vehicles, raj, to be able to prove to state regulators that, hey, our vehicles are safe, and they deserve to be back on the road. Important to note that while california is now saying that these cars are unsafe, cruise still has driverless vehicles in other states. So i think it remains to be seen what regulators in other states may do as a result of whats happening here in california. Today Oakland Police admit they want to try something new here, something out of the box. Theyre going to test it this weekend. The Department Released these videos of a typical car breakin. People hop out of a car, break a window, grab stuff, then move on. These crimes aric request, which make them difficult to track. It happe across the bay area. This weekend the department is going to try a pilot program. Heres the skinny. Its goingo set up two temporary accounts, one on instagram, on another twitter, or x. Theyre asking anyone who sees a crime to immediately post it or dm these two accounts. People with opd wille monitoring the accounts and will send the info to surveillance teams in the community. Those teams will use undercover officers, air sueillance, decoy cars, and more. The goal is to arrest as many people as quickly as possible. Were going to be throughout the city, but we really focus on the downtown area this weekend where restaurants are, where our nightclubs are, where our visitors are at, so people can come and enjoy oakland and not have to worry about their cars getting broken into. When speaking with my neighbors and community members, its hard to not find someone that hasnt been affected by it. I can tell you from my own personal experience, my wife and i were having dinner in Jack London Square when her car was burglarized, resulting in her losing her car for a month. I think it shows the people of oakland that opd is trying to stop or do anything to curb the car breakins. Whats your take on this new strategy . Yeah. You know, we meet every single week to really think through the different strategies that were going to be hosting. We look at the data, and were really datadriven. Like i said before, we are all sick and tired of our windows being broken into. We want people to feel safe when they come out and shop and dine and what have you and really support our small businesses. So this new initiative is going to be an out of the box kind of initiative, but we really need for the public to help us in the sense that this does take a whole village, a whole community. So if you see someone breaking into someones window actively, you know, sending us a direct message on the social media platform instead of calling 911 is going to be something were going to pilot. Did you get this idea from another city and did it work in other areas . We did not get this from another city. I do believe that it was an idea of one of the officers and one of the area captains. So, you know, again, were open to all and every idea that is out there. This does actually help with the communities, who play a role in this. And its going to take all of us. We know were not going to ever be in a place where we can afford to have officers on every street corner. So we really need to pair that up with technology. It is creative. I think a lot of people will be watching closely. Your state of the city was just last week. Is there one or two tangible things that you can share with us tonight that youre doing right now to improve things in terms of Public Safety . Absolutely. You know, were really happy and thrilled that on the same day that i gave my state of the city, that the City Council Unanimously voted to approve my plan to deploy 300 automated license plate readers throughout the city of oakland. These are more than just license plate readers. What theyll be able to do is actually record whats actually happening. Then we can use that as evidence to prosecute. At the same time, what it will do is it will actually help Police Officers to really initiate and actually man the cameras so that if there was, lets say, a burglary thats taking place, we can then identify the vehicle that people are fleeing in. Its just not about reading license plates. Its about this is highdefinition, super highdefinition cameras that can hone in to look at what make, what model, what the license plate currently says on there, if its a stolen plate, or if there are no plates, then we look at the details of any markings of the vehicle that makes it unique so that we can be on high alert. Officers can go in and actually apprehend any suspects and bring them to justice. To be clear, is it implementing right now, or is it still a few weeks away . It is still a few weeks away, but once we get started, it will be implemented and put up across the whole city. 300 cameras. What that would mean is all the cameras or the majority of them should be up and running by the end of the year. Mayor thao, we talk about police. The update now on the search for a police chief. I know theres been some issues with the police commission. Now there are new members of that commission. Will that clear some roadblocks for you . Oh, absolutely. Im really excited for the new commissioners to be seated. Now that they are, you know, im really excited for the work that theyre going to actually be able to implement. Not just that, but of course the search for the police chief. Our application process for the chief of police is actually closed now, and so they are going through interviews. And once they go through their interviews, they will recommend to me at least three candidates of their choosing, where ill be able to interview.
