Today, one of those jurors spoke only with nbc bay area. He claims one juror in particular brought the proceedings to a halt. Robert handa joins us from outside the courthouse with a story youll see only on nbc bay area. Reporter the public allegations against trainer scott shaw have been going on for many years. San Jose State University has paid millions of dollars to settle lawsuits from athletes who complained about shaw, so the mistrial was unexpected and one juror we talked to put the blame on one particular fellow juror who said she simply did no the believe the witnesses. I dont think they got a fair trial out of it and that really bothers me. Its not how our system works. Reporter this man who asked us not to show or identify him was one of the jurors in the federal criminal case against trainer scott shaw, who faced six misdemeanor counts of inappropriately touching female athletes under the guise of athletic treatment. Eight student athletes testified that shaw touched or fondled them. Shaw pled not guilty. The jury voted overwhelmingly for guilty but deadlocked on five of the charges 102 and 111. The juror we talked to says one juror influenced another to go along with her from the start, creating conflicts in the jury room right away. There was a lot of discussion, and we went around the table. There was a couple of other people that had doubts about some of the charges, as you would expect, including myself. And she just made it clear she was not going to budge. And we september our first note to judge freeman within an hour of our first deliberation because it was obvious that she was digging in, she wasnt going anywhere. Reporter legal analyst steven clark says that type of conduct is significant. The governments case was based on strength in numbers. When you look at the number of female athletes that came out and described what happened to them at the hands of scott shaw. I think this is an important case for the government. Reporter the juror we talked to says hes disappointed for the athletes. Hes still baffled by what happened. Her actions were pretty alarming to most of us, that she wasnt willing to discuss and deliberate. Reporter legal analyst steven clark says that conduct will probably lead to a refiling of the case, though the u. S. Attorneys office has not commented on that yet. Shaws Attorney Says he believes there will be a new trial. San Francisco Police just wrapping up a virtual town hall meeting to discuss a deadly officerinvolved shooting. When he refused, officers shot him. Sfpd officers gave cpr at the scene until paramedics took him to the accident where he later died. Community activists are holding a vigil for bluford. This comes on the heels of another town hall where the District Attorney accused judges of being too soft on accused drug dealers. D. A. Brooke jenkins made the remarks last night. Police say drug arrests are up but the d. A. Says too many judges are letting the drug dealers get back on the streets in hours, within hours of their arrest, and ignoring her requests to keep them in jail before trial. They are difficult judgments. The District Attorney certainly does not think that the trial charges in San Francisco certainly have that balance correctly. And thats something that needs to be handled, dealt with. We wouldnt know for sure without looking at statistics. Whether thats true or not. But certainly i think that perception is there. Weve reached out but have not heard back from the courts for a response, but the Public Defenders Office sent a statement saying the money the city spends on crime would be better spent on treatment, overdose prevention, housing, and workforce development. A rift between bay area democrats. Several members of congress are pushing back on a planned bridge toll increase. Representatives from the bay area who disagree with the plan sent a letter to the governor today asking him to stop that bill. The letter says a toll hike would put a strain on communities already struggling. The battle continues between bay area bosses and workers. How to get employees back into the office . There is a little bit of desperation i see. Reporter she says skip the gifts and offer up what people really want.
