Cal fire tells us evacuation warnings are in place for 30 homes around three strings road which is off of mount hamilton. They say the fire started before to 30 this afternoon and they are still looking into what caused it. It ballooned to 66 acres but by 5 00, the cruise had stopped the forward progress. We spoke to people boarding their horses near the fire zone. This man was relieved to see his horse okay. Thanks to the firefighters, he is alive, and im just thanking them for being here for them. And cal fire says it expects to have crews working into the night and into tomorrow morning on this fire, and so for people live in the area, expect to see some of the big trucks from the crews working on the fire, keep your eyes out for them because they may be in your neighborhood. We know that crews are making Good Progress as far as removing the Hazardous Materials here, you can see a Police Presence along here, you know that the evacuation zone has reduced in size. Residents are staying on high alert. Its been more than 24 hours since residents in san pablo were alerted to a Hazardous Material leak in the backyard of a home near stanton avenue. The leak resulted in his regulations but tonight they have removed roughly 75 of the hazardous chemicals. They processed over 600 different chemicals and 800 bottles or vials or containers. Firefighters say the chemicals were first discovered by the brother of the homeowner who passed away several months ago. He was clearing out the home, noticed the odor and called 911. Mark lives next door and was forced to evacuate. He was allowed to come back this afternoon to pick up belongings but had to leave again. We got clothes, medications, a couple of toiletries. Some evacuated neighbors were able to return home today including Johnny Aguilar who lives along 11th avenue but he said he still shaken up. I feel scared because the chemicals are dangerous. One of the challenges has been identifying the chemicals before transporting them. Fire Officials Say the chemicals are being sent to a facility where they will be disposed. The goal is to get residents back home as soon as possible but safety is the top priority. We wanted to make sure we can guarantee that. We are working hard to ensure that. Officials do not believe that the chemicals are tied to any drug operation but they say the goal is to get folks back into their homes by tonight. Former President Trump was back in washington, dc for another court case against him. He pleaded not guilty to federal charges, accusing him of trying to overturn the 2020 president ial election paces this is mr. Trumps third indictment and expert say these are the most serious. After the hearing he called the charges a, quote, persecution of a political opponent. He appeared before a federal judge facing four new felony counts, his fingerprints taken but no mug shot. Now one former employee and longtime shareholder is suing the banks former executives, alleging among other things, breach of fiduciary duty and negligent misrepresentation. They were not being truthful, they were not accurately reflecting the risks that were taking place behind closed doors. The suit claims the shareholder had plans to sell her stock but was convinced by statements made by svb executives, to hold. We reached out to svb for a reaction but have not heard back. Business professor Caroline Chen said the case comes down to what the executives knew and when they knew it. Seven months into her tenure as alameda countys new District Attorney, price is facing a recall effort. She ran on a platform to reform and transform the Justice System. But her critics accuse her of being soft on crime. Tonight, one of her former prosecutors is breaking her silence about prices decision to reduce the charges in one of the most infamous cold cases. There are certain people who should not live outside of prison walls. David is one of them. Colleen mcmanus talking about this man, convicted killer david mitch, sitting in the santa rita jail awaiting a different trial. Hes a serial killer. Mcmahon has spent the last 23 years as a prosecutor in alameda county. I tried almost a dozen murder cases ive tried Sexual Assault cases. Three years ago she began working on one of the most notorious cold cases in bay area history, the disappearance of Michaela Garecht. The case went unsolved for decades. The nineyearold and a friend had written their scooters to a hayward Grocery Store and michaela was grabbed by the waist and pulled into a car. We had to scour through 45 boxes of files that had been organized by the police department. Two palm prints found on one of the scooters back in 1988 according to investigators, now matched david misch pay 59yearold david misch had been charged with the murder of Michaela Garecht. Dna allegedly linked him to the 1986 killings of two young women in fremont. Mcmahons goal, to try the decadesold cases together. In december last year a judge ruled there was enough evidence to try them for three murders plus special circumstance allegations of murder during the commission of , kidnapping, multiple murder and having a prior conviction for murder. He has pled not guilty mcmahon would not get an opportunity to see him face trial. Just days after taking office, District Attorney price reduced the charges by removing the special circumstance allegations, are converted forms of murder that if convicted carry a harsher penalty of life in prison without the possibility of parole. Price ran on a progressive platform aimed at reforming the judicial system she says is rooted in racism. For decades weve had a criminal Justice System that has literally devastated black and brown communities. But mcmahon says the decision to strike the special circumstances against misch without input from the lead prosecutor stunned her. Is that ordinary . Unheard of. I know more about these cases than anyone. And to not have a discussion with me about the impact that charging decision may have on the future of the case is unthinkable. Its unusual. Its remarkable. Defense attorney paula canny agrees. A former prosecutors off, she said das dont have the time to look at a case in death and instead, rely on deputy das to inform them. Is very unusual for the District Attorney to make an announcement about a case and a decision about a case without constructing consulting the assigned prosecutor because you are missing a great opportunity. The assigned prosecutor knows more about that case than any other person. Mcmahon said it more unsettling to her was that price apparently did not confer with the victims families, either. They have a right to be heard. Amended into the constitution, marcys law provides victims the right to meet with prosecutors, to be informed about charges and to be heard. She didnt talk to you and she didnt talk to the victims families . No. To this day ive never met her. Ive never even been in the same building as her. If you charge david misch with three counts of murder in front of a jury, how is it different if you are able to charge him with the three counts of murder in front of a jury and the special circumstances . Just charging three counts of murder sanitizes the cases. The jury isnt going to hear from the reading of the information that there was a kidnapping involved in the Michaela Garecht murder, they will not hear there was an attempted rape that occurred with Michelle Xavier and jennifer dewey. They are not going to hear about the fact that he had committed murder after having been convicted of a prior murder. It really ties your hand as a prosecutor. Id like him to say what happened to michaelas body. Rodney gave up hope that his daughter would come home alive. This is what they say she would look like. Age progression. 34 years after she disappeared, she believes the last hope of getting answers has also vanished. He will never say what happened to michaelas body and im never going to find out. Garrett was counting on prosecutors using the special circumstance allegations as a bargaining chip to find his daughters remains. Hes angry that price met with him and the families of the other two women that misch is accused of killing only after she dropped those charges. She said that was because theres too many black and brown people in prison doing life, you know because of special circumstances. Nancy turned around and said, david misch is white. All three families were so heartbroken. It was a shock pay we invited the District Attorney to sit down with us to discuss the misch case but she did not make herself available. While she didnt address reducing the charges, she did tell a reporter that she understands the families frustration. I appreciate that they are still you know, theyve been held hostage by the system because the case has not been resolved, after so many years. What my commitment to them was then and continues to be is that we are going to prosecute this case as expeditiously as we can pay why would they replace her with somebody that had to start from the beginning and work all over again .
