Today, monday, august 7th, 2023. Deadline day. Donald trumps legal team is running out of time to respond a judges order in the 2020 election case, whats at stake and how the former president is reacting. At risk, extreme weather from coast to coast as floods rip down houses in alaska where the dangerous system is headed next. Deadly collision, two helicopters in california collide midair. Killing abroad one of the choppers. Getting ready to run. If youre planning on competing in a fall marathon you better start training now and if youre not the lessons and the tips we can all use to get a little bit more active. Youre a runner. I am. Are you doing a fall marathon . No. We begin this hour with big Political Legal news in the looming legal deadline for former president donald trump, in that 2020 election case. His legal team must respond today to a request by federal prosecutors for whats called a protective order, limiting what evidence the former president can publicly share about the case, why, its because of posts that mr. Trump has made on his social media platform truth social, today on the platform the former president attacked special counsel jack smith as well as the judge in this case. Here is Vaughn Hillyard and karol lam. Vaughn, a lot to sort through and prosecutors first requested this order on friday, right, there was a lot of back and forth that has taken place since then, walk us through it. A filing that was present bid the department of justice, the prosecutors bringing this case against donald trump. What prosecutors are contending if donald trump if he were to secure the evidence theyre turning over to his Legal Counsel as part of whats called the discovery process that he would share that information thats supposed to be private and only used for the purposes of t criminal trial and thats where this protective order is attempted to be had by the department of justice, now were waiting a 5 00 p. M. Deadline just two hours from now in which we expect Donald Trumps Legal Counsel to file a response to push back on that. Donald trump has pushed back on this effort on having this protective order against him impeding his First Amendment rights. Its important to note that for donald trump he already has a protective order case in the classified documents case. People know about what a gag order is, or they know that term, this protective order isnt the same thing as a gag order, right in. Its not the same thing at all. Gag orders are rarely imposed because of First Amendment concerns about a defendants right to speak, one hasnt been imposed in the case, its important to convey how common protective orders are, in fact in my district, as a federal prosecutor we had so many cases that a protective order was par for the course, a boiling point that they signed in order to receive their discovery, made into a big deal here is a little bit unusual, its usually something thats agreed between on the prosecution and the defense, the fact that it has to go to a judge at all is unusual. Go to a judge over one particular point, but this is sort of making a big deal out of nothing from the defense point of view as i see it, there should not be a delay, i think whats going on here is the government is not going to turn over discovery to the defense until it has a ruling on the protective order, contesting the idea of the protective order is another way to delay the ultimate trial. Is it unusual to kind of go up to the wire, to put this filing in for the trump team . No, i dont think unusual. They have a deadline and presume mri theyll meet the deadline, thats what deadlines are, if they want to take the time the judge has given them to file thats their choice. Vaughn, we have been talking about the federal election charges against the former president , but an indictment could come any day in staterelated case down in georgia, in fulton county, what are we hearing from the d. A. In georgia as well as trumps team in that case. Were expecting the charges either against donald trump or a litany of potential allies to be brought over the course of the next two weeks. The window that the District Attorney had given the other federal officials to expect an indictment to come down. Number one, this is about effort in georgia specifically by donald trump and others to overturn his loss in his 2020 election specifically, georgia here, we saw last week with the charges stemming from the special counsels office those were federal charges. The classified documents, those were federal charges. In this case theyre state charges. Reelected as president in 2024 he would not be able to pardon himself of these state charges, this indictment, a fourth indictment were to come down against him here he would be facing a very serious trial, powerless in the executive office in the white house to have any impact on those specific charges also any convictions that may come from them. Some developments in another case today. Former president s defamation involving the author e. Jean carroll, what happened there. Donald trump is staring at marathon of these legal cases against him, this was particularly essentially amounted to a counterlawsuit by donald trump, this spring he was found liable for sexual abuse and defamation of e. Jean carroll who suggested that and asserted that he had raped her back 30 years ago, found to have sexually abused her but not raped her. He continually denied the charges against him. This is a counterlawsuit. A judge here denying that case from being heard. Thank you both. We appreciate it. Reporter dominating is the perfect word. Walk through the gold medals, shall we . She got the allaround gold medal for the entire core hydration classic. She got individual gold medals for the beam, the floor and the vault. The vault is key, guys, because that was the event back two years ago that sort of caused her to falter and ultimately sidelined herself during the Tokyo Olympics getting that case of twisties. I worked on myself a lot. I still do therapy weekly. Its just been so exciting to come out here and have the confidence. My goal was this and then championships and then after that on to worlds and then well see. So far its heading in the right direction. The right direction, yeah. One of the bays largest districts started class today. Bob is at oakland skyline high school. Bob, one big difference this year, no teacher strike. Its back to school for thousands of students within the Oakland Unified School district. Its been a busy morning here in the hills of oakland. This morning at hoover elementary, oakland superintendent welcomed parents and students. Last may, they were out of school for over a week while the teachers were on strike. Now the teachers and district finally came to an agreement on higher salaries and common good changes including a Reparations Task force for black students and more say from parents and teachers in school decisions. Its the first of the year, i dont want to put words in our students and families mouth. The increase in salary made it more feasible. There have been many years where weve lost teachers not because they didnt want to teach in oakland but they just couldnt make the amount work with the high cost of living. Im kind of jealous because they got all this new stuff here and we didnt get to have none of this. So now i like the change. I like everything they have done. Back to school can be a bummer but you can help ease your kids back into the daily grind by coming up with a family plan. We spoke with a child psychologist who suggests getting organized from things like School Supplies to school clothes. Just to limit the chaos. Also establish a routine so kids know what to expect in the morning, what to expect when they come home from school through bedtime and start easing into that routine a few days before school. Also, schedule family time. Especially time to read together. Reading book, help express your feelings. How to engage with others. Not just kids. If they learn at home, then it will be easier for them. That child psychologist adds another point. Communicate with your kids teacher and if you have middle of high schoolers, make sure your kids are in the loop about those communications. Thank you. Dasha burns joins us now. You pressed him on that issue, talk about that part of the interview. Reporter one of the questions for all of the candidates frankly is on the abortion issue because it has come up for both democrats and republicans, so what would if a candidate got the chance to be in white house, what would they do if a bill came to their desk that was a National Abortion ban. We had a conversation about where he stands on this issue. Should it be held should it be decided at the federal level, state level, take a listen to our conversation. Would you veto any bill that would try any ban. Well be a prolife policy. I wouldnt allow what the left wants to do to override prolife protections throughout the country all the way up until the moment of birth in some instance which is i think this is infanticide thats a misrepresentation of whats happening, i mean, 1. 3 of abortions happen at 21 weeks or higher. But their view all the way up until that no Legal Protection theyve done it in california and other states. They havent instituted that policy. Yeah, they have. Theyll say that, you know, if theres some type, theyll use different ways to really have extremely rare. 1. 3 and in those circumstances their extremely emotional. But i do think that the left in this country has moved on from a position that said, you know what, we do want to discourage abortion to now viewing it as a more positive good for society and i think most americans regardless of how they feel on Legal Protections i dont think most americans think its positive good for society, its tragic circumstance. Reporter on the campaign trail desantis emphasized what hes done in florida on that sixweek ban, less so in New Hampshire where that tends to be that he thinkst should b a lied omup kind of decision, the states shodecide statey state, whaty believe is the t thing to do. Notyar on we would n termseral level ban. Kate. Dasha thank you. More of the interview with Governor Ron Desantis tonight on nbc nightly news with lester holt. Joining us now is Stephanie Mansour for some helpful tips, start with how to get started. If youre thinking about running or if youre a runner and you want to gear up for a marathon, where do you start. Like you, kate, im not a marathoner either. Im a runner. Yeah, yeah. Im actually lucky if i run 1. 5, 2 miles at a shot. I help my clients who are training for marathons when youre starting off with a new workout program, tryg to run more or walk more, make sure you have the right gear, training in the summer, moisturewicking dryfit material. Get the right shoes. You always want to make sure that devise a plan, slow and steady win the race, shorter, eaer runs or maybe work up to that and make sure that you add in some stretching, both before you run and after you run, because you want to focus on recovery, too. Youre trying to get a foundation, right, for running and then sort of build up from there. Yes, absolutely. I recommend people start with three to five times a week for cardio and adding a little bit of a strength training, one or two times a week minimum. We want to body to work like an orchestra while youre out there running. We want your legs and arms to be strong. Is three to five for the marathon trainer yes. Some people arent going to run three to five times a week. Ride a bike or do a spin class. Cardio, people in our start today Program Starting with walking down the block and then jog half a mile. Thats such great advice. People wonder about injuries. The overuse is a huge problem, so when you get shin splints or your hip or back feel off thats when you want to have a wellrounded routine. Streth training, stretching before, make sure youre doing dynamic stretching, warming up with movement. Youre moving your arms and your legs, youre not holding a stretch, youre moving them. But then afterwards you get the reward of holding the stretch for 10 to 20 seconds. I encourage people to treat yourself, get a massage, do a foam rolling class, the mind can get in our way if were trying to beat a personal record or run faster and longer lets talk about food and fuel. You want to make sure youre eating before you run, however its not too soon sooure not getting nauseous. Do meal planning, snack planning, shop ahead, make sure youre getting those proteins, healthy fats. You do want to make sure your meals are balanced and youre not overdoing it just because you feel like youre exercising a lot more. How do you keep track, a calendar, in your phone in. Whatever you prefer, if youre more old school and like to right down pen and paper track in a journal. Or download a fitness app or tracker, make sure too you not only have a plan youre following you get this cleared by your doctor, too, you want to make sure youre exercising for your level and not starting at me one mile a day and then trying to run 20. I have done a half marathon. Maybe one day. Maybe one day. Thank you. Stephanie mansour, thanks so much. Stay with us. Theres more news ahead. Youre watching nbc news daily. One east bay leader is now calling for a widespread investigation into all unlicensed Contra Costa County spies. This comes in the wake of an outbreak of legionnaires disease. The day spa on san pablo avenue is accused of spreading the disease. Three victims used the spa. County supervisor says the spa operated its jacuzzi without a county Health Permit and was never inspected. The Health Leaders have been conducting tests to confirm their theory. Were going to devise a strategy to look at how to investigate these types of massage parlors and spas that are out there that may not have a county Health Permit because theres no way to know unless you actually go into the facility and inspect it. All right, well, it is the first week back at school for many students and they are starting the new year with nice sunshine. Heres kari hall with what to expect. Its going to still be hot for the in land areas today reaching into the low to mid90s but look at how much cooler its going to be for tomorrow. Some valleys reaching into the low 80s, mostly 70s for the inner bay. Well also have breezy winds with us through the end of the week with our highs nice and mild for the next several days. For the weekend, it will heat up again, more sun and temperatures reaching into the mid90s. San francisco is going to be mostly sunny reaching into the upper 60s but as the fog rolls in tomorrow, we may have drizzle throughout the morning and highs in the low 60s. Whenever a fire, flood or other issue damages your home, youll have a lot of work to do, really. Im talking about paperwork. Im talking about documenting what you lost so your insurance policy pays up. Theres a step you can take today whether you own your own home or you rent to make the work easier tomorrow. Heres chris with how to do so. A Home Inventory is a list of everything you own and insure. If you ever have to file an insurance claim, you have to prove what you have before you get paid. Having a Home Inventory can help. This is your not so secret weapon. A smartphone. Use it to record a video. Nothing fancy. Just walk through every room and go slowly. Make sure the clip records everything in each room. Talk about what you see. Show the brand names and model numbers. Speak about where you bought your stuff. When and how much you paid. It might help jog your memory later on. Go all over. Open every drawer, cup board, closet. Some people have stuff in their garage, too. When youre done, up load your photos, videos, documentation to the cloud in case your phone is destroyed or goes missing during a disaster. A full inventory can save you time, money, and heart ache and yes, an Insurance Industry survey found 80 of people in the past year didnt have an inventory or didnt update it. Maybe thats because its a bit of work but it doesnt have to be. Theres a number of tools that are now available. Many through your Insurance Company probably for free.
