A fremont family risks losing their home they say after renting it out only to find out their tenants were gone and there were strangers living there through airbnb. Investigative reporter candice wynn looked into the bizarre circumstances that critics say reveal a loophole in airbnbs policy. A policy that can leave small landlords vulnerable. You got to lower your voice. Reporter its a homeowner tenant. I i dont even know their name. Reporter airbnb nightmare that has flipped their families lives upsidedown. In august 2019 they bought their first home in fremont, but they couldnt move in right away because they were locked in a leasesy they rented it out for a year to this couple. Theyre a family like us, trying to build a life here. Reporter instead their tenants turn their dream home into a hotel. Their rental agreement prohibited subletting, but in june neighbors showed them these airbnb posts. About 200 guests had stayed there. I was furious. All they wanted to do was make money off our house. Reporter which raises the question does airbnb check if the person creating the listing owns or manages the property . So here we are in my apartment. I can tell you im not allowed to put it on airbnb, but lets try. So twice now weve gone through this and already im here, i can start hosting starting in november, but not once have i been asked to provide any sort of document proving that i can even list it on airbnb. Airbnb declined our repeated requests for an interview saying these issues are rare but we take them very seriously. The Company Tells listers by clicking next you certify you have all the necessary rights to list your space. They say that lack of thorough vetting by airbnb led to this mess. Im the homeowner. I do not give you consent. Reporter he was called to the house after his tenants locked out the airbnb guests they had subleased the property to. He says his original tenants were nowhere to be found. He later learned they were attempting to return and i dont know them. I dont even know their names. Reporter the airbnb guests later got back into the house. We reached out to the original tenants for the story but they wouldnt talk to us. We may end up doing afore closure. Reporter they say they also blame airbnb for this dilemma. I shared the contract to prove i shared my county title papers but i am the owner of this house, but still they refuse to take down the listing or interact with me in anyway. Reporter airbnb tells us they took down the listings in august. Online the company told the jhas even when offered proof of ownership they cannot arbitrate these disputes. These are situations happening all over the bay area and especially in alameda county. Reporter allan is a landlord attorney. I cant speak for what happens out there but i can tell you i have multiple cases that are like this where weve got people that have come onto a property under the guise of airbnb and have just decided not to leave. Reporter these home owners say theyre not getting any rent, they dont have any sort of rental agreement with these airbnb guests. Thaguests are claiming residency because they stayed there for more than 30 days. Whos right, whos wrong . Legally the tenant may very well be right. Legally theres nothing the landlords can do about this. Reporter the covid Eviction Moratorium makes it even harder on small landlords like the jhas which is why we reached out to Scott Haggerty and richard bya. I think its criminal airbn has not looked and seen whos on title for that property. Reporter after the Eviction Moratorium you voted for is it leaving some smaller landlereds stuck . I could see where that would happen. The general concept was we wanted to protect the general population especially the homeless. Reporter so is there room for improvement . Theres always room for improvement, i agree with you. So were looking at the potential of extending the moratorium beyond december 31st. We want to hear from the public to hear these stories. Reporter until then theyre forced to absorb the losses, losses that have taken more than just a financial toll. Sorry, just emotional that, you know, this has turned out to be such a nightmare. Reporter airbnb says theyve taken down those unauthorized listings and suspended one of the guest accounts, but the jhas say those airbnb guests are still living in their house. And throughout it all theyve never received rent. Candi candice nguyen, nbc bay area news. You can call 888996tips. Time to check in with meteorologist jeff ranieri already in the holiday spirit and were going to need to be outside if we have family over. You are exactly right, and that weather i think is going to cooperate on thanksgiving. A little bit breezy at times, but we are expecting dry weather. So you can be outside with that air circulating and moving around. Lets bring into that microclimate forecast right now and were looking at a storm system beginning to drop down. Theres no heavy rainfall associated with that for us but i think its going to bring a blast of colder air and even a chance here of a bit of drizzle as we move through tomorrow morning. Let me take you to storm ranger and the only one in the bay area and just one of six here in the United States and youll see some of that rainfall welloff to the north. This is expected to break up as it gets closer to us. Let me show you that better on my future cast and you can see 2 00 tomorrow morning just a few hours from now well see those showers and a bit of drizzle getting close and continues to break up as it moves down the south bay at 7 00 a. M. I think well start off with early cloud cover and just a slight chance of some of that spotty drizzle for the south bay. Then through the afternoon we get that sunshine back. Do you know if youre headed up to tahoe we could get a dusting of snowfall for the afternoon. So watch out for winter conditions on the interstate and well start off on the cold side. Plenty of low 40s for the morning and mix of some sun and also some clouds. Well start off with temperatures around 42, 43 degrees there for the south bay. Also the east bay looking at those mid40s. And for the trivalley, 41. Youll see here for the east bay 44 and the north bay going down to 42 degrees. Daytime highs dont really change a whole lot as you travel through the bay area. 62 in martinez, and there you go. 62 also in morgan hill. My extended forecast shows dry weather the next seven days here in San Francisco. A little bit breezy there thanksgiving, 10 to 25 mile per hour winds. And then for the inland valleys what i want you to notice is once we hit friday well likely see inland temperatures for the mornings go down close to the freezing mark, so time to bundle up.
